Four TDP Lawmakers Switch to BJP; How This Does Not Violate Provisions of Anti-Defection Law

June 21, 2019 by Nasheman

The brilliance of the merger move lies in the fact that it managed to avoid the penalties under the anti-defection law.

TDP Rajya Sabha MPs Y Sujana Chowdary (2nd L), TG Venkatesh and CM Ramesh join BJP in the presence of party’s Working President JP Nadda (C) and party’s senior leader BJP general secretary Bhupender Yadav (L), in New Delhi, Thursday, June 20, 2019. (PTI Photo/Ravi Choudhary)

New Delhi: Former Andhra Chief Minister N Chandrababu Naidu’s Telugu Desam Party (TDP) plunged into a political crisis on Thursday after four out of its six Rajya Sabha members joined the BJP.

The four MPs, YS Chowdary, CM Ramesh, Garikapati Mohan Rao and TG Venkatesh, submitted a letter to Rajya Sabha chairman and Vice President M Venkaiah Naidu seeking that they should be recognised as a separate group.

While the move has deepened the TDP’s crisis after it lost 22 of the 25 Lok Sabha seats, and 151 out of 175 Assembly seats to Jaganmohan Reddy’s YSRCP, it has given the ruling BJP a major boost in the Upper House of the Parliament.

The brilliance of the merger move lies in the fact that it managed to avoid the penalties under the anti-defection law.

News18 explains the anti-defection law and what this move means for the BJP.

What is Defection?

Listed under the Tenth Schedule of the Constitution, the Anti-defection law was introduced by 52nd Amendment in 1985 during the tenure of former Prime Minister Rajiv Gandhi.

The law defines defection as “to abandon a position or association, often to join an opposing group which essentially describes a situation when a member of a particular party abandons his loyalty towards that party and provide his support (in the form of his vote or otherwise) to another party”

Need for Anti-defection Act

During the formulation of the Constitution of India, there was no mention of political parties and their existence, let alone defection.

It wasn’t until the 1967 elections that things changed when the country evolved into a multiparty democracy. This was the beginning of the coalition era.

Between 1967 and 1971, close to 142 MPs and over 1,900 MLAs defected to other parties. It was during this period that the Hindi expression “Aaya Ram Gaya Ram” became popular when a Haryana MLA changed his party thrice in one day.

However, it took 17 years for the issue of defection to be addressed in the Parliament in 1985.

Conditions of Disqualification Under Anti-defection Act

The Act states that a member of a political party may be disqualified primarily on two grounds mentioned under the fourth paragraph of the Tenth Schedule of the Constitution.

One, if the member voluntarily resigns from the party or disobeys the directives of the party on a leadership vote. Two, if the member votes or abstains from voting as per the party’s whip and without prior permission.

However, the Act also states that it will not be considered a defection under law if a complete political party merges with another political party, if a new party is created by the elected members of another, if the party members don’t accept the merger between the two parties and opt to perform as a separate group.

91st Amendment Act, 2003

The law before the 91st Amendment Act, 2003 defined defection by one-third of the elected members of a political party as a ‘merger’. A merger avoided the penalty of disqualification under the Act.

However, the 2003 Amendment changed this by positing that at least two-thirds of the members of a party must be in favour of a merger to gain validity before the law.

The Amendment also made it mandatory for all defectors to resign from their legislative membership and seek a re-election in the House.

What the defection of four TDP MP’s means?

With four TDP MP’s defecting to the BJP, the saffron party has managed to increase its tally in the Rajya Sabha to 77.

The TDP has eight MPs of which six are members of the Rajya Sabha and the rest of the Lok Sabha. The four members migrating to the BJP is defection by two third of its elected members. Thus, the move is an act of merger and the MP’s will face no disqualification over it under the Anti-defection Act.

The defection assumes significance for the BJP given that it is expected to attain a majority of 124 seats in the House by 2021. However, this depends on how the Assembly elections in Maharashtra, Haryana and Jharkhand play out. Besides, the moves also gives the BJP a toehold in another southern state besides Karnataka.

Currently, the BJP led-NDA now has 102 members in the 245 seat Rajya Sabha out of which the BJP has 73 MPs. The Congress led-UPA has 101 seats with the Congress at 50.

The BJP now awaits the largest attrition drive in the Rajya Sabha in 2020 when 72 members will retire.

ICC World Cup 2019: Ruthless Australia Beat Inspired Bangladesh to Register Fifth Win

June 21, 2019 by Nasheman

Australia registered their fifth win of the World Cup as they beat Bangladesh by 48 runs in a hard-fought encounter at Trent Bridge on Thursday (June 20).

David Warner led the way for Australia as his 166 helped the team post 381-5. In reply, Bangladesh on the back of a maiden World Cup ton from Mushfiqur Rahim, managed 333-8.

Bangladesh were struck an early blow in their chase when a mix-up between the two openers saw Soumya Sarkar get run out after an accurate throw from Aaron Finch.

Tamim Iqbal was then joined by Shakib al Hasan. The two put together a decent partnership that ended when Shakib departed due to a leading edge off Marcus Stoinis’ bowling which was easily claimed by Warner at mid-off.

Tamim then stitched together a 42-run partnership with Mushfiqur but a stroke of bad luck saw the former play a short ball from Mitchell Starc right onto his stumps and end what could have been a promising stand.

A lot rested on Mushfiqur and Liton Das but the latter would also depart just as the partnership begun to get going. Adam Zampa trapped Das plumb and not even a review saved him.

Undeterred, Mushfiqur batted with calmness and responsibility, eventually bringing up a fifty-run stand with Mahmudullah after completing his own half-century.

The two looked to rotate the strike so as to not let the asking rate get to far ahead of them. The 100-run stand soon came up but when Nathan Coulter-Nile dismissed Mahmudullah and Sabbir Rahman off successive balls, that ended Bangladesh’s resistance.

Mushfiqur brought up his 8th ODI ton towards the end of the match but Bangladesh’s highest-ever ODI total still saw them fall well short.

Warner Sets the Tone

Earlier, Warner made Bangladesh pay for an early drop with a big hundred as the reigning champions piled on the runs after opting to bat.

The opener, who was dropped on 10, made 166 in Australia’s imposing total of 381-5 — his second century of the World Cup thus far.

The 32-year-old looks back to his devastating best for Australia after completing a 12-month ban for his role in a ball-tampering scandal in South Africa.

Soumya Sarkar gave Bangladesh fans something to cheer with 3-58 in eight overs on a day when not much seemed to be going their way.

The Tigers suffered a blow before play when a back spasm ruled out Mohammad Saifuddin, their leading bowler at the tournament.

His absence from the attack was definitely felt, with the recalled Rubel Hossain’s nine wicketless overs costing an expensive 83 runs.

Even so, Warner could have been out for just 10 when a slashing cut off Bangladesh captain Mashrafe Mortaza found its way to Sabbir Rahman at backward point.

But the fielder appeared not to have seen the ball properly against the backdrop of the crowd and it burst through his hands.

Finch was out soon after completing his eighth fifty in 11 ODI innings when he guided a rising Sarkar delivery straight to Rubel at short third man. But that did not stop Warner pressing on to a hundred.

He eventually fell when, trying to uppercut Sarkar, he lobbed a catch to Rubel at short third man. Warner faced 147 balls, hitting 14 fours and five sixes.

But his exit simply brought in the big-hitting Glenn Maxwell, who smashed 32 off 10 balls before he was run out.

Khawaja fell in sight of a hundred when he bottom-edged a pull off Sarkar and wicket-keeper Mushfiqur Rahim dived forward to hold a good catch while Steve Smith was plumb lbw to Mustafizur Rahman for one.

A brief rain break halted play after 49 overs before Australia scored 13 off the last over.

New Delhi: In a surprising admission, Janata Dal (Secular) supremo HD Deve Gowda on Friday said that mid-term Assembly polls in the state are imminent as he is uncertain about how long the coalition government would last.

“I am not sure how long the coalition government will last. Going by the developments, in the past two months, mid-terms polls seem imminent. People can understand everything…let me see how things pan out,” he told a Kannada news channel.

Gowda’s statement comes just two days after his son Chief Minister HD Kumaraswamy said that he is “in pain” every day but has the responsibility of running the government smoothly.

The Congress-JD(S) government in Karnataka has been in deep waters since February as news emerged of the BJP, which holds the highest number of seats in the state Assembly, allegedly indulging in horse-trading.

The saffron party received a boost from the Lok Sabha results that were declared on May 23, which saw the BJP make a near clean sweep.

Following this, in an attempt to placate disgruntled lawmakers, the Kumaraswamy government decided to expand the cabinet, inducting two independents.

The two independent MLAs, R Shankar and H Nagesh, were inducted into the Ministry overlooking the claims of several senior leaders, particularly in the Congress, who are sulking ever since they failed to make it to the ministry earlier.

Narendra Modi writes to Imran Khan, says ‘ties with India can improve only if Pakistan acts strongly against terror’

June 20, 2019 by Nasheman

This comes days after Imran Khan wrote to Prime Minister Modi, saying Islamabad desired talks with New Delhi to resolve all issues, including Kashmir.

Narendra Modi writes to Imran Khan, says 'ties with India can improve only if Pakistan acts strongly against terror'

Prime Minister Narendra Modi has reiterated that relationship with Pakistan can improve only if the neighbouring country takes decisive steps against terrorism. Responding to a letter by Pakistan Prime Minister Imran Khan, Modi wrote back to him, laying India’s pre-condition for any dialogue in clear terms.

“For this (talks), It is important to build an environment of trust, free of terror, violence and hostility,” said Prime Minister Modi in his letter.

Confirming the development, the Ministry of External Affairs said that the letter was in accordance with “established diplomatic practice” to respond to “congratulatory messages” received from Pakistan.

The statement released by the Ministry of External Affairs said, “As per the established diplomatic practice, PM and EAM have responded to the congratulatory messages received from their counterparts in Pakistan. In their messages, they have highlighted that India seeks normal and cooperative relations with all neighbours, including Pakistan.”

The MEA also emphasised on the need for an “atmosphere free from the shadow of terror and violence”.

This comes days after Imran Khan wrote to Prime Minister Modi, saying Islamabad desired talks with New Delhi to resolve all issues, including Kashmir. In his letter, Imran congratulated Modi for the latter’s victory in the recently concluded Lok Sabha election.

He had said that talks between India and Pakistan was the only way to resolve differences and work to tackle menace like poverty.

During the recently held Shanghai Cooperation Organisation (SCO) in Kyrgyzstan, no talks or meeting happened between the two leaders. Notably, Prime Minister Modi did hold bilateral talks with China, Russia, Afghanistan and Kyrgyzstan.

However, reports said that the Prime Ministers of the neighbouring countries did exchange “usual pleasantries” in the Leaders’ Lounge during the SCO summit in Bishkek.

Pakistan Foreign Minister Shah Mahmood Qureshi had said, “There was no scheduled structured meeting between two leaders. On the second day of the SCO, but they met, shook hands. They also exchanged pleasantries.”

India has repeatedly turned down Pakistan’s request for resumption of dialogue, citing that there has been no concrete proof of the country’s action against terrorism. New Delhi has maintained that terrorism and talks cannot go hand in hand.

Tensions between India and Pakistan have spiralled following the February 14 Pulwama terror attack. Both the countries were almost on the brink of a war after India’s military planes struck a terrorist training camp in Pakistan’s Balakot on February 26 and Pakistan carried out a counter-offensive the next day.

Meanwhile, US has also said that Pakistan needs to act against terrorism to improve ties with India. Urging Pakistan to take more decisive steps against terror, the US said that the country needed to arrest and prosecute the ones involved in terrorist activities.

Sunil Gavaskar kept promise to Ranveer, broke into jig after India beat Pakistan

Manchester: Batting great Sunil Gavaskar fulfilled the promise he made to actor Ranveer Singh that he will dance to a hit hindi movie song if India beat Pakistan by breaking into an impromptu jig on Sunday.

In a video that went viral, Gavaskar was seen singing and dancing to Shammi Kapoor’s hit song ‘Badan Pe Sitare’ along with Ranveer, who also tried to imitate Shammi Kapoor’s moves on the classic number from the 1969 film ‘Prince’.

Spin great Harbhajan Singh, who recently launched his YouTube channel `Turbanator`, posted the video.

Ranveer, who plays Kapil Dev in the upcoming sports period drama “`83”, had said at the post-match show in Hindi that “you haven`t seen the real side of Sunny paaji!”

Virat Kohli-led India have so far won three of their four games at the World Cup convincingly, while the tie against New Zealand was washed out without a ball bowled. In their opener, the Men in Blue beat South Africa by six wickets and followed it up with a 36-run victory over Australia.

In the big-ticket clash against arch-rivals Pakistan, India romped to a 89-run win (D/L method) in a rain-affected tie.

“Can’t Express The Pain I’m Going Through Everyday”: HD Kumaraswamy

June 20, 2019 by Nasheman

“I need to solve the pain of people of the state. I have the responsibility of running the government smoothly,” Karnataka Chief Minister HD Kumaraswamy said.

'Can't Express The Pain I'm Going Through Everyday': HD Kumaraswamy

HD Kumaraswamy alleged that one of his party legislators was offered Rs. 10 crore by the BJP.

HIGHLIGHTS

  1. I have the responsibility of running government smoothly: HD Kumaraswamy
  2. He alleged one of his party leaders was offered Rs. 10 crore by the BJP
  3. Fears of poaching by BJP after coalition’s poor dismal performance

Days after expanding his cabinet in Karnataka in an attempt to keep the coalition together, Chief Minister HD Kumaraswamy today said he “cannot express the pain” he goes through everyday, adding that he has the responsibility of running the government smoothly.

“I promise I will fulfil your expectations. I can’t express the pain I am going through every day. I want to express it with you, but cannot. But I need to solve the pain of people of the state. I have the responsibility of running the government smoothly,” Mr Kumaraswamy said at an event in Channapatna on Tuesday.

The Congress-Janata Dal (Secular) coalition government in Karnataka has been left vulnerable after their massive defeat in the national election. Both the parties won just a seat each, with the BJP sweeping polls in Karnataka with 25 of 28 seats in the bag.

The dismal performance has raised fears of a potential revival of what is referred to as “Operation Lotus”. The term was first used in 2008, when the BJP was accused of inciting several opposition legislators to defect to ensure the stability of its government headed by BS Yeddyurappa.

On Tuesday, Mr Kumaraswamy also alleged that one of his party legislators was offered Rs.10 crore by the BJP. “One of our MLAs called me after he got a call by a BJP leader. They offered him Rs. 10 crore to leave JD(S) and join BJP. These attempts are being done continuously by BJP leaders. But by God’s grace and your blessings this government is safe for another four years,” he said.

The BJP has said that it would not take any active steps to bring down the coalition government. The party denies any plan of luring away legisaltors from the Congress or the JD(S). Just before the Lok Sabha elections, one legislator, Umesh Jadhav, did join the BJP and was given the Lok Sabha ticket from the Kalaburagi seat. Mr Jadhav defeated Congress veteran, Mallikarjun Kharge in Kalaburagi.

Congress leader and former Karnataka chief minister Siddaramaiah said that there is “no threat” to the coalition government in his state.

“There is absolutely no threat to the government in Karnataka, there is no problem. They (BJP) are trying desperately but they will not succeed,” Mr Siddaramaiah said in Delhi.

The All India Congress Committee has decided to dissolve the existing Karnataka Pradesh Congress Committee (KPCC). However, the president and working president will remain unchanged, said an AICC release on Wednesday.

KPCC campaign committee head and former Minister H.K. Patil had already tendered his resignation to the post following the party’s poll rout. KPCC president Dinesh Gundu Rao and working president Eshwar Khandre will continue to hold the posts.

This is part of Congress’s effort to restructure KPCC after the party’s drubbing in the Lok Sabha elections. With the party being the alliance partner of the Karnataka government, it managed to win just a single seat from the State in the recently concluded general elections.
