Nasheman News :The Supreme Court has held that a consensual sexual relationship between live-in partners would not amount to rape in some cases such as when the man, due to adverse circumstances beyond his control, does not marry the woman.
“The acknowledged consensual relationship between the parties would not constitute an offence under Section 376 (rape) of the Indian Penal Code,” said the bench of Justice A. K. Sikri and Justice S. Abdul Nazeer in a recent judgment.
“There may be a case where where the prosecutrix agrees to have sexual intercourse on account of her love and passion for the accused and not solely on account of misconception created by accused, or where an accused on account of circumstance which he could not have foreseen or which were beyond his control, was unable to marry her despite having every intention to do so. Such cases must be treated differently,” the bench said.
The court said this while quashing an FIR lodged against a doctor by a Maharashtra based nurse who were, for quite some time, in a live-in relationship.
Pointing to clear distinction between rape and consensual sex between live-in partners, the court said, “The courts, in such cases must very carefully examine whether the complainant had actually wanted to marry the victim or had mala fide motives and had made a false promise to this effect only to satisfy his lust, as the later falls within the ambit of cheating or deception.”

Man arrested for threatening wife, forcing her to enact porn videos
A harrowing case of domestic violence has come to light in Bengaluru’s Nelamangala area, where a 38-year-old woman’s husband allegedly demanded that she enact scenes from porn videos, and also threatened to kill her. On Saturday, the Nelamangala Town police arrested 42-year-old Vasanth Kumar, an English lecturer, for allegedly sexually abusing Nirmala*, assaulting her, demanding dowry and threatening her life.
Speaking to media, the Nelamangala police said that Nirmala and Vasanth Kumar got married on June 14, 2004. Nirmala, who used to work for a local NGO, had quit her job over a year ago in order to take care of her two children.
She was unable to work long hours and look after the kids. She decided to quit her job and had allegedly told Vasanth that he would have to manage the finances for a while until she could find a job which did not involve putting in too many hours of work.
“Ever since the day she discussed this with Vasanth, he began fighting with her. Initially he would call her a freeloader and would mock her. He would not chip in and help look after the kids. A few months ago, he informed her that the property they had bought together would now be signed over to his brother’s name. He said that she had no standing in it because she was not helping out financially,” the police alleged.
Over a month after Nirmala quit her job, Vasanth allegedly stopped bringing in groceries for her and the children. He would allegedly ask her to bring money from her parents and fight with her for not having got any dowry when they got married.
“This was not all of it. Vasanth would call her names in front of the children. He would constantly address her as “prostitute” instead of using her given name. When she confronted him about it and asked why he was insulting her in front of the children, he told her that the children were not his as she had been sleeping with multiple men. He even demanded that a DNA test be conducted,” said Veena*, Nirmala’s relative.
The harassment only increased as the days passed. Soon, Vasanth allegedly began telling his children that Nirmala has AIDS and that they should not touch her, lest they would get infected too. On the night of February 6, however, Vasanth’s harassment escalated.
“He came home at around 6.30 pm and her sister’s children were there. He waited for them to leave and he once again began telling his children that Nirmala is a prostitute and that she has AIDS. He dragged her into the room, showed her a porn video, asked her to wear only her underwear and act like the woman in the video,” Veena claimed, adding, “When Nirmala refused, Vasanth tore her clothes, scratched her arms and breasts. He fished out a knife from his bag and threatened to kill her. He bit her all over her body. He chased her to the kitchen and hit her with the stick used to make ragi mudde. She bit him and escaped from there. She reached her mother’s house in torn clothes and then she was taken to the hospital.”
On February 7, the Nelamangala Town police arrived at the hospital to take down Nirmala’s complaint and an FIR was registered against Vasath Kumar. Vasanth, who was absconding, was arrested on Saturday by the police.
He has been booked under sections 498a (domestic violence), 323 (assault), 324 (assault with a dangerous weapon), 504 (intentional insult with intent to provoke breach of peace) and 506 (criminal intimidation) of the IPC. When asked why sections under the Dowry Prohibition Act were not applicable, the police said that on interrogation, the sections would be added before filing the chargesheet.

Kumarswamy accuses Modi of playing cheap politics
Chief minister H D Kumaraswamy has accused the government in the center led by Prime Minister Narendra Modi of exhibiting low class politics for not inviting him for the official programme of the PM in Hubballi – Dharwad.
Speaking to the media on Sunday, February 10, Kumaraswamy said, “The state bears its share of 50% on all railway projects. Still no official invitation is sent to me for the government programme in which the Prime Minister was participating. This shows the petty politics played by the Prime Minister. I do not have any ill-feeling or objection for the BJP party event that they are organizing. However, they should have had the basic courtesy of inviting me for the government function.”
The programmes attended by Modi on Sunday, February 10 in the twin cities of Hubballi – Dharwad included the foundation stone laying ceremony of the proposed new IIT building at Dharwad and gas pipeline projects, in addition to addressing a political rally in Hubballi.
The Congress leaders also cried foul on the behaviour of the central government and said that it is an insult to the chief minister Kumaraswamy. KPCC president Dinesh Gundu Rao said that the Modi government is taking the credit of the establishment of IIT in Dharwad but they have forgotten that the state government has provided 500 acres of prime land for this dream to become a reality.
Joining in the bashing of Modi, D K Shivakumar, minister for water resources said, “The protocol is not followed in this case. Just printing the name of H D Kumaraswamy is not enough. He is the chief minister of the state and should have received a personal invitation. The CM wanted to take part in the event. But he was ignored. This is a huge insult to our state.”
Speaker orders probe into audio tape released by HDK
The Karnataka Assembly Speaker on Monday ordered an inquiry into an audio clip, released by Chief Minister H D Kumaraswamy last week to expose the BJPs alleged attempts to lure a JD-S MLA, that mentioned his name.
In the clip former Chief Minister and BJP leader B S Yeddyurappa allegedly mentioned Speaker K R Ramesh Kumar’s name while in conversation with Nanganagiuda Kandakur’s son, Sharanagouda, on February 7.
Playing the clip to the media here on February 8, Kumaraswamy and Sharanagouda alleged that Yeddyurappa agreed to pay an unspecified amount if Kandakur left the Janata Dal-Secular and joined the Bharatiya Janata Party.
“I have asked the Chief Minister to form a Special Committee to inquire into the contents of the audio tape in which my name was mentioned,” Kumar told the members, after Congress Minister for Rural Development and Panchayat Raj Krishna Byre Gowda raised it in the Lower House of the Assembly.
Kumar also said the Committee must submit its report in the next 15 days.
Sharanagouda also claimed that Yeddyurappa told him that the Speaker could be booked by paying Rs 50 crore for not invoking the anti-defection law against Kandakur in the event of his defecting to the BJP from the JD-S.
Terming the reference to him in the audio tape as contempt of the House, Kumar said he was pained by his name being mentioned in the episode.
“Whichever MLA took my name in the audio tape must step out of politics or I should be out of politics. Such a statement is a contempt of the House,” Kumar told the legislators as the issue rocked the proceedings of the Budget Session.
The purported audio tape in Kannada was said to have been recorded on February 7, between Yeddyurappa and Sharanagouda at a guest house at Devadurga in Raichur district, about 480 km from here.
Yeddyurappa, however, on Sunday claimed that the audio tape was fabricated and its contents doctored though it was in his voice and accused Kumaraswamy of blackmailing him.
“I met Sharanagouda at Devadurga on February 7 and discussed many things. But the content in the audio tape is fabricated and its voice doctored,” Yeddyurappa told reporters at Hubballi.
Recalling what transpired between him and Sharanagouda, Yeddyurappa said he would retire from politics if Kumaraswamy would prove that he told Sharangouda money (Rs 50 crore) would be given to Kumar for not invoking the anti-defection law if Kandakur joined the BJP.

“Winds of change are evident in the global energy arena. There is a shift in energy consumption from West to East,” Modi said addressing the Petrotech Expo Mart being organised here.
“Energy supply, energy sources and energy consumption patterns are changing. Perhaps, this could be a historic transition,” he added.
The Prime Minister also said that signs of convergence between cheaper renewable energy, technologies and digital applications was also becoming evident.
“This may expedite the achievement of Sustainable Development Goals (SDGs). Nations are coming together to tackle climate change,” he stated.
Talking about energy justice in India which has been given top priority by the government, Modi stated that many policies have been developed and implemented.
“We need to move to responsible pricing, which balances the interests of both the producer and consumer. We also need to move towards transparent and flexible markets for both oil and gas,” he noted.
Boney Kapoor to produce remake of Egyptian film
Nasheman News : Producer Boney Kapoor has taken the rights of Egyptian drama “Hepta: The Last Lecture” to remake the film in Hindi and other languages in India.
The film will be produced by Kapoor’s Bayview Projects and co-produced by Fresh Lime Films, read a statement issued on the former’s behalf.
Based on Mohamed Sadek’s best-selling book, “Hepta…”, directed by Hadi El Bagoury, revolves around the seven stages of love.
Kapoor said: “India and Egypt have been strongly influencing each other’s culture, arts and architecture since ancient times.
“It is a pleasure to cooperate with Egyptian cinema. I strongly believe that this is only the beginning and we shall soon be seeing films from Egypt and India being remade in their respective languages.”
Kapoor is also remaking Hindi film “Pink” in Tamil. Titled “AK 59”, it features superstar Ajith, and is currently being shot.

London-based Indian music producer, mix and mastering engineer Prashant Mistry’s album “Symbol” was nominated for the Best Immersive Audio Album at the 61st Grammy Awards. The honour went to “Eye In The Sky – 35th Anniversary Edition”.
Falguni, on the other hand, was nominated for her album “Falu’s Bazaar” in the Best Children’s Music. The award was given to Lucy Kalantari & The Jazz Cats for “All The Sounds”.
