US court refuses to reinstate Trump’s Muslim ban

In setback to US president, appeals court declines to back ban on travellers from seven predominantly Muslim countries.

A federal appeals court has refused to reinstate US President Donald Trump’s ban on travellers from seven predominantly Muslim nations, dealing another blow to his young administration.

In a unanimous decision, the panel of three judges from the San Francisco-based 9th US Circuit Court of Appeals declined on Thursday to block a lower-court ruling that suspended the ban and allowed previously barred travellers to enter the US.

Shortly after the ruling, Trump responded furiously on Twitter, writing his response in capital letters.

He told reporters his administration ultimately would win the case and dismissed the ruling as “political”.

Trump’s January 27 order barred travelers from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen from entering for 90 days and all refugees for 120 days, except those from Syria, whom he would ban indefinitely. He said his directive was “done for the security of our nation, the security of our citizens.”

District Judge James Robart in Seattle issued a temporary restraining order on the ban on February 4 after Washington and Minnesota states sued, prompting Trump to label him a “so-called judge”.

The 9th Circuit judges noted that the states had raised serious allegations about religious discrimination.

Asked about Trump’s tweet, Washington state Attorney General Bob Ferguson said: “We have seen him in court twice, and we’re two for two.”

An appeal to the Supreme Court is possible.

A point-by-point rebuttal

In its ruling on Thursday, the 9th US Circuit rejected the administration’s claim that the court did not have the authority to review the president’s executive order.

“There is no precedent to support this claimed unreviewability, which runs contrary to the fundamental structure of our constitutional democracy,” it said.

Al Jazeera’s Rob Reynolds, reporting from San Francisco, said the court presented “a point-by-point rebuttal of the government’s case in the ruling”.

Speaking to Al Jazeera, Melanie Sloan, a consultant and a longtime ethics monitor in Washington DC, said: “This tells the world that there is a significant portion of our country that is not behind this kind of thing at all.

“We will work very, very hard to defeat this kind of discriminatory ban that really doesn’t help anybody.”

Justice Robart’s ban order temporarily suspended the nation’s refugee programme and immigration from countries that the Trump administration says raise security concerns.

Justice department lawyers appealed to the 9th US Circuit, arguing that the president has the constitutional power to restrict entry to the US and that the courts cannot second-guess his determination that such a step was needed to prevent terrorism.

The states, however, said Trump’s travel ban harmed individuals, businesses and universities.

Citing Trump’s campaign promise to stop Muslims from entering the US, they said the ban unconstitutionally blocked entry to people based on religion.

Both sides faced tough questioning during an hour of arguments on Tuesday conducted by phone – an unusual step – and broadcast live on cable networks, newspaper websites and social media. It attracted a huge audience.

The judges chipped away at the administration’s claim that the ban was motivated by “terrorism fears”, but they also challenged the states’ argument that it targeted Muslims.

Sloan, the Washington DC-based ethics monitor, said: “It’s really wonderful. As an American I can be so proud of these folks and the image we want to project to the world.

“I think you will see, going forward in the Trump administration, that often it will be lawyers and judges who will be on the forefront, stopping these abuses of power. Remember we are only in Week Three of the administration.”

Judge Robert temporarily halted the ban after determining that the states were likely to win the case and had shown that the ban would restrict travel by their residents, damage their public universities and reduce their tax base.

‘Thoughtful opinion’

Robart put Trump’s executive order on hold while the lawsuit worked its way through the courts.

After that ruling, the state department quickly said people from the seven countries – Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen – with valid visas could travel to the US.

Commenting on the 9th Circuit decision, Noah Purcell, Washington state’s solicitor-general, described it as an “excellent, well-reasoned, careful, thoughtful opinion that seriously considered all the government’s arguments – and rejected them”.

He said it is “important to recognise the real impact that this is already having on people’s lives. We have just been hearing from people all over the state and all of the country about what a difference this has made, and we’re so thrilled for that”.\

The Supreme Court has a vacancy, but there is no chance Trump’s nominee, Neil Gorsuch, will be confirmed in time to take part in any consideration of the ban.

The ban was set to expire in 90 days, meaning it could run its course before the court would take up the issue.

The US administration also could change the order, including changing its scope or duration.

“We could go on for several more rounds … but presumably everything would be done very quickly, just as this has happened,” David Levine, a law professor at the University of California’s Hastings College in San Francisco, told Al Jazeera.

“The US government has several choices. One is that they could go to the Supreme Court in Washington … to see if they can get a stay. The other thing they can do is try to and get a majority of judges in the 9th Circuit here to agree to review the ruling.

The government has 14 days to ask the 9th Circuit to have a larger panel of judges review the decision “en banc,” or appeal directly to the Supreme Court, which will likely determine the case’s final outcome.

Bangladesh post 41/1 at stumps, trail by 646 runs vs India on Day Two

Hyderabad: Bangladesh scored 41/1, trailing by 646 runs, at stumps on the second day of the one-off cricket Test against India at the Rajiv Gandhi International Stadium here on Friday.

Tamin Iqbal (24) and Mominul Haque (1) were at the crease when umpires dislodged the bails for the day.

Bangladesh lost opener Soumya Sarkar (15) in the 12th over when the score was 38. Umesh Yadav took the wicket.

Earlier, Indian skipper Virat Kohli’s record double hundred and Wriddhiman Saha’s second hundred (106 not out) enabled India declare their first innings at a mammoth total of 687-6 in the final session.

Bill supporting Kambala, Bull Cart Race proposed in Karnataka assembly session today

Bengaluru: A bill supporting Kambala has been proposed in Karnataka state legislative assembly session on Friday morning. According to the proposed bill, two rural sports events, Kambala and bull card race have been permitted to organise in the state with some rules and regulations under prevention of cruelty to animals act.

The both races will be exempted from the animal violence prevention act. The proposed bill has asked the the organisers of the events not to harm the animals while conducting either Kambala or bull cart race. Also, the bill has asked to ensure that domestic breeds have been utilised in the above said events. Culture, language of the land should be promoted while conducting Kambala and cart race.

Virat Kohli climbs ‘The Wall’, eclipses ‘The Don’

Hyderabad: Indian captain Virat Kohli continued his unbelievable record-breaking spree today and surpassed the legendary Sir Donald Bradman and Rahul Dravid by becoming the first batsman to score double hundreds in four successive Test series.

Kohli’s double tons came in the series against the West Indies, New Zealand, England and now Bangladesh, which is in India for a one-off Test.

Bradman and Dravid had achieved the feat in three successive series.

Kohli hit his maiden double hundred (200) at North Sound against the West Indies in July last year followed by 211 against New Zealand at Indore in October.

This was followed by his current career-best score of 235 against England in Mumbai in December and now 204 against Bangladesh.

While statistically Kohli had broken Bradman and Dravid’s record but a cursory look at ‘The Don’s’ statistics would tell that his numbers during that 1930-31 phase was phenomenal.

In the 1930 Ashes series in England between June and August, the then 22-year-old Bradman scored 254 at Lord’s, 334 (his career best) at the Leeds (Headingley) followed by 232 at the Oval — all in a single series.

In the following series against the West Indies in January 1931, Don hit 223 at Brisbane (the series was played in Australia). The next series that he played against South Africa (again Down Under), he hit 226 at Brisbane becoming the first batsman to score a double hundred in three successive series.

For Dravid, the hat-trick of double hundreds in successive series came in the 2003-04 season.

He scored 222 against New Zealand at Ahmedabad (October 2003) followed by 233 against Australia at Adelaide (December 2003). The hat-trick was accomplished with his career-best 270 against Pakistan in the very next series.

Attacks against minorities, Dalits grew sharply in BJP-led regime: US report

Washington: Religious tolerance has deteriorated and religious freedom violations have increased in India under Prime Minister Narendra Modi’s regime, a report by an independent bipartisan American body has claimed.

The report, titled ‘Constitutional and Legal Challenges Faced by Religious Minorities in India’ and sponsored by the US Commission on International Religious Freedom (USCIRF), said the religious minority communities and Dalits face discrimination and persecution in India where hate crimes, social boycotts and forced conversion have escalated dramatically since 2014.

“Under Congress Party and BJP-led governments, religious minority communities and Dalits, both have faced discrimination and persecution due to a combination of overly broad or ill-defined laws, an inefficient criminal justice system, and a lack of jurisprudential consistency. In particular, since 2014, hate crimes, social boycotts, assaults, and forced conversion have escalated dramatically,” said the report.

“Since the BJP assumed power, religious minority communities have been subject to derogatory comments by BJP politicians and numerous violent attacks and forced conversions by affiliated Hindu nationalist groups such as Rashtriya Swayamsevak Sangh, Sangh Parivar, and Vishva Hindu Parishad,” it said.

The USCIRF-sponsored report is written by Iqtidat Karamat Cheema, who is director for UK-based Institute for Leadership and Community Development. The report further says there are constitutional provisions and state and national laws in India that do not comply with international standards of freedom of religion or belief, including Article 18 of the UN Declaration of Human Rights and Article 18 of the International Covenant on Civil and Political Rights.

The report suggested that the US government should put religious freedom and human rights at the heart of all trade, aid and diplomatic interactions with India.

“India is a religiously diverse and democratic society with a Constitution that provides legal equality for its citizens irrespective of their religion and prohibits religion-based discrimination,” said USCIRF chair Thomas J. Reese.

“However, the reality is far different… India’s pluralistic tradition faces serious challenges in a number of its states.”

“During the past few years, religious tolerance has deteriorated and religious freedom violations have increased in some areas of India. To reverse this negative trajectory, the Indian and state governments must align theirs laws with both the country’s constitutional commitments and international human rights standards,” he said.

The report stated that India faces serious challenges to both its pluralistic traditions and its religious minorities. “Muslims, Christians, Sikhs, and Jains generally are fearful of what the future portends. Dalits also are increasingly being attacked and harassed”.

“The Indian government-at both the national and state levels-often ignores its constitutional commitments to protect the rights of religious minorities. National and state laws are used to violate the religious freedom of minority communities; however, very little is known about the laws,” it said.

It stated that the states of Uttar Pradesh, Andhra Pradesh, Bihar, Chhattisgarh, Gujarat, Odisha, Karnataka, Madhya Pradesh, Maharashtra, and Rajasthan tend to have the greatest number of incidents of religiously-motivated attacks and communal violence, as well as the largest religious minority populations.

Quoting India’s Home Ministry figures, it said that in 2015, India experienced a 17% increase in communal violence, when compared to the previous year. In 2015, there were 751 reported incidents of communal violence, up from 644 in 2014.

The report recommended the US government to urge the Indian government to push its states that have adopted anti-conversion laws to repeal or amend them to conform to international norms.

It further urged the Indian government to immediately lift its sanctions against non-governmental organisations working for the welfare of the minorities in India.

“Identify Hindutva groups that raise funds from US citizens and support hate campaigns in India. Such groups should be banned from operating in the United States if they are found to spread hatred against religious minorities in India,” it said.

The report further stated that Indian government should reform the anti-conversion laws and appreciate that “both conversion and reconversion by use of force, fraud, or allurement are equally bad and infringe upon a person’s freedom of conscience”.

It said that India should not impose Hindu personal status laws on Sikh, Buddhist, and Jain communities, but instead provide them with a provision of personal status laws as per their distinct religious beliefs and practices.

It recommended that India adopt the International Convention on the Elimination of All Forms of Racial Discrimination.

“Operationalise the term ‘minority’ in its federal laws and comply with the United Nations Declaration on the Rights of Persons Belonging to National or Ethnic, Religious, and Linguistic Minorities.

“Drop Explanation II in Article 25 of its constitution and recognize Sikhism, Buddhism, and Jainism as distinct religions with their own separate religious identities.

Lastly, it said that India should also not impose Hindu personal status laws on Sikh, Buddhist, and Jain communities, but instead provide them with a provision of personal status laws as per their distinct religious beliefs and practices.

India requests UK High Commission for Vijay Mallya’s extradition

New Delhi: The Ministry of External Affairs (MEA) on Thursday informed that India has on Wednesday handed over the request for extradition of embattled business tycoon Vijay Mallya received from the Central Bureau of Investigation (CBI) to the United Kingdom High Commission.

“We have today handed over the request for extradition of Vijay Mallya as received from the CBI to the UK High Commission in New Delhi,” MEA official spokesperson Vikas Swarup told the media.

Mallya left for the UK last year after facing heat for defaulting on loans worth Rs 9,000 crore.

Under the laws of extradition, a host country is expected to ship back a man wanted for a crime in his own country.

The Centre has signalled its intention to frame a law that stops loan defaulters from fleeing the country and another to seize the assets they leave behind.

Mallya — who has called his stay in the UK since last April a “forced exile” — has denied the charges against him.

The CBI last month filed charges against Mallya, his now defunct Kingfisher Airlines and nine other executives and bankers, alleging he dishonestly induced the delivery of property and illegally obtained pecuniary advantage — charges that can carry a sentence of up to seven years in prison.

In April last year, the Indian government cancelled Mallya’s passport but despite a warrant for his arrest the UK turned down a request to deport him on the grounds that he had entered Britain with a valid passport.

Mumbai: The Shiv Sena today hailed the development works done by successive Congress governments at the Centre and again targeted Prime Minister Narendra Modi, saying he is not ready to admit the “chaos” created by the note ban exercise.

 

About Modi’s “raincoat” remark against former Prime Minister Manmohan Singh, it said being in power with the corrupt is also corruption. But for the work done by the Congress governments, Modi would be governing a backward nation in Africa, an editorial in Sena mouthpiece ‘Saamana’ said.

“Modi is not ready to accept the chaos demonetisation has caused. His personal advertisement machinery tries to hide every wrong policy of his government and leaves no stone unturned to attack the Congress. Modi should come out of this negative perception now,” it said.

“Even if one believes the Congress governed while indulging in corruption, it transformed the nation, which could not even produce a needle during Independence, to one that is at the forefront of economic and industrial development. The previous rulers have made India what it is today,” it said.

Referring to Modi’s “raincoat” remark, it said being in power with the corrupt is also corruption. Therefore, even if one wears a raincoat and bathes, the body is bound to get wet.

“Today, if you do not believe with closed eyes that the previous government only indulged in corruption, you will be termed as an anti-national and killed,” the ruling alliance partner said sarcastically.

Referring to Indira Gandhi, the Sena said the former Prime Minister taught Pakistan a lesson in the 1971 war, never displayed a hypocritical stand on anti-nationals, did not trouble the poor by demonetising currency notes and was thus nicknamed ‘Durga’ by Atal Bihari Vajpayee.

“Her strong will was the nation’s shield. She nationalised banks, made better the nation’s economy, gunned down Khalistani terrorists and gave the message that India will not bend before terrorists. She sacrificed her life for the nation,” it said.

Eulogising Rajiv Gandhi, the Sena said, “He had the will to govern by clean means. He may have got the taint of Bofors, but he has to be credited with bringing computers to India. The development of technology today is only because he laid a strong foundation.”

“Narasimha Rao and Manmohan Singh were successful in saving the nation from economic imbalance. Had all this not happened in the last 60 years, Modi would today be governing a nation like Somalia or Burundi,” it said.

Sasikala sacks AIADMK Presidium Chairman Madusudanan

Chennai: Sending a strong message to her detractors, AIADMK General Secretary V K Sasikala today sacked party Presidium Chairman E Madusudanan from the primary membership, a day after he switched over to the rebel camp led by Chief Minister O Panneerselvam.

Madusudanan had been removed from all posts besides the primary membership for going against the party principles and bringing disrepute to it, she said in a statement here.

She also announced the appointment of former minister K A Sengottaiyan as the new AIADMK Presidium Chairman. Sengottaiyan was relieved as the party’s Organisation Secretary, a post to which he was appointed last week.

Sasikala urged the party workers not to have any truck with Madusudanan and said they should extend their cooperation to Sengottaiyan. Giving a major boost to the rival camp, Madusudanan yesterday extended his support to Panneerselvam, saying “he wanted to “safeguard” the party.

“To protect AIADMK, everybody should join hands with OPS (Panneerselvam),” he had said.

Sasikala had removed Panneerselvam from the Treasurer post immediately after his revolt, but he has maintained that being a temporary General Secretary, she does not have the powers to appoint or remove party functionaries.

Sasikala had appointed another senior leader Dindigul C Srinivasan as the Treasurer.

Insisting that he continued to be the Treasurer, Panneerselvam had on Feb 8 written to two banks here asking them not to allow anyone else to operate the party’s accounts.

Police arrest 2 Kerala youths for fake bomb threat at Bengaluru Airport

Bengaluru: The police arrest two youth from Kerala in connection with fake bomb threat in Kochi bound domestic Air Asia flight. According to the sources, the Alappuzha district based youths Arjun and Neha Gopinathan called Bengaluru international airport manager threatening a bomb has been planted in Kochi bound flight which was scheduled to depart from Bengaluru international airport to Kochi on late evening hours of Wednesday.

Based on the call received, the security officials checked each and every inch of the flight and didn’t find any suspicious material in it. After a detailed search, the flight was departed to Kochi in the early hours on Thursday.

The call was found fake as the security personnel didn’t find anything in the flight. After an inquiry, the police found that the call was from a public telephone booth located at Alappuzha in Kerala state. Later, the police arrested the accused for further inquiry on Thursday in connection with fake bomb threat.

A Malaysian ship carrying 2,300 tonnes of aid for tens of thousands of persecuted Rohingya Muslims arrived in Yangon where it was met by Buddhist protesters.

Health workers and activists crowded onto the deck of the Nautical Aliya as it docked at Thilawa port near Myanmar’s commercial capital on Thursday carrying food, medical aid, and clothing.

Myanmar’s social welfare minister was among a delegation meeting the ship, which has been at the centre of a rare diplomatic spat with fellow ASEAN member Malaysia.

Outside the docking area, dozens of Buddhist monks and demonstrators waited waving national flags and signs reading: “No Rohingya”.

“We want to let them know that we have no Rohingya here,” a Buddhist monk named Thuseitta, from the Yangon chapter of the Patriotic Myanmar Monks Union, told AFP news agency.

Myanmar denies citizenship to the million-strong Rohingya, despite many of them living on its soil for generations.

Buddhist nationalist groups are especially strong in their vitriol, rejecting Rohingya as illegal immigrants from neighbouring Bangladesh.

Hundreds of Rohingya have reportedly been killed in a brutal campaign launched by security forces in October, which the United Nations says may amount to ethnic cleansing.

The violence started after a series of attacks by armed men on border posts killed nine policemen.

Tens of thousands of Rohingya have fled to neighbouring Bangladesh, bringing harrowing tales of murder and sexual assault.

“We’ve document atrocities, serious crimes that have been committed by Myanmar’s security forces,” Matthew Smith, executive director of the group Fortify Rights, told Al Jazeera.

“We’re documenting killings, we’re documenting mass rape … throats being slit, bodies being thrown into fires, villages burned to the ground.”

Myanmar’s treatment of the Rohingya has sparked criticism from Muslim-majority Malaysia in a rare spat between the Southeast Asian neighbours.

Myanmar initially refused to allow the aid ship into its waters and has barred it from sailing to Rakhine’s state capital, Sittwe.

Al Jazeera’s Yaara Bou Melhem, reporting from Yangon, said the aid will be unloaded and distributed by the government from there.

“What we know is that a plane from here in Yangon will take the aid to Sittwe, which is nearest to the conflict zone … to distribute the aid among both Rohingya and Buddists,” she said.

“There’s no clear indication the aid will reach the Rohingya, because the area has been in lockdown since the renewed fighting began in October.”

The delivery comes days after a blistering report from the UN accused Myanmar’s security forces of carrying out a campaign of rape, torture, and mass killings against the Rohingya.

Based on interviews with hundreds of escapees in Bangladesh, investigators said the military’s “calculated policy of terror” likely amounted to ethnic cleansing.

For months, Myanmar has dismissed similar testimonies gathered by foreign media and rights groups as “fake news” and curtailed access to the region.
