London: Vijay Mallya assets freeze order in UK courts until April 2018

London: Vijay Mallya, who is undergoing an extradition trial in a UK court over Rs 9,000-crore fraud and money laundering charges, will face next year a parallel litigation brought by 13 Indian banks to freeze nearly USD 1.5 billion of his assets.

According to court documents submitted at the UK High Court, the claim brought by the Indian banks against the 61- year-old embattled liquor baron will come up for a hearing in April next year.

“The First Respondent’s (Mallya) application to set aside the Freezing Injunction is to be set down for hearing on the first available date after 11 April 2018 with a time estimate of 2 days,” states the court document.

The litigation in the Queen’s Bench Division of the commercial court in England’s High Court of Justice lists the State Bank of India, Bank of Baroda, Corporation Bank, Federal Bank Ltd, IDBI Bank, Indian Overseas Bank, Jammu & Kashmir Bank, Punjab & Sind Bank, Punjab National Bank, State Bank of Mysore, UCO Bank, United Bank of India and JM Financial Asset Reconstruction Co. Pvt Ltd as the applicants.

Mallya and related concerns Ladywalk LLP, Rose Capital Ventures Ltd and Orange India Holdings are listed as respondents.

The claim, dated November 23, relates to a judgment of the Debt Recovery Tribunal (DRT) in Karnataka dated January 19 this year, which concluded that Mallya was “liable” to the banks in the sum of INR 62,033,503,879.42 plus interest and as at November 22, that judgment sum is “still unsatisfied as to INR 98,530,512,249.42”.

The “freezing order” involves Mallya and related concerns being “restrained until further order, from removing from the jurisdiction any of their assets in the jurisdiction up to a limit of 1,145,000,000 pounds and in any way disposing of, dealing with or diminishing the value of any of their assets whether they are inside or outside the jurisdiction up to the same value”.

The UK court had upheld the Indian courts injunction last week and given Mallya’s lawyers more time to respond due to the ongoing extradition trial at Westminster Magistrates Court, which is now expected to conclude on December 20.

A ruling in the extradition case is expected a few weeks later, by mid-January.

Meanwhile, Mallya remains on a 650,000-pound bail bond since his arrest on an extradition warrant by Scotland Yard in April this year.

Since December 4, he has been in court over five days of hearings to establish if he can be forced to return to India to face charges of fraud and money laundering involving his now-defunct Kingfisher Airlines default of bank loans worth nearly Rs 9,000-crore.

The Crown Prosecution Service (CPS), representing the Indian government, has claimed that the evidence they have presented confirms “dishonesty” on the part of the businessman, who acquired the loans through misrepresentation and had no intentions of repaying them.

Mallya’s defence team has been deposing a series of expert witnesses to try and establish that the default by Kingfisher Airlines was the result of business failure within a wider context of a global financial crisis and that its owner had no “fraudulent” intentions.

The extradition case returns for one of its final hearings today, when Judge Emma Arbuthnot is set to hear the testimony of prisons expert Dr Alan Mitchell, who is expected to critique Indian jail conditions as a potential “bar to extradition”.

The CPS will need to demonstrate a prima facie case to show that the criminal charges against Mallya, for which his extradition is sought, are justified.

The defence, on the other hand, will try and prove that the businessman will not get a fair trial in India because the case against him is “politically motivated”.

EC has become Modi’s ‘captive puppet’: Congress

New Delhi: The Congress on Thursday accused the Election Commission of becoming a “captive puppet” in the hands of Prime Minister Narendra Modi, who it said was brazenly breaking rules in a final bid to save the BJP’s “sinking ship” in Gujarat.

Charging the poll panel with not acting on Congress complaints against the BJP and Modi, the party said the poll panel was turning a blind eye to democratic and constitutional norms being violated by the ruling party openly.

The Congress denounced Modi’s “roadshow” after he voted in Ahmedabad on Thursday. This, it said, was a flagrant violation of the model code of conduct.

“It was an election campaign. Modi’s roadshow after casting vote is a clear case of violation of the model code of conduct. The Election Commission, it seems, is working under pressure from the Prime Minister and PMO,” Congress leader Ashok Gehlot said.

“If any shame is left in the Election Commission, it should act on the Congress complaints,” party spokesperson Randeep Surjewala told reporters here.

“It seems the Election Commission is blind. They cannot see Modi openly and brazenly violating the model code of conduct.

“This shows how unfortunately the Election Commission has become a captive puppet of the BJP,” Surjewala said.

“The Election Commission has different standards for the BJP and the Congress. What is the reason for the Election Commission to behave like a front organisation of the BJP?”

“When Rahul Gandhi gave interview to news channels, a notice was sent to him. But when Arun Jaitely released BJP’s manifesto on December 8, it was not a violation. When Modi appealed to people on December 9 to vote… it was not a violation. No notices were sent to them. The Election Commission remained silent then,” he said.

“Amit Shah using the Ahmedabad Airport to hold a press conference was not a violation? Arun Jaitley holding a press conference in Ahmedabad and one union minister (Piyush Goyal) holding a press conference in Delhi twice was not a violation?”

He alleged that Amit Shah was aware a case was being filed by the poll panel against the news channels for airing Gandhi’s interview much before it was announced.

“The EC was receiving orders from the PMO. Several ministers were calling the journalists and threatening them.”

Surjewala said when the Congress asked the poll panel about its complaints, it was told they would be looked into after 5 p.m. — when the second and final phase of Gujarat election would end.

“The Chief Election Commissioner (A.K. Joti), who was Chief Secretary to Modi (when he was Chief Minister of Gujarat), is still acting as the Chief Secretary to Modiji. This is shameful for the Election Commission.”

The Congress said the way the BJP was behaving showed Modi had conceded defeat in Gujarat.

Replying to questions, Surjewala said either the Commission was blindfolded or sleeping.

He said on Wednesday, the Congress sought an appointment with the Election Commission around 4.30 p.m. and was told the meeting would take place on Thursday morning.

“It was only after we threatened to stage a ‘dharna’ we were given an appointment at 10.15 at night,” he said.

“We are trying to wake up the Election Commission. We appeal to the Election Commission not to turn blind and deaf.”

Putin orders beginning of withdrawal from Syria

Russian President Vladimir Putin has made a surprise visit to a Russian base in Syria and ordered his troops to start withdrawing from the war-torn country.

Syrian state TV reported that Syrian President Bashar al-Assad met with Putin at Khmeimim Air Base, southeast of Latakia, on Monday morning.

Russia’s state news agency Novosti cited Putin as saying that “in general, the combat work in this territory is completed by the complete eradication of terrorists”.

Putin made the stop in Syria on his way to Egypt, where he met with President Abdel Fattah el-Sisi later on Monday.

As the Syrian government’s main ally in the war, Russia started its intervention in September 2015, after an official request by the Syrian government for military help against rebel groups.

Since then, Russia mainly conducted air strikes against groups opposed to the government, including the Syrian National Coalition, the Islamic State of Iraq and the Levant (ISIL), al-Nusra Front, and others.

In addition, Russian military advisors and special operations forces are stationed in Syria. Prior to the intervention, Russian involvement in the war had mainly consisted of supplying the Syrian army.

‘Saving Syria’
In November, Assad thanked Putin for “saving” his country and for Russia’s support in Syria.

The two heads of state met for talks in the Russian Black Sea resort of Sochi on November 22 to discuss the fight against “terrorism” and the possibilities for a political settlement in Syria, which has entered its seventh year of war.

After the meeting, Assad in a statement expressed his readiness to hold discussions with parties interested in resolving the conflict.

In response, Putin commended Assad’s cooperation.

Last month, various factions, including the Syrian government and opposition groups, met in Kazakhstan’s capital, Astana, for talks aimed at implementing a lasting ceasefire agreement.

International initiatives to end the war over the years include an attempt at establishing four “de-escalation zones” across the country, with Russia, Turkey and Iran acting as guarantors.

To date, some 465,000 people have died in the conflict, and more than 12 million Syrians have been displaced.

Gujarat elections: Pakistan tells India don’t drag us into your politics

Islamabad: Pakistan on Monday said India’s politicians should not drag the country into its domestic politics during campaigning for the Gujarat assembly polls.

“India should stop dragging Pakistan into its electoral debate and win victories on own strength rather than fabricated conspiracies, which are utterly baseless and irresponsible,” Pakistan’s Foreign Office spokesman Mohammad Faisal said on Twitter.

Prime Minister Narendra Modi on Sunday claimed at an election rally that there was an attempt by Pakistan to interfere in the Gujarat polls. Modi also raised questions about the alleged appeal by former director general (DG) of the Pakistan Army Sardar Arshad Rafiq for making senior Congress leader Ahmed Patel chief minister of Gujarat.

Modi alleged that Congress leader Mani Shankar Aiyar had held a meeting at his house which was attended by former prime minister Manmohan Singh, a former Indian vice president, Pakistan’s high commissioner in India, and a former Pakistani foreign minister.

“On one hand, Pakistan Army’s former DG is interfering in Gujarat’s election, and on the other, Pakistani people are holding a meeting at Mani Shankar Aiyar’s house. After that meeting, people of Gujarat, backward communities, poor people and Modi were insulted.

Don’t you think such events raise doubts?” the prime minister had said while addressing a poll rally in Gujarat.

India ranks 109 in mobile internet speed: Report

New Delhi: India is ranked 109th in the mobile internet speed and 76th for fixed broadband speed globally, which is a 15 per cent increase, according to data from Ooklas November Speedtest Global Index.

“At the start of 2017, the average mobile download speed in India was 7.65 Mbps. Heading into the end of the year, average mobile download speed is 8.80 Mbps as of November. That’s a 15 per cent increase,” a statement said here on Monday.

“While mobile speeds increased modestly, fixed broadband speeds increased dramatically. Average fixed broadband download speed in January was 12.12 Mbps. As of November, it’s at 18.82 Mbps, a close to 50 per cent jump,” it added.

As of November, Norway ranks first in the world for mobile internet with an average download speed of 62.66 Mbps. Singapore takes the top spot for fixed broadband with a 153.85 Mbps average download.

“Both mobile and fixed broadband internet in India are getting faster, that’s good news for all Indian consumers no matter which operator or plan they use to access the internet. India still has a long way to go to catch up with countries that have top speeds around the world, however, we at Ookla are highly optimistic about the capacity for growth that is available in the Indian market and look forward to watching how the market grows in this coming new year,” said Doug Suttles, Co-Founder and General Manager at Ookla.

Ookla analyses the performance of the internet in every country based on consumer-initiated tests taken by real people using Speedtest.

India to host Afghanistan for first-ever Test

India will host newly promoted Test side Afghanistan for their first-ever Test match, the Board of Control for Cricket in India (BCCI) announced on Monday.

The dates of the historic Test will be chalked out later, BCCI acting Secretary Amitabh Choudhary announced after a Special General Meeting here.

He said India will also host 81 matches across all the three formats from 2019 to 2023 according to the new Future Tours Programme (FTP).

“Afghans were scheduled to play their first Test in 2019 versus Australia but considering the historic relationship between India and Afghanistan, we decided to host their first Test,” Choudhary told reporters.

The next FTP cycle at home will include high-profile series against England, South Africa and Australia.

Among other important decisions taken at the SGM were lifting the ban on the Rajasthan Cricket Association, provided former IPL czar Lalit Modi stays away from its functioning.

“Yes, the ban on the RCA has been lifted but with certain conditions,” BCCI acting President C.K. Khanna told IANS.

The RCA was suspended by the Indian cricket board in May 2014 when ex-Indian Premier League (IPL) Commissioner Modi was re-elected its president.

Since its suspension in 2014, RCA’s cricket affairs are being looked after by the BCCI.

The RCA filed a suit against its suspension by the BCCI, to which the board had asked the association to withdraw all pending cases and not to involve the cricket board in any case.

The Supreme Court-appointed Committee of Administrators (CoA) already dissolved the ad-hoc committee that was constituted to run the affairs in Rajasthan cricket, paving the way for the ban to go.

The BCCI also decided against coming under the jurisdiction of the National Anti-Doping Agency (NADA) and reiterated that it already follows the regulations laid down by World Anti Doping Agency (WADA).

Rahul Gandhi elected Congress President

New Delhi: Rahul Gandhi has been elected unopposed as Congress president, party’s central election authority head Mullappally Ramachandran announced on Monday.

Rahul Gandhi will collect the certificate formally declaring his ascension to the post on December 16, he told reporters here. The 47-year-old scion of the Nehru-Gandhi family was the lone candidate in the fray. He is the sixth member of the Nehru-Gandhi family to take over the top post

Rahul Gandhi succeeds his mother Sonia Gandhi, who remained in the post for 19 years. The CEA received a total of 89 nomination papers proposing Rahul Gandhi’s name for the top post.

All the nomination papers were found to be valid, Ramachandran said.

“Since the withdrawal of date/time is over and as there is only one candidate (Rahul), as per Article XVII (d) of the Constitution of Indian National Congress, I hereby declare Shri Rahul Gandhi elected as president of the Indian National Congress,” Ramachandran said.

Rahul Gandhi became the vice-president of the party in January 2013.

Scores of Palestinians hurt as Jerusalem protests rage

Thousands of Palestinians have taken to the streets of Jerusalem, the West Bank and the Gaza Strip to protest against the US decision to recognise Jerusalem as the capital of Israel, a contentious move that has inflamed tensions in Palestine and across the region.

In the occupied West Bank, Palestinians clashed with Israeli forces in a handful of cities throughout Thursday.

Over 50 Palestinians were injured in the protests, and 16 were sent to hospital, according to local health authorities in the West Bank.

Al Jazeera’s Hoda Abdel-Hamid, reporting from Ramallah, said the clashes were dissipating after “several hours of quite vigorous confrontation between the youth and the Israeli army”.

Palestinian protesters gathered at the central Al Manara square in Ramallah and marched towards El Bireh, where they were met by Israeli troops firing tear gas and rubber bullets.

Protests were also held in Hebron, Nablus, Jenin, Tulkarem and Jericho in the West Bank, according to Anadolu news agency, as well as in East Jerusalem and the Gaza Strip.

At least four Palestinians were injured in Gaza after Israeli soldiers fired live ammunition at dozens of demonstrators who assembled east of Khan Younes, in the southern part of the coastal territory, according to Palestinian news agency, Wafa.

Trump’s ‘escalation’
Trump, ignoring warnings from the international community, announced on Wednesday that the US formally recognises Jerusalem as the capital of Israel and will begin the process of moving its embassy to the city, breaking with decades of US policy.

The decision has been condemned by world leaders who have described it as a “dangerous escalation” and a final nail in the coffin of peace negotiations between Israelis and Palestinians.

Palestinians want East Jerusalem as the capital of their future state, while Israel says the city, which is under Israeli occupation, cannot be divided.

Trump’s “announcement has the potential to send us backwards to even darker times than the ones we are already living in”, said Federica Mogherini, high representative of the European Union for foreign affairs.

In a speech in Gaza City on Thursday, Hamas leader Ismail Haniya has said the US decision is a “war declaration against Palestinians”, and called for a new Intifada, or uprising.

Haniya said US President Donald Trump’s recognition “killed” the Israeli-Palestinian peace process.

“This decision has killed the peace process, has killed the Oslo [accord], has killed the settlement process,” he said.

“The US decision is an aggression, a declaration of war on us, on the best Muslim and Christian shrines in the heart of Palestine, Jerusalem. We should work on launching an Intifada in the face of the Zionist enemy,” Haniya said.

Days of Rage
Palestinians had called for three days of rage in response to Trump’s announcement on Wednesday, and for the closure of local schools and stores.

Al Jazeera’s Harry Fawcett, reporting from East Jerusalem on Thursday, said a small-scale protest had been ongoing for most of the day outside Damascus Gate, the main entrance to the Old City.

“There has been a good deal of anger and just disbelief at what has happened overnight coming out of the White House,” he said.

Israeli police, meanwhile, attempted to break up the protest and confiscated Palestinian flags, he reported.

In Ramallah, Al Jazeera’s Abdel-Hamid said “another round of confrontations” between Palestinians and Israeli soldiers was expected on Friday.

“We expect more scenes [of] violence and unrest across the entire occupied West Bank,” she said.

Ignoring warnings
On Thursday, Mustafa Barghouti, secretary-general of the Palestinian National Initiative, told Al Jazeera from Ramallah that Trump was “joining Israel in the war crimes and in confirming the annexation of the occupied Palestinian Territories”.

“I hope that the Palestinian Authority will not accept to meet with this American team any more,” he said.

“Israel decided it wants everything. They want everything? Fine. We will also fight for everything,” he said.

“We might be talking about a popular wide uprising but non-violent one, similar to the first Intifada. That’s what we need. Israelis should see the Palestinian resistance everywhere.”

India to host senior women’s, men’s boxing World Championships

India will host the Senior Women’s World Boxing Championships next year and the Senior Men’s World Championships in 2021, Sports Minister Rajyavardhan Singh Rathore announced on Friday.

“Our boxers need more international exposure and more international tournaments need to be held in India. From now on, we will try to hold at least one high quality international boxing tournament in India every year,” he told the media.

“We need to ensure that the best boxers from the top boxing nations come and compete in India. This will help to improve our infrastructure,” Rathore added.

He went on: “We recently held the Youth Women’s World Championships and it was perhaps the best World Championships ever organised.”

Praising the Indian junior women’s boxing squad for their performance at the junior World Championships, Rathore said Indian boxers have the ability to do well at the Olympics.

Rathore was speaking a function to felicitate the Indian women’s squad which registered a tally of five gold and two bronze medals at the Youth Women’s World Championships in Guwahati last month.

“It seems that the women boxers have more prospects of winning medals at the international level. So we will try to give them the best facilities and best coaches,” he said.

Asserting that willpower and extreme dedication to training were the only way to sporting success, the Olympic silver medallist asked the young boxers to keep working hard irrespective of results.

“Earlier we used to think that only we in India have problems while foreign athletes have all the facilities. This is a fallacy. Everybody in this world have their share of what they have and don’t have,” Rathore said.

“It is willpower that wins an tournament or a match. Just having financial resources and facilities is no guarantee of sporting success. Look at the list of medal winners in Olympics and see how many corporate heads, kings and queens you can spot. The list is full of people from middle class families.

“What makes you win is your ability to pursue your passion absolutely undeterred. You have to live your passion and keep working hard irrespective of whether you win medals or not.”
