PhD scholar Gulzar Ahmed lost 16 yrs in jail; UP govt should compensate: Court

May 23, 2017 by Nasheman

Gulzar Ahmed Wani

New Delhi: The Uttar Pradesh government has been directed by a Barabanki court to compensate former AMU scholar Gulzar Ahmed Wani, who was acquitted of terror charges after 16 years of incarceration in the 2000 Sabarmati Express blast case.

The court directed the Yogi Adityanath-led government to pay compensation to Wani in terms of the average income in accordance with his educational qualification for the time he spent in jail, saying he was a victim of “negligence” of officials in probing the case.

Wani was pursuing PhD in Arabic from Aligarh Muslim University when he was arrested from Delhi on July 30, 2001.

The court held the UP government responsible for the damage caused by its officials to the state exchequer for their negligence in probing the case leading to financial loss.

It said the officials had not obtained sanction to prosecute the accused and a charge sheet was filed in dereliction of their duty, violating Wani’s physical independence and also harming him physically and mentally.

The court’s findings came as it acquitted Wani and Mohd Abdul Mobeen of the charge of having allegedly orchestrated the Sabarmati Express blast in 2000 that had claimed nine lives and left several others injured.
It said the police had not produced any evidence to prove that the two had conspired with others to cause a bomb blast in the train and wage a war against the country.

Additional Sessions Judge M A Khan, in his judgement written in Hindi, said if the government feels, it can recover the compensation amount from the concerned police officials.

It said if the government failed to pay the compensation, Wani would be at liberty to approach the Allahabad High Court.

A total of 11 cases were lodged against Wani, of which he has been exonerated in 10 — either acquitted or discharged.

The Supreme Court had granted bail to Wani in April this year, observing that he has suffered incarceration for over 16 years and has been acquitted in nine out of 11 cases.

The apex court had said that Wani should be released on bail from November one on set terms and conditions of the trial court, irrespective of the completion of the trial.

In one case, Wani was convicted and sentenced to 10 years in jail for carrying explosives to trigger a blast in Delhi. However, the Delhi High Court had suspended this sentence.

His counsel M S Khan said “an intellectual person’s life has been spoilt. There is an irreparable damage to his career. He was such an educated person and would have excelled in his life. The erring police officials should be punished and they must be taught a tough a lesson.”

While reprimanding the police officials for their lapses in investigation, the court said neither did they try, nor did they gather any evidence in support of the charge of criminal conspiracy against the accused.

The judge said it was the duty of senior police officers to check the charge sheet, remove the defects and file it in the court, but they showed negligence in their duty which also harmed the government.

The court directed the government to take appropriate action against the erring police officials and said that a copy of the judgement be sent to the district magistrate, Barabanki, and the Home Secretary of the state government.

Wani, who was arrested by Delhi Police in 2001 allegedly with explosives and incriminating materials, is a resident of Peeparkari area of Srinagar in Jammu and Kashmir and is lodged in a jail in Lucknow.

The blast was carried out on the eve of Independence Day near Kanpur when the train was on its way from Muzaffarpur to Ahmedabad, claiming nine lives and several others injured.

The prosecution had alleged that the accused had hatched a conspiracy in May 2000 at the Habib Hall of the Aligarh Muslim University to carry out a blast in the Sabarmati Express on August 14, 2000. Charges were framed against him in July 2001.

Hamas decries Trump’s terror allegation

Hamas says its battle is against Israeli occupation, not the West [Reuters]

by Al Jazeera

Hamas Movement has rejected US President Donald Trump’s comments linking it to “terrorism” in his speech in Saudi Arabia, saying it shows his “complete bias” towards Israel.

“The statement describing Hamas as a terror group is rejected and is a distortion of our image and shows a complete bias to the Zionist occupation,” Hamas spokesman Fawzi Barhoum said in a statement on Sunday.

Barhoum dubbed the speech a “confirmation” that Trump is following the policy of previous US administrations.

Trump addressed the leaders of 55 Muslim countries in Riyadh, Saudi Arabia and said they must take the lead in combating “radicalisation”.

“The true toll of ISIS [the Islamic State of Iraq and the Levant], al-Qaeda, Hezbollah, Hamas, and so many others, must be counted not only in the number of dead. It must also be counted in generations of vanished dreams,” said Trump in the speech.

Hamas says its battle is against Israeli occupation, not the West.

The movement presented a new political charter earlier this month that accepts the formation of a Palestinian state along the 1967 borders, without recognising the statehood of Israel, and says that the conflict in Palestine is not a religious one.

Trump’s speech came on the second day of a visit to Saudi Arabia, part of Trump’s first foreign tour that will take him next to Israel and occupied Palestinian Territories and then to Europe.

Palestinian activists call for protests against Trump

Meanwhile, Palestinian activists have called for a “Day of Rage” when Trump visits the West Bank on Tuesday.

The call for mobilisation was put out by a group calling itself the Supreme National Leadership Committee, which includes various Palestinian political factions, including Abbas’s Fatah movement.

The committee was set up in support of Palestinian prisoners on hunger strike in Israeli prisons.

The demonstrations are meant to draw attention to a month-long hunger strike by hundreds of prisoners being held by Israel and to protest what many Palestinians say is unfair US support for Israel.

In a statement, the group said on Sunday the Palestinian factions “affirm their rejection of the American position, which is biased in favour of the occupation”.

Trump’s visit to Israel and occupied Palestinian territories on Monday and Tuesday will be closely scrutinised as he seeks ways to restart peace efforts.

Missing Indian dies after climbing Mt Everest

May 22, 2017 by Nasheman

Mt Everest Ravi Kumar

Kathmandu: A 27-year-old Indian climber, who went missing on Mount Everest, has died after he fell some 200 metres on his return after conquering the world’s tallest peak, the fifth fatality on the mountain this season, an official said today.

Ravi Kumar from Uttar Pradesh’s Moradabad fell from the 8,200 metre altitude, which is popularly known as Balcony, and died, said Dinesh Bhattarai, Director General of Department of Tourism.

“Our liaison officer deputed in Mt Everest has confirmed that he died after he fell some 150 to 200 metre down from the Balcony while he was descending after the summit,” he told PTI.

Balcony is the final resting spot before climbers ascend the south summit of the mountain.

With this, the total number of people who died from the Nepal side of Mt Everest has reached five.

Kumar successfully climbed the 8,848 meters high Mount Everest at 1:28 PM on Saturday. His climbing guide Lakpa Wongya Sherpa was also found unconscious after suffering from frostbite at Camp IV.

Kumar and the climbing guide got separated during the descent.

Ang Tshering Sherpa, president of Nepal Mountaineering Association earlier had earlier said that “the chances of his survival were slim, as more than 24 hours had elapsed since he went missing in the extreme climate”.

An American and a Slovakian died near the summit of the world’s highest peak yesterday. An Australian also died while the identity of the fourth person was not immediately known.

Nepal has cleared 371 mountaineers to climb Mount Everest during the current season ending this month.

Nearly 300 people have died on Mt Everest since the first ascent to the peak was made in 1953.

It is estimated that more than 200 dead bodies are still lying on the mountain.

Mumbai beat Pune to win IPL

Mumbai Indians clinched record third IPL title with a one-run win over Rising Pune Supergiant at the Rajiv Gandhi International Stadium, Hyderabad.(BCCI )

Hyderabad: Mumbai Indians defeated Rising Pune Supergiant (RPS) in a low-scoring final to win the Indian Premier League (IPL) title here on Sunday.

In a match that went right down to the last ball, Mumbai registered a one-run victory in front of packed stands at the Rajiv Gandhi International stadium.

This is Mumbai’s third IPL title.

Chasing a target of 130 runs, Pune could only manage to post 128/6 in their 20 overs.

Australian fast bowler Mitchel Johnson was the most successful for Mumbai with figures of 3/26, while young pacer Jasprit Bumrah also played a crucial role, returning figures of 26/2 in four excellent overs.

Veteran Sri Lankan pacer Lasith Malinga also bowled well and was unlucky not to manage a wicket. He conceeded just 21 runs in his four overs.

Pune skipper Steven Smith led from the front scoring a fighting half-century in a losing cause.

He notched up 51 runs off 50 deliveries with two boundaries and an equal number of sixes before falling in the last over.

Pune started off on a shaky note when Bumrah trapped Rahul Tripathi leg before.

Ajinkya Rahane and Smith tried to rebuild the innings with a 54-run partnership before Kieron Pollard pulled off a superb catch at long on to send the captain back to the pavilion.

With the Mumbai bowlers maintaining a tight line, Mahendra Singh Dhoni and Smith found the going tough and could only add 27 runs between them in as many balls.

Dhoni scored 10 runs in 13 balls before falling to a poor shot in the 17th over, slashing a Bumrah delivery which was slightly outside off-stump but only managed an easy top edge to wicket-keeper Parthiv Patel.

His departure seemed to put the pressure on the Pune batsmen.

Malinga conceded just five runs in the 18th over and Bumrah bowled another miserly over in the 19th to put pressure. With 11 runs needed off the final over, Manoj Tiwary started with a boundary to square leg off Johnson but an attempted smash into the stands off the very next ball saw him caught at long on by Pollard.

Smith fell on third ball, caught by Ambati Rayudu at the cover boundary.

Two runs came off the next ball but with four needed off the last ball, Daniel Christian was run out sending the Mumbai players into wild celebrations.

Earlier, braces by bowlers Jaydev Unadkat, Adam Zampa and Christian enabled Pune to restrict Mumbai to 129 for eight.

Mumbai’s top and middle order batsmen put up a horrific show against the disciplined bowling from Pune and the former were left reeling at 79/7 in the 15th over. All-rounder Krunal Pandya’s 47 off 38 deliveries pulled Mumbai out of the hole.

Opting to bat, Mumbai had a disastrous start as left-arm medium pacer Unadkat (2/19) removed Parthiv Patel (4) and Lendl Simmons (3) in the third over, reducing them to 8/2.

Mumbai skipper Rohit Sharma (24) and Rayudu (12) then weathered the storm briefly but the Pune bowlers continued to keep it tight. Young off-spinner Washington Sundar continued to be impressive, giving away only 13 runs in his four overs.

The partnership lasted for 33 runs as Rayudu was caught short of the crease while taking a single in the eighth over.

Mumbai’s batting ran into further trouble when Rohit and Pollard (7) fell to Australian leg-spinner Zampa (2/32) in the 11th over to be left at 65/5. Rohit pulled a half-pitched ball to Thakur at deep mid-wicket, while Pollard offered an easy catch to pouch for Tiwary at long-on.

After Zampa, Christian (2/34) removed all-rounder Hardik Pandya (10) in the 14th over, while in the next, Karn Sharma, a handy low-order batsman, was run out at 1, to leave Mumbai at 79/7.

Later, Krunal and Mitchell Johnson (13 not out) shared a strong 50-run partnership to take Mumbai to 129/8.

Jaitley files fresh Rs 10 crore defamation suit against Kejriwal

May 22, 2017 by Nasheman

Arun-Jaitley

New Delhi: Union minister Arun Jaitley today filed a fresh civil defamation suit of Rs 10 crore against Delhi Chief Minister Arvind Kejriwal whose lawyer allegedly used an objectionable word against him in court last week.

Jaitley, who holds the twin portfolios of Finance and Defence, filed the fresh suit after Kejriwal’s counsel Ram Jethmalani allegedly abused him in open court during the proceedings of another defamation suit he had filed against the Aam Aadmi Party (AAP) chief and five other party leaders.

The noted lawyer, during the cross-examination of the union minister on May 15 and May 17 in the Delhi High Court, had used certain words which were objected to by Jaitley.

Advocate Manik Dogra, who is representing Jaitley, said they had filed a fresh civil defamation suit against Kejriwal as he, through his counsel, had used abusive language in the open court, which was also recorded in the order sheet. This warrants filing of a separate defamation suit, he added.

Jaitley had filed a civil defamation suit earlier seeking Rs 10 crore in damages from Kejriwal and five other AAP leaders — Raghav Chadha, Kumar Vishwas, Ashutosh, Sanjay Singh and Deepak Bajpai — for accusing him of financial irregularities in the Delhi and District Cricket Association (DDCA) of which he was president from 2000 to 2013.

Jaitley had denied all the allegations levelled against him by the AAP leaders. Besides the civil defamation suit, Jaitley had also filed a separate criminal defamation case in the trial court against the AAP leaders.

Murderous ideology: Tie Arundhati Roy to Army jeep instead of stone-pelter, tweets Paresh Rawal

May 22, 2017 by Nasheman

paresh-rawal

New Delhi: BJP MP Paresh Rawal today kicked up a row with his remark that author Arundhati Roy should be tied to an army jeep instead of a stone pelter, a reference to an incident in Kashmir where a protester was used as a “human shield” by security personnel against a mob.

“Instead of tying stone pelter on the army jeep tie Arundhati Roy (sic)!” the actor-politician tweeted, taking a swipe at the author who has been a trenchant critic of the BJP and the Army action in the Valley.

His tweet drew condemnation from many users on the social media platform with some accusing him of inciting violence.

When a supporter suggested that instead of the Booker Prize winning author, a woman journalist should be treated in a similar manner, Rawal said, “We have a wide variety of choices!”

Congress general secretary Digivijay Singh hit out at the BJP, asking, “Why not (tie) the person who stitched PDP-BJP alliance?”

Instead of tying stone pelter on the army jeep tie Arundhati Roy !

— Paresh Rawal (@SirPareshRawal) May 21, 2017

Wonderful sir, too good. You really are a model parliamentarian https://t.co/rPjPWRYC3Q

— Sagarika Ghose (@sagarikaghose) May 22, 2017

Union Minister Smriti Irani, however, sought to distance the party from Rawal’s tweet, saying “nowhere will we, in any way, support any violent message by anybody, against any individual of the country.”

The BJP leader, who was addressing a party press conference, however, added that she had not seen his tweet and any answer she has given will not be fully “correct and knowledgeable”.

Many right wing supporters lapped up Rawal’s remarks, alleging that Roy was an “anti-national”. Rawal’s tweet came against the backdrop of an Army officer’s decision to tie an alleged stone pelter to a jeep’s bonnet as a human shield against violent protesters who were trying to disrupt bypoll to Srinagar Lok Sabha constituency last month.

It was done, according to security officials, to prevent stone-pelters from targeting soldiers. The Army had ordered a court of inquiry into the incident.

NCERT Class 12 textbooks won’t describe 2002 Gujarat carnage as ‘anti-Muslim’

May 22, 2017 by Nasheman

gujarat 2002

Ahmedabad: The 2002 Gujarat carnage, one of the worst instances of communal violence since Independence will now not be referred to as ‘anti-Muslim riots’ in the NCERT textbooks. It will be instead referred to as the “Gujarat riots” henceforth.

According to a national English daily, the decision was taken at a review meeting where representatives of the Central Board of Secondary Education (CBSE) and the National Council of Educational Research And Training (NCERT) were present. The change is to be made in a 2007 class 12 textbook which was published during the UPA’s tenure.

According to the estimates of Gujarat government, nearly 800 Muslims and more than 250 Hindus were killed in the violence in February-March, 2002. However, it is believed that the government gave wrong figures by decreasing the number of Muslim victims. Thousands of Muslim women were raped and properties belonging to Muslims were looted and destroyed by the violent mob during the alleged government sponsored riot.

The violence was sparked by the death of 57 Hindu pilgrims who were burnt alive in a train compartment at a station in Godhra. Though the Sangh Parivar blames the local Muslims for the tragedy, many studies have claimed that it was an ‘inside job.’

The NCERT’s move could rile the minority community that bore the brunt of the weeks-long violence. Over the past three years, changes in textbooks have been a controversial issue. Several BJP-ruled states, including Rajasthan, Gujarat, Haryana and Maharashtra, tweaked schoolbooks in a way that triggered opposition allegations that these governments were trying to saffronise education.

The NCERT – the government’s think thank on school education — termed the move a routine to keep textbooks updated.

“Points raised by CBSE have already been taken up by NCERT. Changes will be made and it will be reflected once the book is reprinted by the end of the year,” a senior NCERT official told HT seeking anonymity.

“This review is an ongoing process and before every reprint we do incorporate new acceptable feedback and also update the information. This year we are doing it in a more planned and comprehensive manner.”

The official also said the NCERT is carrying out a review of all textbooks to ensure that the latest developments are included.

A chapter titled “Politics in India since Independence” (page 187) in the Class XII political science textbook has a passage under the heading “Anti-Muslim riots in Gujarat”.

“In February-March 2002, large-scale violence against Muslims took place in Gujarat …. A bogey of a train that was returning from Ayodhya and was full of karsevaks was set on fire… Suspecting the hands of Muslims in setting fire to the bogey, large-scale violence against Muslims began in many parts of Gujarat…” the passage reads.

It also talks about the National Human Rights Commission criticising the Gujarat government’s role in failing to control violence and provide relief to victims. Narendra Modi was the chief minister of Gujarat at that time.

Sources said the meeting decided to change only the subtitle, as of now. HT has a copy of the minutes of the meeting.

Besides NCERT and CBSE representatives, teachers of some private schools also attended the review meeting on May 11 in Delhi. The CBSE reviewed the book on its own and sent a report to the NCERT following which the meeting was called, the sources added.

In a separate development on May 13, the NCERT also decided to replace the map of East and South East Asia in the same textbook that showed ‘Aksai Chin’, an area in Kashmir under China’s control, as a disputed area.

UP Police registers murder case in Karnataka IAS officer’s death

May 22, 2017 by Nasheman

IAS officer Anurag Tiwari

Lucknow: The Uttar Pradesh police today registered a murder case in the death of a Karnataka-cadre IAS officer here, hours after his family members met Chief Minister Yogi Adityanath and demanded a CBI probe.

“An FIR has been registered in Hazratganj police station against unidentified persons in IAS officer Anurag Tiwari’s case under IPC section 302 (murder). The complaint was lodged by his brother Mayanak,” Circle Officer, Hazratganj, Avanish Kumar Mishra told PTI.

Earlier, the family members of the officer met the chief minister and pressed for a CBI probe.

“We are not satisfied with the police probe. We have requested the CM to recommend a CBI probe,” Mayank told reporters.

Tiwari, 36, was found dead on May 17, his birthday, under mysterious circumstances near a guest house, where he was staying, in the high-security Hazratganj area here.

His family had alleged foul play. He was posted as commissioner in the department of food, civil supplies and consumer affairs in Bengaluru.

“My son was very honest. Corrupt officers did not like him. They must have somehow got him murdered,” Tiwari’s father B N Tiwari had alleged in Bahraich, his native place.

Kannadiga can’t rule TN: Pro-Tamil group protests Rajini’s political entry

May 22, 2017 by Nasheman

Rajinikanth

Chennai: Members of a fringe pro-Tamil outfit on Monday burnt an effigy of actor Rajinikanth, opposing his entry into politics.

With the ‘Tamizhar Munnetra Padai’ planning to picket the actor’s house at Poes Garden, security was stepped up there.

The slogan-raising activists burnt an effigy of the actor at the busy Cathedral Road, police said, adding that scores of members of the outfit were detained.

The activists raised slogans against Rajinikanth’s possible entry into politics, an issue which has gained steam following his hints last week that he could take the plunge.

The actor’s Kannada origins are often a focal point of discussion in Tamil Nadu, with pro-Tamil groups raising the pitch whenever the Cauvery river water sharing dispute between Tamil Nadu and Karnataka escalates.

Intense speculation has ruled the grapevine for the past couple of days about the Tamil superstar’s entry into politics after Rajinikanth, in an interaction with fans, said that he is a “Pachchai Thamizhan” and asked them to be prepared for “war”. Last week, the superstar said he would join politics if ‘God wants me to’.

A number of BJP leaders have warmed up to the idea of Rajinikanth joining the party. Union Minister Pon Radhakrishnan had welcomed the star to join the BJP, and the party’s Tamil Nadu chief Tamilisai Sounderajan had on Sunday said that BJP would be strengthened if Rajinikanth joined the party.

BJP chief Amit Shah had also expressed his approval of the Superstar joining the saffron party. According to reports, Amit Shah said to a news channel, “Every good person is welcome to join politics,” but added that only Rajini could decide when to enter politics.

But Union Minister M Venkaiah Naidu on Sunday also said he was not aware of any possible meeting between actor Rajinikanth and Prime Minister Narendra Modi.

”Rajinikanth is a great actor. Modi is a great leader. If he wants to meet the Prime Minister, there is no problem”, Naidu told reporters in Bengaluru.

But Tamil Nadu Congress Committee chief S Thirunavukkarasar said that he believes that Rajinikanth, who is his friend since 35-40 years, will float his own party.
