SC says Gurunath Meiyappan was involved in betting, tells Srinivasan to choose between CSK and BCCI top job

After almost 18 months of deliberations on the 2013 Indian Premier League betting and match-fixing scandal, the Supreme Court has said that N. Srinivasan’s son-in-law Gurunath Meiyappan and Raj Kundra of Rajasthan Royals were involved in betting. However, it also said that Srinivasan was not guilty of cover-up and “charges against him, at best, be regarded as suspicion.” It also said that “BCCI functions are public functions, amenable to judicial law.”

However, the top court has said that conflict of interest issues remain and Srinivasan has to choose between his IPL team Chennai Super Kings and the cricket Board. Srinivasan is also the first chairman of ICC.

Srinivasan is seeking a re-election as BCCI president and Thursday’s order will be a shot in the arm. In the wake of the IPL probe, Srinivasan was stood down last year by the top court from his position as Board chief. The BCCI has already postponed its Annual General Meeting and elections twice. As per its constitution, the AGM should have been held by September 30 last year. Srinivasan is seeking another term, this time as a candidate backed by the BCCI’s East Zone units.

The Supreme Court-appointed probe committee, led by Justice Mukul Mudgal, had in its first report indicted Meiyappan of betting and sharing team information. Srinivasan had mentioned that Gurunath was a mere ‘cricket enthusiast.’ Srinivasan was earlier charged with conflict of interest and not taking adequate action against involved in ‘misdemeanours.’

The case dates back to June 2013 when Aditya Verma, secretary of the Cricket Association of Bihar (CAB), raised charges of a conflict of interest in the BCCI’s original two-member inquiry panel for the IPL corruption issue.

A Bombay High Court ruling later termed the probe panel “illegal”. The BCCI and the CAB filed petitions in the Supreme Court against this order, with the CAB contending that the Bombay High Court could have suggested a fresh mechanism to look into the corruption allegations.

The Supreme Court then appointed a three-member committee, headed by former High Court judge Mukul Mudgal and comprising additional solicitor general L Nageswara Rao and Nilay Dutta to conduct an independent inquiry into the allegations of corruption against Srinivasan’s son-in-law and Chennai Super Kings official Gurunath Meiyappan, India Cements, and Rajasthan Royals team owner Raj Kundra, as well as with the larger mandate of allegations around betting and spot-fixing in IPL matches and the involvement of players.

New Delhi: N. Srinivasan, the Indian cricket board’s sidelined chief, Wednesday told the Supreme Court that if he is re-elected, he would stay away from the Indian Premier League (IPL) governing council till a proposed committee decides on the larger question of conflict of between his BCCI role and his IPL franchise Chennai Super Kings.

Responding to a poser from the court Tuesday, senior counsel Kapil Sibal told a bench of Justice T.S. Thakur and Justice F.M.I. Kalifulla that Srinivasan would stay away from the governing council and its activities and also from the Board of Control for Cricket in India (BCCI) meetings related to the IPL.

Sibal said: “Mr. N. Srinivasan, further undertakes that if he is elected as president of BCCI, till the (proposed) committee suggests the procedure to deal with the issue of conflict of interest, he will not attend any IPL governing council meeting or any other IPL related discussion in ant meeting of working committee or general body meeting of the BCCI.”

This the court was told in a note on the scope of reference of the committee to be appointed by the apex court or the BCCI into the question of conflict of interest. The note said the committee could suggest “the sanctions to be imposed, in accordance with the applicable IPL rules on person prima facie found to be involved in the act of backing by the Mudgal Committee.”

The committee may also determine the liability of the franchisees for the act of backing by their “team officials and to suggest the consequential sanctions that can be imposed on them in accordance with the IPL rules.”

The note said that another term of reference for the proposed committee would be to “consider and suggest a mechanism to identify the potential conflict of interest in the BCCI and to suggest the procedure to be adopted for dealing with situations of potential conflict of interest.”

Sibal said this during the hearing on a Public Interest Litigation (PIL) by Cricket Association of Bihar which has sought to oust Srinivasan as BCCI president on the ground of his being in the conflict of interest situation being the president of the cricketing body and also the owner of CSK.

The PIL is also seeking the cancellation of IPL franchisee CSK on the ground of Srinivasan’s son-in-law Gurunath Meiyappan’s alleged involvement in betting.

Cracking the whip in the Indian Premier League corruption case, the Supreme Court on Tuesday insisted that action must be taken against Board of Control for Cricket in India president in exile N Srinivasan’s son-in-law Gurunath Meiyappan.

The Supreme Court was clear that it did not want to short-circuit BCCI’s working machinery and offered four options to the BCCI:

  1. Srinivasan steps aside and a BCCI committee takes a decision on Meiyappan
  2. Two independent judges are appointed to look into the punishment for Meiyappan
  3. The IPL Governing Council decides on punishment for Meiyappan
  4. The Mudgal Panel decides what punishment to hand out to Meiyappan

Srinivasan was accused of taking no action against Meiyappan and now the apex court wants the BCCI to spell out how the former CSK official should be punished. “Want action against Meiyappan.

What can be done to decide quantum of punishment? We don’t want to bypass BCCI, announce punitive measures,” the Court said on Tuesday.

According to PTI, Supreme Court objected to Srinivasan attending Tamil Nadu Cricket Association Meetings Despite stepping aside as cricket administrator.

Srinivasan admitted it was a mistake and said he should not have attended the meetings.

Earlier on Monday, the Supreme Court observed that it is very difficult to accept N. Srinivasan’s plea that there is no conflict of interest arising out of owning IPL team CSK and heading the BCCI.

A bench headed by Justice TS Thakur said that conflict of interest is equal to bias and even though actual bias may not be in the case but even likelihood of bias is important.
It said purity of cricket has to be maintained and all persons at the helm of its affairs should be above suspicion.

“Taking all circumstances in account, it is very difficult to accept your contention that there is no conflict of interest. You being MD of India Cements, India Cements owning CSK, an official of CSK involved in betting and you heading the BCCI,” the bench, also comprising Justice FMI Kalifulla, told Srinivasan’s lawyer Kapil Sibal.

Sibal, however, submitted that by that standard, conflict of interest is prevalent in every sphere of activities and noted that Hockey Federation and FIFA allow it.

New Delhi: N. Srinivassan, his son in law Meiyappan, Sunder Raman former COO IPL, Rak kundra, co owner of Rajasthan royals and husband of bollywood actress Shilpa Shetty, figure in the list of those Mudgal committee, who probed the IPL match fixing and betting, mentioned in its report.

Supreme Court today revealed the six names including Stuart Binny who was named in the remaining two ODI against Sri Lanka.

After the revelation the AGM of BCCI has been postponed for four weeks. The meeting was scheduled to be held on 20th of November. The meeting was to be followed by the elections of BCCI President. Former president Srinivasan had to step down after Mudgal committee mentioned his son inlaw in the IPL match fixing.

Srinivasan is desperately trying to make a come back and postponement may come a breather for him as it will give him more time to garner the support.

Supreme Court has not mentioned their roles in the match fixing. Mudgal Committee has mentioned 13 names in its report which was submitted to the apex court.

The apex court bench headed by Justice T. S. Thakur said that the report dealing with the conduct and role of Srinivsasan, Meiyappan, BCCI official Sundar Raman and Rajasthan Royals co-owner Raj Kundra will be given to these four people as well as to the BCCI and the petitioner Cricket Association of Bihar.

The court, however, said that the names of the players named in the report will be held back for the time being.

The court said all the parties will file their objections to the report within four days of its receipt and they will have the liberty to file responses to rival objections in another four days and directed the listing of the matter for Nov 24.

The court recorded the statement by BCCI counsel T.A. Sundaram that the meeting of the BCCI annual general body which was scheduled to be held Nov 20, will now take place after four weeks.

The sixth IPL season last year was marred with a major controversy after police launched legal proceedings against several IPL officials and cricketers, including former Test fast bowler Shanthakumaran Sreesanth, for illegal betting and spot-fixing.

The IPL, which began in 2008, features the world`s top players signed up for huge fees by companies and high-profile individuals in a glitzy mix of sport and entertainment.

Justice Mudgal submits final IPL probe report to SC

New Delhi: Justice Mukul Mudgal Monday submitted to the Supreme Court the final report of its investigation into the allegations of betting and spot fixing in the 2013 edition of Indian Premier League (IPL).

Justice Mudgal committee that investigated the allegations against sidelined BCCI chief N. Srinivasan and 12 others submitted the report in a sealed cover.

The apex court bench headed by Justice T.S. Thakur, before which senior counsel Raju Ramachandran submitted the report Monday, said that it will be taken up for hearing as scheduled Nov 10.

In the course of the last hearing on the matter, the court gave Justice Mudgal committee another two months time to complete its probe.
