Rajya Sabha takes up Juvenile Justice bill for discussion

December 22, 2015 by Nasheman

rajya Sabha

New Delhi: The Rajya Sabha on Tuesday took up for discussion the Juvenile Justice amendment bill, a day after members cutting across party lines agreed that the important legislation should be taken up immediately.

The Juvenile Justice (Care and Protection of Children) Bill, 2014, provides for the trial of those between 16-18 years as adults for heinous offences. Also, anyone between the age of 16-18 who commits a less serious offence may be tried as an adult if he is apprehended after he attains the age of 21.

Giving out the bill’s details, Women and Child Development Minister Maneka Gandhi said borstals — a custodial institution for young offenders — would be set up under the proposed law to house juveniles accused of heinous crime.

“They (juvenile convicts) will not stay with adults in jails meant for adults… They will be kept in borstals. It does not exist at present… it will be created,” the minister said.

The convicted juvenile will stay in borstals till they attain the age of 21, and will be evaluated to decide whether they should be released.

“There will be a review… if they still have a criminal bent of mind, they will serve the complete sentence,” said the minister.

Maneka Gandhi said juvenile crime was being encouraged by the existing law.

“Juveniles’ involvement in crime is increasing the fastest. Children walk into police stations and say we have murdered… send us to a juvenile home,” the minister said.

Pointing out that even children committed crime against other children, she wondered: “Are we going to protect the victim or the criminal?”

“It (the bill) will stop a 16-year-old from saying ‘I have burnt a jhuggi. Send me to juvenile justice (board)’. ‘Or I have raped, murdered, send me to JJ…’,” Maneka Gandhi said.

Dec 16 gang-rape: SC dismisses plea against release of juvenile convict

December 21, 2015 by Nasheman

Delhi-gang-rape-juvenile

New Delhi: The Supreme Court on Monday dismissed the plea to stay the release of the 20-year-old who was convicted for the December 16, 2012 gang rape and was released from a remand home on Sunday.

The apex court in its judgement said to DCW: ‘We share your concern but under existing law, detention cannot go beyond 3 years’.

The Delhi Commission for Women, Swati Maliwal, had approached the Supreme Court to stay release of the juvenile convict, who is now 20 years old and was known to be the most brutal of the attackers.

“How many more Nirbhayas will we create before we change the system. Nirbhayas rapist should not be released under any circumstances today,” Maliwal tweeted.

“SC accepted petition. Matter was listed on Monday as Item No 3. Case subjudice now. Nirbhaya rapist should not be released until case heard,” Maliwal said in another tweet.

A vacation bench comprising Justices A K Goel and U U Lalit in their order pronounced at 2 AM on Sunday, posted the matter for hearing on Monday.

The Special Leave Petition filed by DCW against the order of the Delhi High Court, which refused to restrain the release of the convict, was referred by the Chief Justice of India T S Thakur before the vacation bench.

After the order by the court, DCW chairperson and the lawyers of the women’s panel hoped that since the matter has become sub judice, the government and Delhi Police will not release the juvenile offender today as scheduled.

The juvenile was moved out of Delhi on Saturday even as distraught parents of the victim strongly kept on opposing his release. The parents were briefly detained by the police after they held a protest against the convict’s release.

Sources said that the convict was taken to an undisclosed location from a correction home in North Delhi amid concerns that there was threat to his life.

They said the juvenile has been kept under observation of an NGO under protection of Delhi Police.

Dec 16 gangrape: Delhi HC refuses to stop juvenile’s release

December 18, 2015 by Nasheman

Delhi-gang-rape-juvenile

New Delhi: Decks were cleared for the release on Sunday of the juvenile convict in the horrific December 16, 2012 gangrape case with the Delhi High Court today refusing to intervene, saying he cannot be stopped from walking free under the existing provisions of law.

The convict, now 20-year-old, is expected to walk out of the reformation home on December 20, at the end of his three- year jail term unless there is a stay from the Supreme Court.

Brushing aside the public outcry against his release, a high court bench of Chief Justice G Rohini and Justice Jayant Nath directed the Juvenile Justice Board to interact with the convict, his parents and concerned officials of Department of Women and Child Development regarding his “rehabilitation and social mainstreaming”.

The bench said BJP leader Subramanian Swamy’s plea seeking stay on the release of juvenile convict cannot be allowed as the statutory and existing law was coming in its way.

“Having regard to the fact that the maximum stay that can be directed in the Special Home under Section 15(1) of the Juvenile Justice Act is three years and that the convict would be completing the period of three years by December 20, 2015, there cannot be any direction to continue his stay in the special home beyond December 20. Hence, we decline to issue any direction as prayed by the petitioner,” the bench said while allowing the convict to walk free.

Six persons, including the juvenile, had brutally assaulted and raped a 23-year-old girl in a moving bus in south Delhi on December 16, 2012. The victim had died in a Singapore hospital on December 29, 2012.

Mukesh, Vinay, Pawan and Akshay were awarded death penalty by trial court in the gang rape and murder case which was later confirmed by Delhi High Court. Their appeals are pending before the Supreme Court.

Accused Ram Singh had allegedly committed suicide in Tihar Jail on March 11, 2013, and proceedings against him were abated following his death.

Rapes are common, happened during Ram Rajya too: UP top cop

December 16, 2015 by Nasheman

Jagmohan Yadav Rape

Lucknow: Uttar Pradesh Police Director General Jagmohan Yadav on Tuesday courted controversy by saying that “rapes were committed even during the Ram Rajya”.

Responding to a question by a young reporter on increasing number of sexual assault cases, Yadav asked him to meet him in private to get an answer to the question.

Yadav, who is set to retire this month, told a press conference here that rapes were a common phenomenon happening in all states. He said police were unable to completely stop crimes against women.

In the past too, Yadav has stirred controversies but the state government has paid no heed to it owing to the police officer`s alleged proximity to the family of Samajwadi Party supremo Mulayam Singh Yadav.

BJP spokesman Vijay Bahadur Pathak termed the DGP`s remarks “loose, unwarranted, cheap and irresponsible”.

“While what Jagmohan Yadav said is condemnable, I think powers that be need to answer why they do not act against such officials,” the BJP leader said.

Bengal girl raped for 6 months by 10 men in Mangaluru, other places

December 9, 2015 by Nasheman

rape

New Delhi: An 18-year-old girl is battling for life after being raped repeatedly by different men for the last six months. The girl has been admitted to Delhi’s Guru Teg Bahadur Hospital with severe injuries all over her body and doctors say her condition is serious.

The girl has told the police that she was trafficked from West Bengal last year and was taken to Rishikesh, Haridwar, Manali, Mangaluru and other places where she was raped by different men.

According to a report in Hindustan Times, an NGO, Shakti Vahini, had received the information about the girl’s trafficking in April but they were not able to locate her. It was on Monday that Kolkata Police informed Shakti Vahini that she was admitted at uru Teg Bahadur Hospital.

“The girl lies in a critical state, unable to make use of her lower limbs. The victim has reported about sexual abuse and multiple sexual assaults over the last six months. She has also reported about her being used in prostitution rackets,” the daily quoted president of Shakti Vahini, Ravi Kant, as saying.

The NGO has helped police identify the main accused who first lured the girl out of Kolkata and pushed her into a prostitution racket. The main is a history sheeter of the area and has been arrested by the police.

A team of Kolkata Police is on its way to Delhi to record the victim’s statement and take her back to Kolkata for further action in the case.
