Nasheman News : Hours after re-joining office after nearly two-and-half months, CBI Director Alok Verma on Wednesday revoked most of the transfer orders issued by agency’s interim chief M. Nageswara Rao.
The Central Bureau of Investigation (CBI) Director’s order came a day after the Supreme Court reinstated him as the agency’s head, though with limited powers.
On Tuesday, the Supreme Court reinstated Verma as the agency chief, setting aside the Central Vigilance Commission (CVC) and the Centre’s decision to divest him of his powers to function as its head but with a caveat that he will not take any policy decision till a high-level committee goes into the issue afresh.
While reinstating Verma, the top court also junked the Centre’s order appointing Rao as the interim Director.
According to a senior official, Verma can still file FIRs and sign on the transfer orders as Rao also discharged these duties after being orderd by the apex court not to take any major policy decision.
On October 24, Rao, after being appointed as the interim Director, transferred transferred 13 officials, including the agency’s Joint Director (Policy) A.K. Sharma, Deputy Inspectors General M.K. Sinha, Anish Prasad, K.R. Chaurasia, Tarun Gauba, Additional Superintendent of Police S.S. Gurm and Deputy Superintendents of Police A.K. Bassi and Ashwani Kumar.
Bassi and Sinha were investigating Verma’s deputy Rakesh Asthana, who the agency has accused of corruption. The Centre had relieved Asthana too of his duties on October 23.
According to an agency source, earlier in the day, Bassi and Ashwani Kumar met Verma at his office.
Verma was asked to proceed on leave on the night of October 23-24.
Verma after re-joining the office met several officials of the agency at its headquarters at south Delhi’s Lodhi Road and also reviewed the progress of various high profile cases.
The judgement was culmination of a six-month-long battle between Verma and Special Director Rakesh Asthana. Both levelled corruption allegations against each other. In October, matters came to a head when Verma lodged an FIR against Asthana on a complaint by Satish Sana Babu, the alleged middleman in meat exporter Moin Qureshi’s case.

Parliament passes upper caste quota Bill
Nasheman News :Ahead of the Lok Sabha elections, the Parliament on Wednesday passed a landmark Constitution amendment bill providing for 10 per cent reservation to upper castes in government jobs and higher educational institutions, with the Rajya Sabha voting it late in the night after rejecting a demand for referring it to a select committee for detailed scrutiny.
The House passed the Constitution (124th Amendment) Bill, 2019 — which was adopted by the Lok Sabha on Tuesday — with 165 members in its favour and seven against it in a division amidst broad support from the Congress and other opposition parties despite their reservations over its constitutional validity and the timing in view of the approaching elections.
Earlier, the House rejected an amendment moved by DMK member Kanimozhi and CPI(M)’s T.K. Rangarajan for referring the bill to a select committee for indepth scrutiny, with 155 voting against it and 18 for in a House of 244. Several other opposition amendments were also negatived. A constitutional amendment needs a special majority of more than half of the House present and two-thirds of those present voting in favour of it.
The AIADMK, which is friendly with the Bharatiya Janata Party (BJP), staged a walkout opposing the Bill with its member A. Navaneethakrishnan saying it violated the basic structure of the Constitution.
Rejecting the opposition criticism that the bill was brought late in the government’s tenure with an eye on upper caste votes in the coming Lok Sabha elections, Social Justice Minister Thawarchand Gehlot said the measure had been brought with good intentions and was aimed at justice for the economically weaker sections.
He called the bill historic and allayed fears that the legislation would face legal hurdles, saying since it is a constitutional amendment even the Supreme Court would accept it, should there be any challenge.
The Minister told the Congress party that unlike the Narasimha Rao government which issued a government order to implement a similar quota, the Modi had taken precaution by bringing in a statute amendment.
Intervening in the over eight-hour debate, Law and Justice Minister Ravi Shankar Prasad said that the proposed quota would not breach the Supreme Court’s cap of 50 per cent on overall reservations.
He said the legislation would apply to both Central and state governments.
Senior Congress member and an eminent lawyer, Kapil Sibal, said the bill had been brought with “complete non-application of mind” and raised questions over the constitutionality of the bill and its implementation.
“If the bill is passed, the implementation of the reservation due to complexities involved and absence of required data with the government would be like demonetisation.”
Calling it a “jumla” (gimmick), Sibal said: “Kamal ka hamla, aur ek jumla (attack of lotus, one more gimmick).”
“What was the hurry? The bill could have been sent to the Select Committee. There would have been discussions and suggestions before it was introduced (in Parliament),” he said.
Earlier, his party colleague and deputy leader in the House, Anand Sharma, welcomed the 10 per cent quota for the upper caste poor but questioned its timing as it comes ahead of the Lok Sabha elections.
“We are not opposing it. But the question is why it is being brought all of a sudden. It is the last session (of Parliament)…then there are elections,” he said.
He asked why the BJP did not bring the bill in its four-and-half years of rule and emphasised that the decision came after the saffron party lost five states in the recently-concluded Assembly elections.
Trinamool Congress (TMC) MP Derek O’Brien accused the government of committing a “fraud with the poor and youth” on jobs and “spitting on the Constitution” by moving bills for passage without proper legislative scrutiny.
Samajwadi Party leader Ram Gopal Yadav said that since the government had now breached the 50 per cent ceiling on reservations, it should give OBCs the benefit of quota in accordance with their population at 54 per cent.
BSP member Satish Chandra Misra backed the bill and demanded that minorities also be given reservation.
BJP President Amit Shah, who was present during the entire debate, at one point intervened to accuse the opposition of trying to give quotas for Muslims at the cost of other communities.

The campaign invites entries via nominations from across the world open till January 31, 2019.
“Indian-origin women, working or settled anywhere in the world, are eligible for nomination. The shortlisted entries will be open for public voting on Twitter and the finalists will be selected by a specialized panel of judges. Nominations have been invited in a large number of categories including Health, Media, Literature, Art, Sports, Environmental protection, fashion among others,” it said in a statement.
Shameful that ailing Parrikar propped in CM chair: Ex-Goa RSS chief
Nasheman News : It is shameful that Chief Minister Manohar Parrikar continues to be in power despite being severely unwell, former Goa RSS chief Subhash Velingkar said on Wednesday, adding that an ailing head of state is detrimental to the state and its people.
Velingkar, who was sacked as state Rashtriya Swayamsevak Sangh (RSS) head two years back amid an ongoing feud with Parrikar, also said that his political party, the Goa Suraksha Manch (GSM), would contest the upcoming state Assembly bypolls in Goa.
“It is a matter of shame that a state like Goa is being government by a Chief Minister who is severely ill. The state deserves better. The CM should take rest and it is shameful that he is being kept in the chair in this state,” Velingkar told reporters in Panaji.
Parrikar is suffering from advanced pancreatic cancer and has been in and out of hospitals in Goa, Mumbai, Delhi and New York for 11 months now. The opposition has been demanding his resignation, claiming that his continuance in the chair during the prolonged illness, has led to an administrative slowdown, while the Bharatiya Janata Party (BJP) has insisted that Parrikar is fit enough to rule the state.
Velingkar also announced that his party would contest the upcoming but yet unscheduled assembly bypolls in Shiroda and Mandrem legislative constituencies, which have been necessitated due to the resignations of Congress legislators Subhash Shirodkar and Dayanand Sopte, respectively, both of whom joined the BJP last year.
“The GSM will teach the BJP a lesson. This is an untrustworthy and a lying government which has gone back on its words on several key issues like medium of instruction, mining resumption, banning casino operations, etc,” Velingkar said.
Police assault Congress activists protesting against Modi
Nasheman News : The police assaulted several Congress activists, including from the youth and student wings, when they tried to protest against Prime Minister Narendra Modis visit to the city on Wednesday.
The trouble erupted when some Youth Congress and National Students Union of India activists stood near the roads and raised slogans of ‘Chowkidar Chor Hai’. Others raised black flags and released black balloons as Modi’s motorcade zoomed past.
Angered by this, plainclothes security personnel pounced on the activists, pushed and dragged them, kicking and punching them brutally.
“An Emergency-like situation has prevailed in Solapur since the past couple of days… Party activists, municipal corporators and other elected leaders were served notices, questioned on their movements and today even prevented from staging peaceful protests,” Congress legislator Praniti (Sushilkumar) Shinde told IANS.
She added that several activists – including Nivrutti Gavhane, Ganesh Dongre, Shubham Mane, Shivraj Birajdar, Sidhhram Sagare – were detained by the police.
At least one activist was arrested and slapped with serious charges by the police. But after appeals by local Congress leaders, the charges were modified while others were allowed to go, said Shinde.
Modi, along with Chief Minister Devendra Fadnavis, spent half a day in Solapur to kickstart the Bharatiya Janata Party’s 2019 Lok Sabha election campaign.
Karnataka BJP wants state tax hike on fuel withdrawn
Nasheman News : Slamming the Karnataka coalition government for burdening the people again, the opposition BJP on Wednesday urged Chief Minister H.D. Kumaraswamy to withdraw the 2 per cent hike in state tax on petrol and diesel.
“The basic price of petrol and diesel has declined across the country over the last 2 months due to fall in international crude oil prices. Instead of making the people benefit from lower prices, the state government had increased the sales tax on fuel by 2 per cent since January 1. It should be rolled back,” state BJP’s state unit general secretary C.T. Ravi told reporters here.
Kumaraswamy, who also holds the finance portfolio, increased the state tax to 32 per cent on petrol and to 21 per cent on diesel because their base price decreased since November.
“As the fuel prices declined after fall in crude oil rates in the global market since November, the state tax has been revised to 32 per cent on petrol from 30 per cent and to 21 per cent on diesel from 19 per cent since January 1, 2019,” said a statement by the chief minister’s office here on January 5.
Noting that the state tax on petrol was Rs 20.59 per litre and Rs 13.75 on diesel per litre, which was among the highest in the country, Ravi said the state levy was three times over that levied by the state-run oil marketing firms.
“When fuel prices decline, the ruling coalition partners (Congress and Janata Dal-Secular) say it is owing to fall in crude oil rates and when they go up, they blame the Modi government for it, indulging in double-speak,” said Ravi.
The state government had on September 17 reduced its tax on petrol to 28.75 per cent from 32 per cent and diesel to 17.73 per cent from 21 per cent in a bid to give relief to the people from on soaring international crude oil prices.
In the state budget for fiscal 2018-19 Kumaraswamy presented on July 5 Che increased the state tax on petrol by 2 per cent to 32 per cent from 30 per cent and on diesel to 21 per cent from 19 per cent with effect from July 15 despite protests and public resentment.
“We will launch a protest strike if the hike in the state tax on the fuel is not rolled back before the Sankranti festival next week,” a party official told IANS./Eom/405 words.
SC defers Ayodhya case to Jan 29
Nasheman News : The Supreme Court on Thursday deferred the Ayodhya title dispute to January 29, saying that the five judge bench to hear the case will be reconstituted as Justice U.U. Lalit has recused himself.
The apex court took the decision after senior counsel Rajeev Dhawan, appearing for one of the Muslim parties, told the bench headed by Chief Justice Ranjan Gogoi that Justice Lalit in 1997 appeared for former Uttar Pradesh Chief Minister Kalyan Singh in one of the matters related to the Babri Masjid-Ram Janmabhoomi dispute.
Singh is currently the Rajasthan Governor.
While telling the bench that personally he had no objection to the presence of Justice Lalit on the bench hearing the challenge to the 2010 Allahabad High Court verdict, he was just bringing the issue to the notice of the court.
Thereafter Justice Lalit conveyed to Chief Justice Gogoi and other members of the bench — Justice S.A. Bobde, Justice N.V. Ramana, Justice D.Y. Chandrchud — of his reluctance to continue on the bench and recused himself.
Chief Justice Gogoi in his order said that under the Supreme Court rules in exercise of his administrative powers, it was his perogative to decide the strength of the bench.
He said this while declining the submission by Dhawan that an earlier bench headed by then Chief Justice Dipak Misra had said that a hearing on the batch of petitions will be heard by three judge bench.
The court thereafter directed its registry to go through all the records relating to the Ayodhya case which are available with it and submit a report by January 29 as to how much time it would require for translating the documents and the case material which are in Persian, Arabic, Urdu and Gurmukhi languages.
However, when senior counsel Harish Salve, appearing for one of the Hindu litigants, offered to assist the registry in handling of the papers and their translations, Chief Justice Gogoi said that he will rely entirely on his own registry to do the job.
Having directed the secretary general of the Supreme Court to submit the report in 15 days the court directed that the reconstituted bench will hold the hearing on January 29.
Strike second day sees minimal impact in Karnataka.
There was no major impact of the nationwide shutdown called by trade unions in Karnataka on the second day, with government offices and bus services functioning normally across the state on Wednesday. A number of reported incidences of government-run buses being vandalised by miscreants. On Tuesday, a total of 12 incidents of stone pelting against buses were reported by the state run bus corporations.
A few hundred industrial workers, joined by Anganwadi workers and Accredited Social Health Activists (ASHAs), took out protest march from Town Hall in the city centre to the Raj Bhavan amidst tight police security. There were protest gatherings in major gatherings in Mysore Bank Circle and Corporation Circle as well.
The government offices, hospitals, commercial establishments, bus and metro services, however, remained largely unaffected in the state.
The 48-hour nationwide strike by the trade unions demanding labour-friendly laws and schemes has been in force since Tuesday.
State-run Karnataka State Road Transport Corp (KSRTC) operated about 3,600 of its scheduled 4,100 bus services across the state. Bus services in Bengaluru, however, were fewer, with only 428 bus services plying across the city against the 4,100 scheduled, leading to a high demand for autos and ride-hailing services like Ola and Uber.
Most of the schools in the state that had declared a two-day holiday ahead of the strike remained closed, while few opened on Wednesday. Universities were also forced to postpone examinations in light of the bandh across the state.
The trade unions on strike also held bike rallies in towns and cities waving red flags.
The striking labour unions had 12 demands including stopping all pro-corporate, anti-worker amendments to labour laws, against privatisation of transport system proposed in the Motor Vehicles (Amendment) Bill 2017, institution of universal public distribution system to contain inflation, implementation of complete farm loan waiver and legislation of the right to sell at minimum support price, and measures for generation of stable employment.

Female rapist on gender-based woman; Complaint to High Court
The incident occurred in the Uttarakhand High Court after the police refused to accept the sex of a woman who had sexually transitioned to a woman, claiming her right to feminism.
According to the law, the High Court, which came to the aid of a linguistic woman, ordered the state police to inform the cause of this behavior.
The woman says in her complaint that she loves a man from Kotdwara and has been converting her into a woman to marry him.
But the woman alleged that her future husband called her to Kotdwara after raping her.
When the woman went to police station to complain about her rape, the police refused to file an IPC sub-376 (rape) complaint and filed a case under Section 377 (the criminal offense).
Asked by the woman, High Court Metalliri asked her to direct the police to change her FIR from September 37 to September 37, as she had full rights of feminism.
Justice Lokpal Singh, who listened to a woman complaint, ordered the state government to reply within four weeks.
ACB officials conducted searches in cabinet room
Bangalore: A team of ACB officials conducted searches at Puttur Shetty’s office on Tuesday in connection with the bribe money traced in the corridor of the Vidhana Soudha. Meanwhile, employee typist SJ Mohan Kumar, who was earlier involved with a bag with a bag worth Rs 25.76 lakh, had been arrested in the past five ministers.
“In the past, Mohan Kumar said in a statement to the Vidyasudha police,” In the past, we have worked at Roshanbagh, Umashree, CC Patil, CT Ravi and Chennigappa’s offices. The inquiry has revealed that he has been working in ministries since 2006, not new to the legislature. In the case, Mohan also said that the minister’s office staff, Krishnamurthy, was also present in the case.
