Manohar quits as BCCI president for ICC, Thakur favourite

New Delhi: Shashank Manohar today stepped down as BCCI president barely seven months after being appointed for a second term in place of the late Jagmohan Dalmiya and is all set to take over as first independent chairman of ICC.

Manohar leaves at a time when the board is being directed to comply with the Supreme Court-appointed Justice Lodha panel’s reform recommendations.

In a letter addressed to Thakur, Manohar said, “I hereby tender my resignation with immediate effect from the post of President of Board of Control for Cricket in India. I also resign with immediate effect as the representative of BCCI on the International Cricket Council, as also the Asian Cricket Council on which I was nominated by the General Body of BCCI. I thank all my colleagues and the staff for their support and cooperation during my tenure. I wish all of you all the very best in taking the cause of Cricket to greater heights.”

According to reliable sources, BCCI secretary Anurag Thakur is being tipped to take over the hot seat. IPL chairman Rajeev Shukla is also in the running along with Maharashtra CA president and business magnet Ajay Shirke.

As per BCCI rules, a Special General Meeting (SGM) has to be convened within 15 days, apprising the members of the current situation. It is the prerogative of secretary Thakur to call such a meeting.

As per norms, Manohar has also resigned from ICC chairman’s post as he was a BCCI representative at the apex body and resignation in country’s board effectively means that he does not stay as ICC’s chairman. His tenure was supposed to end in June, 2016, after which he was set to take over as the first independant chairman of ICC.

The 58-year-old Manohar will not be a representative of any country’s cricket board as per the changes recommended by ICC board and will need two independant members of the ICC Board to recommend his name.

According to BCCI sources, Manohar was waiting for the Supreme Court’s final verdict but since it will only come out after the apex court opens post summer vacation, the Vidarbha lawyer possibly did not want to wait.

A top BCCI administrator told PTI: “We all had an idea that Shashank will be quitting BCCI post. But let’s not get into a debate as to whether he has dumped a sinking ship or not. Whether it has been prudent on his part to quit when BCCI is going through tough times is a matter of conjecture.”

Many BCCI members are of the opinion that they expected Manohar to anchor the clean-up process till his tenure ends in 2017 September, but his sudden change of heart to go for safer confines of ICC in Dubai has left everyone in the lurch.

BCCI faces criticism from SC for resisting reforms

New Delhi: BCCI faced scathing criticism for maintaining that any judicial interference in its functioning would compromise its autonomy, with the Supreme Court saying the cash-rich sports body was resisting recommendations to reform and make its working “transparent and visible”.

The apex court also expressed its displeasure over BCCI’s stand that being a private and autonomous body, it cannot accommodate a nominee of CAG in it as suggested by the Justice R M Lodha Panel on the ground that it would be derecognised from the International Cricket Council (ICC).

“You are discharging public function… how best your functioning can be improved? It has to be transparent and visible .. the way you are doing (discharging your function) and how you are doing,” a bench of Chief Justice T S Thakur and Justice F M I Kalifulla said.

Taking note of the submission made by BCCI counsel and senior advocate K K Venugopal, the bench said “what we understand is that you are suggesting that I am answerable to Registrar of Societies. I will be accountable only to Registrar of the society. I will be amenable to criminal law but I will not reform. Don’t ask me to reform. Is it possible?

“What have you done? We have seen the allegations of match fixing and betting.

You have no control over these. But you give money in crores. The Lodha committee has said something. It has been said to make the functioning more transparent and visible and the effort is to reform the BCCI.”

“You are dealing with hundreds of crores of rupees. Do you say that you have complete immunity over it and you can’t be questioned? Do you say that you can’t be questioned how you spend hundreds of crores of rupees if not thousands that you collect from the public. Can we record that statement,” the bench observed.

Venugopal replied in affirmative to the bench’s suggestion that collection of funds by selling tickets and through advertisements, BCCI has total control over it and it cannot be questioned.

The bench said it was going into the issue but made it clear that it was not comparing BCCI with other sporting associations like wrestling, table tennis or kho-kho.

The senior advocate also replied in affirmative that the funds coming from the broadcasters through advertisements cannot be questioned by the court.

The bench was also not happy with the apprehension expressed by BCCI that presence of the government nominee or that of CAG will violate ICC rules and attract derecognition.

“How the presence of government nominee or CAG would violate ICC rules and attract derecognition? You are opposing the nominee of the CAG on the board as it would make you vulnerable to derecognition, but you are all advocating involvement of ministers and bureaucrats. Does it not create government influence or presence,” the bench asked.

The bench said the public money that BCCI was holding as Trust was for the promotion of the game of cricket.

“The money that you have is in your trust. Are you not accountable to the beneficiaries? This money is in trust with you for whose benefit. It is for the benefit of the people who watch matches. Are you not accountable to them?”BCCI said instead of following all the recommendations, “let us see whether there is another way” the Board can be reformed.

“We are now going to appoint a consultant for better management of our affairs,” Venugopal said, stressing that any attempt by the court to interfere would violate Article 19(1) (C) on fundamental right to form associations.

He reiterated BCCI’s position that they would account for their actions before the statutory authorities and said the board was implementing the Lodha Committee recommendations, but would not accept some of them, in respect of which the cricket body was protected by Article 19(1)(c).

The BCCI is averse to the Lodha Committee recommendations which puts a ceiling of maximum of two terms for office- bearers, one state-one vote, presence of CAG representative on the BCCI board and fixing 65 years as upper age limit of office bearers.

Senior advocate Ashok Desai, appearing for the Punjab Cricket Association (PCA), told the court that there could not be uniform rules for all cricket associations and neither a cap on age limit of office bearers.

While the Lodha Committee has recommended an age limit of 65 years, the PCA has an upper age limit of 70 years.

At this, the bench asked,”should there be an upper age limit at all? What is the age at which players retire?”

When the court was getting different type of answers, it asked at what age did Sachin Tendulkar retire.

“The Bharat Ratna retired at the age of 40,” the court said.

During the hearing, Venugopal complained that the press was giving a one-sided story on the development.

“You address a press conference and tell them you are not writing the things properly. We are not addressing press conference,” the bench said.

Venugopal said,”I don’t address press on the matter, I am arguing. These people are very cynical about BCCI.”

However, after he concluded his argument, the bench said “don’t think that everything is negative in BCCI.”

Drought: HC raps BCCI, suggests shifting of IPL out of Maharashtra

Mumbai: Rapping the BCCI and cricket associations in Maharashtra and Mumbai over water wastage when the state is reeling under severe drought, the Bombay high court on Wednesday said ideally Indian Premier League (IPL) matches should be shifted elsewhere, where there is no water crisis.

“Only if water supply to BCCI is cut, you will understand,” the court observed.

“How can you (cricket associations and BCCI) waste water like this. People are more important or your IPL matches? How can you be so careless? Who wastes water like this? This is criminal wastage. You know what the condition is in Maharashtra,” a division bench headed by Justices V M Kanade and M S Karnik said, while hearing a PIL filed by NGO ‘Loksatta Movement’.

The court also asked whether according to BCCI and the other cricket bodies, cricket matches are more important.

“Ideally, you should shift the IPL matches to some other state where water is in abundance,” the court observed.

The court also told the state that ultimately it is the government’s responsibility and duty to do something about this (water wastage) and impose some kind of restraint.

It also asked the state government to spell out tomorrow what steps it plans to take on the issue.

The high court, while posting the PIL for hearing today, had yesterday sought responses from all other respondents, including the Maharashtra Cricket Association Stadium, Vidarbha Cricket Association, Maharashtra government and the civic bodies of Mumbai and Nagpur.

The PIL has challenged the use of nearly 60 lakh litres of water to maintain pitches at three stadiums in the state which will hold IPL matches.

The court today asked the Mumbai Cricket Association how much water would be used in Wankhede stadium, to which MCA’s advocate said they would be using over 40 lakh litres water for the seven IPL matches to be held there.

To this, the court said it is a huge number.

The petitioner then said that pending hearing of the PIL, the court should grant an interim order restraining all the cricket associations in Maharashtra from using water to maintain the pitches.

The high court said it will consider the interim relief sought by the petitioner, during the hearing tomorrow.

The court also asked state acting Advocate General Rohit Deo to appear for the state government in the matter tomorrow.

Brihanmumbai Municipal Corporation’s advocate Trupti Puranik told the high court today that they are supplying water to Wankhede stadium only for drinking purposes.

MCA’s advocate told the court that they are purchasing water to maintain the pitches. This water is non-portable and cannot be used for drinking purposes.

He also said that the association will come out with some contingency plan to tackle the water crisis.

The advocate appearing for the petitioner, however, said several villages in Maharashtra do not even have water for sanitation, cooking and other purposes. This non-portable water could be of use in such villages.

The court also observed that water shortage is not just in Marathwada region, the situation is equally bad in Thane, adjoining Mumbai.

The petitioner’s lawyer then pointed out that from April 5 to 9, there will be absolutely no water supply in Thane.

The court also noted that in some places in Maharashtra, prohibitory orders under section 144 has been imposed in the vicinity of water supply spots.

Notably, authorities in Parbhani town and Latur in the parched Marathwada region of the state, which is experiencing an unprecedented water scarcity this summer, have imposed prohibitory orders near water supply spots in the town.

RCB intimates BCCI about Mallya resignation, Adams new boss

New Delhi: IPL franchise Royal Challengers Bangalore has written to the Indian cricket board (BCCI), intimating them about Vijay Mallya’s resignation from the post of Director of Royal Challengers Sports Private Limited (RCSPL).

According to reliable sources, the top BCCI officials in the IPL governing council received an e-mail on March 7 from franchise official Russell Adams, informing the board about the current ownership status in the franchise. It was five days after the troubled business tycoon left India for United Kingdom.

“Yes, we received an e-mail communication from Russell Adams, who will now be the man in-charge of the RCB team. The e-mail stated that Dr Vijay Mallya has resigned from his post as Director of RCSPL and will only be an Honorary Chief Mentor till his son Siddhartha is in the Board of Directors,” a senior BCCI official, in the know of things told PTI today.

The letter stated that Siddhartha Mallya will be present in the Board of Directors “in a limited role should the members wish to consult him”.

Adams, who is a Vice-President (Commercial Operations and Cricket Academy at RCB), also made it clear that there will be “no change in ownership pattern” due to Mallya’s resignation.

The BCCI official said that clarity on ownership was required after Mallya’s resignation.

“BCCI has some strict rules and regulations in place regarding franchise ownership changing hands. The owners need to intimate BCCI beforehand whether there is partial or complete transfer of stake. As of now they have made it clear there is no change in ownership pattern in RCSPL which is a subsidiary of United Spirits, which is controlled by Diageo,” the official said.

Mallya, who has defaulted in loans in excess of Rs 9000 crore, is facing probe by various investigative agencies.

The 60-year-old bought RCB in 2008 but the popular franchise has not been able to win a single Indian Premier League title in eight attempts.

BCCI revenue may dip from Rs. 2000 crore to Rs. 400 crore

New Delhi: BCCI is set to suffer a financial loss to the tune of Rs. 1600 crore if Lodha Panel’s recommendations on curtailing the advertisement breaks during the matches is implemented.

It is feared that in the wake of loss of revenue not only the smooth functioning of country’s richest sporting body will be hit but also the development of junior cricket in the country.

According to BCCI balance sheet, the operative revenue currently is approximately Rs. 2000 crore, a large chunk of which comes from broadcasting rights and advertisement revenues.

But if Lodha Panel recommendation, which wants the advertisements only during “lunch, tea or drinks break”, then it would come down to Rs. 400 crore.

According to a reliable source in the board, the Star Sports, which has the broadcasting rights of BCCI’s matches, currently gives Rs. 43 crore per match and such a rule could see BCCI earning as less as Rs. 8-10 crore per match.

“Yes, it is true that we are facing a situation which could lead to a revenue loss of Rs. 1600 crore. Star Sports will renegotiate their deal and may be pay us only 20-25 percent of the amount that we get currently per match. Ditto for IPL broadcasters,” a source in the know of things said on conditions of anonymity.

The far-reaching implication of this could mean that during India’s away tours, the hosts countries such as England, New Zealand or Australia will earn more than India out of the broadcast deals.

According to insiders, there are chances that BCCI’s age-group structure, which is one of the most robust in world cricket, will be badly hit if this recommendation comes to effect.

BCCI spends around Rs. 750 crore (approx) on subsidies to state associations, Rs. 400-450 crore (approx) on match-fees and allowances of players right from U-16 to the senior teams.

Save this, another Rs. 350 crore (approx) is spent to conduct around 2000 BCCI matches from U-16, U-19, U-22 to Ranji Trophy across the country.

The former first-class cricketers and international cricketers get monthly pension for which another Rs. 25 crore is spent by the board.

When the BCCI source was asked about the implications of the possible hit in revenue structure, he replied, “The biggest hit could be the age-group matches, U-16, U-19s and the various camps that are organised. The money generated through IPL and international broadcasting rights is used for development of junior cricket which will not be possible then.”

Supreme Court asks BCCI to fall in line with Lodha panel recommendations

The Supreme Court on Thursday gave a stern message to BCCI asking it to “fall in line” with the recommendations of Justice R M Lodha Committee which has suggested a massive restructuring of the country’s apex cricket body.

The apex court said the recommendations are “straight, rational and understandable” and “deserve respect” and “there is no reason to disagree with the committee” which has the most “illuminated and respected members of the legal community”.

While four weeks time was granted to the Board of Control for Cricket in India (BCCI) to respond on the implementation of the recommendations of the Lodha Committee, the court made it clear that since ample opportunity was given to all stakeholders over a long period and their views were taken into consideration before preparing the final report, there should not be any difficulty in accepting the recommendations.

The remarks by a bench headed by Chief Justice T S Thakur came after senior advocate Shekhar Naphade, representing BCCI, said there was a need to consult the 30-odd members of the Board on the recommendations and in view of its legal committee’s meeting on February 7, four weeks be allowed to respond.

However, the bench said, “They all have been heard and have given their views to the Committee. Ask your client to take a strict view of the recommendations. You can’t jump the gun.

You must see the recommendations. These recommendations deserve respect. They have come from the most illuminated and respected members of the legal community. They had invited people and have done extensive deliberations with all stakeholders. The recommendations are straightforward, understandable and rational.”

“The best thing is to fall in line and follow the suggestions to save the trouble,” the bench, which also comprised Justice F M I Kalifulla, said.

“Ultimately any transition and change has to come with whatever problems it has,” the bench said while accepting the Committee’s report which also exonerated former Chief Operating Officer of IPL Sunder Raman of all charges.

The BCCI had submitted that it should not be seen as “obstructionist” and it would come back with “concrete suggestions” after the meeting of the legal committee.

However, the bench said “decks must be cleared for complete reform”.

When Naphade said several technical problems would arise in implementing the recommendations of the committee as BCCI is registered under the Tamil Nadu Societies Registration Act, the bench said it would give the solution for following the suggestions.

“We will find an easy solution. We have simple solutions.

We will accept all recommendations. We will say that since BCCI has difficulties and impediments in respecting and implementing the recommendations, we will direct the same committee to push all recommendations. They will tell you where to get the registration. We will ask the judges (in the committee) to help BCCI in implementing the recommendations.

“We don’t want or intend or dictate a lengthy order. We want and we would end by directing that committee to steer the BCCI in implementation of the recommendations,” the bench said.

Realising the tough stand taken by the bench, Naphade said “I can see the writing on the wall.”

The bench said there was not much complication in the recommendations and if BCCI found any anomaly it can be looked into.

“There is no reason to disagree with the committee,” the bench said while making it clear that some people are going to be affected by the implementation of the Justice Lodha Committee’s recommendations.

The bench, which was hearing the plea filed by Aditya Verma, Secretary of Cricket Association of Bihar, on whose petition N Srinivasan was asked by the apex court to step down as the BCCI President for conflict of interest, posted the matter for further hearing on March 3.

BCCI announces India’s T20 squad for Sri Lanka series, Kohli rested

New Delhi: Vice captain Virat Kohli was today rested for the upcoming Twenty20 series against Sri Lanka as selectors included all-rounder Pawan Negi for the three-match rubber, beginning February 9.

Kohli was in supreme form in the just-concluded Australia T20 series, where he scored 199 runs at an average of 199 with three half-centuries.

Kohli has played 10 One-dayers and five T20s apart from four Test matches from the month of October to end of January.

Roookie all-rounder Negi, who has played under MS Dhoni for the Chennai Super Kings in IPL, and had a reasonably successful Mushytaq Ali and Deodhar trophy, has been brought as a cover for Ravindra Jadeja.

Manish Pandey has also been rewarded for his match-winning century in the Sydney ODI against Australia as the selectors named him in the 15-member T20 squad.

The selection panel chose to drop Rishi Dhawan, Gurkeerat Mann and Umesh Yadav from the squad. All three had not struggled during the Australia tour, failing to put up any notable performance.

Making a comeback was paceman Bhuvneshwar Kumar, who had missed the T20 series after injuring himself during the ODIs.

The selectors also named the squads for the women’s limited over series against Sri Lanka, to be led by Mithali Raj.

The series will begin in Pune (February 9) and followed by matches in Ranchi (February 12) and Visakhapatnam (February 14).

The eves had scripted history by defeating three-time world champions Australia in a T20 series, which was held simultaneously with the men’s series.

The women’s ODI series is scheduled to be played in Ranchi from February 15 to 19 while the three-match T20 series will be held from February 22-26.

BCCI imposes life ban on Chandila; Hiken banned for 5 years

Mumbai: Haryana off-spinner Ajit Chandila was slapped with a life ban for his involvement in the 2013 IPL spot-fixing scandal, while Mumbai batsman Hiken Shah was handed a five-year suspension for making a corrupt approach to a fellow player as the BCCI disciplinary committee sealed their fate after a meeting here today.

However, the committee, headed by BCCI President Shashan Manohar and comprising Jyotiraditya Scindia and Niranjan Shah,deferred a decision on Chandila’s co-accused Pakistani umpire Asad Rauf till February 12, giving him a final deadline of February 9 to file his reply.

The 32-year-old Chandila, an off-spinner who was found guilty of spot-fixing during his stint with Rajasthan Royals, was handed a tougher punshiment for violating the codes pertaining to accepting bribes, fixing, underperfoming, trying to induce a fellow player and betting.

“He is held guilty of misconduct and corruption within the Articles 2.1.1; Article 2.1.2; Article 2.1.3; Article 2.1.4; Article 2.2.2; Article 2.2.3; Article 2.4.1 of the BCCI Anti Corruption Code.

Ajit Chandila is banned for Life from playing or representing cricket in any form or to be associated in any way with the activities of the Board or its Affiliates,” BCCI Secretary Anurag Thakur said in a statement.

“The endeavour of BCCI is to clean cricket and any kind of malpractices will be dealt with severely,” Thakur later said at a promotional event. Batsman Shah, on the other hand, was found guilty of making a corrupt approach to a fellow Mumbai player in the domestic circuit.

“He is held guilty of committing breach of Articles 2.1.1; Article 2.1.2 and Article 2.1.4 of the BCCI Anti Corruption Code. Hiken Shah is banned for five years from playing or representing cricket in any form or to be associated in any way with the activities of the Board or its Affiliates,” the BCCI Secretary said.

The hearing of Rauf was scheduled for today but he did not appear in person and sent a reply stating that “no fair enquiry has been conducted in his matter and hence a de novo enquiry be held by appointing another enquiry officer.” The request was rejected by the Disciplinary Committee.

“The Committee gave him a final opportunity to submit his written statement if any, and produce documents on which he proposes to rely on before February 9, 2016. The date of the hearing and the final order has been scheduled for February 12, 2016 at Cricket Centre, Mumbai,” the BCCI said.

Chandila and Shah had appeared in person before the Committee on December 24 last and were given time till January 4 to file a written response to the charges against them.

The panel met again on January 5 when Shah appeared in person, made an oral submission and a written reply to the findings of the enquiry against him.

Lodha panel recommends separate BCCI, IPL governing bodies

New Delhi: The Justice R.M. Lodha Committee on Monday proposed separate governing bodies for the Board of Control for Cricket in India (BCCI) and the Indian Premier League (IPL) in a bid to partially segregate their functioning, while also suggesting a one-state-one-member pattern for the board.

Submitting its report to the Supreme Court, the three-member committee comprising its former chief justice, Justice Lodha, as also Justice Ashok Bhan and Justice R.V. Raveendran – former judges of the apex court – suggested reforms in the Indian cricket board and announced a slew of measures, among them that the IPL governing body should be of nine members with the secretary and the treasurer of the BCCI as its ex-officio members.

Two other members of the IPL governing council will be nominated or elected by the full members. Of the remaining five, two will be the nominees of franchises, one will be a representative of the players association (that is to be formed) and one will a nominee of the Comptroller and Auditor General of India.

Among other key recommendations, the panel stressed that one representation for one state is a fair idea and one association of each state will be a full member of the BCCI and have a right to vote. Other members from a state, or those without territory or competitive presence — Services, Railways, CCI, NCC — were relegated to associate status without voting rights in the BCCI.

The Lodha panel also recommended the appointment of a Chief Executive Officer (CEO) to manage the day-to-day affairs of the BCCI. The CEO will be assisted by six professional managers. The Lodha panel said the CEO and his managers will be responsible to an apex council that will be comprised of nine members — five elected, two representatives of players association, and one woman.

The Lodha committee has also sought to put some restrictions on the BCCI office-bearers: they should not be aged more than 70, should not be ministers or government servants – and cannot hold office for more than three terms, with a a “cooling-off” period between terms.

Lodha reckoned that a robust agent registration system would safeguard players. There will be a steering committee to include former star all-rounder Mohinder Amarnath, former India women’s captain Diana Eduljee, and legendary leg-spinner and former Test skipper Anil Kumble. They will take up matter with BCCI for formation of players’ association in light of suggestions from the report.

Lodha said the panel prepared an extensive questionnaire and interviewed several BCCI office bearers, stakeholders in Indian cricket, former national captains, including Bishan Singh Bedi, Kapil Dev, Sourav Ganguly, Sachin Tendulkar, Rahul Dravid and Kumble to finalise its report.

BCCI has officially invited us to play in India: Shaharyar Khan

Karachi: The BCCI has officially invited Pakistan to play its ‘home’ series in India in December, Pakistan Cricket Board (PCB) chairman Shaharyar Khan said today.

Shaharyar told the media in Lahore that he was given a formal proposal by his Indian counterpart Shashank Manohar during a phone call yesterday.

“Shashank Manohar called me up on Friday evening and told me they have got clearance from their government to play against us. But he said they wanted to play the series in India and not in the UAE,” Shaharyar said.

“Manohar also said that the Indian board would provide the best security to our team and schedule the matches in places like Mohali and Kolkata where there is no problem at playing a Indo-Pak match,” Shaharyar added.

“Thirdly he said that the Indian board would devise a formula to ensure that we don’t suffer any loss of revenues for playing our home series in India,” he said.

The PCB chief said that he had however informed Manohar that Pakistan would like to play the series in December in UAE as per the MOU signed with the BCCI.

“Why should we play our home series in India and not in UAE which is stated in the MOU and there is the matter of security for our team and plus the nearly USD 50 million that we expect to earn from hosting the series,” he said.

“I told Manohar how can we play in India when there is so much anti-Pakistan sentiments there by some of their groups.

We have played our last two series in India and I think it is time we now got to host the series,” Shaharyar said.

The PCB chief however said he was not authorised to take a decision on Manohar’s offer and he would consult the board of governors when they meet on 17 November.

“But more importantly I have to first also seek clearance from the prime minister for any decision we take. At the moment I have told the Indian cricket chief to send us a detailed proposal in writing,” he said.

Interestingly, the chairman of PCB’s executive committee Najam Sethi today told the media that he would advise the board not to accept any offer from BCCI to play the series in India.

“In my personal opinion we should not go to India as it is our home series and the BCCI should honor the MOU they signed with us which states Pakistan will host this series,” Sethi said.

Sethi was chairman of the board when the PCB and BCCI signed a MOU last year under which the two countries will play six series against each other between 2015 and 2023 with Pakistan hosting the first series in December this year in UAE.
