India, France ink deal for 36 Rafale fighter jets

New Delhi: India and France today signed the Euro 7.87-billion deal for Rafale fighter jets, equipped with latest missiles and weapon system besides multiple India- specific modifications that will give the IAF cutting edge capability over arch rival Pakistan.

The deal was signed by Defence Minister Manohar Parrikar and his visiting French counterpart Jean Yves Le Drian sixteen months after Prime Minister Narendra Modi announced India’s plans to buy 36 Rafale fighter aircraft in fly away condition during his trip to France.

The deal comes with a saving of nearly 750 million Euros, gained through hard negotiations by the Indian side, over the one struck during the previous UPA government, which was scrapped by the Narendra Modi government, besides a 50 per cent offset clause.

The 50 per cent offset clause means that Indian businesses, both big and small, will gain work to the tune of over three billion Euros.

These combat aircraft, delivery of which will start in 36 months and will be completed in 66 months from the date the contract is inked, comes equipped with state-of-the-art missiles like ‘Meteor’ and ‘Scalp’ that will give IAF a capability that had been sorely missing in its arsenal.

The features that make the Rafale a strategic weapon in the hands of IAF include its Beyond Visual Range (BVR) Meteor air-to-air missile with a range in excess of 150 km.

Its integration on the Rafale jets will mean IAF can hit targets inside both Pakistan and across the northern and eastern borders while staying within India’s territorial boundary.

Pakistan at present has only a BVR with 80 km range. During the Kargil war, India had used a BVR of 50 km range while Pakistan had none. However, Pakistan later acquired 80-km-range BVR, but now with ‘Meteor’, the balance of power in the air space has again tilted in India’s favour.

‘Scalp’, a long-range air-to-ground cruise missile with a range in excess of 300 km, also gives IAF an edge over its adversaries. Sources said the “vanilla price” of just the 36 aircraft is about 3.42 billion Euros. The armaments cost about 710 million Euros while Indian specific changes, including integration of Israeli helmet-mounted displays, will cost 1,700 million Euros.

Associate supplies for the 36 fighter jets will cost about 1800 million Euros while performance-based logistics will cost about 353 million Euros.

Scarlett Keeling case: 8 years on, Goa court acquits both accused

New Delhi: A Goa court acquitted on Friday two men accused of raping and killing British schoolgirl Scarlett Keeling in 2008, triggering outrage in a case that put a global spotlight on the dark underbelly of India’s tourism industry.

“I find them not guilty of all charges,” Judge Vandana Tendulkar said after the trial of Samson D’Souza and Placido Carvalho in the state capital Panaji.

But Scarlett’s mother Fiona MacKeown said she was devastated by the outcome and promised to fight to overturn the verdict.

“I am reeling. It’s been eight years of agony. I feel devastated and will definitely be challenging the verdict,” she told reporters outside the court.

“We had been waiting all this time and it’s just rubbish. India’s whole judicial system has totally let me down,” she added.

“Somebody murdered my daughter in this country and somebody must be held accountable.”

Fifteen-year-old Keeling’s bruised and half-naked body was found on popular Anjuna beach eight years ago. Her death made headlines worldwide and triggered a debate on how unsafe the popular tourist destination was for foreigners, especially women.

Police initially dismissed the teenager’s death as an accident but opened a murder probe after Keeling’s mother, Fiona MacKeown, pushed for a second autopsy, which proved she had been drugged and raped.

MacKeown also accused local authorities of trying to cover up the death to protect drug gangs operating in Goa.

Several weeks after the attack, local men D’Souza and Carvalho were arrested.

Kiwi bowlers push India on backfoot

Kanpur: India faltered after a sound start to their first innings as New Zealand banked on a strong bowling performance to grab the upper hand on the opening day of their first cricket Test here on Thursday.

Electing to bat after winning the toss, the Indians had a promising start to their innings, doing well in the pre-lunch session. But the Kiwi bowlers hit back, claiming eight wickets in the next two sessions for the hosts to finish the day at 291/9.

In the historic 500th Test match for India, Ravindra Jadeja and Umesh Yadav were at the crease at the close of play on 16 and eight runs, respectively.

For New Zealand, pacer Trent Boult (3/57) and left-arm spinner Mitchell Santner (3/77) picked up three wickets each while Neil Wagner (1/42), Mark Craig (1/59) and Indian-origin leg-spinner Inderbir Singh Sodhi (1/50) chipped in with a wicket apiece.

Most of the Indian batsmen fell to poor shots after misreading the turn or bounce of the ball rather than any top quality bowling by the visitors.

The Indians started off on a positive note with opener Lokesh Rahul hitting Boult for a couple of boundaries in the very first over of the series.

The New Zealand pacers recovered thereafter to restrict the flow of runs to some extent.

Rahul, however, continued to target Boult, hitting a couple of consecutive boundaries off the pacer in the seventh over.

The opener swept Santner for a six in the 11th over, but the spinner had his revenge off the very next ball when Rahul misread an outgoing delivery.

Rahul scored at a decent rate, posting 32 runs off 39 deliveries. His innings was studded with four boundaries and a six.

Cheteshwar Pujara then joined Murali Vijay in the middle and the duo negotiated the New Zealand bowling with skill and patience to ensure that the hosts went into the lunch break at a decent 105/1.

Santner was the only Kiwi bowler to bag a wicket in the morning session.

The rest of the Kiwi bowlers toiled away without reward under hot and humid conditions.

But whatever advantage the hosts had managed to claim was fritterred away in the post-lunch session as the Kiwi bowlers struck back to claim the crucial wickets of Vijay, Pujara and Indian skipper Virat Kohli.

Boult outfoxed Vijay in the very first over after lunch with a cross-seam short pitched delivery. The Indian opener was surprised by the extra bounce as the ball took the outer edge of his bat and travelled to where first slip should have been.

But the lack of a fielder at that position saved Vijay and the Kiwis could only watch as the ball raced to the boundary.

Santner bagged his second wicket when Pujara misread the spin on a slightly overpitched delivery which did not turn much after pitching. Pujara played for the spin, expecting it to turn towards the off-stump but only managed to offer a tame caught and bowled chance to Santner.

Kohli (9) seemed to be in good touch, hitting two boundaries during his short stay at the crease. But he fell to a rash shot, attempting to pull Wagner for a six. The Indian captain misjudged the bounce and the ball flew off the top edge for a relatively easy catch for Sodhi.

The Kiwis continued their resurgence after tea, clinching five wickets in the final session.

Craig sent back Ajinkya Rahane (18) shortly after the resumption when the batsman edged one to Tom Latham at short leg.

Rohit Sharma (35) and Ravichandran Ashwin (40) then tried to stitch together a partnership before the former attempted a rash shot off Santner, only to see Sodhi palm the catch at long on.

Wriddhiman Saha (0) and Ashwin soon went back in quick succession while Mohammed Shami’s (0) off-stump was uprooted by a beautiful delivery from Boult.

Earlier, Indian skipper Kohli won the toss and elected to bat in the first Test of the three-match series against New Zealand at the Green Park Stadium here.

India are playing their historic 500th Test. The hosts are playing with six batsmen, two fast bowlers and two spinners while the visiting New Zealand are playing with three spinners and two fast bowlers.

India have played 14 Tests under Kohli’s captaincy so far, winning 10 of them. The hosts will be eager to register their 11th win under Kohli and make the historic 500th Test a memorable one for cricket lovers in the country.

Court grants bail to MLA Somnath Bharti, says he deserves it

New Delhi: AAP leader Somnath Bharti, who was arrested today in connection with the AIIMS boundary wall dispute case, was granted bail by a Delhi court which ruled that chances of the legislator fleeing from justice was remote and he deserved the relief.

Metropolitan Magistrate Anuj Aggarwal allowed the bail plea of Bharti while rejecting an application moved by Delhi Police seeking 14-day judicial remand for him.

Bharti was produced before the court following his arrest this afternoon.

“Considering facts and circumstances and nature of the offence and the fact that he is an MLA and a member of bar and therefore, chances of his fleeing from justice are remote, I am not inclined to send him to judicial custody and he deserves to be granted bail,” the magistrate said while asking him to join the probe and not influence witnesseses.

In his order, he said “on perusal of record, in my view Section 353 (assault or criminal force to deter public servant from discharge of his duty) of the IPC is not attracted at present since the security guards who were allegedly assaulted, do not fall within the ambit of public servant.”

The court said of the provisions for which Bharti was booked, there were only two non-bailable offences — section 353 of IPC and section 3 (mischief causing damage to public property) of the Prevention of Damage To Public Property Act.

During the hearing, police sought to remand the MLA in judicial custody saying that being a member of the legislative assembly of ruling party, he may threaten witnesses and hamper the probe, if bail was granted.

Advocate Vijay Aggarwal, representing Bharti, opposed the police plea for judicial custody saying the accused was falsely implicated out of political vendetta.

The counsel also claimed that police arrested Bharti to prevent him from representing another arrested party MLA Amanatullah Khan before the court.

Bharti was arrested by a police team from Malviya Nagar this afternoon and taken to Hauz Khas Police Station where the case was registered against him on September 11. The case was registered on the basis of a complaint filed by chief security officer of AIIMS R S Rawat.

In his complaint, Rawat had alleged that Bharti had provoked a mob to damage the fence of the hospital with JCB excavator at Gautam Nagar Nallah road in South Delhi in order to give access to unauthorised persons inside AIIMS property and had also misbehaved with security personnel.

A case was registered against Bharti under IPC sections 147 (punishment for rioting), 148 (rioting, armed with deadly weapon), 186 (obstructing public servant in discharge of his public functions), 323 (causing hurt), 353 (assault or use of criminal force to deter a public servant from discharge of his duty) and section 3 of the Prevention of Damage to Public Property Act.

Bharti had then defended his action and accused the AIIMS of “lying” on the issue.

“AIIMS is lying. They have been denying legitimate access to Gautam Nagar residents. AIIMS even refused to (go to) PWD meetings. Wherever commonman will be troubled, I will go. The allegation that residents dismantled the wall is a blatant lie. I will fight in court,” he had tweeted then.

Bharti was previously arrested by Delhi Police in December 2015, in connection with the attempt to murder and domestic violence case filed by his wife.

As many as 12 AAP MLAs have been booked by the Delhi Police till now on various charges and 12 have been arrested, including a few multiple times.

Suspicious men spotted near Mumbai, high alert sounded

Mumbai: The Western Naval Command here issued a high alert along the Mumbai coast after four men in military uniform were today spotted moving suspiciously near a Naval facility in Uran, about 47 kms from here.

A search is on to trace the four men, police said. According to Indian Navy Chief PRO Capt D K Sharma, the search operation is going on along with Maharashtra police after the matter came to light.

The Western Naval Command (WNC) issued “the highest state of alert” along the Mumbai, Navi Mumbai, Thane and Raigad coasts after suspicious movement of a group was reported in Uran.

The WNC has roped-in the police and Coast Guard also for the task.

According to initial information received by the authorities, four school students spotted a group of people dressed in uniform similar to that of Indian Army near Uran and Karanja area.

The DGP office immediately issued alerts to all police stations along the coast.

Security has been beefed up at sensitive locations along the coast, including the Gateway of India, Raj Bhawan, Bombay High (rig), Bhabha Atomic Research Centre and other major establishments near the sea.

The Maharashtra police has also issued an alert following the information that some suspects were moving around near Uran, Director General of Police Satish Mathur told PTI here.

All the coastal police stations in the state have been put on alert and police teams are working in coordination with the Navy in search operations, he said.

Mathur, however, was quick to point out that no suspect has been traced so far.

Notably, the coastline is guarded by a three-tier network which starts with the local police (with its coastal police stations) closest to the land, followed by the Union Home Ministry-led Coast Guard while the Indian Navy patrols the high seas.

Singapore: Industrialist Mukesh Ambani was Thursday named India’s richest person for a ninth year in a row with a sharp increase in networth to $22.7 billion, while Sun Pharma’s Dilip Shanghvi was ranked a distant second with a wealth of $16.9 billion.

The Hinduja Family moved up to the third position ($15.2 billion) on the annual Forbes list of India’s 100 Richest People. Wipro’s Azim Premji slipped one place to fourth with a networth of $15 billion.

Patanjali Ayurved’s Acharya Balkrishna, known as a close associate of yoga guru Ramdev, has made a surprise entry at the 48th position with a networth of $2.5 billion on the list compiled by the American business magazine known for its rich lists.

Forbes said the combined networth of India’s 100 wealthiest is $381 billion (nearly Rs 25.5 lakh crore), a rise of 10 percent from $345 billion in 2015.

Mukesh Ambani’s wealth rose in the past one year from $18.9 billion to $22.7 billion (over Rs 1.5 lakh crore) on 21 percent surge in share price of Reliance Industries, the flagship company of his group, which recently launched 4G mobile services with much fanfare. He was ranked 36th in the global rich list.

Younger brother Anil Ambani was ranked 32nd with a networth of $3.4 billion, down from 29th spot last year.

Shanghvi also retained his second position, though his wealth fell by $1.1 billion due to plunge in share price of his group firm Sun Pharma, the world’s fifth largest generic drug maker, Forbes said.

Hinduja brothers rose to the third spot by displacing Premji and saw their worth rising to $15.2 billion, from $14.8 a year ago.

“The four siblings – Srichand, Gopichand, Prakash, and Ashok – control multinational empire Hinduja Group, with businesses ranging from trucks and lubricants to banking and cable television. The group commissioned its much-delayed 1,040 mw thermal power unit in South India in July,” the magazine said.

“In a post-Brexit world, India appears a steady ship with an economy growing at 7 per cent-plus. The majority of India’s 100 richest have notched up handsome gains as their companies have outperformed the stock market in the past year. As the domestic investment cycle starts kicking in, we can expect more gains and new names in the future,” Forbes Asia’s India Editor Naazneen Karmali said about the list.

Forbes also said the fortunes of cement and paint tycoons in the country benefitted from the government’s infrastructure push and housing-for-all policy.

Shree Cement’s Benu Gopal Bangur moved up to the 14th place with a networth of $5.9 billion, while Asian Paints’ Ashwin Dani saw his wealth rise to $3.3 billion to rank him 34th.

As many as 15 people, including these two, saw their wealth rise by more than $1 billion.

Sourav Majumdar, Editor, Forbes India, said: “This year’s list sees a rise in the overall wealth of the country’s top 100 billionaires, in line with the movement of the markets. While the composition at the top of the list remains largely unchanged, the distribution of wealth within the list continues, with the top 20 now contributing 52 percent of the total, down from 55 percent last year.”

Forbes’ 100-richest for 2016 saw eight persons rejoining the ranks and these included biotech major Biocon’s Kiran Mazumdar-Shaw at 65th place with $1.83 billion.

Besides, there are six newcomers including serial entrepreneurs and brothers Bhavin and Divyank Turakhia (95th, $1.3 billion), who sold their ad tech firm Media.net for $900 million to a consortium of Chinese investors.

Balkrishna made his debut at 48th place ($2.5 billion), “thanks to his 97 percent holding in fast-growing consumer goods outfit Patanjali Ayurved, which he co-founded with yoga guru Baba Ramdev.”

Hero group’s Pawan Munjal debuted at 29th place ($3.65 billion), taking his father late Brijmohan Lall Munjal’s spot on the list.

The minimum amount required to make the list was $1.25 billion, up from $1.1 billion in 2015. There were 13 drop-offs from the last year, including textile figure Balkrishan Goenka and co-founders of Flipkart, Sachin Bansal and Binny Bansal.

Forbes said the list was compiled using shareholding and financial information obtained from the families and individuals, stock exchanges, analysts and regulators.

The ranking lists family fortunes, including those shared among extended families such as the Godrej and Bajaj families. Public fortunes were calculated based on stock prices and exchange rates as of 9 September. Private companies were valued based on similar companies that are publicly traded.

Cauvery row: Defiant CM Siddaramaiah decides not to release water till Friday

Bengaluru: Chief minister Siddaramaiah on Wednesday decided to convene a one-day legislature session on Friday to seek the opinion of elected representatives on the Supreme Court’s order to release 6,000 cusecs ofCauvery water per day to Tamil Nadu. He has deferred implementation of the order until such time.

The move – which virtually amounts to defying the apex court – will give some reprieve to the Congress government, under fire from agitating farmers in Mandya and Mysuru . The CM is likely to take the stand that just as the judiciary is of utmost important to him, so is the legislature. The legislature’s unanimous resolution against releasing water will be submitted to the apex court.

The decision came after Siddaramaiah held day-long talks with his cabinet colleagues, JD(S) leaders and the legal fraternity. Speaking to reporters after a late-evening cabinet meeting, Siddaramaiah said the opinion at the all-party meeting was to immediately convene a legislature session to discuss the issue.

A big push for the government’s position came from former Prime Minister HD Deve Gowda, who attended an all-party meeting that the BJP boycotted. Gowda was vociferous that the government cannot release water at the cost of farmers’ interests.

BJP sources said Prime Minister Narendra Modi has asked Union water resources minister Uma Bharati to convene a meeting of all Cauvery basin states.

Karnataka counsel Fali S Nariman was of the view that the state should release water and express its difficulty before the court on September 27, the date of the next hearing.

It is learnt the Karnataka government took a cue from the Haryana-Punjab row over the Sutlej-Yamuna Link (SYL) Canal. In May , the Punjab assembly had passed a resolution against the SYL Canal saying the state did not have water to share with Haryana.The latter, in turn, accused Punjab of “crossing all limits” and decided to approach the Centre and the Supreme Court. Punjab CM Parkash Singh Badal moved a resolution in the assembly saying his state did not have even one drop to share with other states. The Karnataka leg islature’s unani mous resolution will cushion the state government to some extent against contempt of court, sources said, as the issue would become one between the legislature and the judiciary. With assembly polls one and a half years away, the Congress government cannot afford to take the Supreme Court head on.

At a meeting of the council of ministers earlier in the day, the majority opinion was against releasing water. Some ministers are said to have pointed out that Karnataka had expected some relief from the court on Tuesday .

As all pleas by the state were turned down, there is a possibility of the state being asked to continue releasing water and make good the deficit in the next hearing on September 27. Therefore, it is necessary for the state gov ernment to adopt a hard position now, they felt.

At the all-party meeting, M Veerappa Moily , MP, exhorted the government to not release water, saying the apex court has no jurisdiction over the issue. A delegation led by Siddaramaiah is planning to call on President Pranab Mukherjee to apprise him of the situation and request him to direct PM Narendra Modi to call a meeting of the CMs of the Cauvery basin states.

“We are committed to protecting the interests of our farmers and meet the drinking water needs of Mysuru, Bengaluru and other cities. So we want to seek the opinion of all legislators,” a senior minister said.

The BJP welcomed the cabinet decision to defer the decision to release Cauvery water to Tamil Nadu till they discuss the issue at the emergency session of the legislature. “It’s a belated decison but we welcome it. The two decisions taken at the late night cabinet meeting – to defer the decision to release water and convene an emergency legislature session -are the demands the BJP had been making for a long time in the shortterm and long-term interest of the people,” BJP leader BS Yeddyurappa said.

The minister, however, said the legal team will continue its fight by seeking modification of the top court’s order to release 6,000 cusecs.

Commenting on the state’s hard stance, a legal expert said: “The decision will harm Karnataka’s interests during future hearings in court as it would be regarded a rogue state. There could be a constitutional crisis if Tamil Nadu moves the apex court to enforce its order.”

In 2002, then chief minister SM Krishna was pulled up by the apex court when he defied its order to release water to Tamil Nadu. He apologized and released water later. S Bangarappa tried to defy the interim order of the Cauvery Water Disputes Tribunal by promulgating an ordinance that was struck down by the apex court. He released water as stipulated in the interim award.

New Delhi: Mahendra Singh Dhoni has been named the captain of the all-time India Test XI chosen by cricket magazine Wisden.

The celebrated team has been picked ahead of India’s 500th Test which will be played against New Zealand in Kanpur from tomorrow.

The openers in the side are Sunil Gavaskar and Virender Sehwag, followed by Rahul Dravid, Sachin Tendulkar, VVS Laxman, all-rounder Kapil Dev and Dhoni the wicket-keeper batsman.

The bowlers who made the cut are Anil Kumble, Javagal Srinath, Zaheer Khan and Bishan Singh Bedi. The 12th man is Mohammad Azharuddin.

The Union Cabinet has approved the proposals of Ministry of Finance on certain landmark budgetary reforms relating to (i) the merger of Railway budget with the General budget, (ii) the advancement of the date of Budget presentation from the last day of February to the 1st of February and (iii) the merger of the Plan and the Non-Plan classification in the Budget and Accounts. All these changes will be put into effect simultaneously from the Budget 2017-18.

Merger of Railway Budget with the General Budget:

The arrangements for merger of Railway budget with the General budget have been approved by the Cabinet with the following administrative and financial arrangements-

(i) The Railways will continue to maintain its distinct entity -as a departmentally run commercial undertaking as at present;

(ii) Railways will retain their functional autonomy and delegation of financial powers etc. as per the existing guidelines;

(iii)The existing financial arrangements will continue wherein Railways will meet all their revenue expenditure, including ordinary working expenses, pay and allowances and pensions etc. from their revenue receipts;

(iv)The Capital at charge of the Railways estimated at Rs.2.27 lakh crore on which annual dividend is paid by the Railways will be wiped off. Consequently, there will be no dividend liability for Railways from 2017-18 and Ministry of Railways will get Gross Budgetary support. This will also save Railways from the liability of payment of approximately Rs.9,700 crore annual dividend to the Government of India;

The presentation of separate Railway budget started in the year 1924, and has continued after independence as a convention rather than under Constitutional provisions.

The merger would help in the following ways:

· The presentation of a unified budget will bring the affairs of the Railways to centre stage and present a holistic picture of the financial position of the Government.
· The merger is also expected to reduce the procedural requirements and instead bring into focus, the aspects of delivery and good governance.
· Consequent to the merger, the appropriations for Railways will form part of the main Appropriation Bill.

Advancement of the Budget presentation:

The Cabinet has also approved, in principle, another reform relating to budgetary process, for advancement of the date of Budget presentation from the last day of February to a suitable date. The exact date of presentation of Budget for 2017-18 would be decided keeping in view the date of assembly elections to be held in States.

This would help in following ways:

· The advancement of budget presentation by a month and completion of Budget related legislative business before 31st March would pave the way for early completion of Budget cycle and enable Ministries and Departments to ensure better planning and execution of schemes from the beginning of the financial year and utilization of the full working seasons including the first quarter.
· This will also preclude the need for seeking appropriation through ‘Vote on Account’ and enable implementation of the legislative changes in tax; laws for new taxation measures from the beginning of the financial year.

Merger of Plan and Non Plan classification in Budget and Accounts:

The third proposal approved by the Cabinet relates to the merger of Plan and Non Plan classification in Budget and Accounts from 2017-18, with continuance of earmarking of funds for Scheduled Castes Sub-Plan/Tribal Sub-Plan. Similarly, the allocations for North Eastern States will also continue.

This would help in resolving the following issues:

· The Plan/Non-Plan bifurcation of expenditure has led to a fragmented view of resource allocation to various schemes, making it difficult not only to ascertain cost of delivering a service but also to link outlays to outcomes.
· The bias in favour of Plan expenditure by Centre as well as the State Governments has led to a neglect of essential expenditures on maintenance of assets and other establishment related expenditures for providing essential social services.
· The merger of plan and non-plan in the budget is expected
to provide appropriate budgetary framework having focus on the revenue, and capital expenditure.

Cabinet approves the River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016

The Union Cabinet under the Chairmanship of Prime Minister Shri Narendra Modi has approval the River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016. The Order lays down a new institutional structure for policy and implementation in fast track manner and empowers National Mission for Clean Ganga to discharge its functions in an independent and accountable manner. It has been decided to grant a Mission status to the Authority with corresponding powers under Environment (Protection) Act, 1986 to take cognizance of the provision of the said Act and follow up thereon. Similarly, there is adequate delegation of financial and administrative powers which will distinctly establish NMCG as both responsibility and accountability centre and effectively accelerate the process of project implementation for Ganga Rejuvenation.

Salient Features:

Briefly, the Order envisages:

1. Creation of the National Council for River Ganga (Rejuvenation, Protection and Management), as an Authority under the Chairperson of Hon’ble Prime Minister, in place of the existing NGRBA for overall responsibility for superintendence of pollution prevention and rejuvenation of river Ganga Basin.

2. Setting up of an Empowered Task Force chaired by Hon’ble Minister of Water Resources, River Development and Ganga Rejuvenation to ensure that the Ministries, Departments and State Governments concerned have:

§ an action plan with specific activities, milestones, and timeliness for achievement of the objective of rejuvenation and protection of River Ganga,

§ a mechanism for monitoring implementation of its action plans.

It will also ensure co-ordination amongst the Ministries and Departments and State Governments concerned for implementation of its action plans in a time bound manner.

3. Declaration of National Mission for Clean Ganga (NMCG) as an Authority with powers to issue directions and also to exercise the powers under the Environment (Protection) Act, 1986 to enable it to carry out efficiently its mandate. The NMCG will have a two-tier management structure with a Governing Council (GC), to be chaired by DG, NMCG. Below the GC, there will be an Executive Committee (EC) constituted out of the GC, to be chaired by the DG, NMCG.

NMCG will comply with the decisions and directions of the National Ganga Council and implement the Ganga Basin Management Plan approved by it; co-ordinate and carry out all activities necessary for rejuvenation and protection of River Ganga and its tributaries.

4. At the State level, it is proposed to create the State Ganga Committees in each of the defined States as Authority, to function as Authorities in respect of each State and perform the superintendence, direction and control over the District Ganga Protection Committees under their jurisdiction.

5. Similarly, the District Ganga Committees in each of the Ganga Bank Districts will carry out the assigned tasks as an Authority at the district level, to take cognizance of local threats and needs of river Ganga and conceptualise such measures as necessary to ensure overall quality of water in river Ganga and monitor various projects being implemented.

The proposed structure is to be implemented through the subordinate legislation route by issue of an Order invoking the provisions under Section 3 of Environment (Protection) Act, 1986 (29 of 1986) relating to creation of authorities to achieve its objectives.

The other main features of the proposal are as follows:

§ This will give more teeth to the NMCG for Clean Ganga for the environmental protection/rejuvenation of River Ganga. It will also ensure proper co-ordination with the local bodies and compliance with the directions of NMCG for pollution abatement of the river Ganga.

§ NMCG will, however, take action only in the event when required action is not taken by CPCB. CPCB shall also take action jointly with NMCG under the provisions of said Act.

§ A special focus of the revamped structure would be to maintain required ecological flows in the river Ganga with the aim of ensuring water quality and environmentally sustainable development.

For taking up fast track creation of sewerage treatment infrastructure in Ganga basin, an innovative model based on Hybrid Annuity has also been approved. This will ensure that the infrastructure created under the project is operational on a sustainable basis.

In order to ensure transparency and cost effectiveness, a provision for concurrent audit, safety audits, research institutions and financial framework has been made.

Background:

The Ganga Action Plan (GAP) Phase-I was launched in 1985 and later GAP Phase-II was initiated in 1993 with the objective of improving the water quality of river Ganga and was later expanded to include some of its tributaries also. In May, 2015, the Government approved the Namami Gange programme as a comprehensive mechanism to take up initiatives for rejuvenation of river Ganga and its tributaries as a Central Sector Scheme with hundred per cent funding by the Union Government. The programme, despite making moderate gains in arresting the declines in water quality, had certain limitations in implementation.

Although, the NMCG has been functional as a registered Society since 2012 its role has been largely limited to fund the projects to implementing organisations. It neither had the mandate to take cognizance of various threats to river Ganga nor the powers to issue directions to the concerned authorities/polluters. While the organisation has been made responsible as custodian of river Ganga in both public eye as well as various courts, the mission is grossly ill-equipped to handle such expectations.

It is expected that the move will ensure effective abatement of pollution and rejuvenation of the River Ganga; maintain ecological flows in the River; impose restrictions on polluting industries; and carry out inspections to ensure compliance. In addition, it is proposed to maintain and disseminate data and carry out research on the condition of the river.

Cabinet approves provision of submarine optical fibre cable connectivity between mainland (Chennai) and Andaman & Nicobar Islands

The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has given its approval for provision of a direct communication link through a dedicated submarine Optical Fibre Cable (OFC) between Mainland (Chennai) and Port Blair & five other islands viz. Little Andaman, Car Nicobar, Havelock, Kamorta and Great Nicobar.

The estimated cost of the project is Rs. 1102.38 crore including operational expenses for 5 years. The project is likely to be completed by December 2018.

The approval would equip Andaman & Nicobar Islands (ANI) with appropriate bandwidth and telecom connectivity for implementation of e-Governance initiatives; establishment of enterprises & e-commerce facilities. It will also enable the provision of adequate support to educational institutes for knowledge sharing, availability of job opportunities and fulfil the vision of Digital India.

Background:

The Andaman and Nicobar Islands are of immense strategic significance for India. The geographical configuration and the location of the Andaman & Nicobar Islands chain in the Bay of Bengal safeguard India’s eastern seaboard. Provision of secure, reliable, robust, and affordable telecom facilities in these islands is of importance from a strategic point of view to the country and also an important requirement for the socio-economic development of the islands.

Currently the only medium of providing telecom connectivity between Mainland and Andaman & Nicobar Islands is though satellites, but the bandwidth available is limited to 1 Gbps. Satellite bandwidth is very costly and its availability is limited due to which future bandwidth requirement cannot be met solely through it. Then, there is an issue of redundancy, that is, no alternate media is available in case of any emergency. Lack of bandwidth and telecom connectivity is also hampering socio-economic development of the islands. Hence it is essential to have submarine OFC connectivity between the Mainland India and Andaman & Nicobar Islands, being the only option for catering to projected future bandwidth requirements.

Winding up of Hindustan Diamond Company Private Limited

The Cabinet Committee on Economic Affairs, chaired by the Prime Minister Shri Narendra Modi, has given its approval for initiating the process of winding up of Hindustan Diamond Company Private Limited (HDCPL), a 50:50 joint venture of the Government of India and De Beers Centenary Mauritius Limited (DBCML).

The HDCPL was incorporated under the Companies Act, 1956 in 1978. The objective of formation of the Company was to supply rough diamonds to diamond processing industry in India, particularly to small and medium diamond jewellery exporters, who had no direct access to rough diamonds from Diamond Trading Company (DTC), London, the marketing arm of De Beers who held a very large chunk of world’s rough diamonds market.

The winding up of HDCPL is not likely to affect supply of rough diamonds to Indian diamantaires as Indian diamond industry has grown in these years and several Indian players are sightholders with top diamond producers now. Also, with the objective to facilitate the constant supply of rough diamonds and to make India an International Diamond Trading Hub, the Government has created a Special Notified Zone (SNZ) at Bharat Diamond Bourse, Mumbai in 2015. At present viewing operations are being carried out in the SNZ at Mumbai wherein Foreign Mining Companies (FMCs) only display their rough diamond lots to the Indian manufacturers and then take them back. Thereafter the sales are carried through e-auction from offices situated in other countries to Indian manufacturers. This facility has enabled even smaller Indian players to have direct access of supply of rough diamonds.

Cabinet gives ex-post facto approval to enhancement of Pension for Freedom Fighters

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has given its ex-post facto approval to enhancement of Pension for Freedom Fighters and for the spouses (widows/widowers), eligible daughters and dependent parents of deceased Freedom Fighters, under the Swatantrata Sainik Samman Pension Scheme (SSSPS), 1980.

(i) The revised scale of pension has taken effect from 15.O8.2016. Further, the revised total amount of pension will be taken as basic pension for the respective categories of Freedom Fighter pensioners for calculating Dearness Relief.

(ii) The existing Dearness Relief system based on All India Consumer Price Index for Industrial workers, which was so far applicable to freedom fighter pensioners on annual basis, is being discontinued and replaced by the Dearness Allowance system applicable to Central Government employees twice a year. This will be termed as “Dearness Relief”, the appropriate term in case of pensioners.

All freedom fighters and spouses and dependent parents/eligible daughter pensioners of deceased freedom fighters drawing pension under the Swatantrata Sainik Samman Pension Scheme, 1980 would be benefitted by the decision.

Background

. Government of India introduced in 1969, the ‘Ex-Andaman Political Prisoners Pension Scheme’ to honour the freedom fighters who had been incarcerated in the Cellular Jail at Port Blair. In order to commemorate the 25th Anniversary of Independence in 1972, a regular scheme for grant of freedom fighters’ pension was introduced. Thereafter, with effect from 1.8.1980, a liberalized scheme, the Swatantrata Sainik Samman Pension Scheme’ is being implemented. Besides the freedom fighters, spouses (widows.widowers), unmarried and unemployed daughters (up to maximum three at any point of time) and parents of deceased freedom fighters are eligible for pension under the Scheme. Till 2016, a total of 1,71,605 freedom fighters and their eligible dependents have been sanctioned pension under the scheme. At present, 37,981 freedom fighters and their eligible dependent pensioners are covered under the scheme. Out of these, 11,690 are freedom fighters themselves, 24,792 are spouses (widows/ widowers) and 1,490 are daughter pensioners. Instructions have been issued to all the authorized banks for ensuring Aadhar linked disbursement of Freedom Fighter pension as early as possible.

Cabinet approves enactment of Admiralty (Jurisdiction and Settlement of Maritime Claims) Bill 2016 and to repeal five archaic admiralty statutes

The Union Cabinet under the Chairmanship of Prime Minister Shri Narendra Modi has given its approval to the proposal of Ministry of Shipping to enact Admiralty (Jurisdiction and Settlement of Maritime Claims) Bill 2016 and to repeal five archaic admiralty statutes.

The Bill consolidates the existing laws relating to admiralty jurisdiction of courts, admiralty proceedings on maritime claims, arrest of vessels and related issues. It also repeals five obsolete British statues on admiralty jurisdiction in civil matters, namely, (a) the Admiralty Court Act, 1840 (b) the Admiralty Court Act, 1861, (c) Colonial Courts of Admiralty Act, 1890, (d) Colonial Courts of Admiralty (India) Act, 1891, and (e) the provisions of the Letters Patent, 1865 applicable to the admiralty jurisdiction of the Bombay, Calcutta and Madras High Courts.

Salient Features of Admirability Bill, 2016

This legislative proposal will fulfil a long-standing demand of the maritime legal fraternity. The salient features are as follows:-

· The Bill confers admiralty jurisdiction on High Courts located in coastal states of India and this jurisdiction extends upto territorial waters.
· The jurisdiction is extendable, by a Central Government notification, upto exclusive economic zone or any other maritime zone of India or islands constituting part of the territory of India.
· It applies to every vessel irrespective of place of residence or domicile of owner.
· Inland vessels and vessels under construction are excluded from its application but the Central Government is empowered to make it applicable to these vessels also by a notification if necessary.
· It does not apply to warships and naval auxiliary and vessels used for non-commercial purposes.
· The jurisdiction is for adjudicating on a set of maritime claims listed in the Bill.
· In order to ensure security against a maritime claim a vessel can be arrested in certain circumstances.
· The liability in respect of selected maritime claims on a vessel passes on to its new owners by way of maritime liens subject to a stipulated time limit.
· In respect of aspects on which provisions are not laid down in the Bill, the Civil Procedure Code, 1908 is applicable.

Background:

India is a leading maritime nation and maritime transportation caters to about ninety-five percent of its merchandise trade volume. However, under the present statutory framework, the admiralty jurisdiction of Indian courts flow from laws enacted in the British era. Admiralty jurisdiction relates to powers of the High Courts in respect of claims associated with transport by sea and navigable waterways. The repealing of five admiralty statutes is in line with the Government’s commitment to do away with archaic laws which are hindering efficient governance.

Cabinet approves USOF support to BSNL for Rural Wire-line connections installed prior to 1.4.2002

The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has approved the proposal to extend subsidy support of Rs. 1,250 crore to Bharat Sanchar Nigam Limited (BSNL) from Universal Service Obligation Fund (USOF), as compensation for deficit incurred by BSNL in operating the Rural Wire-line connections installed prior to 1st April, 2002. The eligible rural wire-line connections installed prior to 1.4.2002 is 32.32 lakh, across India as on 31.3.2014.
The Cabinet also approved that the above subsidy support would be the last and final payment and no further request from BSNL for financial/subsidy support from USOF on this count shall be considered.
In order to make Bharat Sanchar Nigam Limited (BSNL) eligible for subsidy funding on nomination basis from USOF, amendment will be required in Rule 526 of the Indian Telegraph Rules (ITRs), 1951. It stipulates that the criteria for selection of Universal Service Providers shall be made by bidding process from amongst eligible entities for implementation of USOF schemes. Corresponding Amendment in Rule 525 will also be required.
Full/lump-sum amount of Rs. 1,250 Crore shall be disbursed, consequent to necessary amendment of the ITRs and signing of USOF agreement with BSNL. Utilization certificate of’ the USOF subsidy disbursed towards operation and maintenance of the rural wire-line connections would be submitted by BSNL.

Background:
USOF since its inception in 2002 has been providing subsidy for BSNL for the rural wire line connections installed prior to 1.4.2002. A total of Rs. 8,692 crore has been extended as USOF subsidy support till date, for the rural wire-line connections, installed by BSNL prior to 1.4.2002. The details are as follows:

Telecom Commission, in its meeting dated 11.12.2012, considered the views of the TRAI and USOF and directed that an assessment be carried out of the current status of the infrastructure.

Cabinet approves raising Extra Budgetary Resources to augment infrastructure spending

The Union Cabinet under the Chairmanship of Prime Minister Shri Narendra Modi has given its approval for raising a total of Rs. 31,300 crore in the financial year 2016-17 and to service the principal and interest against the Extra Budgetary Resources (EBR) of Rs. 16,300 crore by Government of India to augment infrastructure spending.

Out of the EBR of Rs.31,300 crore, it is proposed to finance the funds to be raised by Power Finance Corporation (PFC), Indian Renewable Energy Development Agency (IREDA), Inland Waterways Authority of India (IWAI), and National Bank for Agriculture and Rural Development (NABARD) by Government of India. This implies that the principal and the interest in respect of the EBR of Rs.16,300 crore to be raised by PFC, IREDA, IWAI, and NABARD shall be financed by Government of India by making suitable budget provisions in the Demand of respective Ministries/Departments.

The move is intended to supplement the efforts of the Government to improve infrastructure spending and to improve the revenue-capital mix of the expenditure for a more sustainable growth.
