Ahmedabad: Self-styled spiritual guru and rape accused Asaram’s son Narayan Sai, jailed in a rape case, was today granted three weeks’ temporary bail by the Gujarat High Court to attend to his ailling mother, who is schedule to undergo a surgery.

Justice V M Pancholi granted conditional temporary bail to Sai, who will remain under police surveillance during his bail period.

The court told Sai to surrender in four days from the date of his release from Surat jail if his mother’s surgery does not take place till then.

Sai, who is in jail since December 2013, is likely to come out of Surat jail tomorrow.

Rape accused spiritual guru Asaram.

The relief for Sai came amid reports of attacks on witnesses of rape cases against him and his father Asaram, who is behind bars in Jodhpur in connection with a rape case.

A key witness, Mahendra Chawla, was attacked in Panipat district of Haryana on May 13 this year. Till now, two persons, who had given testimonies in the rape case, have been killed and four persons, including Chawla, faced attacks.

In June last year, Gujarat-based witness Amrut Prajapati was shot dead in June last year at his clinic in Rajkot. Another prosecution witness, Akhil Gupta, was also shot dead in Uttar Pradesh’s Muzaffarnagar.

The High Court had on April 16 granted three-week bail to Sai for attending the proposed surgery of his mother Lakshmiben for a cervical ailment at a hospital in Ahmedabad.

However, the Supreme Court had on April 29 modified the order saying that Sai would be released on bail only after the date of his mother’s operation was fixed.

The apex court had acted then on a plea of Gujarat police seeking cancellation of interim bail granted to Sai on various grounds including that the accused may tamper with evidence in the case in which charges are yet to be framed.

Sai is behind bars since December 2013 in the rape case filed by two Surat-based sisters.

The sisters from Surat had lodged two different rape complaints against Sai and Asaram.

Sai’s mother Lakshmiben was also booked in the alleged rape case filed against Asaram by one of the sisters. Later, she was granted bail.

Sai was booked under various IPC sections, including rape, unnatural sex, molestation, wrongful confinement, unlawful assembly, rioting armed with deadly weapon, criminal intimidation and criminal conspiracy.

The younger of the two sisters had in her complaint accused Sai of repeated sexual assault between 2002 and 2005 when she was living at his Surat ashram.

Punjab Minister kicks up row, says Moga victim's death God's will

May 2, 2015 by Nasheman

MOGA-RAPE

Moga: Punjab Education Minister Surjit Singh Rakhra today triggered a controversy by making an insensitive comment that the death of the teenage girl, who was molested and thrown off a bus belonging to the ruling Badal family, was God’s will. ‘Nobody can stop accidents. Whatever happens does so by God’s will.

“We can always meet with an accident. We will do more for the people….What has happened is unfortunate. You cannot go against nature’s will,” he said.

Rejecting government compensation and demanding action against the owners of the vehicle, family members of the girl have refused to perform her last rites.”There is no headway on this issue (on the cremation),” Moga SSP Jatinder Singh Khehra said.

The body of girl has been kept in a mortuary at Singhawala village here. All attempts by the state authorities to persuade the bereaved family to cremate her proved futile after they rejected a compensation of Rs 20 lakh, a government job for her mother, her free treatment and holding trial of the case in a fast track court.

The family was insisting that the owners of the bus, Orbit Aviation, be booked in connection with the offence and its road permits be cancelled, a demand vociferously supported by AAP.

“I want justice. I want justice for my daughter. FIR should be registered against those whom the bus belonged to,” victim’s father had said yesterday.

When he was asked whether he wanted registration of FIR against Sukhbir Badal, he had said, “FIR can be lodged against him (Sukhbir) after all he is a human being.””Is there nobody in the world who can lodge FIR against him (Sukhbir),” he had questioned yesterday.

The 13-year-old victim and her mother were thrown off the moving bus by a group of men, including the conductor, after they resisted molestation attempts on Thursday.

Meanwhile, Punjab Congress led by its chief Partap Singh Bajwa has given a call for ‘Rail Roko’ agitation for an hour starting at noon to protest against the “deteriorating” law and order situation in the state and to draw attention to the farmers’ problems.

“The deteriorating law and order situation will be part of the ‘Rail Roko’ agitation whose main focus will be the demands of the farmers,” he said.

Congress Spokesperson Randeep Surjewala charged that the family has refused to cremate the victim as the police is pressuring them to arrive at a compromise.

“Ministers of Akali Dal-BJP government are giving out insensitive statements. This is inhuman and completely reflects the arrogance of power that has surpassed the basic tenets of humanity,” he said.

SAD MLA Joginder Singh Jain accused the opposition parties of adding fuel to the fire.

“The government has taken all action possible within its limits till now. The opposition parties including AAP and Congress are simply adding fuel to the fire.

They are misleading the family and bringing disrepute to the girl’s modesty,” he said.

As far as the compensation issue is concerned, he said “It has been given as ex-gratia and not as a bribe. The opposition is watching the drama        and doing nothing. They (family) have not refused to take compensation from us. Infact they were the ones who demanded money and a job.”

“We got a special exemption from the government to give a job in the corporation to their 16-year-old son,” he said.

Cabinet nod for trial of juveniles as adults for rape, murder

April 23, 2015 by Nasheman

Calls have been growing louder for stricter punishment for minors ever since the 2012 Delhi gang rape

Calls have been growing louder for stricter punishment for minors ever since the 2012 Delhi gang rape

New Delhi: Overruling the recommendations of a parliamentary panel, government on Wednesday went ahead with a proposal to try juveniles in the age group of 16 to 18 years accused of heinous crimes under laws for adults.

“The Cabinet has approved amendments to the Juvenile Justice (Care and Protection of Children) Act, whereby juveniles in the age group of 16-18 can be tried under Indian Penal Code (IPC) if they are accused of heinous crimes,” I T and Communication Minster Ravi Shankar Prasad told reporters after the Cabinet meeting.

The issue was brought before the Cabinet a fortnight ago but was dropped from the agenda at the last moment and it was decided that an informal group of ministers will examine the issue.

Rejecting the recommendations of a Parliamentary Standing Committee, the Women and Child Development Ministry had decided to go ahead with the proposal. The Supreme Court had also recently observed that there was a need to relook at the provisions of Juvenile Justice Act in cases where the accused have committed crimes like rape, murder dacoity and acid attacks.

Several ministers in the Cabinet meeting supported the proposal saying a person accused of crimes like rape should be treated as an adult, a senior minister said after the meeting.

“The new proposed Act (the amendment bill) provides that in case a heinous crime has been committed by a person in the age group of 16-18 years it will be examined by the Juvenile Justice Board to assess if the crime was committed as a ‘child’ or as an ‘adult’.

“Since this assessment will be made by the Board which will have psychologists and social experts, it will ensure that the rights of the juvenile are duly protected if he has committed the crime as a child. The trial of the case will accordingly take place as a juvenile or as an adult on the basis of this assessment,” an official statement said.

The amended bill also proposes to streamline adoption procedures for orphaned, abandoned and surrendered children. It establishes a statutory status for the Child Adoption Resources Authority (CARA).

The legislation proposes several rehabilitation and social integration measures for institutional and non-institutional children. It also provides for sponsorship and foster care as completely new measures.

Mandatory registration of all institutions engaged in providing child care is also in the offing.

New offences, including illegal adoption, corporal punishment in child care institutions, use of children by militant groups and offences against disabled children have also been incorporated in the proposed legislation.

The major amendments include removal of Clause 7 that relates to trial of a person above the age of 21 years as an adult for committing any serious or heinous offence when the person was between the ages of 16-18 years; enhancing the period of preliminary inquiry by the Juvenile Justice Board in case of heinous offences committed by children in the age group of 16-18 years; increasing the reconsideration period for surrender of children by parents or guardians; enhancing the period for inter-country adoption in case the child is not given for domestic adoption; assigning the role of designated authority to monitor the implementation of the Bill to the National Commission for Protection of Child Rights and making the central and state governments responsible for spreading awareness on the provisions of the bill.

The amended bill will be brought before parliament again in the ongoing budget session, official sources said.
