BJP to capture UP after 14-year hiatus; Cong ahead in Punjab

New Delhi: The BJP headed for a stunning victory today in Uttar Pradesh and Uttarakhand, trampling a fragmented opposition that had hoped the demonetisation exercise would have chipped away at Prime Minister Narendra Modi’s popularity.

The BJP was also locked in a close contest in Goa and Manipur with the Congress, which won the consolation prize of Punjab where it was certain to form the government.

The party was now set to return to power after a 14-year gap during which regional parties such as the SP and BSP had held sway.

“The prime minister has clearly established himself as the predominant leader in India,” said Aarti Jerath, a political analyst, on NDTV.

BJP president Amit Shah, who crafted and conducted the election strategy in UP, credited Modi and his policies for the victory. “This is the victory of the corruption-free rule and pro-poor polices under the leadership” of Modi, he tweeted.

“BJP has reached new heights in Uttarakhand and Uttar Pradesh and changed the political picture of the country,” Union Home Minister Rajnath Singh said amid scenes of jubilation at party offices in UP.

Party members danced and distributed sweets on streets and BJP offices. Women gathered in groups to watch results on TV danced as the results came in. One party leader said Holi, which will be celebrated on Sunday and Monday, has come a day early.

Terming the BJP victory as “shocking” and “difficult to swallow,” BSP leader Mayawati hinted at vote fraud in the elections that were spread over seven phases during the last two months in the five states.

She provided no evidence for her allegation, and it is unlikely to be taken seriously. Her party is expected to finish third. After five hours of counting, the BJP was ahead in xxx races in UP. Along with its allies Apna Dal (Soneylal Patel) and Suheldev Bhartiya Samaj Party (SBSP), the party will likely control at least 305 seats for a comfortable two-thirds majority in the 403-member legislative assembly.

The party had however not put forward any chief ministerial candidate. BJP leaders said the decision will be taken by the BJP parliamentary board and the legislature party in the state soon.

The BJP, which had just 47 seats in the outgoing Assembly, garnered 40 per cent vote share in the most riveting contest seen as a gamechanger and a virtual referendum on Modi’s popularity and demonetisation.

The party also went to the elections without fielding any Muslim candidate. The nascent SP-Congress coalition was ahead in only 64 seats while Mayawati’s BSP was a distant third leading only in 20 places. The SP, whose campaign was spearheaded by Chief Minister Akhilesh Yadav on development agenda, led in 55 seats.

Congress spokesperson Abhishek Manu Singhvi acknowledged the party’s defeat was massive. “Yes, UP is a bad loss, it hurts…I agree that, in UP, we need fundamental restructuring thinking for the Congress as a whole. These have to be hard, tough decisions about strategy,” Singhvi said.

The previous best showing by BJP in UP was in 1991, at the height of Ram Janam Bhoomi movement, when it got majority on its own winning 221 seats out of 425 in an undivided state.

SP leader and a state minister, Gayatri Prajapati, who is wanted in an alleged gangrape case and attempt to rape a minor, was trailing in Amethi, where Garima Singh (BJP), the first wife of Congress leader Sanjay Sinh, was leading.

Ameeta Singh (Cong), the current wife of Sanjay Sinh was also trailing. In Noida, Home Minister Rajnath Singh’s son Pankaj Singh was leading by an impressive margin.

The trends also showed BJP’s Sangeet Singh Som, who was booked in the Muzaffarnagar riots, was leading in Sardhana. Kailash Vijaywargia, a BJP general secretary, that the perception that the BJP was a party of the upper caste has been demolished as all sections of the society including Dalits and Muslims voted for it.

“The central government schemes have benefitted everyone. Muslim women have also benefitted from the schemes. Modi has created confidence in every section,” he said.

In Uttarakhand, the BJP put up a splendid show and is leading in 56 seats in the 70-member Assembly while Congress was way behind ahead in only 10 seats. Congress Chief Minister Harish Rawat lost Haridwar (Rural) seat to BJP’s Yatishwaranand by over 12,000 votes.

Congress leader Shakeel Ahmad attributed the party’s poor show in the politically crucial UP to “public mood” and said its performance will be “scrutinised”.

He, however, stressed that Congress’ gains in Punjab and likeliness of the party forming government in Goa, ruled by the BJP until before the elections, should not be ignored

In Punjab, the Congress won 16 and was leading in 60 of the 117 constituencies while the AAP, making a debut in Punjab Assembly polls, was in second position winning six seats and ahead in 16.

The ruling SAD was demolished with the party winning one and leading in 13 while its coalition partner BJP led in three seats. Punjab Congress President Amarinder Singh, who is the party’s chief ministerial face, thanked people of the state for their overwhelming support.

The Congress legislature party will meet tomorrow to elect its leader, he said.

In Goa where trends and results were available for 25 seats, the ruling BJP and Congress won seven seats each and were also leading in two seats each, in what could lead to a hung Assembly whose strength is 40.

The BJP suffered a big reverse when Chief Minister Laxmikant Parsekar lost to his Congress rival from Mandrem. Former Chief Minister Digambar Kamat (Congress) won from Margao constituency.

In Manipur, the ruling Congress won 9 seats and was ahead in seven while the BJP bagged four leading in 12, according to details available for 39 out of 40 constituencies.

Chief Minister Okram Ibobi Singh won from Thoubal Assembly seat by a margin of 10,400 votes. Rights activist Irom Sharmila, making her poll debut, was relegated to the fourth position.

Trump’s travel ban challenged by Washington and Hawaii

Several US states have said they will move forward with legal challenges to President Donald Trump’s revised executive order that targets citizens of six Muslim-majority countries and refugees.

Washington state, which was the first to sue over Trump’s initial travel ban that created chaos worldwide and was eventually blocked, argued that the revised order violates the constitution “by disfavouring Islam”.

Bob Ferguson, the state’s attorney general, said a motion by his office calls on an existing injunction against the travel ban issued in January to be applied to the new directive.

“My message to President Trump is – not so fast,” Ferguson said. “After spending more than a month to fix a broken order that he rushed out the door, the president’s new order reinstates several of the same provisions and has the same illegal motivations as the original.”

Attorney generals in the states of New York, Massachusetts and Oregon said they had taken steps to join the lawsuit that Washington had filed along with Minnesota.

The opposition comes on top of a separate legal challenge to the new ban brought by Hawaii.

The revised executive order issued on Monday bars new visas for people from Syria, Iran, Somalia, Libya, Sudan and Yemen, and temporarily shuts down the US refugee programme for 120 days.

It is supposed to go into effect on March 16, and does not apply to travellers who already have visas.

Oregon Attorney General Ellen Rosenblum said the executive order has hurt Oregon, its residents, employers, agencies, educational institutions, healthcare system and economy.

New York Attorney General Eric Schneiderman called the executive order “a Muslim ban by another name”.

The attorney general in Hawaii argued that while the new order features changes to address complaints raised by courts that blocked the first travel ban, the new order is pretty much the same as the first one.

“Nothing of substance has changed: There is the same blanket ban on entry from Muslim-majority countries (minus one),” state attorney general Doug Chin said in a statement.

Hawaii’s lawsuit says the order will harm Hawaii’s Muslim population, tourism and foreign students.

White House spokesman Sean Spicer said Thursday the administration believed the revised travel ban will stand up to legal scrutiny.

“We feel very confident with how that was crafted and the input that was given,” Spicer said.

A federal judge in Seattle issued a temporary restraining order halting the initial ban after Washington state and Minnesota sued. The 9th US Circuit Court of Appeals refused to reinstate the order.

University of Richmond Law School professor Carl Tobias said Hawaii’s complaint seemed in many ways similar to Washington’s successful lawsuit, but whether it would prompt a similar result was tough to say.

Given that the new executive order spells out more of a national security rationale than the old one and allows for some travellers from the six nations to be admitted on a case-by-case basis, it will be harder to show that the new order is intended to discriminate against Muslims, Tobias said.

“The administration’s cleaned it up, but whether they have cleaned it up enough I don’t know,” he said. “It may be harder to convince a judge there’s religious animus here.”

Tobias also said it is good that Hawaii’s lawsuit includes an individual plaintiff, considering that some legal scholars have questioned whether the states themselves have standing to challenge the ban.

Imam Ismail Elshikh of the Muslim Association of Hawaii is a plaintiff in the state’s challenge. He says the ban will prevent his Syrian mother-in-law from visiting him.

II PUC exams begin on a smooth note amidst heavy security at centers

Bengaluru: After last year’s chaos caused due to the paper leak during the II PUC exams, this year’s exam began on a smooth note across the state on Thursday with students answering Biology and History papers.

Heavy security was put in place at all centers to prevent any untoward incident.

The Department of Pre-University Education (DPUE) keeping in mind last year’s paper leak, this year prevented students from answering exams in their own colleges.

Meanwhile, it is said that some of the students arrived late while some forgot to bring ID cards and such students were excused as it was the first day; however, Director of DPUE Shikha said that students would not be excused during other exams.

Centers had put up notices that no gadgets and phones would be allowed in the exams hall and that students were under surveillance; however, contrary to a statement issued on Wednesday by Tanveer Sait, Minister for Primary and Secondary Education, a few photocopy shops in and around exam centers in Malleswaram and Rajajinagar were found open.

When questioned, they said that that it was their daily bread and that they would not shut down the shop. Director Shikha assured of necessary action in this regard.

There were also incidents of malpractice reported from Kalaburagi and Davangere. Meanwhile, there were rumours that the Biology paper had leaked, but Shikha dismissed the rumours.

Students will answer Electronics and Computer Science papers on Friday.

Dunedin: South Africa took a slender five-run second innings lead to end the third day’s play at 38/1 after bowling New Zealand out for 341 in their first essay in the opening cricket Test at the University Oval here on Friday.

At stumps, opener Dean Elgar, the centurion in the first innings, was unbeaten on 12 runs with Hashim Amla giving him company on 23.

Earlier, resuming the third day at 177/3, the Kiwis rode on skipper Kane Williamson (130)’s 16th Test ton and wicketkeeper-batsman Bradley-John Watling’s patient half century to post 341 and get a meagre 33-run lead.

Williamson’s ton brought him level with Ross Taylor and one behind the New Zealand record of 17 held by the Martin Crowe.

After the departure of Williamson, New Zealand saw a batting collapse as they lost their middle order batsmen in 27 runs after lower order batsman Neil Wagner (32) steadied the fort for the hosts.

Apart from Watling and Wagner, no other lower-middle order batsmen stood up to the occasion as the tailenders — Mitchell Santner (4), Trent Boult (2) — only managed to add six runs in the end.

For South Africa, Keshav Maharaj scalped five wickets while pacer Morne Morkel, Vernon Philander took two wickets each.

Mallya says ready to talk to banks for one-time settlement

New Delhi: The embattled liquor baron Vijay Mallya today took to Twitter saying he is ready to negotiate with banks to pay a one-time settlement charge on Rs 9,000-crore loan default.

“Public sector banks have policies for one-time settlements. Hundreds of borrowers have settled. Why should this be denied to us? Our substantial offer before the honourable Supreme Court was rejected by banks without consideration. (I) am ready to talk settlement on fair basis,” Mallya said in a tweet.

He further said: “Wish the Supreme Court would intervene and put an end to all this by directing banks and us to negotiate and settle. We are ready.” Mallya added that he has “humbly obeyed every single court order without exception” and “seems as if government is bent on holding me guilty without fair trial”.

“The allegations against me by the Attorney General before the Supreme Court only prove the attitude of the government against me,” he went on to say. On Thursday, the Supreme Court posed a question to Mallya about the “truthfulness” of his disclosure of assets and transfer of USD 40 million to his children.

A bench of Justices Adarsh Kumar Goel and U U Lalit put forth the queries during the day-long hearing following which it reserved the orders on two pleas from lenders seeking contempt action against Mallya and a direction to him to deposit USD 40 million received from offshore firm Diageo.

Last month, the Indian government handed over to the UK an extradition request for the businessman, who is facing cases of loan default and other financial irregularities. Mallya, whose now-defunct Kingfisher Airlines owes more than Rs 9,000 crore to various banks, had left India on March 2.

This date, 15 years ago on March 11, I lost my dad the late Usman Asad. Not only was it a loss for me and my family, but it was a loss to Urdu journalism as well.

My dad started The Nasheman Weekly on 26th January 1962. It instantly created a revolution in the field of journalism, in particular in the Urdu media. It was known for its free, frank and fearless style of journalism, and even 56 years later, it is still known for this.

My dad never compromised on his principles, despite many odds, and he was even jailed many times for his fearless writing against the system. Even during the emergency in 1975, he was behind the bars. He was a man, who never went after power and led a very simple life, inspite of being rich and famous. He never flaunted his wealth, and he never went after power and politics. He was an institute in himself.

Even today, when I say I am from Nasheman, people speak very high of my dad, and praise him for his writing and his immensely popular column – Thapdakhien.

I have learnt a lot from him, and he was like no other. He gave me life, nurtured me, thought me, dressed me, fought for me, held me, shouted at me, hugged me, but most important of all, he loved me unconditionally.

There are not enough words say to describe, how important my father was to me, and what a powerful influence he continues to be. I thank all those who have supported me, after his demise in running his legacy, which is a huge responsibility.

Even if I become 1 per cent of what he was, I will be a better person, both as a human being and as a journalist.

I’ll continue to follow what he says. I love you dad. May your soul rest in peace.

WikiLeaks Releases Trove of Alleged C.I.A. Hacking Documents

The CIA can turn your TV into a listening device, bypass popular encryption apps, and possibly control your car, according to thousands of documents published by WikiLeaks, an anti-surveillance group.

The group posted nearly 9,000 documents on Tuesday it said were leaked from the Central Intelligence Agency, in what it described as the largest-ever publication of secret intelligence materials.

It said the trove of documents “appears to have been circulated among former US government hackers and contractors in an unauthorised manner, one of whom has provided WikiLeaks with portions of the archive”.

Jonathan Liu, a spokesman for the CIA, said: “We do not comment on the authenticity or content of purported intelligence documents.”

Experts who have started to sift through the material said that it appeared legitimate.

The leak, named “Vault 7” by WikiLeaks, claims the CIA developed a malware to infect mobile phones to allow easier surveillance – but lost control of the technology. If the CIA really lost control of the technology, hackers worldwide could use the tools to steal data.

Edward McAndrew, a lawyer with a speciality in cyber security, said the security breach is a major concern for the CIA because its technology could already be in the wrong hands

“What we’re hearing from WikiLeaks and others is that pieces of the toolkit are now outside of Langley [the CIA’s Virginia headquarters],” he told Al Jazeera.

“If that’s true, once these tools are introduced into the wild of the internet, they cannot be reclaimed. We’ll then see a race between those who would use these tools to exploit others and those trying to close all these vulnerabilities that have now come to light.”

The actual hacking tools were not part of the WikiLeaks trove.

WikiLeaks said it planned to avoid distributing tools “until a consensus emerges” on the political nature of the CIA’s programme and how such software could be analysed, disarmed and published.

Malware systems

WikiLeaks said the documents show the CIA has produced more than 1,000 malware systems – viruses, trojans, and other software that can infiltrate and take control of target electronics.

These hacking tools have targeted iPhones, Android systems such as the kind of personal phone reportedly still used by President Donald Trump, popular Microsoft software and Samsung smart TVs, which can be transformed into covert microphones, according to WikiLeaks.

The agency has also examined hacking into the electronic control systems on cars and trucks, potentially enabling it to control them.

By infecting smartphones, WikiLeaks said, the CIA can get around the encryption technologies of popular apps such as WhatsApp, Signal, Telegram, Weibo, and Confide by collecting communications before they are encrypted.

Matthew Green, professor of computer science, told Al Jazeera that “ordinary people” should not have to worry about the revelations.

“What I would perhaps worry about is that some of this might get into the hands of very sophisticated criminal organisations or foreign governments and be used in a very targeted way against activists or human rights workers,” he said.

Myanmar ‘unlikely’ to face UN probe on Rohingya abuses

Myanmar looks set to escape an international investigation into alleged atrocities against its Rohingya minority, after the European Union decided not to seek one at the UN Human Rights Council, a draft resolution seen by Reuters news agency showed.

The EU takes note in the draft resolution seen on Wednesday, of “the very serious nature of the allegations” and “current investigations conducted at the domestic level”.

But it stops short of the investigation sought by UN High Commissioner for Human Rights Zeid Ra’ad al-Hussein.

EU diplomats told a meeting on Tuesday that they preferred using an existing mechanism that had received good cooperation and access from Myanmar’s government, rather than a new approach, and to give more time to the domestic process.

The EU has historically taken the lead on issues relating to Myanmar on the Council.

Zeid, in a renewed appeal on Wednesday, told the Council that the severe violations follow “longstanding persecution” of the stateless Rohingya minority in majority-Buddhist Myanmar, and warranted a review by the International Criminal Court.

“I therefore urge the Council, at minimum, to establish a Commission of Inquiry into the violence against the Rohingya, particularly during security operations since 9 October 2016,” he said.

The UN said in a report last month that the army and police had committed mass killings and gang rapes of Rohingya Muslims in northern Rakhine state, and burned villages in a campaign that may amount to crimes against humanity and ethnic cleansing.

Independent probe

Setting up a full international commission of inquiry into the findings – similar to those for Syria and North Korea – has been seen as a test of international resolve at the main annual session of the Council that ends on March 24.

The draft resolution from the EU suggests it may fail that test.

Some 70,000 people have fled Rakhine state to Bangladesh since Myanmar’s military began a security operation last October in response to what it says was an attack by Rohingya armed men on border posts, in which nine police officers were killed.

Human rights monitors have voiced serious doubts that several investigative commissions set up by the Aung San Suu Kyi government and its security forces had the tools and independence needed for an impartial probe.

Activists said the security forces continued to carry out serious crimes demanding an international probe.

“Our research indicates that it (the abuse) is systematic, and the idea that the government could or would be able to participate in a proper investigation of what is going on simply isn’t realistic,” said Louis Charbonneau of Human Rights Watch.

“An investigation needs to be independent, credible and international.”
