Criminal, anti-terror laws should not be misused to quell dissent: SC judge D Y Chandrachud

New Delhi: The criminal law including the anti-terror legislation should not be misused for quelling dissent or harassment of citizens, Supreme Court judge Justice D Y Chandrachud has said while underlining the role of the apex court in protecting fundamental rights in challenging times.

Observing that the Indian Supreme Court plays the role of a counter-majoritarian institution , Justice Chandrachud said it is the duty of the top court to protect the rights of socio-economic minorities .

The Supreme Court has to act in furtherance of its role as sentinel on the qui vive (watchful guardian) and respond to the call of Constitutional conscience and it is this role that prompts it to address the challenges of the 21st century, ranging from the pandemic to the rise of intolerance, features which we find across the world, he said, adding that some termed interventions as judicial activism or judicial overreach .

Justice Chandrachud made these comments on Monday while speaking on the “Role of the Supreme Court in protecting fundamental rights in challenging times at a conference hosted by the American Bar Association with the Society of Indian Law Firms and Chartered Institute of Arbitrators.

He referred to the apex court’s orders on decongestion of jails during the COVID pandemic and said that while it is important that prisons are de-congested because they are highly susceptible to becoming hotspots for the virus, but it is equally important to examine why they are congested in the first place.

Referring to his judgement in the Arnab Goswami case, Justice Chandrachud said: The criminal law, including anti-terror legislation should not be misused for quelling dissent or for the harassment of citizens.

As I noted in Arnab Goswami vs The State of Maharashtra & Ors, ‘our courts must ensure that they continue to remain the first line of defense against the deprivation of the liberty of citizens. Deprivation of liberty even for a single day is one too many. We must always be mindful of the deeper systemic implications of our decisions, he said.

He said the role of the Indian Supreme Court and its involvement in aspects affecting the daily lives of the population of India cannot be understated.

While being acutely aware of this responsibility, the judges of the Supreme Court of India are careful to maintaining the separation of powers.

Many of its interventions have changed the course of Indian history – be it in protecting civil and political liberties which cast a negative obligation on the State or in directing the State to implement socio-economic rights as affirmative obligations under the Constitution, he said.

As the guardian of the Constitution, it has to put a break where executive or legislative actions infringe fundamental human rights. Even in the context of the separation of powers, the scheme of checks and balances through supervision results in a certain degree of interference by one branch into the functioning of the other.

Instead of imagining separate branches of government isolated and compartmentalised by walls between them, we should view their working taking effect in a complex interactive, interdependent and interconnected setting where the branches take account of and coordinate with the actions of the other, he said.

Justice Chandrachud said the top court has used various methods in holding the executive and legislature accountable, whether it is by striking down a law and ruling on its unconstitutionality, or by restraining to intervene in certain matters of policy or through its deliberative approach of making the executive and legislature aware of the constitutional implications of the decisions at hand.

Siddaramaiah attacks BS Yediyurappa over bank exam language row, calls Karnataka CM a "mouse"

Bengaluru: Accusing the Centre of betraying Kannadigas by not allowing candidates to take the Institute of Banking Personnel Selection exams in Kannada, senior Congress leader Siddaramaiah on Tuesday called Chief Minister B S Yediyurappa a “mouse” for not standing up to the Centre on it.

In a series of tweets with “#IBPSMosa” (#IBPSCheating) he hit out at the ruling BJP at the centre and the state on the issue and demanded the resignations of Union Finance Minister Nirmala Sitharaman, a Rajya Sabha member from the state, and also Yediyurappa if they cannot ensure justice to Kannadigas.

“Narendra Modi is betraying Kannadigas by not allowing candidates to take IBPS exams in Kannada.

Latest notification by IBPS is an example for BJP’s anti-Kannada stand.

Central govt should immediately address this and ensure justice to Kannadigas,” Siddaramaiah tweeted.

Noting that Karnataka has elected 25 MPs to the Lok Sabha, he asked “What are these MPs doing? Though slavery is abolished, BJP Karnataka MPs are behaving like slaves of Narendra Modi. Shame on them!!”

“Yediyurappa’s followers call him Huli (Tiger) but in reality he is ili (Mouse).

He hides in burrows when he has to stand up in front of Narendra Modi. Let him resign if he cannot ensure justice to Kannadigas,” he added.

Pointing out that IBPS had called for applications to fill more than 3,000 vacant clerical positions in 11 nationalised banks, of which 407 posts are in Karnataka, the former Chief Minister said injustice to Kannada will result in huge unemployment by leaving out Kannadigas in the competition.

“Candidates were able to write IBPS exams in regional languages before 2014. After BJP came to power, rules were changed to allow English and Hindi only.

We had even written a letter to Narendra Modi to protest against this,” he said.

Further, noting that most of the schemes of the Central and State governments are implemented through banks, on which farmers, labourers, women and many others are dependent, he said rural people are facing harassment from staff who don’t know Kannada.

“Being elected to the Rajya Sabha from Karnataka, Nirmala Sitharaman has constantly betrayed Kannadigas and Kannada.

She has continued the same with respect to IBPS exams.

She is unfit to represent people of Karnataka in Rajya Sabha.

Karnataka: KSRTC, BMTC buses to offer free transportation to SSLC students appearing for exams

Bengaluru: Karnataka State Road Transport Corporation (KSRTC) and BMTC buses in the state will offer free rides for students appearing for SSLC examination. The students will be able to avail services of the bus for free to and from their examination centres.

The students will have to present their SSLC exam hall tickets when asked by the bus conductor or driver during their travel.

The bus drivers and conductors have been instructed to not charge money from the students appearing for the exams that will be held from July 19 to July 22, 2021.

General secretary of state youth congress among 17 persons booked under Disaster Management act for organizing cycle rally violating guidelines issued by Karnataka government and city police commissioner in Sanjaynagar to protest fuel price hike during prohibitory order in force on Monday. 

Senior officer told reporters,that the protestors had applied for the permission to hold a rally from Baptist hospital to the race course to protest against fuel price hike.The police denied permission citing covid protocol and also warned them not to carry. 

Despite warning the rally was organised violating the protocol and the protestors did not wear any masks nor maintained social distance,Mr. Nagesh said in his complaint .

As a preventive measure the police seized the bicycles and stopped the rally citing coalitions of the prohibitory orders enforced by the city police commissioner.

The Sanjaynagar police have also seized five bicycles from Sandeep Kumar,Srinivasa BV,Raksha Ramaiah, Deepak Reddy,Ateequalla Khan,Bhavya KR and Akhil Ahmed and others and also charged the protestors under unlawful assembly, disobedience of order and under negligence act to spread infection and further investigation is on he added.

Conman posing as royal family member cheats women on Matrimonial websites arrested by Whitefield CEN Police

The Whitefield cyber crime police on Monday arrested a 33-year-old man who,claimed to be a member of the Mysuru Royal family and software engineer in Microsoft company in US,cheated women on matrimonial websites promising to marry them.

The accused has been identified as,Siddarth K alias Siddarth Urs alias Sandy alias Vinay alias Mutthu is a resident of Bylakuppe in Periyapatna of Mysuru district. 

Senior officer told media persons,A seventh standard dropout,the accused learnt to speak Spanish and English fluently with US accent and sent morphed photos of the royal family to gain the trust of the victims and lure them.

He befriended many Tibetans to learn different languages and ascents from them.

The accused has created fake profiles on various matrimonial websites.He expressed interest in some profiles and got the contact number of those who accepted his request.

 He claimed he was a member of the Mysuru Royal family of Urs and he worked for Microsoft company in the US.He also sent them morphed pictures of the royal family in which there were children and told them one of them was him.

He cheat them by speaking English in an American accent and Spanish languages.After gaining their trust,he told them there was a medical emergency and he needed some money. The gullible victims transferred the money to the bank account numbers given by him.

Siddarth was arrested following a complaint by a 30-year-old woman with the Whitefield CEN police.He was arrested based on her complaint and it was found he had created multiple fake profiles on matrimonial sites.He has admitted to his role in three such cases where he cheated women,including a lecturer,to the tune of Rs.42 lakh.We are investigating whether he has cheated women similarly.

The accused would use the bank accounts of villagers to get the money transferred from the victims,Siddarth has been taken into custody to ascertain his criminal background and further investigation is on.

Notorious House break theft four member gang arrested by Begur Police recovered stolen property Worth Rs.52 Lakhs

The Southeast Division police of Begur police have arrested a gang of four persons involved in 18 house break thefts and have recovered valuables worth Rs.52 Lakhs from them.

The accused have been identified as Devendra SL 24,a resident of Varthur,Ganesh Kumar,29 of Medahalli in KR Puram,Kantharaj,46 of Peenya, and Santosh,36 of Kadabagere Cross on Magadi Road.

Senior officer told reporters,a camera shop was burgled in which miscreants have theft cameras and Foto flash cameras and escaped in Begur police station limits.

As soon as the incident was reported Begur police inspector, Shivakumar Muchandi and his team rushed to the spot and after inspecting the crime scene the team collected CCTV footage from the vicinity and shop.

The team under the leadership of ACP,Pavan N inspector of Begur and his team swung into action and after obtaining identity of the accused from the CCTV footage the team were pressed into action based on the CCTV footage the team detained one person by name Devendra SL in connection with burglary case.

The inspector and his team questioned him in their style who confessed the crime and revealed his associates and based on his statement our team arrested his 3 associates who are part of the crime.

After arresting all the four accused the team grilled them who spilled the beans that they are involved in around 18 House break thefts and shop burglary cases across city.

Based on their statement the team recovered 1kg,09 grams of gold ornaments and 120 grams of silver articles,and cameras,photo flash cameras and other valuable items total worth of Rs.52 lakhs from them.

With their arrested we have managed to solve 10 cases of house break thefts registered in Begur, four cases each registered in Electronic City and Hulimavu police stations and further investigation is on.

The organized crime wing of CCB unearthed a cheating case and arrested 3 Car dealers and recovered 19 Hi-End Cars worth Rs.3 Crore

The CCB officials of Organized crime wing on Wednesday arrested three car dealers and recovered 19 high end cars worth Rs.3 crore from them.

The accused have been identified as Naseeb, Mohammed Azam and Maheer Khan used to lure owners of high end cars with best price offers and take their cars along with the documents.

Senior officer told media persons,three victim complainant registered complaint in Jnanabharathi,Vyalikaval and Pulakeshinagar police a few days ago.

They stated in their complaint that they have been cheated by a person who on the pretext of  buying car has escaped with their documents and when they call him and ask for the car and for the remaining the person who said them he is a car dealer has assaulted them and run away with car and documents too without our knowledge.

And when they call him to return the car and pay the remaining amount the miscreant used to threaten them with dire consequences.

Considering the magnitude of the cases,city police commissioner Kamal Pant entrusted the case to CCB.

As soon as the case was entrusted to CCB,Joint commissioner of police crime,Sandeep Patil led a special team under the leadership of DCP Crime-2 BS Angadi,team headed by ACP OCW, Parameshwar and team swung into action and visited the crime spot.

After obtaining concrete evidence our team was deployed as decoy and asked the car dealer to come to buy their car and as the car dealer agreed to come and see the car as ACP and team  rushed to the spot and rounded up the area and as soon as the car dealer came to fix a deal our team of police secured him.

After securing the accused the team grilled and during interrogation the accused confessed the crime and revealed in detail as.

The accused would either mortgage the cars and sell them in different cities and pocket the  Money.

The accused would abduct,assault and threaten them with dire consequences if they demanded for the money or ask for their vehicles back . 

Using this modus operandi,the accused have misused 19 high end cars and cheated over 3 crore from several people .

A team of police led by ACP, HS,Parameshwar and team recovered the cars sold in places including,Mysore,Bhatkal,Davanagere and Chitradurga and other places all the three are notorious.

The police are now trying to contact the owners to the vehicles for further investigations cases has been registered in various police station against the accused.

Covid positivity rate down, but mortality rate up in Karnataka

BENGALURU: Despite reporting a low number of deaths, Karnataka is seeing an increase in mortality rate. From July 1to 4, the state’s mortality rate was 1.23%, it increased to 1.24% between July 5 and 12, and on Tuesday, further increased to 1.25%.On June 30, Karnataka reported 115 deaths, which dropped to 93 deaths on July 1, and further dropped to 68 deaths on July 9, and 48 deaths on July 13. In the past seven days, some districts reported CFR higher then 10% — Haveri with 13.64%, Dharwad 16.86%, Ballari at 20.83% and Bagalkot at 35.71%.

After consistently recording a low number of cases, Bengaluru’s positivity rate has gone below 1%. An eight-week analysis by the BBMP war room shows that from having 18.65% positivity rate from May 17-23, the positivity rate dropped to 0.81%, from July 5 to 11.The total positive cases recorded from May 17 to 23 were 60,857, followed by 37,996 cases from  May 24 to 30, and cases dropped to 21,899 from June 1 to 6. The number dropped to 5,700 cases from June 21 to 27, and 4,188 cases from June 28 to July 4, and 3,516 cases from July 5 to 11. Tests also increased from 3,26,344 between May 17 and 23, to 4,32,561 between July 5 and 11.

On Tuesday, the city reported 401 positive cases with eight deaths, 12,671 active cases and 707 single-day discharges. Karnataka reported 1,913 new cases, which was slightly higher than Monday’s figure, when the state reported 1,386 cases. State’s positivity rate has gone below 8 per cent — from 7.96 per cent on Monday to 7.94 per cent on Tuesday.However, active cases have dropped drastically, from 65,312 to 34,848.

The West Division police of Annapoporneshwari   Nagar police,Byatarayanpura police and Kalasipalya have arrested three persons two habitual bike lifer and Drug peddler recovered twelve stolen bikes and gold ornaments worth Rs 10 lakh and 724 grams of Marijuana Seized.

The accused has been identified as,Hanumantha arrested by Annapoorneshwarinagar police and Imran Khan arrested by Byatarayanpura police station and a drug peddler identified as Navaz Pasha arrested by kalasipalya police.

Senior officer told media persons,The  Annapoorneshwarinagar police have arrested a habitual bike lifer and recovered seven bikes worth Rs 4 lakh from him. 

The accused Hanumantha was caught by the beat police while he was riding one of the stolen vehicle without documents.

The accused was brought to the station and a detailed questioning Hanumantha confessed that he was stealing bikes. 

Based on his confession the police recovered seven bikes which he had stolen from Jnanabharati,Kengeri,Annapoorneshwarinagar and Byadarahalli police station limits.

The Byatarayanpura police inspector MN Nagaraju and his staff arrested a habitual bike lifter,Imran Khan while they were on patrolling in the area to nab bike lifters

At the same time the Byatarayanpura police beat police found one person coming in dio bike the beat police flagged them and asked them to show their vehicle documents as he dint produced and confessed that he is stealing bikes and with this the team arrested him and based on his statement the crime team has recovered 5 stolen bikes and gold ornaments worth Rs.6 lakhs from him.

A thief thrives until the police arrives! @byatarayanpuraps team has arrested a person involved in several cases of vehicle robbery and house break-ins and thefts.Gold ornaments and 5 two-wheelers worth ₹6 lakh have been seized from the accused.Good job, team! Meanwhile the Kalasipalya police inspector and staff arrested a accused identified as Navaz Pasha and recovered 724 grams of Marijuana and bike used in crime from the accused who was planning to sell it on Dispensary road where he was caught red handed.

Two Habitual offenders bike lifters arrested by JC Nagar police stolen bikes Worth Rs.4.3 lakhs recovered

The North Division police of JC Nagar police arrested two habitual offenders and recovered seven stolen two wheelers Worth Rs 4.3 lakh from them.

The two accused name has been withheld due to new guidelines.

Senior officer told media persons,the JC Nagar police team were on patrolling near Nandidurga on Sunday during patrolling our police team found two persons moving suspiciously in the area and kept a close watch on their movements and when they found that the accused is trying to steal bikes.The two accused were caught red handed.

During investigation the duo confessed the crime and the team grilled them and the duo spilled the beans and based on their statement the team has recovered seven stolen bikes worth of Rs.4.3 lakhs from them.

A detailed investigation by the team it was revealed that the duo are habitual offenders arrested in 2016 for bikes theft cases.

After releasing on bail the accused were doing odd jobs but due to lock down, they lost jobs and resorted to their old habit of stealing bikes and selling them to throw away prices are now cooling their heels in jail.
