Triple Talaq: SC issues notice to Centre on plea against new law; agrees to examine validity

New Delhi The Supreme Court on Friday agreed to examine the validity of a newly enacted law which makes the practice of instant divorce through triple talaq among Muslims a punishable offence entailing imprisonment of up to three years.

A bench of justices N V Ramana and Ajay Rastogi issued notice the Centre on a batch of petitions which has sought to declare The Muslim Women (Protection of Rights on Marriage) Act 2019 as “unconstitutional” on grounds that it allegedly violates the provisions of the Constitution.

“We will examine this,” the bench told senior advocate Salman Khurshid, who was appearing for one of the petitioners.

Khurshid told the bench that there were many dimensions, including making the practice a punishable offence and jail term of up to three years, which was required to be examined by the top court.

INX media case: P Chidambaram spends a quiet night at CBI headquarters after dramatic arrest

Chidambaram, accompanied by the members of the investigation team, was brought to the CBI headquarters at around 10 Wednesday night, officials said.

NEW DELHI: Former Union finance minister P Chidambaram spent a quiet night in the CBI guest house on the ground floor of the agency headquarters after his dramatic arrest from his posh residence in the INX media corruption case, officials said on Thursday.

Chidambaram, 73, was kept in the suite 5 of the guest house, they said.

It is normal for the agency to keep high security arrested accused in the guest house to ensure proper security and monitoring, the officials said.

Chidambaram, accompanied by the members of the investigation team, was brought to the CBI headquarters at around 10 Wednesday night, they said.

After a thorough medical check-up by a doctor from the Ram Manohar Lohia Hospital, he was taken to the room where he spent a quiet night, the officials said.

Mostly, they said, he remained silent except answering a few queries as and when questioned by the CBI officers.

His questioning will start at around 10 Thursday morning under DySP R Parthasarathy who is leading the probe in the alleged corruption in Rs 305 crore clearance given to INX media when he was the Union finance minister, the officials said.

The firm once promoted by Peter and Indrani Mukerjea, both in jail for murdering latter’s daughter Sheena Bora, had allegedly made payments to a firm linked to finance minister’s son Karti Chidambaram, the CBI has said in the FIR.

P Chidambaram has strongly denied the allegations, saying the payments were for consultancy and his son was in no way associated with that company.

Robbery bid at jewellery store, four accused arrested

A woman and her husband managed to foil an armed robbery bid in broad daylight, after two miscreants entered a jewellery shop in the guise of customers and  tried to rob them .The incident took to rob them. The incident took place at samrat jeweles located in pal e Guttahalli 2nd Main Road, just a few hundred meters from vyalikaval police station on Wednesday afternoon. Ashish and his wife Rakhi, the shop owners were in the store when two men entered armed in the guise of customers and asked for the specific design of jewellery, when Rakhi took out to show it to the duo ,suddenly one of them pulled out a gun and fired at the ceiling. Rakhi immediately picked up the chair and threw it at the man and her husband also tried catching the robbers . Ashish screamed for help causing robbers to flee.Staffers of nearby shop joined, while another robber waiting for his accomplices outside,flee the spot.  Soon after the incident a FIR was registered in vyalikaval Police Station and the team led by Sanjeev Gowda, the Police Inspector , worked for different clues available and was successful in catching the four accused. 1. The animal welfare Board of India is a statutory advisory body on animal welfare laws to promote animal welfare in the country. The Board ensure animal welfare laws in the country and provide grants to animal welfare organizations (AWO) and advise the central and state government on animal welfare issues. Since, one of the most important functions of the Board is to provide financial assistance to the recognized AWOs and then, the AWBI support the AWOs, if organizations are recognized by Board. Therefore, the Board invites the applications for recognition in the prescribed format.


               The Samast Mahajan is now adopted 25 villages in border area of Rajasthan for the rescue and rehabilitation. A total expenditure of RS. 1.76 crore have been spent so far for the rescue operation only. However, this amount is very tinny to complete the project and making the village self-depend by developing the natural and traditional system of a village

Anil Kumble should be chairman of selectors but BCCI needs to raise pay: Virender Sehwag

NEW DELHI: Former skipper Anil Kumble’s ability to boost confidence of the players makes him an ideal candidate for the role of chairman of selectors, said Virender Sehwag, who also advocated a hike in remuneration for the job.

Never to mince his words, former opener Sehwag said BCCI needs to pay more for heading the selectors’ committee.

The current selection panel, led by MSK Prasad, has faced a lot of flak for it being a lightweight with a cumulative experience of 13 Tests.

“I think Anil Kumble could be the right candidate for the chairman of selectors post. He is someone who has interacted with Sachin (Tendulkar), Sourav (Ganguly) and Rahul (Dravid) as a player and with youngsters as a coach,” Sehwag told reporters during launch of a new app ‘The Selector’.

“When I made a comeback (Australia series 2007-08), captain Kumble came to my room and said you will not be dropped for the next two series. That’s the kind of confidence a player needs,” said Sehwag.

However, Sehwag also said that he doesn’t think that Kumble will agree to do the job right now since the chairman gets Rs 1 crore per annum.

“BCCI needs to raise bar as far as pay is concerned. Then a lot of players will be interested,” said Sehwag.

Asked if he would also be interested in this post, Sehwag said that he doesn’t like too many restrictions.

“I write columns, appear on TV and being selector will mean a lot of restrictions. I don’t know whether I would like so many restrictions,” the Nawab of Najafgarh said.

Sehwag, who had lost the race to be India’s coach in 2017 to Ravi Shastri, said that he did not apply this time.

“In 2017, the BCCI secretary and (late) Dr MV Sridhar (GM Cricket Operations) asked me to apply so I applied. This time no one asked me, so I didnt apply,” said Sehwag when asked if he was amused in the manner Shastri was re-appointed the coach.

Sehwag also said he finds it difficult to comprehend the conflict of interest rules.

“I can understand that I can’t run an academy if I am a selector but if I am the national coach I don’t understand why I can’t run an academy,” he said.

As the talk veered towards playing XI for the first Test against West Indies, Sehwag’s vote went to Ajinkya Rahane if India played five bowlers.

“Ajinkya Rahane has been batting at No 4 (No 5) so if it is a case of five bowlers then he should play. Rohit Sharma comes in only if you go with four bowlers,” Sehwag reasoned.

He also felt that “Mahendra Singh Dhoni should have batted at number five” in the World Cup semi-final against New Zealand.

“Players like Hardik Pandya, who can play big shots should have come in at number seven towards the end,” said the former India captain.

He also expressed his happiness at S Sreesanth’s life ban being reduced to seven years.

“I am very happy for him. He now needs to play domestic cricket,” he said.

Sehwag was amused when he was asked about suggestions on wearing neck guards in the wake of Steve Smith recent injury.

Smith took a blow from England pacer Jofra Archer in the first Ashes Test and has ruled out of the third Ashes Test due to concussion.

“Why do you need to show your neck to the bowler? You have a bat and you are wearing a helmet. In my entire career, I never used chest pads,” Sehwag said.

A member of NADA’s anti-doping appeals panel (ADAP), Sehwag said filling the whereabouts clause was a real problem that bothered the Indian cricketers.

BCCI recently agreed to be NADA-compliant after years of resistance.

“I have appeared for many dope tests. Even in domestic cricket when I was out of the team, during IPL. The problem with whereabouts is I can’t pinpoint where I will be at a specific hour of the day on a specific date. I may mention it initially and then I might have a change in plan,” he said.

Three-time MLA from Malleswaram, Dr Ashwathnarayan is a doctor, politician and is also vocal in his concern for environmental issues.

Doc-turned ‘accessible’ 3-time MLA 

Three-time MLA from Malleswaram, Dr Ashwathnarayan is a doctor, politician and is also vocal in his concern for environmental issues. Soon after he took oath as minister on Tuesday at Raj Bhavan, he appealed to his followers to plant a sapling instead of handing out  flower bouquets and other gifts. “That would be the best gift to mother nature and me.’’

Known as the ‘accessible man of Malleswaram’, Dr Ashwathn arayan is the only MLA from Bengaluru who has not held a ministerial portfolio. Having carried out several pro-people initiatives, voters in his constituency remember him as the ‘phone call away MLA’. Be it street light issues, garbage issues or any other major issue, he makes sure to solve them.

He also served as Senate Member of Bangalore University, Syndicate and Senate Member of Rajiv Gandhi University of Health Sciences Employees Association. He studied in Bengaluru and did his MBBS from Kasturba Medical College, Mangaluru.  This doctor-turned-politician also served as president of Junior Doctor’s association. 

Prabhu Chauhan, 50, who hails from Bonthi Thanda of Aurad taluk, Bidar, told TNIE that he spent most of his life in Mumbai involved in the scrap business. He somehow managed to get into politics in Mumbai, and was a close follower of late Maharashtra CM Gopinath Munde. It is said that Munde sent Chauhan to Aurad, and former MLA Gundappa Vakil introduced Chauhan to B S Yediyurappa in 1999.

He got elected as MLA not only in the 2008 Assembly elections, but also in 2013 and 2018. Chauhan is the only MLA who got elected on a BJP ticket in 2018 from Bidar.Chauhan is currently inspecting flood-hit districts in Raichur. My seniority, commitment to the party and to the welfare of the people are the main reasons behind me getting a berth,” he told TNIE over the phone.Chauhan said that the immediate task before him is to develop Bidar, especially Aurad taluk, and all other works “entrusted to him by the chief minister.”

MLC and now minister in the state cabinet – Kota Srinivas Poojary was born on January 1, 1960 to Annappa Poojary and Lacchi Poojary, from Kota Thattu village in Udupi district. He didn’t have a political background, but his ‘fight for justice’ attitude has landed him in his present elevated position. Hailing from the Billava community, Poojary had discontinued his education due to poverty.

However, he his honed his skills and has written several columns on the panchayat raj system and the three-tier local governance for a Kannada daily.

His political journey started when he became a member of Kota gram panchayat in 1993. He became Udupi taluk panchayat member in 1996. He tasted defeat at the hands of K Jayaprakash Hegde when he contested as a BJP candidate in 1999 and 2004 in the state assembly election from erstwhile Brahmavara constituency. He was Inland Water Transport minister in 2012. He was re-elected as an MLC in 2015, and became the leader of opposition in the legislative council in 2018.

Mediation should become new mantra among lawyers: Justice M.N. Venkatachalaiah

Speaking at Legal Leadership Conclave, he said there was a loss of Rs 2 lakh crore per year as legal cases drag on and called for technological intervention. 

Bengaluru: Mediation should become the new mantra among lawyers before it escalates to any level, opined Justice M.N. Venkatachalaiah, former Chief Justice of India.

Speaking at the inauguration of the one-day Legal Leadership Conclave on “Challenges and Future of Arbitration and Mediation in India,” organised by India Legal Research Foundation, Justice Venkatachalaiah said with increasing number of litigants and cases, it was high time the country accepted and adopted mediation and arbitration as a formal legal route.

“We have 34 million pending cases across the country. Of the 22,000 subordinate courts in the country, there are a minimum of 120 litigants and 120 Lawyer’s plus witnesses who visit these courts everyday. Most of the time, they go back empty handed as their matters are delayed. This is a precious loss of man hours and we should not allow it to come to such a stage.”

Pegging such delays in economic terms, the justice said there would be a notional loss of Rs 2 lakh crore per year due to such delays. “Even if a reasonable amount of Rs 200 was spent by every person, the amount of money wasted in prolonged litigation and court visits is enormous,” he pointed out.

Justice Venkatachalaiah said the judiciary should adopt new tools and technology that will speed up the process and mitigate delays. “Recognising and giving more importance to arbitration and mediation of disputes is one way to reduce pending cases. Appointing more number of judges is not the answer as this also adds to spending,” he said.

The former CJ also said technology should be used to the optimum and even the use of Artificial Intelligence would be a big step. By just spending 5% of this cost in alternative dispute resolution mechanism, the people can benefit enormously. The Prime Minister, Law Minister and other stake holders should own up to this problem. “In days of digital dictatorship and digital divide, mediation is the right way in arbitration,” he added.

Union Minister for Highways, Nitin Gadkari said there was an economic slowdown in infrastructure building, especially in his sector of national highways, as contractors were being affected hugely due to delays in litigation.

Speaking from New Delhi, via a live feed, Shri Gadkari wished the conclave all the best and said time was very important and acknowledged that in many cases of litigations, arbitration was the best way ahead for the country.  

Justice B.N. Srikrishna, former Supreme Court judge, who headed a committee and gave recommendations on mediation as a forward looking idea, said even sovereign states should get into bilateral treaties and arbitration before third parties impose anything. 

He spoke on “Challenges and Reforms in Indian Arbitration and Mediation System – Way Forward” and said the 2015 Act was very clear as it was recognised as a cut-off-date as far as arbitration of disputes were concerned.

Justice Srikrishna also stressed on the fact that it is better to have institutional arbitration especially with Supreme Court and High Courts supervising such institutions.

“The future challenge is to make effective use of the new law which is a relevant and live substitute for antiquated laws,” he added.

Justice T.S. Thakur, former Chief Justice of India, who moderated the session, said the main challenge was that anyone should be able to access the arbitration mechanism.  “Even a small municipal contractor should have easy access to the arbitration mechanism to settle his dispute.”

He was also of the opinion that India should build an international and domestic arbitration hub.

Justice Alok Aradhe, Karnataka High Court judge and President of the Arbitration Centre said arbitration as a means of redressal featured even in the Upanishads. “It’s a very old system that we need to have. As there is a rapid escalation of trade, Parliament is bringing in Acts. These Acts facilitate quick disposal of commercial matters,” he said while speaking on “Challenges to Arbitral Awards – Commercial Courts and need for training of judges.”

He said State judicial academies should train judges in modern methods of arbitration.

Allies BJP-SAD cut into strongholds in Punjab

While the saffron party demanded more seats in the 2022 assembly elections, Shiromani Akali Dal wants the two-decade old seat sharing agreement to continue.

CHANDIGARH: All is not well between the alliance partners Shiromani Akali Dal (SAD) and Bharatiya Janata Party (BJP) in Punjab, as both parties have started aggressive membership drives in the state cutting into each other’s strongholds. 

While the saffron party demanded more seats in the 2022 assembly elections, Shiromani Akali Dal wants the two-decade old seat sharing agreement to continue.  The saffron party, which has reportedly enrolled 5 lakh new members in a month to its existing 23 lakh members, is eyeing for a bigger share of seats for both the assembly and Lok Sabha elections in Punjab. Currently, the BJP can contest on 23 seats in Assembly polls out of a total of 117 seats in the state and three seats in the Lok Sabha out of a total of 13 seats.

Meanwhile, senior alliance partner Shiromani Akali Dal has 55 lakh members and has also started an aggressive enrolment drive by appointing its sitting MLAs and former ministers as special supervisors to monitor the drive. 

The target of the party is to expand its base in urban areas where the saffron party has the base and the assembly segments of the BJP. The saffron party tried to make inroads in the constituencies of the Akali Dal.    

Clashes were witnessed between workers of both parties in Malwa region of the state last month.  Former Minister and SAD spokesman Daljeet Singh Cheema said that one should not disturb the decorum of the alliance and called for maturity so that the understating in both parties is maintained.

He said that the assembly elections are two and half years ahead and thus no statements should be made. Recently, Punjab BJP president Shwait Malik had hinted at the party expecting a bigger share of seats.
