Nasheman News : Ousted CBI chief Alok Verma resigned on Friday, a day after he was shifted from the post by a high-level committee chaired by Prime Minister Narendra Modi.

Verma, who was transferred as Director General, Fire Services, Civil Defence and Home Guards, refused to take up the new job and instead sent his resignation to the government.

“… Also, it may be noted that the undersigned would have already superannuated as on July 31, 2017 and was only serving the government as Director, CBI, till January 31, 2019, as the same was a fixed tenure role. 

“The undersigned is no longer Director, CBI, and has already crossed his superannuation age for DG Fire Services, Civil Defence and Home Guards. Accordingly, the undersigned may be deemed as superannuated with effect from today,” he said in his letter to Personnel Secretary Chandramouli C. 

Verma’s two-year tenure as CBI chief was to expire on January 31. 

Nasheman News : While welcoming the decision to ensure 10 per cent reservation in jobs to economically backward sections in the general category, the Sikkim Democratic Front (SDF) on Friday expressed doubts over its proper implementation, saying there was a “political motive”.

“We welcome it. However, I must say the cut-off of Rs 8 lakh per year is pretty high,” SDF spokesman and Sikkim’s sole Lok Sabha member P.D. Rai told IANS, reacting to the Rajya Sabha clearing the legislation.

He said the certification process will also be “highly problematic”.

“The reservation will be very dynamic in the sense that people will be in and out of the cut-off. Now, consider a case where a person has a job which is within the cut-off, but then he lands another job which is above the threshold. How will the authorities come to know of it?”

“Do we keep a monitor? Who will give the certificates?” he asked.

Rai, a passout from IIT Kanpur and IIM Ahmedabad, said he was not certain whether the latest reservation decision would withstand judicial scrutiny.

He referred to former Chief Justice of India A.M. Ahmadi, who has dubbed the move as “directly in conflict” with the Supreme Court’s judgement capping caste-based reservation at 50 per cent.

“I’m not a lawyer. But I find Justice Ahmadi (who was part of the 1992 bench that put the cap on caste-based reservation) has said that the decision is against the grain of the Supreme Court judgement. Also, legal luminaries have spoken out against it. So I am not sure if it would stand judicial scrutiny,” Rai said.

According to Rai, after losing Assembly polls in Rajasthan, Madhya Pradesh and Chhattisgarh, Prime Minister Narendra Modi might be of the opinion that the reservation decision will be his trump card to win the upcoming Lok Sabha polls.

“He is entitled to his thoughts, facts can be otherwise,” he said.

Rai also described as “secretive” the way the Modi government went about the legislation.

“Another aspect is the great secrecy with which this was brought up, the secretive way in which it was passed by the Union Cabinet. The opposition was not given adequate time to debate the Bill or get their act together in terms of preparing for the debate.

“All these developments taken together are indicative of a political motive behind the decision,” he added.

In this context, Rai pointed out that the P.K. Chamling government in Sikkim has done much in ensuring an equitable distribution of resources.

“We are quite happy that in Sikkim we have done so much by way of social justice. Everyone has got access some way or the other not only to resources, but also on priority basis,” he said. 

Nasheman News : As protests against the Citizenship (Amendment) Bill 2016 continued in Assam, a group of agitators vandalised a BJP office near here, police said on Friday.

The agitators belonging to Oikya Sena Asom on Thursday night vandalised the office in Palashbari area.

The police said the protesters set fire to the effigies of Prime Minister Narendra Modi, Assam Chief Minister Sarbananda Sonowal, and also blocked the national highway shouting slogans against the BJP-led NDA government.

Later, the police took the agitators into custody.

Assam has witness protests since the Union Cabinet on Monday approved the Bill that aims to amend the Citizenship Act, 1955, to make illegal migrants who are Hindus, Sikhs, Buddhists, Jains, Parsis and Christians from Afghanistan, Bangladesh and Pakistan eligible for citizenship of India, after a Joint Parliamentary Committee submitted its recommendations to the Lok Sabha.

While the Asom Gana Parishad (AGP) has snapped its ties with the BJP over the Bill and it’s three ministers resigned, four members of the Central government nominated high powered committee to implement Clause 6 of Assam Accord have also declined to be participate.

On Tuesday, the northeastern states observed a total shutdown in protest.

Nasheman News : Bahujan Samaj Party (BSP) supremo Mayawati and Samajwadi Party (SP) chief Akhilesh Yadav will hold a joint press conference here on Saturday, an official said on Friday.

According to the press invite, jointly signed by SP national general secretary Rajendra Chowdhary and BSP’s national general secretary Satish Chandra Mishra, the joint-presser will be held at the five-star hotel Taj.

Sources told IANS that with the blueprint between the two parties ready, the top leaders might announce the formalisation of the alliance for the upcoming Lok Sabha polls but also share the seat sharing formula.

Four-time Uttar Pradesh Chief Minister Mayawati, flew into Lucknow late Thursday an is likely to deliberate with her party leaders on Friday, before sealing the deal with SP.

The sources said that while the mining scam and its repercussions on the alliance were still to be thrashed out, the deal is “almost done”.

A senior party leader said that while the SP and BSP will share 37 seats each, they will leave two for Ajit Singh’s Rashtriya Lok Dal (RLD).

The alliance might also leave two seats – Amethi and Rae Bareilly for the Congress.

These two seats are pocket boroughs of the Congress and sends party President Rahul Gandhi and UPA chairperson Sonia Gandhi to Lok Sabha.

Nasheman News : India and the US on Thursday discussed the ongoing peace process in Afghanistan during a meeting between External Affairs Minister Sushm Swaraj and US President Donald Trump’s Special Envoy on Afghanistan Zalmay Khalilzad here.

“Both sides shared their perspectives on peace and reconciliation efforts in Afghanistan,” External Affairs Ministry spokesperson Raveesh Kumar tweeted soon after the meeting.

Thursday’s meeting comes after Trump earlier this month said that India was not doing enough for peace and stability in Afghanistan.

India hit back with sources here saying that New Delhi does not send troops abroad except under a specific UN mandate.

Pointing out that India plays a significant role as a development partner in Afghanistan, the sources said this partnership was built on the specific needs and requirements worked out with the Afghan government.

Khalilzad’s visit for an intra-Afghan political settlement reflects New Delhi’s stand that it is is for an “Afghan-owned, Afghan-led and Afghan-controlled” peace and reconciliation process.

Khalilzad is leading an inter-agency delegation to India, China, Afghanistan, and Pakistan from January 8-21

Earlier in the day, former Afghan President Hamid Karzai said that India’s role is needed in the war-ravaged country’s peace process.

“India and Afghanistan share an amazing relationship, an almost romantic one,” Karzai said in response to a question during a session in the Raisina Dialogue, India’s flagship annual geopolitical and geostrategic conference, here.

“Most of the Afghan people view in such good light… We want India to do as much as possible,” he said.

Stating that India is the “greatest contributor” to Afghanistan, Karzai said that it should play its role in the peace process on its own detached from other countries.

He said that an Afghan-owned, Afghan-led peace process is one in which the Taliban, along with other stakeholders, sit down for dialogue.

“It means truly the leadership of Afghanistan,” the former President said.

He said till now there have been three peace processes in Afghanistan – first by China, the US, Pakistan and Afghanistan, then by Russia engaging with the Taliban, and now the latest one with Trump appointing Khalilzad as his Special Envoy for Afghanistan.

“We have tremendous hope for the peace process (with Khalilzad’s role) to succeed,” Karzai said.

“Khalilzad himself is an Afghan and understands us, knows what peace means for us.”

Nasheman News :A day after he resumed duties, CBI Director Alok Verma was on Thursday unceremoniously removed from the post after a 2-1 decision by the high-level Selection Committee, a decision that came under attack from the opposition and legal experts.

The decision of the committee came after CJI nominee Justice A.K. Sikri of the Supreme Court sided with the government that Verma should be shunted out of the post on the basis of the findings of the Central Vigilance Commission (CVC), which went into some allegations levelled against him. 

The meeting was attended by Prime Minister Narendra Modi, Justice Sikri and Leader of Congress in the Lok Sabha Mallikarjun Kharge, the other member of the committee, who gave a dissent note and opposed the majority decision.

Shortly after the meeting, Verma was appointed Director General, Fire Services, Civil Defence and Home Guard till January 31 when his tenure would end.

The government also brought back M. Nageswara Rao, Additional Director, CBI to look after the duties of the Director, CBI till the appointment of a new Director or until further orders, whichever is earlier, a notification by the Appointment Committee of Cabinet said.

Verma, who was removed from the agency’s helm on the midnight of October 23 after his fight with Special Director Rakesh Asthana became public, was reinstated on Tuesday by the apex court on the ground that the government cannot transfer or alter the duties of the CBI chief without going to the Selection Committee.

The committee’s members are the Prime Minister, leader of the largest opposition group and the Chief Justice of India. Chief Justice Ranjan Gogoi, who heard the case arising out of Verma’s challenge against the government decision, nominated Justice Sikri as his nominee to attend the committee meeting. 

The Supreme Court, while reinstating Verma, had said that the Committee should meet within a week and decide the issue afresh. 

Modi convened the meeting of the committee on Wednesday but Kharge sought the CVC report on the allegations against Verma and also time to study it. The committee met briefly and decided to meet on Thursday. 

Sources said the Committee took into account the “extremely serious” nature of observations made by the Central Vigilance Commission against Verma.

It was of the view that being the head of a very sensitive organisation, Verma was not functioning with the integrity expected of him, they said. 

They said the CVC found evidence of influencing of investigation in the Moin Qureshi case. There was also evidence of taking of bribe of Rs. 2 crore. The CVC was of the view that his conduct in the case is suspicious, and there is a prima facie case against him. 

“The CVC also felt that the entire truth will come out if a criminal investigation is ordered,” the sources said citing the Committee’s view. 

In the IRCTC case related to former Railway Minister Lalu Prasad, the CVC felt that it can be reasonably concluded that Verma “deliberately” excluded a name from the FIR for reasons best known to him.

The CVC found evidence against Verma in several other cases as well. The CVC also found instances of wilful non-production of record, and fabrication of record. The Committee also took note of Verma’s attempts to induct officers of doubtful integrity in the CBI.

On the criticism that Verma was not given an opportunity of being heard on the charges against him, the sources said Verma was given an opportunity to present his case before the CVC in the presence of retired Justice A. K. Patnaik. 

The Supreme Court also provided a copy of the CVC report to Verma’s advocate. The mandate of the Selection Panel headed by the PM is limited to the appointment of the CBI chief and transfer of the CBI chief, the sources said.

The Committee felt that as a detailed investigation, including criminal investigation, was necessary in some cases his continuation as CBI Director was not desirable and he should be transferred.

In his dissent note, Kharge demanded that the Committee restore to Verma the full powers he enjoyed by the office of the Director CBI to ensure proper functioning of the organisation and to restore normalcy. He also sought an additional period of 77 days being the number of days lost by him on account of the “patently illegal” orders of the CVC and the personnel department on October 28. 

Kharge said an independent investigation must be carried out to verify the actual events that took place on the night of October 23-24 with respect to Verma’s removal as CBI Director. 

Referring to the events of the midnight drama in October and the way the government hastened the exit of Verma would “point to the fact that the entire exercise was in furtherance of a pre-meditated decision to remove Verma as CBi Director with reasons and processes being manufactured as an afterthought”. 

He urged the Committee to allow Verma to explain himself before it on the charges against him before any decision is taken in the matter. 

Kharge also listed the various allegations made against Verma including influencing the investigation by taking bribe and illegal delay in finalising the probe report in a bank fraud case which were not substantiated, Kharge also listed and said in the light of the above it would be grossly unfair not to restore Verma to the post of the CBI chief and compensating for the loss of 77 days by extending his tenure by that period. 

Meanwhile, the removal of Verma as CBI Director came under severe attack from opposition parties and legal experts saying it was the “desperation” of the government as Modi does not want any probe into the Rafale jet deal.

The critics of the decision also asked how the committee could take a decision without hearing Verma.

The Congress criticised the committee’s decision and said Modi had shown that he was “too afraid” of an investigation into the Rafale deal. 

“By removing Alok Verma from his position without giving him the chance to present his case, PM Modi has shown once again that he’s too afraid of an investigation, either by an independent CBI Director or by Parliament via JPC,” the Congress tweeted. 

BJP leader Subramanian Swamy said if it was a majority decision to remove Verma, then it was unfortunate. “I don’t know why Verma was not asked to reply to the charges against him. I have very poor opinion of the CVC,” he said.

Senior lawyer Prashant Bhushan saw a conflict of interest in the role of the Prime Minister, who is part of the three-member committee that also has Leader of the Congress group in the Lok Sabha Mallikarjun Kharge and the CJI nominated representative Justice A.K. Sikri of the Supreme Court.

Nasheman News :Continuing with the trend of trusting the old guard, the Congress on Thursday appointed former Chief Minister Sheila Dikshit as the new President of Delhi Congress.

The 80-year-old and three-time Delhi Chief Minister, succeeded Ajay Maken, who quit as the Delhi Congress president on January 4 citing health reasons. 

“Congress President Rahul Gandhi has appointed Sheila Dikshit as the new Delhi Congress president,” party leader P.C. Chacko told the media here. 

The Congress also announced the appointments of Rajesh Lilothia, Devender Yadav and Haroon Yusuf as Delhi unit’s Working Presidents.

The longest serving Chief Minister of Delhi, from 1998 to 2013, Dikshit said she was honoured at being given the responsibility. 

While asserting the Congress’ revival in Delhi, where currently it has no representation in the Assembly, Dikshit remained evasive about the probability of the party forging an alliance particularity with Delhi’s ruling Aam Aadmi Party (AAP) in the Lok Sabha polls. 

“We will talk after it happens,” she said when asked about such an alliance. 

“I have no opinion about the alliance just now. And I do not want to share anything right now to anybody. Let me first understand the situation right from the top to down and then only I can say anything,” she added. 

Former AAP leader and journalist Ashutosh recently claimed that the AAP and Congress are likely to fight the upcoming Lok Sabha polls in Delhi, saying that AAP supremo and Chief Minister Arvind Kejriwal was desirous of such an alliance. 

“Kejriwal wants an alliance with Congress. He has been pushing for it for the past one year. Some other parties have also worked as communication channels for AAP and Congress,” Ashotosh had written for satyahindi.com, a news portal he co-founded.

Earlier Dikshit too had said that she will “not question” if the party leadership decided to align with the AAP. 

Congratulating Dikshit, Maken in a tweet exuded confidence of the party playing a “role of a strong opposition” to the Narendra Modi government at the Centre and the Arvind Kejriwal government in Delhi.

The security cover of Punjab Local Bodies Minister Navjot Singh Sidhu has been upgraded to Z-Plus and a bullet-proof Land Cruiser has been given to him by the state government.

The Amarinder Singh government has also written to the Ministry of Home Affairs (MHA) to provide him Central Armed Police Forces (CAPF) security cover in wake of threats issued to him by Right-wing groups.

Sources said the number of security personnel provided to the Congress leader has been doubled from present 12.

Punjab’s Additional Chief Secretary (Home and Justice) Nirmaljeet Singh Kalsi has written to Union Home Secretary Rajiv Gauba saying Sidhu has developed a very acrimonious relationship with the Shiromani Akali Dal over his criticism of their alleged anti-people policies and support to mafia and criminal elements. He has also earned the wrath of the drug and mining mafia and criminals, especially in the Majha region, due to his high-pitched campaign against them, it states.

In July last year, Dera Sacha Sauda followers had threatened Sidhu for his comments against Dera chief.

“The threat perception is only likely to escalate further in view of his strident and continuous criticism of policies of the opposition parties as well as that of activities of Right-wing groups,” the letter stated.

In view of such, the state government recommended that Sidhu be provided CAPF security cover, preferably by the CISF. His threat perception has increased significantly after his visit to Pakistan to attend the swearing-in-ceremony of Imran Khan, where he hugged the Pakistan Army Chief,” the letter stated.
