Subramanian Swamy to move SC against Jayalalithaa's acquittal if Karnataka doesn't do

Bengaluru: Senior BJP leader Subramanian Swamy today said he will move the Supreme Court next month against the acquittal of AIADMK supremo J Jayalalithaa in a grafts case if the Karnataka government did not do so by then.

“I have decided to file SLP (Special Leave Petition) in SC after June 1st if K’taka govt does not file. So no need to go to KHC (Karnataka High Court),” he tweeted.

The BJP leader’s statement comes two days after he had indicated on micro blogging site ‘Twitter’ that he could file an appeal in the apex court against Jayalalithaa and “prove that the KHC judgment is a ‘tragedy of arithmetic errors'”, adding she would have to resign as Chief Minister if she had taken over by then.

Swamy is the original complainant in the case. He had filed a case in 1996 against Jayalalithaa alleging that during her tenure as Chief Minister from 1991 to 1996, she amassed properties disproportionate to her known sources of income.

The DMK government subsequently filed cases, including the Rs 66.65 crore disproportionate assets case, against Jayalalithaa which led to her conviction in September last by a special court.

The Karnataka High Court acquitted Jayalalithaa on Monday.

Modi government not much different from UPA: Govindacharya

New Delhi: Days after Arun Shourie criticised Narendra Modi Government, BJP’s former ideologue KN Govindacharya on Tuesday too questioned its performance, saying it was not much different from the UPA dispensation and the PM has to come up with “Made for India” policies.

Govindacharya, founder of outfit Rashtriya Swabhiman Andolan, said people continue to witness the “same partial” and “corrupt” dispensation at the central level.

“The government has completed a year. But at this moment, we can’t see a ground to list their achievements, which is a matter of concern. On one hand, it is directionless (on policy issues). On the other, there are internal differences amongst ministries.

“People feel even though Modiji looks different from others…People will have their own assessments…. But (I) can’t see much of a difference in the (two) Governments. Same partiality, corruption is there,” he told reporters.

On the Government’s policies over land acquisition bill and concepts of Smart Cities and Make in India, he cautioned the Prime Minister Modi over his advisors in these matters.

“I don’t know who are the advisors of Narendra Modi… who unnecessarily (have) brought into his head this type of a problem of Land Acquisition bill in which the basic norms could not be followed.

“Therefore, I think, that a clever person like Narendra Mod…I think he should beware of his advisors,” he said.

Govindacharya advised the government to properly supplement the “Make in India” concept with “Make for India” and “Made by India” policies.

“Otherwise, it will just be a signboard that ‘India on Sale’, which won’t do any good to people of Bharat,” he said.

Shourie, a minister in the Atal Bihari Vajpayee government, had earlier this month hit out at the Modi Government saying its economic policy was “directionless” while the social climate was causing “great anxiety” among the minorities.

With no majority in RS, can't pass law for Ram temple this time: Rajnath Singh

Ayodhya: A dearth of majority in the Upper House of Parliament was coming in the way of BJP to bring in a motion and make law for construction of a Ram temple in Ayodhya, Union Home minister Rajnath Singh today said.

Construction of a Ram Temple in Ayodhya was among the promises made by BJP in its election manifesto which it had released in the run up to last year’s General elections.

Some other contentious issues like abrogation of Article 370 which gives special status to Jammu and Kashmir and enactment of Uniform Civil Code were also promised in the party’s manifesto.

“BJP does not have a majority in Rajya Sabha, so this time it is not possible to bring motion in the Parliament to make law for the construction of Ram temple,” the senior BJP leader said.

He was here to take part in a programme of senior Vishva Hindu Parishad (VHP) leader Nritya Gopal Das. When asked if BJP will bring the motion for a Ram temple if it gets a majority in Rajya Sabha in the days to come, Singh said,”It is an imaginary question.”

The ruling party has 45 members in the Upper House and it is unlikely that it will have the numbers during its current tenure. In the House of 243 members, Opposition has at least 132 MPs.

Reacting to a question on underworld don Dawood Ibrahim, Singh said he will speak “some thing on Dawood in a day or two.” The government was left red-faced for its contradictory reply in Parliament on the whereabouts of Dawood Ibrahim.

Later, minister of state for home Kiren Rijiju said the underworld don lives in Pakistan and the Centre would continue to pursue the case very seriously.

'NGOs are not anti-national just because they differ with government on some matters'

Here is the full text of the letter, which has been signed by members of civil society urging Narendra Modi to “review all orders placing restraints on organisations, and revoke such orders where due process has not been followed by the government, no redress mechanism is clearly stated, and grounds are vague, subjective or flimsy”.

Dear Mr. Prime Minister,

We write to you today as members and representatives of Indian civil society organizations and, most importantly as Indian citizens, to express our deep concern at how civil society organizations in general and their support systems, including donors, are being labeled and targeted.

Funds are being frozen, intelligence reports are being selectively released to paint NGOs in poor light, disbursal of funds are being subjected to case-by-case clearance, and their activities are reportedly being placed on ‘watch lists.’ As a result several NGO projects have shut down, donors are unable to support work, and there is an overall atmosphere of State coercion and intimidation in India’s civil society space.

Today, standing in solidarity with India’s most marginalized communities, with the NGO sector and donors who support us, affirmed by the guiding principles of our Constitution – justice, equality and liberty – we address you through an open letter.

As you are aware, NGOs work both in the welfare sector and in empowering people to be aware of and enforce their rights as enshrined in our Constitution. Such action may include questioning and protesting decisions taken by government in many areas. This work is both our right and our responsibility as civil society actors in a democratic nation. Indeed the Indian government acknowledged this. At the Universal Periodic Review of India at the UN Human Rights Council in 2012, the Government spoke of “…the Government’s active association with civil society and the increasing and important role that civil society and human rights defenders are playing in the area of human rights.’”Government of India further said that, “The media, civil society and other activists have helped the Government to be vigilant against transgressions.”

Many of us receive both Indian and foreign donations in compliance with laws and carry out activities intended to help those marginalized in India’s development. Many of us have partnered with Government, both at State and Central levels, towards many goals – achieving universal education, access to health care, women’s empowerment, and providing humanitarian relief in times of tragedy such as the recent earthquake. We have also worked in pilot projects – some over the years have been scaled up, and others have richly contributed to the policy framework of the Government of India. It should be a matter of pride for any government and a sign of robust people-centric engagement that NGOs and citizens have impacted State policy.

On other issues, your government and indeed previous governments may or may not agree with some of our views. These may include the issue of nuclear power plants, acquiring tribal and other lands, upholding Dalit rights, protecting rights of minorities against the scourge of communalism, protecting rights of sexual minorities, or campaigning for the universal right to food. Yet, we expect that Government protect our right to work and express our views.  It does not behoove the Government to label any and every conflicting voice on these issues as “anti-national”,”‘against national security” or “donor driven” and seek to create a public atmosphere that justifies “a crack down on NGOs.” These very words shame any society. “Watch lists” and “crack-downs” belong in another age and have no place in a modern democracy.

Your government has raised the issue that some NGOs may not have complied with the Foreign Contribution Regulation Act, the law governing receipt of foreign donations in India. We state categorically that we stand fully for transparency and accountability in both government and NGO practice, and it is in fact civil society actors who have fought hard for these principles to be enshrined in all areas of public life. So let us constructively ensure transparency and legal compliance across the vast NGO sector, including societies, trusts and a range of public and private institutions. However, such efforts cannot be capricious, selective or based on flimsy grounds. At the moment it seems that ‘compliance’ is serving as a garb to actually target those organizations and individuals whose views the government disagrees with, and indeed to monitor and stifle disagreement itself.

There is irrefutable documentary evidence that State action against select organizations has been arbitrary, non-transparent, and without any course of administrative redress. The effect has been to harm important work being done by NGOs at the grassroots and send a signal of threat to civil society. Our concern includes the manner in which many Indian NGOs and  international partners have been targeted for different reasons. Thus, civil society organizations in India today find themselves in a situation where the only avenue of redress appears to be through the judiciary. Mr. Prime Minister, this kind of coercive domestic environment being created under your watch does not augur well for the worlds largest democracy that professes aspirations to being a global leader in promoting freedoms and democratic values.

Further, in an increasingly globalized world, where even business interests freely collaborate across national boundaries, to label any individual or NGO that engages with international forums or any donor who supports such NGOs, as “anti-national” is illogical. India is signatory to international conventions and treaties and seeks to adhere to the highest international standards of democracy, liberty, justice and human rights. The Government of India regularly reports at these forums. It is accepted practice that NGOs and civil society actors also present their views at these forums, often disagreeing with the views of their respective governments. Many of us, signatories to this letter, engage in active advocacy at international forums. This upholds the best traditions of global democratic debate, and the right to seek a more just nation and more just world. It is not anti-national to do so. We do not believe that any government can claim that it alone has the prerogative to define what is ‘national interest’. The citizens of this country, who elect the Government into power, are the ultimate stakeholders, and must be allowed to define, articulate and work towards their idea of ‘national interest’ too, whether or not it concurs with the views of the Government.

Mr. Prime Minister, it does your Government no credit to use its power to stifle the rights of individuals or NGOs to legally and freely associate, to work with communities, to receive donations to do such work, and to express their views on a range of issues that directly affect our country and its people. An atmosphere of hostility against civil society actors in a democracy, and the uncertainty and insecurity created among communities across the country, can only be to the detriment of our society and the Government.

We therefore ask the Government to:

1. Put an end to coercive actions against NGOs and donors, without reasonable cause or due process, or seek to cripple the ability of these organisations to carry on their legitimate and sanctioned work.

2. Urgently review all orders placing restraints on organizations, and revoke such orders where due process has not been followed by the government, no redress mechanism is clearly stated, and grounds are vague, subjective or flimsy. Those we are currently aware of include, among others, INSAF, Peoples Watch, Sabrang Trust, Greenpeace India, Ford Foundation, HIVOS and ICCO.

3. Initiate an immediate dialogue between the NGO sector and Government to address our concerns going forward. Amend the presently opaque FCRA rules and regulations; ensure complete clarity and transparency on provisions and processes, as well as forums and mechanisms of redress; remove all provisions that are amenable to subjective interpretation; ensure their uniform application to all NGOs, trusts, foundations, and societies.

We look forward to your response and action on these vital issues of national interest.

One year on, no achievements on ground by Modi government, admits BJP MP

New Delhi: BJP Member of Parliament from Ballia, Bharat Singh has dropped a bombshell in the parliamentary party meeting when he said that Narendra Modi-led government was talking about its achievements at the end of NDA’s one year in power but things were not that visible on the ground.

What was worrisome for the party leaders and Union Ministers was that this found resonance in the meeting and several MPs from U.P. thumped their desks.

Prime Minister Narendra Modi was present, but did not speak.

Road not constructed

Asking to be heard after BJP Union Ministers Venkaiah Naidu, Arun Jaitley, Ananth Kumar and party’s organising secretary Ram Lal spoke about taking to the people the good work done by the NDA, Mr. Bharat Singh said not an inch of road had been constructed under the Pradhan Mantri Gramin Sadak Yojna in Uttar Pradesh and MPs were not being heard.

“Hume bhi bolne ka mauka dijiye (Give us an opportunity to speak),’’ he reportedly said after the Ministers asked MPs to be present in the House as Constitutional Amendments Bills on GST and Land Boundary Agreement with Bangladesh were coming up.

Mr. Singh, who is a former president of the Banaras Hindu University, said MPs were “neither heard by Ministers in U.P. nor here [Centre].” His observation came at the fag end of the hour-long meeting which was then abruptly concluded.

Fellow party MPs endorse Bharat Singh’s views

Several BJP MPs confirmed the observations of Mr. Bharat Singh. They said more time should be given to MPs at the parliamentary party meeting to air their views.

A senior leader from Bihar expects the Prime Minister to address the grievance as he is “sensitive.’’ A Delhi MP said the problem has arisen because there are no District Vigilance and Monitoring Committees in place in States.

In a bid to counter the Opposition attack on the NDA on the Land Acquisition Bill and the delay in reaching compensation to rain and hail-hit farmers, MPs are under pressure to tell people about the achievements of the government and the welfare measures taken for the underprivileged sections and farmers such as the “Jan Kalyan Parva” starting from May 26 to June 1.

After achieving a target of over 10 crore members, the BJP now plans to have a mass contact programme, Mr. Ram Lal told MPs.

The party has issued a whip to its MPs in both Houses of Parliament till Friday.

Addressing the meeting, Union Finance Minister Arun Jaitley gave details of the GST Bill saying that it was a revolutionary taxation reform which will curb leakage of revenue, end corruption, the burden of multiple taxation and harassment of common people.

Regarding the Bill to operationalise the Land Boundary Agreement with Bangladesh, Parliamentary Affairs Minister Venkaiah Naidu told MPs that it was in the “national interest.”

“Our boundary will be secured, fencing will be done with Bangladesh and there will be no further infiltration. The road distance between India and Bangladesh will also be reduced and good ties will be maintained. We decided to accept the Congress suggestion of including Assam in the agreement,’’ he added.

Greenpeace says the government restrictions are an “attempt to silence criticism”

The environmental group Greenpeace has said it may be forced to shut down in India in a month because the government has frozen its bank accounts.

The pressure group said it had only about 30 days’ worth of funds with which to pay office costs and salaries.

India blocked the group’s accounts last month, accusing it of violating tax laws and working against its economic interests.

Greenpeace says the restrictions are an “attempt to silence criticism”.

The group, which says it is being targeted because of its campaigns on issues such as pollution and harmful pesticides, is preparing a legal challenge.

“We have one month left to save Greenpeace India from complete shutdown, and to fight MHA’s [ministry of home affairs] indefensible decision to block our domestic accounts,” Greenpeace India official Samit Aich said in a press release on Tuesday.

The group has been present in India for 14 years and employs 340 people.

An official in India’s home ministry told the BBC they had not seen the Greenpeace release and hence could not comment on it.

In April, while freezing its bank accounts for six months, the government accused Greenpeace of not fully declaring the amount of foreign funds it brings into the country.

Greenpeace India rejected the charge – it said it had complied with the law governing foreign contributions.

In a long-running dispute India has accused the environmental group of “stalling development projects” by protesting against large infrastructure plans.

Since coming to power in May last year, Prime Minister Narendra Modi’s government has pushed through a series of long-awaited reforms and new policies making it easier for companies to win approval for new projects.

Greenpeace activists have accused him of watering down environmental rules after the government allowed industries to operate closer to protected green zones.

New Delhi: Union Transport Minister Nitin Gadkari has said that he uses his urine to grow his plants faster, a revelation that may not impress his neighbours, including Congress president Sonia Gandhi.

In a video uploaded on YouTube, Gadkari is heard revealing that he once used his own urine on plants in his lawns at his 2, Motilal Nehru Marg residence, a bungalow that used to be the office of the former National Advisory Council headed by Sonia Gandhi and is just across the road from her 10, Janpath home.

Gadkari was at a workshop organized by the ruling Bharatiya Janata Party (BJP) on tackling drought.

“I collected my urine in a small plastic can. And after collecting all of it in a 50-litre can – I have a big bungalow in Delhi. It used to be Madam Sonia Gandhi’s bungalow. I have some one acre of farming land in my compound in the bungalow,” he said.

“I am just telling you about urine, I’m not going any further than that. This is manure. You keep a 50-litre can in your house. You can try this out. This has urea and nitrogen. And, if you water an orange tree with this, you observe its growth rate. You observe the growth and number of flowers, fruit — this is very good manure. To save money is to earn money. Being industrious and innovative is important,” he was quoted as saying in The Telegraph.

Only grabbing headlines: Arun Shourie attacks Modi government

Arun Shourie, a Minister in the Vajpayee Cabinet, hit out at the Narendra Modi government on Friday, saying its economic policy was “directionless” while the social climate was causing “great anxiety” among the minorities.

Mr. Shourie said the one-year rule of Modi was “good in parts”, his transformation as Prime Minister was good in foreign policy, but the promised turnaround in the economy had not happened.

“The government seems to be more concerned with managing headlines than putting policies in place. The situation is like the many pieces of a jigsaw puzzle lying in a mess with no big picture in mind about how to put them together,” he told a private news channel. Mr. Shourie, who is not active in BJP these days, said despite promises, the fears of foreign investors on retrospective taxes and incentives for manufacturing have not materialised on the ground. “They (investors) require stability and predictability,” he said, adding that the concern expressed by banker Deepak Parekh on the situation on the ground should be seen as a “wake-up call“.

Asked if the Modi government had done enough to put India on growth path, Mr. Shourie said that it was “all hyperbole.”

“Such claims are meant to grab headlines but lack substance,” he said. “The government is talking big on economic matters, but nothing is happening on the ground. Delivery is missing,” he added.

In an apparent reference to Finance Minister Arun Jaitley, he said the government lacked a stable approach in dealing with investors and that “lawyerly arguments” would not convince them. He was also critical of handling of the tax issues which was keeping foreign investors away. “First it alienated them but now it has made them laugh. You come out as bullies.”

New Delhi: Well-known for his controversial remarks, BJP leader Sakshi Maharaj has made heads turn again by stating that Rahul Gandhi’s ‘impure’ visit to Kedarnath has led to the disastrous earthquake in Nepal.

Sakshi Maharaj stated that Rahul Gandhi ate beef and visited Kedarnath without ‘purifying’ himself and hence, the earthquake took place, according to a report published in The Times Of India.

Reacting to Sakshi Maharaj’s insensitive remark, Congress spokesperson Sushmita Dev has asked the Modi government to take immediate action against their party member.

The Nepal quake has claimed nearly 4300 lives till date, as per reports. The stranded people in Nepal, filled with grief and fear, are spending nights out on streets.

Relief and rescue operations are on and countries across the globe are stepping forward to their bit for the quake victims.

Modi, who once refused to wear a skull cap, now sends 'chaadar' to Ajmer Sharif dargah

New Delhi: Prime Minister Narendra Modi on Tuesday pitched for harmony among all religions, citing the “great message” of Sufi saint Khwaja Moinuddin Chishti as he sent a ‘chaadar’ to be offered at his dargah in Ajmer.

Greeting people on the occasion of the annual ‘Urs’ of Khwaja Chishti, Modi said in a message that India has been a land of sages, saints and prophets for thousands of years.

He recalled Khwaja Chishti’s message of amity to his followers and said it is relevant even today.

“Khwaja had given a great message to his followers from all religions to live in harmony, keeping with the tradition of sufis and saints. That message is relevant even today,” the Prime Minister said.

He handed over the ‘chaadar’ to be offered at the dargah to Mukhtar Abbas Naqvi, minister of state for minority affairs.
