Nasheman News : Justice Dinesh Maheshwari and Justice Sanjiv Khanna were on Friday sworn in as judges of the Supreme Court.
They were administered the oath by Chief Justice Ranjan Gogoi.
With their swearing in, the apex court now has 28 judges against its sanctioned strength of 31.
Before their elevation to the top court, Justice Maheshwari was the Chief Justice of the Karnataka High Court and Justice Khanna was a Judge in the Delhi High Court.
President Ram Nath Kovind had appointed them as Supreme Court Judges on Wednesday after the government accepted the top court collegium’s recommendation on their elevation.
The collegium decision of January 10 triggered a controversy as it had revoked its December 12, 2018, decision to recommend the elevation of Rajasthan High Court Chief Justice Pradeep Nandrajog and Delhi High Court Chief Justice Rajendra Menon to the Supreme Court.
Justice Khanna was elevated to Supreme Court superceding three senior most judges of Delhi High Court and he stood at number 33 of the all India seniority of the High Court judges.

Government curtails tenure of Asthana, 3 other CBI officers
Nasheman News : The Central government on Thursday curtailed the tenure of Special CBI Director Rakesh Asthana, who had a bitter fight with ousted agency Director Alok Verma and who himself faces corruption charges, with immediate effect.
Along with him, the tenure of three other top officers — Joint Director Arun Kumar Sharma, DIG Manish Kumar Sinha and SP Jayant J. Naiknavare, who were considered close to Verma during the fight with Asthana — was also reduced.
Naming the four officials, an official notification said the Appointments Committee of the Cabinet has approved the proposal of Department of Personnel and Training for “curtailment of tenure” of the Indian Police Service officers working in the rank of Special Director, Joint Director, Deputy Inspector General (DIG) and Superintendent of Police (SP).
The government on October 23 had sent Asthana on forced leave divesting him of his powers along with Verma after their clash levelling mutual allegations of corruption against each other.
Asthana had levelled serious charges against Joint Director Sharma with Central Vigilance Commission alleging that he and his family operates shell companies in partnership with dubious individuals.
Gujarat-cadre IPS officer Sharma was appointed Joint Director (Policy) in March after Verma took over as Director in February.
Sharma was also appointed the officer supervising the investigation of a bribery case registered against Asthana on October 15.
DIG Sinha was also supervising the probe into an allegation of bribery against Asthana.
Verma, who approached the Supreme Court against the order, was ousted as CBI Director on January 10 by a three-member selection committee headed by Prime Minister Narendra Modi and two of its members including leader of Congress in the Lok Sabha, Mallikarjun Kharge, and Chief Justice of India-nominated Justice A.K. Sikri.
CBI registers four more FIRs in Muzaffarpur shelter home case
Nasheman News : The CBI has registered four more FIRs in the alleged abuse of children in four shelter homes across Bihar, an official said on Thursday
Among those, two shelter homes are in Munger and one each in Gaya and Bhagalpur. The Central Bureau of Investigation registered these FIRs on Wednesday.
According to the FIR, these shelter homes were being run in violation of provisions of Juvenile Justice Act 2015, besides being involved in financial irregularities.
On November 28 last year, the Supreme Court had asked the CBI to probe the alleged abuse of inmates at 17 shelter homes in Bihar listed in a study conducted by Tata Institute of Social Sciences (TISS).
The maximum numbers of these shelter homes are for boys. The preliminary enquiry conducted by TISS revealed that the women staffers of these shelter homes asked the boys to send lewd messages to other women.
The TISS had claimed in its report that the boys in the shelter home were forced to work for the Superintendent whose residential quarters were in the same premises.
The CBI on Tuesday had also registered four FIRs against different shelter homes that included the Director of Samaj Samiti Boys’ Children Home in Bhagalpur and DORD Children Home in Gaya for allegedly physically and mentally assaulting the inmates.
These actions are in addition to the CBI’s ongoing probe into the case of sexual exploitation of minor girls at the Muzaffarpur shelter home in which the CBI had registers two separate FIRs.
The Muzaffarpur case caught national attention last year after the TISS study highlighted that out of the 42 girls lodged at the short-stay home run by an NGO, 34 were found to have been sexually assaulted. The shelter home was being run by Brajesh Thakur.
An FIR was lodged against 11 people, including Thakur, on May 31. The probe was later taken over by the CBI.
SC asks search panel to recommend names for Lokpal by Feb end
The Supreme Court on Thursday requested the search committee to complete its task of shortlisting names for Lokpal and its members by February end and submit the list for consideration to the Selection Committee. The apex court will hear the matter next on March 7.
A bench headed by Chief Justice Ranjan Gogoi also directed the Centre to provide the search committee, which is led by Justice (retd) Ranjana Prakash Desai, the necessary infrastructure and manpower to complete its work.
The direction of the bench, which also comprises Justices L N Rao and S K Kaul, came after Attorney General K K Venugopal, appearing for the Centre, pointed out certain problems like lack of infrastructure due to which the search committee was not able to hold deliberations on the issue.
The court was hearing a contempt plea filed by NGO Common Cause against the government for delaying the appointment of Lokpal. Appearing for the NGO, advocate Prashant Bhushan raised doubts on the working of the Search Committee.
To this, Chief Justice Ranjan Gogoi said, “Don’t look at things from a negative point of view. Look at things positively and the world would be a better place. We are trying to make the world a better place.”
The Lokpal and Lokayuktas Act, enacted in 2013, received presidential assent on January 1, 2014, and came into force on January 16, 2014. However, the appointment of the first Lokpal is yet to occur. Some states are also yet to appoint Lokayuktas.
The selection committee comprises of the prime minister, the leader of the single largest opposition party, the Lok Sabha speaker and an eminent jurist.
Congress leader Mallikarjun Kharge, who is the leader of the largest opposition party, has so far skipped meetings of the selection panel, taking objection to the government inviting him as a “Special Invitee”. Kharge has maintained that there is no provision in the Lokpal Act for a Special Invitee.
Social activist Anna Hazare has threatened to launch a hunger strike from January 30 over the Centre’s failure to appoint the Lokpal as per the Lokpal and Lokayukta Act, 2013.
Modi jealous of Andhra Pradesh: Chandrababu Naidu
Nasheman News : Chief Minister N. Chandrababu Naidu on Thursday alleged that Prime Minister Narendra Modi was jealous of Andhra Pradesh and hence was behind the proposed Federal Front of Telangana Chief Minister K. Chandrashekhar Rao.
Reacting to the meeting of Telangana Rashtra Samithi (TRS) leaders with YSR Congress Party President Y.S. Jaganmohan Reddy to discuss the proposed front, Naidu said that “jealous people were coming together under a conspiracy against Andhra Pradesh”.
During a teleconference with leaders of the Telugu Desam Party (TDP), he said Modi was jealous of his state as it was making rapid progress.
According to TDP sources, the TDP chief said Modi was afraid that the southern state might overtake Gujarat in development.
He alleged that TRS President Chandrashekhar Rao was also against Andhra Pradesh’s development and afraid of his own inefficiency while Jaganmohan Reddy was scared that he might have to go to jail in corruption cases.
Claiming that KCR’s Federal Front was not getting a response from any party, he said this was the reason his son K.T. Rama Rao met Jagan in a hurry.
“With this meeting the nexus between them is exposed,” said Naidu, who was trying to play anchor to an anti-BJP front at the national level.
Naidu also remarked that the three parties were attacking Andhra Pradesh like vultures. He alleged that they were trying to create a rift among various communities and castes in his state.
The TDP chief alleged that the Federal Front was aimed at implementing the Bharatiya Janata Party’s agenda. He said the BJP was trying to ensure that the parties against it do not unite.
“It wants to create confusion among people. It wants to split anti-BJP votes,” he said.
KCR’s son Rama Rao, who is also the Working President of the TRS, met Jagan in Hyderabad on Wednesday to discuss the Federal Front proposed as an alternative to both the National Democratic Alliance (NDA) and the United Progressive Alliance (UPA).
KCR plans to visit Andhra Pradesh soon for further talks with Jagan, whose YSR Congress is the main opposition party in Andhra Pradesh.
Indra Nooyi under Trump administration consideration to head World Bank
Nasheman News : Indian-American business leader Indra Nooyi, who headed the multinational PepsiCo, is under consideration for heading the World Bank, according to multiple media reports.
If she is nominated by US President Donald Trump to be the Bank’s president, she will succeed Jim Yong Kim, a Korean immigrant who unexpectedly announced at the beginning of the year that he is quitting.
By tradition, the US president names the head of the global financial institution and the nomination is rubber-stamped by the executive directors.
Nominating Nooyi, an immigrant woman from a developing country, could head off the mounting challenges to the US role in determining the Bank’s presidency.
She would also fit the bill for Trump’s preference for the private sector and for making international organisations fiscally more efficient.
Trump’s daughter, Ivanka, who is an admirer of Nooyi and considers her as a mentor is said to be backing her for the Bank job, according to the media reports quoting anonymous administration sources.
Nooyi stepped down as chairwoman of the PepsiCo last August after leading the international soft drinks, food and snacks giant for 12 years.
When Nooyi was leaving Pepsico, Ivanka Trump called her an inspiration and a mentor and gushed, “I am deeply grateful for your friendship. Thank you for your passionate engagement on issues that benefit the people of this country, and beyond.”
If Nooyi becomes the Bank’s president, the four top jobs in international financial policy-making would be held by women, two of them by women of Indian descent.
This month Gita Gopinath became the chief economist of the International Monetary Fund’s (IMF), which is headed by Managing Director Christine Lagarde. The Bank’s chief economist is Pinelopi Koujianou Goldberg.
Another Indian-American, Nikki Haley, who stepped down as the US Permanent Representative to the UN at the end of last year, is also on the list of candidates under consideration, according to The Financial Times.
The former South Carolina governor was the first Indian-American to be on the US federal cabinet and she pushed the UN to cut its budget and enhance efficiency.
If Nooyi, who headed a multinational with an annual revenue of $63.5 billion and assets of $79.8 billion, gets Trump’s nod, it will mark an ideological turnaround from former President Barack Obama’s orientation.
Departing from the tradition of economists or politicians heading the Bank, Obama appointed Kim, a medical doctor and academic, to reinforce the mission of fighting poverty and promoting what was considered a more holistic development.
But Kim also advocated greater cooperation with the private sector for financing development, which Nooyi would strengthen if she gets the job.
During her tenure PepsiCo, Nooyi led its reorganisation, shedding some parts of the conglomerate.
The formal process of selecting the nominee to head the Bank is being overseen by a panel made up of Ivanka Trump, Treasury Secretary Steven Mnuchin and the president’s acting chief of staff Mick Mulvaney.
Although Trump has been critical of international organisations and called for curtailing their budgets, he had – at least openly – a close rleation with Kim and backed increasing the Bank’s capital by $13 billion.
Nooyi had a rocky start in relating to Trump: after his election she said that her employees were in “mourning.’
She, however, drew close to Trump as he began pushing business-friendly policies and firmer ties to business leaders.
Nooyi served on his business advisory council and has had dinners with him and other business leaders at his golf club in New Jersey.
Delhi High Court order the demand of Rs 462-Crore Penalty
The Delhi High Court has stayed the demand of Rs 462 crore made on Hindustan Unilever Ltd. by the National Anti-Profiteering Authority, which claimed that the consumer goods major failed to pass on the benefits of lower goods and service tax rate.
The court directed the authority that no coercive action be taken, and no penalty proceedings be continued against HUL until it makes a final determination on the matter.
Since the matter involves issues requiring detailed examination of contentions of both the parties, the court asked HUL to deposit Rs 90 crore in two installments (Rs 50 crore by March 15 and Rs 40 crore by May 15) to the Consumer Welfare Fund by May 15.
The authority ruled in December that HUL profiteered Rs 419.67 crore due to sales realisation following an increase in base prices after a GST rate cut in two slabs—from 28 percent to 18 percent and 18 percent to 12 percent.
HUL was also accused of availing transition credit of Rs 76.06 crore, which wasn’t passed to consumers by reducing prices. The company’s redistribution stockists wrongly availed input tax credit of Rs 36.19 crore at 28 percent GST, when it was cut, on several items, to 18 percent.
India aim to end Australia tour on unbeaten note
Nasheman News : With the three-match ODI rubber tantalisingly poised at 1-1, the task is cut out for both India and Australia to pull up their socks in the series decider at the Melbourne Cricket Ground (MCG) here on Friday.
India bounced back from the 34-run loss in the series opener at Sydney, with another Virat Kohli masterclass century combined with his predecessor Mahendra Singh Dhoni’s vintage finish to pull off a 6-wicket win at Adelaide.
Going into the final ODI, India will be aiming to take the winning momentum and end the ongoing tour Down Under without losing a series.
The Virat Kohli-led side started their tour with a three-match Twenty20 International (T20I) series that ended in a 1-1 draw, followed by a historic first-ever 2-1 Test series win for India on Australian soil.
In the crucial series decider at the MCG, India will once again hope for their in-form top order, comprising Rohit Sharma, Shikhar Dhawan and skipper Kohli to score the bulk of the runs.
With Dhoni marshalling the less-tested middle-order, and Kedar Jadhav still warming the bench, both Ambati Rayudu and Dinesh Karthik will aim to get some runs if they are to stay in contention for a berth in the 2019 World Cup squad.
While the bowling department led by Bhuvneshwar Kumar has impressed in both the games, with pacer Mohammed Shami and the spin duo of chinaman Kuldeep Yadav and Ravindra Jadeja providing good support, India’s main point of concern will be the fifth bowler in the absence of suspended all-rounder Hardik Pandya.
The Men-in-Blue tried left-armer Khaleel Ahmed in the first ODI before handing a debut to Mohammed Siraj in the second, but neither could make an impact.
In that scenario, the team management could be tempted to test all-rounder Vijay Shankar on Friday or may opt for the leggie Yuzvendra Chahal, who has been warming the bench for the first couple of matches.
Meanwhile, the hosts have made two changes to their playing XI on the eve of the decider. Pacer Billy Stanlake replaced Jason Behrendorff, who has been ruled out with back soreness, while off-spinner Nathan Lyon has been dropped to make way for leggie Adam Zampa.
Lyon’s axing from the side comes just two matches after he’d replaced Zampa in the side for the series opener in Sydney. Pacer Kane Richardson has also been called into the squad as a cover.
While the bowlers have done a decent job, Australia will hope for their ODI skipper Aaron Finch to find some form with the willow.
Australia’s top-order batting has mainly revolved around their No.3 and No.4 in Usman Khawaja and Shaun Marsh, with the latter blasting a 123-ball 131 in the second match, albeit for a losing cause.
The middle-order, comprising the likes of Peter Handscomb, Glenn Maxwell and Marcus Stoinis have also been among the runs this series, and the hosts will be hoping to put on a 300 plus total to challenge the strong Indian batting.
A victory for Australia at the MCG on Friday would hand them their first series win in almost two years, having won just four of their past 23 One-day Internationals.
Teams:
India: Virat Kohli (Captain), Rohit Sharma (Vice Captain), Shikhar Dhawan, Ambati Rayudu, Dinesh Karthik, Kedar Jadhav, MS Dhoni (WK), Kuldeep Yadav, Yuzvendra Chahal, Ravindra Jadeja, Bhuvneshwar Kumar, Khaleel Ahmed, Mohammed Shami, Mohammed Siraj, Vijay Shankar.
Australia: Aaron Finch (Captain), Alex Carey (WK), Usman Khawaja, Shaun Marsh, Peter Handscomb, Marcus Stoinis, Glenn Maxwell, Jhye Richardson, Peter Siddle, Adam Zampa, Billy Stanlake.
