Nasheman News : Haryana Chief Minister Manohar Lal Khattar said on Thursday that people in Haryana will vote for the BJP and the party will win all 10 Lok Sabha seats as well as Assembly elections this year.
Khattar said that the Bharatiya Janata Party was leading by over 9,500 votes in the Jind Assembly seat by-election after seven rounds of counting on Thursday.
“The people have voted for the good governance and transparency of the BJP government in Haryana,” Khattar told the media here.
The Chief Minister said the issue of holding Assembly elections in Haryana along with the Lok Sabha polls had not been discussed by his government yet.
“If any suggestion in this regard is received from the Centre, we can discuss it. As of now, the Lok Sabha and Assembly polls will be held as per schedule,” Khattar said.
Khattar has been leading the first Bharatiya Janata Party (BJP) government in Haryana since October 2014.
Missiles specialist Vice-Admiral Ajit Kumar P. is new WNC chief
Nasheman News : Vice-Admiral Ajit Kumar P. a missiles specialist, took over as the new Flag Officer Commanding-in-Chief, Western Naval Command (WNC) of the Indian Navy, here on Thursday, an official said.
He succeeded Vice-Admiral Girish Luthra who attained superannuation after an illustrious career spanning nearly four decades with the Indian Navy.
At an impressive ceremonial parade held at the Naval Air Station Shikra, the outgoing and incoming WNC chiefs were accorded a guard of honour before the formal handing over, and later Vice-Admiral Luthra was “pulled out” in true naval traditions.
An alumnus of the Sainik School, Kazhakootam in Kerala, and National Defence Academy, Pune in Maharashtra, Vice-Admiral Ajit Kumar P. was commissioned in the Indian Navy on July 1, 1981.
A missiles and gunnery specialist, he has served onboard frontline warships of both the Indian Navy and abroad.
He has a rare distinction of commanding six warships — the guided missile corvette INS Kulism, guided missile frigate INS Talwar, guided missile destroyers INS Mumbai and INS Mysore, besides including two foreign fighter vessels.
Ajit Kumar P. has also completed a Naval Higher Command Course and is an alumnus of the prestigiouis Naval War College, Newport, US.
He has earlier served with the WNC in initial specialist and command appointments and as Chief Staff Officer (Operations), here.
Later, he was the Flag Officer Commanding of the Eastern Fleet, Commanding Officer of Gunnery and Missiles Training School, INS Dronacharya, Chief of Staff Southern Naval Command and Commandant of Indian Naval Academy, Ezhimala, Kerala.
Immediately prior to his new appointment, Ajit Kumar P. was the Vice-Chief of Naval Staff, Naval Headquarters, New Delhi.
In recognition of his services to the country, he has been decorated with several honours including Vishist Seva Medal (2006), Ati Vishisht Seva Medal (2014) and the Param Vishisht Seva Medal this year (2019).
Pakistani singer Rahat Fateh Ali issued ED notice
Nasheman News : The Enforcement Directorate has issued a show-cause notice to Pakistani singer Rahat Fateh Ali Khan for allegedly violating foreign exchange rules involving Rs 2 crore, officials said on Wednesday.
The notice, issued on Monday, has been served in a case that pertains to the seizure of undeclared US dollars from him at the Delhi airport in 2011. Khan lives in Pakistan.
“The show-cause notice has been served to Khan for violation of foreign exchange rules,” an ED official said.
The ED has registered a case under the Foreign Exchange Management Act (FEMA) on the basis of a case filed by the Directorate of Revenue Intelligence (DRI).
On February 13, 2011, Khan was going to attend a music programme from India to Dubai in the United Arab Emirates.
Khan, a popular Bollywood playback singer, who was in Delhi to perform at an Indo-Pakistan peace initiative, was to board an Emirates flight to Karachi via Dubai with his entourage of 14 persons.
He was detained at the Indira Gandhi International Airport for travelling with undeclared currency to the tune of $300,000 US dollar (around Rs 2.10 crore) along with Pakistani and Indian currency, the ED official said.
The DRI then said that Khan had not declared the amount to the immigration authorities.
As per rules, a foreign national cannot carry more than $5,000 in cash and $5,000 in other instruments. In the event he has more cash, he has to declare it to the Customs Department.
Khan was unable to give a proper response regarding the source of the money and he also did not show any relevant documents for the same.
According to the DRI sources, Khan was paid in Indian rupees and dollars for his shows in India.
The ED had earlier questioned Khan a number of times.
A case under FEMA is not considered a criminal case. Even the accused is not arrested but if the charges are proven, then the agency can impose heavy fines of up to three hundred times of the said amount.
The 45-year-old nephew of Pakistani singing legend late Ustad Nusrat Fateh Ali Khan was earlier also involved in a controversy when organisers of a concert in Gurugram filed a police complaint against him in July 2010 for his failure to turn up for a show.
Centre gives Rs 949 cr aid to drought-hit Karnataka
Nasheman News : The central government has approved Rs 949.49-crore aid to drought-hit Karnataka, said Union Minister for Agriculture Radha Mohan Singh on Tuesday.
“The central government has approved Rs 949.49-crore assistance to drought-hit Karnataka for Kharif 2018-19 season,” Singh tweeted.
Karnataka in October 2018 sought drought relief aid of Rs 2,434-crore to compensate for the crop losses in drought-hit districts.
The state had pegged the losses incurred due to the drought situation in 100 sub-districts (taluks) in 24 of the state’s 30 districts at Rs 16,500-crore and asked the central government for a relief of Rs 2,434 crore.
A total of 26.18 lakh hectares of agricultural area and 1.94 lakh hectares of horticulture area have suffered more than 33 per cent crop loss, the state earlier said.
Several districts, particularly the northern and north interior regions, have been reeling under drought due to scanty rainfall.
Karnataka is estimated to have suffered Rs 20,000 crore loss due to floods and drought since last year, according to the Revenue Department.
“The prevailing condition is unprecedented as the state was affected by floods (in August 2018) and is facing acute drought conditions during kharif and rabi seasons, impacting the state’s economy,” the Revenue Department said earlier.
No relaxation of order limiting import of pet coke: SC
Nasheman News : The Supreme Court on Monday rejected a batch of applications from different industries seeking relaxation of its earlier order limiting the import of pet coke for the use of certain industries, including cement and aluminium, as feed stock.
“We will die one day but these industries will prosper,” said a bench of Justice Arun Mishra and Justice Deepak Gupta refusing to dilute their last year’s order limiting the import of pet coke to 1.4 million metric tonnes.
“We are not going to dilute our order in any way, it (hearing) is over,” said Justice Mishra as a battery of senior lawyers including Abhishek Manu Singhvi, Ranjit Kumar, Shyam Divan, Jayant Bhushan appearing for different industries tried to impress upon the court the need to relax the order and permit more imports.
The bench, in another matter relating to sealing of unauthorised constructions, barred the Delhi High Court from entertaining any plea challenging the order of the top court appointed monitoring committee on sealing of unauthorised structures in the national capital.
Staying an order of the High Court in a matter and restraining it from entertaining any issue arising from the decision of the monitoring committee, the bench said: “This (top) court had made it clear that any decision of the monitoring committee can be challenged before it only.”
The court on Monday cited its December 15, 2017 judgment and the orders of September 7 and November 27, 2018, clearing saying that any decision of the monitoring committee could only be challenged before it.
NIA arrests one for 2006 Kerala twin blasts
Nasheman News : The National Investigation Agency (NIA) on Thursday said it has arrested one of the men involved in the 2006 Kerala twin blaste from the airport here.
Mohammad Ashar, who had since been absconding, was arrested on Wednesday from the Indira Gandhi International (IGI) Airport here after he arrived from Saudi Arabia, an NIA spokesperson told IANS.
Ashar had escaped to the Middle East nation in 2007. He would be produced later in the day before an NIA Special Court in the national capital to obtain a transit remand to take him to Kochi for his production before the Special Court in Ernakulam.
The twin blasts near the Kerala State Road Transport Corporation and Mofussil bus stands had rocked Kozhikode on March 3, 2006, and left two persons injured and a few properties damaged.
The counter-terror agency had taken over the case from the Kerala Police in 2009 and filed the charge-sheet against eight accused in August 2010 under several sections of the Indian Penal Code (IPC), Arms Act and Unlawful Activities (Prevention) Act.
The NIA official said that thier probe revealed that besides Ashar, another absconder P.P. Yusuf, was involved in the conspiracy hatched by prime accused T. Naseer and others to carry out the IED blasts after bail was denied to the accused involved in the Marad communal riots of 2003 in Kozhikode district.
Ashar and Yusuf had assisted Naseer in preparing the Improvised Explosive Devices and planting them.
Hindu-Muslim Couple’s Child Legimitate, Has Right Over Father’s Property, Says SC
The Supreme Court ruled out a marriage between a Muslim man and a Hindu woman to be a regular one but said that children born out of the wedlock are legitimate and will have a claim over the property of their father.
Terming the marriage between a Muslim man and Hindu woman an irregular one, the apex court said, “The marriage of a Muslim man with an idolater or fireworshipper is neither a valid (sahih) nor a void (batil) marriage but is merely an irregular (fasid) marriage. Any child born out of such wedlock (fasid marriage) is entitled to claim a share in his father’s property.”
The top court said, “The position that a marriage between a Hindu woman and Muslim man is merely irregular and the issue from such wedlock is legitimate has also been affirmed by various high courts.”
The bench of Justice N.V. Ramana and Justice Mohan M. Shantanagoudar in their judgment upheld an order of the trial court and that of the Kerala High Court. Speaking on behalf of the bench and explaining the marriage between the individual of the two communities to be invalid, Justice Shantanagoudar said, “It would not be out of place to emphasise at this juncture that since Hindus are idol worshippers, which includes worship of physical images/ statues through offering of flowers, adornment, etc., it is clear that the marriage of a Hindu female with a Muslim male is not a regular or valid (sahih) marriage, but merely an irregular (fasid) marriage.”
It must be noted that a wife cannot inherit the husband’s property but is entitled to get dower, ruled the Supreme Court. “The legal effect of an irregular marriage is that in the case of consummation, though the wife is entitled to get dower, she is not entitled to inherit the properties of the husband,” said the court.
The SC’s judgement came in lieu of the property dispute matter in which Shamsuddin, the son of Ilias and Valliamma, had sought to inherit the ancestral property after his father’s demise. The top court’s decision came as it upheld the plea by Mohammed Salim. Salim was born to Mohammed Ilias and Valliamma, and court described him as their legitimate child.

Centre red-flags 11 recommendations for appointment as HC judges
Nasheman News : The Centre has recently red-flagged a host of recommendations for the appointment of judges to high courts with the top court collegium deciding not to press some of them and remitting others to the Delhi, Punjab and Haryana and J&K high courts, according to the Supreme Court collegium.
In two cases relating to appointment of judges to Delhi High Court from among the lawyers, the top court collegium has deferred the decision by two to three weeks.
The top of the list is Punjab & Haryana High Court, followed by Delhi High Court and the High Court of Jammu and Kashmir.
The collegium on January 16 remitted back to the Punjab and Haryana High Court the names of seven lawyers out of 11 that the High Court had recommended on November 24, 2017 for appointment as high court judges.
The recommendation for the appointment of 7 lawyers as High Court judges was considered by the top court Collegium on September 4, 2018 when it was decided to defer it for more inputs.
On January 16, the top court collegium after assessing their “merit and suitability” decided to remit their names back to the High Court.
Similarly, for the appointment of advocates as judges of Delhi High Court, the High Court collegium had on October 13, 2017 recommended four names out of which the top court collegium deferred a decision on two and remitted two to the High Court.
In August 2017, the J&K High Court collegium had recommended three lawyers for appointment as judges of High Court.
In the case of one, the top court collegium decided to recall its April 6, 2017 recommendation for his elevation as HC judge.
However, in case of other it asked the Centre (Department of Justice) to “furnish specific information in detail on the basis of which the proposal for elevation has been referred back for reconsideration by the collegium.”
Amrita Singh may face court battle in property dispute
NashemanFilm : actor Amrita Singh and her aunt Tahira Bimbat may have staked claim over 4 acres of prime property in Clement Town area of Dehradun city but they may be in for a long drawn court battle.
Last week, Amrita Singh along with her actor daughter Sara Ali Khan lodged a police complaint stating that the Clement Town property be protected from a land mafia and also put up a board claiming that the land belongs to them.
Legal experts say both Amrita Singh and Tahira Bimbat are likely to face a dragging court battle for a final settlement.
On the other hand, Khushi Ram, the caretaker of the property, also lodged a complaint with the police pleading protection of the property.
The dispute arose when Madhusudan, who was suffering from cancer, died a few days ago.
Police officials say that Madhusudan’s father, who was an Air Force officer, had bought the property in 1969.
After the death of his parents, Madhusudan, who was unmarried, was staying alone in the Clement Town property.
Amrita Singh is the daughter of Rukhsana Sultana, who is the daughter of Madhusudan’s father from his first divorced wife. Rukhsana Sultana was known for her close links with then Congress leader Sanjay Gandhi during the Emergency period.
After divorcing his first wife, Madhusudan’s father married Asha Bimbat with whom he fathered both Madhusudan and Tahira.
Tahira Bimbat and Amrita Singh have already filed a court case against Madhusudan over the Clement Town property.
The Uttarakhand Police is treading a cautious path and has ruled out any probe by the Special Task Force (SIT).
“This is a civil court property dispute and we will not interfere in the matter,” said Director General of Police (DGP) Anil Raturi.
However, the police officials who received complaints from Amrita Singh and Khushi Ram said they were examining them and would file a final report in the civil court.
Police are also verifying reports that Madhusudan had left a will in which he wanted to handover the property to a trust.
45 followers of UP cult leader sentenced to 3 years in jail
A local court Monday sentenced 45 people to three years’ imprisonment for assaulting government employees and creating hindrance in their functioning in a case involving the followers of a cult leader who had clashed with police at Jawahar Bagh here in 2016, leading to about 30 deaths.
According to the prosecution, Additional Civil Judge (Senior Division-II) Jahendra Pal Singh pronounced the verdict.
Fifty-two people were booked for the attack on employees of the horticulture department on March 15, 2016 when they went to harvest potatoes from a land, then illegally occupied by the followers of cult leader Ram Vriksh Yadav.
The judge acquitted two women accused and the trial against five accused was partially pending due to their non-appearance in court.
The court also slapped fine of Rs 2,300 each on the convicts.
Yadav and his supporters ran an illegal settlement at Jawahar Bagh in Mathura in Uttar Pradesh for over two-and-a-half years.
At least 29 people were killed in clashes in June 2016 when the police tried to evict the encroachers from the compound from where a large cache of arms was also recovered.
