Kerala HC fails to stay ‘S Durga’ screening at IFFI

Kochi: The Centre on Friday suffered a setback when a division bench of the Kerala High Court failed to stay the single bench order earlier this week that directed the screening of the certified copy of Malayalam film “S Durga” at the 48th IFFI.

The Centre had on Thursday filed an appeal before the division bench against the single bench’s verdict that asked for the film to be screened at the ongoing International Film Festival of India (IFFI) in Goa.

Even while opposing the single bench order, the Centre’s counsel pointed out that including the film at this time would create a problem for the schedule, but the division bench failed to stay the single bench verdict and instead it accepted the petition in its file.

“S Durga”, a Malayalam movie directed by Sanal Kumar Sasidharan, and Ravi Jadhav’s Marathi movie “Nude” were controversially dropped by the Union Information and Broadcasting Ministry from the screening schedule at the IFFI’s Indian Panorama section, despite the jury’s approval.

The crew of “S Durga” continues to wallow in uncertainty over whether the film will be screened at all.

No seeking independence, Tibet wants to stay with China: Dalai Lama

Kolkata: Tibet does not seek independence from China but wants greater development, Tibetan spiritual leader the Dalai Lama said here Thursday.

China and Tibet enjoyed a close relationship, though there were occasional “fights”, he said at an interactive session organised by the Indian Chamber of Commerce.

“The past is past. We will have to look into the future,” he said.

He stressed that Tibetans wanted to stay with China.

“We are not seeking independence… We want to stay with China. We want more development,” the spiritual leader of the Tibetan people said.

The Dalai Lama said China must respect Tibetans culture and heritage.

“Tibet has a different culture and a different script… The Chinese people love their own country. We love our own country,” he said.

Holding that no Chinese “understand what had happened in the last few decades”, he said the country had changed over the years.

“With China joining the world, it has changed 40 per cent to 50 per cent of what it was earlier,” he said.

The Dalai Lama also referred to the ecological significance of the Tibetan Plateau and recalled that a Chinese ecologist had said its environmental impact was like that of the South Pole and the North Pole.

“The ecologist called it the Third Pole,” the Buddhist leader said.

The Dalai Lama said, “From Yangtze to Sindhu rivers, major rivers … come from Tibet. Billions of lives are involved. Taking care of the Tibetan Plateau is not only good for Tibet but for billions of people.”

India bundle out Sri Lanka for 205 in second Test

Nagpur: Indian spinners Ravichandran Ashwin and Ravindra Jadeja wreaked havoc, sharing seven wickets on the opening day of the second Test to bowl out Sri Lanka for 205 in their first innings at the Vidarbha Cricket Association (VCA) Stadium here on Friday.

Ashwin, who went wicketless in the first two sessions, broke the backbone of the Sri Lankan innings by removing skipper Dinesh Chandimal, who top-scored with a patient 122-ball 57 before adding three more wickets to return with figures of 4/67.

Left-arm spinner Jadeja complemented the off-spinner well, finishing with 3/56 while veteran paceman Ishant Sharma also picked up three wickets giving away 37 runs in his 14 overs.

Resuming the final session at 151/4, the tourists found the going tough and lost wickets at regular intervals with their last six wickets falling for just 54 runs.

The series is currently squared at 0-0 after the drawn opening Test at the Eden Gardens in Kolkata.

Madras HC summons Bengaluru Jail official with Jayalalithaa’s fingerprints

Chennai: The Madras High Court on Friday summoned the Superintendent of Parappana Agrahara Jail in Bengaluru to appear before it with the fingerprint records of Tamil Nadu’s late Chief Minister J.Jayalalithaa in connection with affixing of the thumb impression on poll documents, said a lawyer.

The prison official will have to appear before the High Court on December 8, V.Arun, the lawyer for P.Saravanan, the DMK candidate for the Thirupparankundram assembly constituency in the by-election held, if she had taken an Aadhar card, had also asked the Central government to produce the Aadhar card details of Jayalalithaa if any, he said, adding that the fingerprints of Jayalalithaa with the Bengaluru jail and with the Central government if she had taken an Aadhar card would be compared with those in the poll papers.

Saravanan had approached the court to cancel the election of AIADMK’s A.K. Bose from the Thirupparankundram Assembly constituency in the by-election held last year, raising doubts on affixing of the thumb impression by Jayalalithaa, also the AIADMK chief, in his poll documents.

Jayalalithaa was lodged in the Parappana Agrahara prison after she was convicted in a corruption case by the trial court in 2014 but later let out on bail.

In September 2016, she was admitted to Apollo Hospital for illness. In October 2016, she had an inflamed right hand as she had undergone tracheostomy and had to affix her left thumb impression in the poll documents submitted by the AIADMK candidate.

As per the Representation of People Act, a candidate contesting on behalf of a political party has to submit Form B, where their party leader has to authorise the candidate to contest under the party’s election symbol.

The by-polls in Aravakurichi, Thanjavur and Thiruparankundram assembly constituencies in Tamil Nadu were slated for November 19, 2016 and the ruling AIADMK candidates had submitted their papers on October 28, 2016 to the Returning Officers.

The thumb impression of Jayalalithaa was attested by a government doctor – P.Balaji, Professor of Minimal Access Surgery, Madras Medical College.

In his comments, Balaji said: “Since the signatory has undergone tracheostomy recently and has an inflamed right hand, she is temporarily unable to affix her signature. Hence she has affixed her left thumb impression on her own in my presence.”

Dr Babu K. Abraham, working in Apollo Hospitals, signed as a witness.

Tracheostomy is a medical procedure whereby a direct airway is created by an incision in the windpipe enabling a person to breathe directly without the use of nose or mouth.

Jayalalithaa was admitted to the hospital with fever and dehydration on September 22 and died after over 70 days in December.

‘Padmavati’: Body of man found hanging on Nahargarh Fort in Jaipur

Jaipur: The body of a 40-year-old man was found hanging from the outer walls of Nahargarh Fort here on Friday morning, with the message “‘Padmavati’ ka virodh” – in protest against the film “Padmavati”.

The message, written on the stones near the fort wall adjacent to the body, read, “Hum putle nahin jalate….latkate hain” (we don’t burn effigies, we hang them).

“It is early to comment on it as the matter is under investigation. The identity of the man, around 40-years-old, is yet to be ascertained,” Satyendra Singh, DCP Jaipur (North), told IANS.

Sanjay Leela Bhansali’s “Padmavati” has been mired in controversies since its shooting started. Activists of the Karni Sena, a Rajput community, besides other groups have been protesting against the movie, claiming the film “distorts” historical facts.

“They are trying to defame queen Padmavati by distorting historical facts. It is not acceptable,” an activist of the Karni Sena said.

Activists of the Karni Sena earlier this month vandalised a theatre in Kota, Rajasthan, over reports that it was showing a trailer of “Padmavati”. A Karni Sena leader threatened actress Deepika Padukone, who plays the lead in the movie, with physical harm.

The release of the movie, earlier scheduled for December 1, has been deferred.

Mladic sentenced to life in prison for genocide

Former Bosnian Serbian commander Ratko Mladic has been sentenced to life in prison for genocide and war crimes during the Balkans conflicts more than two decades ago.

The presiding judge of the the International Criminal Tribunal for the former Yugoslavia (ICTY) on Wednesday found that the 74-year-old general “significantly contributed” to genocide committed at Srebrenica.

Previous judgments already ruled that the massacre of about 8,000 Muslim men and boys in Srebrenica was genocide.

Judge Alphons Orie ruled that the perpetrators of the crimes committed in Srebrenica intended to destroy the Muslims living there.

The judge also ruled that Mladic carried out and personally oversaw a deadly campaign of sniping and shelling in Sarajevo.

“The crimes committed rank among the most heinous known to humankind,” he said.

The former general initially appeared relaxed as he listened intently to the verdict but was later removed from the courtroom after he shouted at the judges when he was refused an adjournment.

His lawyer said Mladic needed a break for treatment of high blood pressure but the continued reading the verdict after Mladic removal from court.

The former general, dubbed the “Butcher of Bosnia”, was accused of 11 counts – including genocide, war crimes and crimes against humanity committed by his forces during the war in Bosnia from 1992 and 1995.

Many Bosnian Serbs, however, view Mladic as a national hero who helped Serbia through the war that broke up former Yugoslavia.

Serbian daily newspapers on Wednesday featured photos of Mladic on the front page with captions reading “I’m innocent; they can’t take my soul” and “I’m not guilty.”

Al Jazeera’s Marko Subotic, reporting from Serbia’s capital, Belgrade, said support for Mladic there is still widespread.

“The media in Serbia never reported on what the Serbian army, under the command of Mladic, committed in Bosnia and Herzegovina. Because of this, researchers say residents are confused because they don’t know why Mladic is standing trial at the tribunal in the Netherlands,” Subotic said.

“A study in 2012 concluded that 42 percent of residents in Serbia don’t know why Mladic is being tried at all. They know more about what went on while he was in hiding; they know that he was looking for strawberries when he was arrested in Serbia in 2011.”

Wednesday’s verdict was long awaited by tens of thousands of victims across former Yugoslavia, and dozens gathered early outside the courtroom, many clutching photos of loved ones who died or are among the 7,000 still missing.

The court said, however, it was “not convinced” of genocidal intent in six other municipalities, in line with previous judgments.

“We’re sad and disappointed because Mladic wasn’t declared responsible for the genocide in Prijedor and in the other five municipalities that were listed,” Sejida Karabasic, from Prijedor, said.

“3,176 people [killed] in Prijedor isn’t enough in order to prove that there was a mass killing. So, more than 10,000 of us should have been killed in order to prove that genocide happened there,” Karabasic said.

“There were mass rapes, killings, concentration camps. They found the largest mass graves in the Prijedor region, none of that was enough for the verdict to include genocide,” she added.

Mladic’s trial was the last before the tribunal and came as the court in The Hague prepared to close its doors next month.

Sindhu, Saina, Prannoy advance at Hong Kong Open

Kowloon: Indian shuttlers P.V. Sindhu, Saina Nehwal and H.S. Prannoy advanced to the second round while Parupalli Kashyap and the women’s doubles pair of Ashwini Ponnappa and N. Sikki Reddy fell in the opening round of the Hong Kong Open Superseries on Wednesday.

While second seed Sindhu eased past Hong Kong’s qualifier Leung Yuet Yee 21-18, 21-10, Saina registered a hard-fought 21-19, 23-21 win over Denmark’s Mette Poulsen.

In the men’s singles, Prannoy moved into the second round after a 19-21, 21-17, 21-15 win in an hour and one minute over Hong Kong’s Hu Yun.

Kashyap lost 21-15, 9-21, 20-22 to South Korean Lee Dong Keun in an hour and nine minutes.

Sourabh Verma too exited the competition, losing to Indonesian Tommy Sugiarto 15-21, 8-21 in 30 minutes.

The women’s doubles pair of Ashwini and Sikki fought hard but couldn’t prevent China’s Huang Dongping and Li Wenmei from advancing to the next round. The Chinese won 21-11, 19-21, 21-19 in 55 minutes.

Hadiya case: SC refuses urgent hearing for in-camera proceedings

New Delhi: The Supreme Court today refused to accord urgent hearing on a plea filed by the father of a Kerala-based woman, who converted to Islam before marrying a Muslim man, that interaction with the woman be conducted in- camera.

A bench comprising Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud said that it will deal with this plea on November 27 itself when the woman would be brought before it for interaction.

The counsel for Ashokan K M, the father of the woman, sought an urgent hearing on his plea saying that it would become infructuous if the earlier order mandating open court interaction is not modified. The apex court had on October 30 directed that the woman be produced before it on November 27 for an interaction in open court.

Asokan referred to the communally sensitive nature of the case and sought in-camera interaction on some grounds including that radical elements could jeopardise the safety and privacy of his daughter and the family.

The top court had on August 16 said it would speak to the woman in-camera before taking a final decision on the matter. It has later modified the order saying “We may further add that this court shall speak to her not in camera but in open court.”

The apex court had earlier observed that the free consent of a major to marriage has to be ascertained amid an assertion by National Investigation Agency (NIA) that an indoctrinated person may be incapable of giving free consent to marriage.

The NIA had referred to “psychological kidnapping” and said that an indoctrinated person may be incapable of giving free consent. It had also alleged that there was a “well-oiled machinery working in Kerala” indulging in indoctrination and radicalisation and 89 such cases have been reported.

The NIA had claimed that this was a case in which the woman was indoctrinated and hence the court could invoke parental authority even if she was a major. The counsel for her father had earlier claimed that Shafin Jahan, the alleged husband of the woman, was a radicalised man and had links with persons who used to recruit for ISIS.

The woman, a Hindu, had converted to Islam and later married Jahan. It was alleged that the woman was recruited by Islamic State’s mission in Syria and Jahan was only a stooge. Jahan had on September 20 approached the apex court seeking recall of its August 16 order directing the NIA to investigate the controversial case of conversion and marriage of a Hindu woman with him.

He had moved the top court after the Kerala High Court had annulled his marriage, saying it was an insult to the independence of women in the country.

Assembly directs to arrest journalists Ravi Belagere and Anil Raju

Belagavi: The Karnataka Legislative Assembly rejected a motion seeking reconsideration of the Speaker’s sentence to two tabloid journalists to one year in jail for breach of privilege over their alleged defamatory articles against legislators.

Ravi Belagere, editor of Hi Bangalore, and Anil Raju, Yelahanka Voice, was rejected by a voice vote and the duo have been arrested with a fine of Rs 10,000 for breach of privilege.

The breach of privilege charge was over an article published in Hi Bangalore in September 2014 about Koliwad’s alleged bid to get a ministerial berth in the Congress government in Karnataka.

A request by Congress MLA B M Nagaraj to order punitive action against Belagere for not appearing before the privileges committee despite multiple notices was upheld by Koliwad as the Speaker on June 21.

The charge against Anil Raj was brought by BJP MLA S R Vishwanath, who accused the journalist of consistently publishing defamatory articles, and continuing to do so despite appearing before the privileges committee and tendering an apology.

Congress agrees to special quota for Patels, says Hardik

Ahmedabad: Patidar leader Hardik Patel on Wednesday declared his support for the Congress in the upcoming Gujarat elections, saying the party had accepted the demand for reservation for the Patel community.

The Patidar Anamat Andolan Samiti (PAAS) leader told reporters here that the Congress will include the extension of reservation benefit to the Patel community in its election manifesto.

The Congress, which has mounted a hectic campaign to dislodge the long-ruling BJP in the home state of Prime Minister Narendra Modi and BJP chief Amit Shah, has been wooing Hardik, who has been spearheading the Patidar stir, for quite some time.

Elections in Gujarat will be held on December 9 and 14.
