CBI Chennai office likely to handle DK Ravi's case

March 24, 2015 by Nasheman

D-K-Ravi

Bengaluru: The Chennai office of the CBI has a homicide and burglary squad which is likely to handle the case of DK Ravi once referred by the state government to the CBI HQ through the MHA, which may take another couple of days. This is subject to the headquarters not appointing any special team for the purpose, sources said.  “But given the heat generated by Ravi’s death, a special team handling the matter cannot be ruled out,” they added.

“Normally, in such cases, the case will be either handed over to the CBI office nearest to the place of crime, or a special team will be formed,” police sources familiar with the way the CBI works said. The nearest CBI office in Bengaluru is headed by an officer of the rank of superintendent of police but this chapter specializes only in ‘anti-corruption and banking frauds’ and officials are not well equipped to investigate cases like the one on hand, the sources pointed out.

A fresh line of inquiry?

CBI sleuths will start afresh from the scene of crime and parallel question officials from the CID and city police, and forensic science laboratory experts who have handled the case till now, sources said. Advocates say they can register a case of murder under section 302 and start the investigation from that angle till they reach a conclusion.

Investigating officials will collect all material evidence, documents, statements and related things from the CID and local police. The video CD of the postmortem will also be taken by the CBI.

If required, the CBI may go in for another postmortem, send viscera samples to special labs in Delhi and Hyderabad. Ravi’s call detail records (CDR) for the past six months have been already taken by the CID and if needed, the CBI will get more CDR, sources said.

The investigators will also keep an eye open for any tampering or destruction of evidence, if any, during the course of investigation by local authorities.

Siddaramaiah government refers DK Ravi case to CBI for investigation

March 23, 2015 by Nasheman

D-K-Ravi

Bengaluru: Karnataka Chief Minister Siddaramaiah on Monday decided to handover the death case of IAS officer D K Ravi to the Central Bureau of Investigation (CBI) for investigation.

“I have decided to handover the case to the CBI for investigation. I had said that CID will investigate and a senior official of CID had started the investigation. We will give a status report on the investigation while the assembly is in session, but even that is not acceptable to the opposition,” said Siddaramaiah in the Karnataka State Assembly.

Before calling for a CBI probe in the case, he said the government’s objective was not to cover up anything and that it is not trying to protect anybody. “This government wants to give fearless environment for officers to work efficiently. We have faith in our police. I have not criticized the CBI and not said anything against it. The CBI is an institution that works independently, so does the CID,” he added.

He further said that he has faith in the police, the CID and democracy. “One shouldn’t do politics over death. We are not here to make political capital over deaths,” he added. The chief minister’s political capital remark was met by an opposition uproar in the assembly.

Earlier in the day, Congress president Sonia Gandhi wrote a letter to Ravi’s wife assuring her of a fair probe in the death case of her husband. Karnataka Pradesh Congress president G Parameshwara had earlier on Saturday requested Siddaramaiah to order a CBI inquiry into the case and had said that the truth in this matter should come to the fore without any confusion.

Ravi, posted as Joint Commissioner in Commercial Tax Department, was found hanging from a ceiling fan in his apartment by his wife on March 16. The police suspect it to be a case of suicide, though no note was found from around the officer’s body.

The state government, which ordered a probe by the Criminal Investigation Department (CID) in the case, has so far ruled out a CBI inquiry.

Massive Violations of Karnataka High Court directives makes a mess of Mavallipura, again

March 21, 2015 by Nasheman

Mavallipura

Since August 2012, when the landfills of Mavallipura were forced shut by orders of the Karnataka State Pollution Control Board as the landfill operator M/s Ramky had not complied with pollution control norms, and consequently caused widespread damage to environment and public health in nearby villages, there have been repeated efforts by BBMP to revive the landfills on one pretext or another. Responding to various Public Interest Litigiations on this issue, the Hon’ble High Court of Karnataka has been categorical that landfilling in commons lands, forests and lakes in villages around Bangalore cannot be a solution to garbage management. (High Court orders may be accessed at: http://tinyurl.com/l88havp)

The frequent, specific and exhaustive orders of the Court to tackle various problems of waste management in Bangalore has resulted in a progressive strategy of segregation and management of waste at source with environmentally friendly technologies that pose no risk to public health.

The Court has gone into the minute details of the waste stream in Bangalore and directed that Bulk Waste Generators (Kalyana Mantaps, Apartments, Institutions, Office Blocks, Bus/Train Stations, Markets, Malls, etc.) would be responsible for their waste which they would manage by setting up stations locally to manage segregated waste, compost/bio-methanate organic waste, recover all recyclables for further processing, and also minimise waste generation. For households and neighbouhoods, the Court directed that dry-waste collection centres and composting units must be set up in each ward, and that the effort must be to ensure that all waste is managed locally and not be trucked out to landfills which not only destroy villages, but also involve wasteful investment in enormous quantities of diesel. The Court has also taken stern action against truck lobbies that tended to leach valuable resources, and on a thorough evaluation brought down the annual expense of trucking waste out from Rs. 800 crores to about Rs. 300 crores.

Justice Mr. N. Kumar and Justice B. V. Nagarathna of the Karnataka High Court have been monitoring the situation regularly, and have also directed that punitive actions should be initiated against anyone who does not comply. To ensure there is widespread public participation and transparency in waste management operations, the Court directed the State Government to set up Constitutionally mandated Ward Committees, which were required to be set up two decades ago. When the High Court learned that BBMP had not paid Pourakarmikas (who are amongst the poorest of the poor) their due wages for over 6 months, the Court observed “the Special Commissioner will have no moral authority to call upon the persons to perform their functions in the matter of solid waste management unless the bills submitted by them are cleared expeditiously”. This forced the BBMP to release Rs. 120 crores of pending payments in March 2015.

Gross Mismanagement at Mavallipura

In the case of Mavallipura, the Court has been clear and categorical that no more landfilling would be allowed. The Court has directed BBMP to initiate bio-mining and remediation of the legacy waste and BBMP is on record in Court that it has issued tenders. That was six months ago. Yet, absolutely no action has been initiated to take care of the legacy waste till date.

When the Chief Minister of Karnataka took a decision to close down the Mandur landfill on December 1st, 2014, and garbage piled up all over the city, the High Court allowed only a small amount of segregated organic waste to be taken for composting at Mavallipura to the capacity of the windrow platforms, and ensuring all necessary precautions are in place. The concerns of Yelahanka Air Force Base that birds attracted to the landfill seriously threatened the flight movements of defense aircraft was taken note of, and BBMP was directed to ensure the entire facility was covered and made bird proof. In addition, the Court directed BBMP to provide drinking water daily to all the affected villages (as all wells and tubewells have been contaminated), ensure that health surveys and cattle surveys were done in collaboration with 5 affected Panchayats, and initiate various public health measures to tackle the adverse impacts.

Instead, BBMP has resorted to bring unsegregated waste, upto 200 tonnes per day on most days, and resorted to dumping the waste at the landfill. There is no effluent treatment plant to treat the leachates, which find their way into local streams and ponds. Cattle deaths are frequent and the suffering of the local villagers from the pollution continues. Thousands of birds hover over the landfill, and this presents a clear and present danger to the flight movements of Indian Air Force. (Attached is the affidavit filed by IAF in the High Court, that highlights the grave risks the landfill poses to the defense of the country.)

Talks with BBMP Spl. Commissioner ends in failure

On 18th March 2015, Mr. Darpan Jain, IAS, Spl Commissioner (SWM) of BBMP held a meeting with representatives of impacted villages as directed by the High Court. But this meeting ended without any resolution. This was because BBMP was not willing to commit to any time bound action plan, thus violating its commitments before the Court.

When Bhargavi Rao of Environment Support Group read out various Court directions relating to cleaning up Mavallipura and providing relief to local communities issued over the past two years, Mr. Jain kept saying “we are making efforts to comply”. “They all sound so insincere and empty to us”, Bhargavi replied. Srinivas, a Gram Panchayat Member and leader of Dalit Sangarsh Samithi explained how, till date, not a single one of the directions of the Court have been complied with by BBMP. Ramesh, another Gram Panchayat Member, highlighted how the failure to deliver, despite High Court directions, had resulted in an utter lack of faith in Mr. Jain’s assurances, coming as they did without a plan or budgetary support.

Dhanraj of Mavallipura was so frustrated at the end of this 2 hours back and forth with Mr. Jain, that he told the Spl. Commissioner that they have not come for charity, but to assert their Fundamental Rights to Live peacefully, healthily and productively like everyone in Bangalore. He said that to throw some water and mosquito nets at the suffering communities was like rubbing salt into their wounds. Geetha, who lost her husband to cardiac arrest on 23 August 2012 when police lathi-charged villagers peacefully protesting against the illegal operation of the landfill by Ramky, asked how she was to survive with Rs. 4000/month she earns doing coolie work. She said not one rupee has been paid in compensation by the Government, despite all sorts of assurances from all sorts of Commissioners, that she is now homeless and forced to support her three daughters all on her own.

Mr. Darpan Jain was not able to make a single commitment specifically and convincingly. All he did was to assure villagers BBMP was serious in conforming with the High Court directives. Shocked and dismayed by Mr. Jain’s lack of intent in initiating concerted action to tackle their problems, the villagers were forced to return empty handed.

“Garbage Gumma”

People of Mavallipura and other villagers are keen that this problem receives the attention it deserves at all levels: from the household and community all the way to the Chief Minister. They assert that the Right to Life and Livelihood of villagers is as critical as those of residents in metropolitan Bangalore. To raise the consciousness of residents of Bangalore to conform with the directions of the High Court and to also take responsibility for the waste they generate, which is literally killing and maiming people in villages and destroying their livelihoods and health, the villagers inspired Gollahalli Shivaprasad, noted poet and lyricist, to compose a series of songs into an album called “Garbage Gumma”. Set to tune by Shivaprasad and his team, these songs are being made available free to all online.

Bengaluru: Karnataka Chief Minister Siddaramaiah on Saturday, March 21, assured that his government will not protect anyone in the IAS officer DK Ravi death case.

“The government will not hide anything… will not protect anyone,” Siddaramaiah said amid pressure on his government to hand over the death probe to the Central Bureau of Investigation (CBI).

Even Congress president Sonia Gandhi wrote to the Karnataka CM on Friday, March 20, asking him to hand over the investigation to the CBI.

Siddaramaiah said he will speak to Ravi’s parents once his post-mortem is out.

“Have told the parents of DK Ravi that I will speak to them after his post-mortem report comes in and is examined. We also want the truth to come out, that’s what I have promised to the parents,” the CM said.

“I have been in politics for 35 years. I understand people’s sentiments and respect them. More importantly, I have promised the parents that I’ll get to the truth,” Siddaramaiah said further.

The Congress leader said he will make his stand clear on the floor of the House. All the information will be given in the Assembly on Monday, he added.

He rejected Opposition allegations that his government was trying to hide the truth.

“Opposition is making allegations for the sake of politics. I am not interested in burying the truth, that’s not my business,” said Siddaramaiah.

There has been a clamour for CBI probe into Ravi’s death from Opposition parties and the family of Ravi who was found hanging from a ceiling fan in his flat on Monday.

Stepping up the pressure, BJP and JD(S) MLAs had on Thursday marched in a procession from Vidhana Soudha, the state secretariat, to Raj Bhavan and requested the Governor to advise the Siddaramaiah government to refer the case to CBI.

New Delhi: Congress chief Sonia Gandhi has written a letter to Chief Minister Siddaramaiah urging him to recommend CBI probe into the mysterious death of IAS office DK Ravi.

Home Minister Rajnath Singh has also reportedly spoken to Siddaramaiah advising that the state should opt for a CBI inquiry.

According to media reports the state government has decided to change its stand on this issue and it may now agree to handover the probe to CBI.

Today, the Opposition members once again created uproar in the Karnataka Assembly demanding a CBI probe in the incident. Following this, the Assembly was adjourned till Monday 11 am.

The latest development came after CM Siddaramaiah’s earlier decision to refuse demand of CBI probe. He had said, “This is not a case to be handed over to CBI.”

35-year-old Ravi, a popular bureaucrat for being honest and gutsy in taking on the sand and land mafia and tax evaders, was found hanging from a ceiling fan at his room in a flat here on Monday evening.

On Thursday, IAS officers from state had signed an online petition to Narendra Modi to press for their demand of CBI probe.

The case is currently with the state Criminal Investigation Department (CID).

Opposition protest over DK Ravi death forces Assembly adjournment

March 19, 2015 by Nasheman

assembly-karnataka

Bengaluru: Opposition parties continued their dharna for the third day today in the state Assembly demanding a CBI probe into the mysterious death of an upright IAS officer, forcing its adjournment till March 23, as protests over the death persisted across the state.

As the Assembly met, BJP and JDS members, continuing their round-the-clock dharna for the third day, raised slogans insisting on a CBI probe, as government remained unrelenting in its stand that CID was competent enough to do it.

Amid the din, a bill was introduced and a condolence message read out over the passing away of Tulu language film actor Tailor, with the opposition members remaining in the well of the House.

Higher Education Minister R V Deshpande said the government would ensure a “transparent” inquiry into the death of D K Ravi, who was found hanging from a ceiling fan at a room in his apartment on Monday evening.

Government has maintained that it was prima facie a case of suicide, but the opposition parties and the family of the IAS officer have refused to accept the theory and are seeking a probe by CBI.

Opposition BJP leader Jagadish Shettar said the House was not in order but as the ruckus continued, Speaker Kagodu Thimappa abruptly announced adjournment of the House till Monday.

Joining hands, BJP and JDS MLAs staged a dharna in front of the Mahatma Gandhi statue near the Vidhana Soudha, the state secretariat, holding placards and shouting slogans demanding a CBI probe.

Meanwhile, protests continued in Bengaluru and Tumakuru, the district from which Ravi hailed.

In Tumakuru, ABVP students blocked a national highway demanding a CBI investigation but were chased away by police who made a mild laticharge. The district is also observing a bandh today in response to a call given by various organisations.

Students of Agricultural University in Bengaluru, where Ravi graduated in agriculture, also marched in a procession seeking “justice” and a CBI probe into the death of Ravi.

The family of Ravi has alleged that there was “political pressure” and it was not suicide but a murder which should be probed only by CBI.

Several IAS officers in the state have also signed an online petition to Prime Minister Narendra Modi, seeking inquiry by the central agency.

DK Ravi had no family problems; MLA pressured him: Father-in-law

March 19, 2015 by Nasheman

ias-dk-ravi

Bengaluru: Mar 19: Ravi’s father-in-law Hanumantharayappa on Wednesday said that Bangarpet MLA S N Narayanaswamy had pressured Ravi in support of Confident Group, a real estate firm accused of encroaching government land in Kolar district.

Hanumantharayappa said that because of this pressure, he had requested Chief Minister Siddaramaiah to transfer Ravi to any post in Bengaluru.

Hanumantharayappa, a Congress leader, was addressing a press meet at his house at Mallathahalli in Nagarabhavi.

“During Ravi’s stint as Kolar DC, there was pressure from politicians. Narayanaswamy was favouring Confident Group and had been putting pressure on Ravi. When Ravi told me about repeated threats and pressures, I requested the chief minister to post my son-in-law in Bengaluru. I have never interfered in his work, except during his transfer from Kolar,” he said.

Hanumantharayappa said that Ravi had no family issues bothering him. “I have been reading some reports that my daughter was not ready to live with Ravi’s parents. I would like to clarify that all these reports are false. In fact, my daughter wanted to move to the apartment since the government-allotted quarters in Vasanthnagar was under renovation. My daughter wanted to move into the apartment along with Ravi’s parents. During the weekend, Ravi had spoken to the engineer in charge of renovation work of the quarters and told him that he would visit the house along with my daughter for inspection,” Hanumantharayappa said.

Asked about the statement by Home Minister K J George that the suicide was due to some personal problem, Hanumantharayappa said Ravi was not the one who would commit suicide.

“On Monday morning, Ravi was normal. He received a call from Kalaburagi regarding work and he told the caller to meet him on Tuesday to discuss the issue. If it turns out to be true that Ravi committed suicide owing to personal reasons, I feel he has betrayed his parents, his wife and his in-laws,” Hanumantharayappa said.

Asked about the reports that Ravi had made the last call to an IAS officer, Hanumantharayappa said a detailed probe would reveal all aspects.

“His phone call record details will throw up all details. I demand a thorough investigation into the case by CBI or any such agency. He would have left a note if he had committed suicide. The police in our presence searched for the suicide note in his pockets and purse, however nothing was found. I had even called Deputy Commissioner of Police (Southeast) Rohini Katoch Sepat on Wednesday morning to know if any note was found during the investigation. She said the probe has been handed over to CID. Even if he faced any threats with his present assignment, probe will reveal everything,” he said.

DK Ravi death case: BJP demands suspension of M N Reddi

Bengaluru: The opposition party at the state is up in arms against City Police Commissioner M N Reddi for his statement that Ravi had committed suicide.

Leader of Opposition in the Council K S Eshwarappa has questioned the Commissioner as to how he could arrive at the conclusion even before the post mortem or forensic examination reports were out.

Demanding the resignation of Reddi or suspension of the top cop, Eshwarappa wondered if Reddi was making the statement at the government’s behest and further questioned if a murder was being hushed up.

The Commissioner came under attack by Leader of Opposition in the Assembly Jagadish Shettar and BJP leader R Ashok.

However, Congress leaders in the Council and in the Assembly came to the rescue of Reddi stating that the Commissioner had clearly said that ‘Prima facie’ it appears to be a suicide and did not conclude that it was a case of suicide.

Hassan: Deve Gowda turns emotional, offers to resign from Lok Sabha

March 17, 2015 by Nasheman

Hassan: Alleging lack of concern among the ruling class about the interests of poor people and farmers, former prime minister (PM), H D Deve Gowda, who represents this constituency at the Lok Sabha, in an emotional outburst, offered to resign from his Lok Sabha membership.

Karnataka budget: Petrol, liquor, tobacco to be costlier

March 13, 2015 by Nasheman

Karnataka budget

Bengaluru: Liquor and tobacco products are set to become more expensive as CM Siddaramaiah increased the VAT on them from between 17 to 24 percent, while presenting his 10th state budget on Friday.

He also announced 1 percent hike in tax on petrol and diesel in the state budget for 2015-16.

There was a small relief for consumers as he made mobile phone chargers, footware, manufactured sand, wick stove, industrial cables, solar panels and solar inverters cheaper.

There was also some tax relief low-salaried individuals as professional tax for those earning up to Rs 15,000.

Siddaramaiah said he was presenting a responsible budget by keeping fiscal deficit within 25 percent for 2015-16 as mandated in Karnataka Fiscal Responsibility Act.

The total receipts are estimated at Rs 1,39,476 crore from this budget, while the total expenditure is pegged at Rs 1,42,534.

As usual, Bengaluru got the CM’s attention: in order to make city roads safer for pedestrians, Siddaramaiah announced 25 new skywalks that will be built under PPP model. Meanwhile, Rs 80 crore has been allocated to develop underpass and flyover at Hebbal junction, which witnessed a horrible road incident last month. Rs 44 crore has been allocated for a flyover at Doddanakundi.

Ballari road and Jayamal road to be widened.

He also announced Rs 44 crore for flyovers and Doddanakundi while providing Rs 270 crore to deal with the garbage situation in the city. 50 solid waste removal machines are also to be procured.
