National Herald case: HC dismisses Gandhis’ plea against summons

December 7, 2015 by Nasheman

sonia-rahul

New Delhi: In a setback to Congress chief Sonia Gandhi and vice president Rahul Gandhi, the Delhi High Court on Monday dismissed their plea to quash summons issued to them by a trial court on BJP leader Subramanian Swamy’s complaint in the National Herald case.

Justice Sunil Gaur dismissed their pleas which means the Gandhis will have to appear before the trial court in the case.

Apart from the Gandhis, the court also dismissed the pleas of Congress treasurer Motilal Vora, family friend Suman Dubey and party leader Oscar Fernandes who had moved the high court for quashing of summons to them by the trial court.

On June 26, the trial court issued summons to the Congress leaders on Swamy’s complaint about “cheating” in the acquisition of Associated Journals Ltd. (AJL) by Young India Ltd. (YIL) – “a firm in which Sonia and Rahul Gandhi each own a 38 percent stake”.

Senior advocate Kapil Sibal, who had appeared for Sonia Gandhi, sought quashing of the proceedings initiated by the lower court against her and the others, saying that the complaint made by Swamy against them were only “allegations without any supporting proof”.

He had said there was no illegality in Young India Ltd. (YIL) taking over Associated Journals Ltd. (AJL), the publisher of the now-defunct National Herald newspaper, as per the Companies Act.

Swamy had claimed that Sonia and Rahul Gandhi, as majority shareholders of YIL, benefited from the acquisition of AJL. He alleged that AJL had received an interest-free loan of Rs.90.25 crore from the Congress and that the party transferred the debt to YIL for Rs.50 lakh.

At the time, AJL, which had Vora as its chairman, claimed that it could not repay the loan and agreed to transfer the company and its assets to YIL.

Filing the plea in the high court, the Congress leaders had said Swamy was a political opponent and the present criminal proceedings were initiated only with an intent to secure an oblique political objective.

Mulayam PM, Rahul his deputy: Akhilesh’s formula for alliance with Congress

December 4, 2015 by Nasheman

Akhilesh-Yadav

New Delhi: Uttar Pradesh Chief Minister Akhilesh Yadav today suggested that an alliance with Congress is possible in an arrangement where Samajwadi Party supremo Mulayam Singh Yadav is the Prime Minister and Rahul Gandhi his Deputy.

Akhilesh made the comments in the course of a conversation at the Hindustan Times Leadership Summit here in the presence of the Congress vice president. However, Rahul refused to comment when asked to respond.

The UP Chief Minister was replying to a question on whether he was ready to extend his “good” personal relationship with Gandhi to a political level with the Congress.

“You are asking me because I am a Samajwadi (socialist) and you also say that I get rebuked by my father (Mulayam). I also want that Netaji’s dreams are fulfilled and that I work for him. He becomes the Prime Minister and he (pointing at Rahul) Deputy Prime Minister. I am in agreement with this and will make an alliance now,” if it is found acceptable, Akhilesh said, smiling.

He, however, sidestepped a question on whether an alliance with its rival BSP, like the one in Bihar where JD(U) and RJD came together, is possible in UP for the 2017 Assembly polls.

“Her (Mayawati) choice is that stone made elephant statues come up. So how is that possible? I have already told you my formula,” was Akhilesh’s response, referring to his conditions for a possible alliance with Congress.

Earlier, he categorically said, “there is no talk of any coalition at this point. It’s better if we don’t talk of it now.”

The 42-year-old chief minister of India’s most populous state asserted that any relationship with the BJP or any of its associate organisations was not possible “because of the kind of divisions they produce and the language they use.”

SC dismisses PIL on Rahul Gandhi’s citizenship row

November 30, 2015 by Nasheman

Rahul-Gandhi

New Delhi: The Supreme Court today dismissed a plea seeking a direction to CBI to register a case against Congress Vice President Rahul Gandhi for allegedly declaring himself as a British national before company law authorities there.

A bench comprising Chief Justice H L Dattu and Justice Amitava Roy questioned the “authenticity of the document” attached with the PIL and the manner in which the papers were procured.

“Can we start making roving inquiries,” the bench asked while turning the petition as “frivolous”.

Earlier the apex court had refused urgent hearing on a plea filed by lawyer M L Sharma.

Recently, BJP leader Subramanian Swamy has alleged that the Congress Vice President has claimed himself to be a British national before the authorities in connection with incorporation of a firm.

Congress strongly believes in GST, govt has to reach out: Rahul Gandhi

November 25, 2015 by Nasheman

Rahul Gandhi

Bengaluru: On the eve of Winter session of Parliament, Rahul Gandhi today said Congress “strongly” believed in GST, but government should reach out to the Opposition on certain issues, including the cap on rate.

The Congress vice president outlined the party’s stand on the contentious Goods and Service Tax(GST) Bill even as he made an all-round attack on the Modi government calling it “much worse” than “suit-boot-ki-sarkar.” The NDA government is keen to push key reforms legislations like the stalled GST bill in the Winter session.

Fielding questions on a wide range of issues during an interaction with students of a women’s college here, Gandhi also spoke on the “rising intolerance”, saying it “disturbs” him as an Indian, highlighting that “live and let live” was the country’s biggest strength.

Targeting Narendra Modi, Gandhi said he believes the country could be run from the Prime Minister’s Office (PMO) and that he alone could transform the country.

The interaction was the first in the series of Gandhi’s outreach to the students across the campuses in the country.

Targeting Modi’s style of functioning, Gandhi said there were very few people with decision-making powers at the Centre and “one man decides every single decision.”

“…one man can’t have all the answers…,” he said, adding dialogue was very important.

Asked about GST, which is hanging fire for the last several years, Gandhi said, “we strongly believe in GST.”

He said GST and other bills were “very important” but the government’s approach has to be one of reaching out to the Opposition.

Speaking to reporters later, Gandhi said the Congress would raise in Parliament the issues of “rising intolerance”, which was “very disturbing”, GST and also Prime Minister’s “silence” on various issues.

Questioned why the GST bill was being stalled, he said it was Congress which brought it forward and “…we are for GST…we support GST…” But, he noted, the BJP had opposed it and blocked it for three years with Finance Minister Arun Jaitley, then in the Opposition, even justifying blocking Parliament as a strategy.

Gandhi said there were three differences between BJP and Congress on GST. They related to cap on tax to be charged, dispute resolution and one per cent tax on inter-state sales (doing away with it).

He said government had to accept the fact that Congress “sits in Parliament”, “Congress has a view” and “Congress has 20 per cent hope” (referring to the people’s mandate).

Attacking the Modi government for not having “conversation” with the Opposition, he said the Prime Minister had not even once picked up phone and spoken to any Congress leader, which his predecessor Manmohan Singh used to do.

Rahul Gandhi dares government to jail him

November 19, 2015 by Nasheman

Rahul-Gandhi

New Delhi: Congress vice president Rahul Gandhi on Thursday dared the government to jail him if he had done any wrong, saying the RSS and BJP had been throwing muck at his family for years.

Addressing a convention of the Indian Youth Congress here to mark the 98th birth anniversary of slain former prime minister Indira Gandhi, Rahul Gandhi said the RSS and the BJP had been targeting his family including his slain grandmother and father.

Rahul Gandhi said different allegations had been levelled at him but there was no truth in them.

“I want to say one thing, Modiji, you have got agencies. Get investigations done. If you get anything in six months, put me in jail. The muck that you are throwing at me, at my family…. Send me to jail if I have done any wrong,” he said.

The Congress leader said he was not afraid of the Bharatiya Janata Party (BJP) and its ideological mentor, the Rashtriya Swayamsevak Sangh (RSS).

“I will fight for the farmers, for the labourers,” he said, adding that he would continue to expose the government’s failures.

BJP leader Subramanian Swamy alleged on Monday that Rahul Gandhi had declared himself a British citizen in the registration papers of a private company in London.

Manmohan, Sonia, Rahul Pay Tributes to Indira, Patel

October 31, 2015 by Nasheman

Sonia-Gandhi

New Delhi: Former prime minister Manmohan Singh, Congress president Sonia Gandhi and party vice president Rahul Gandhi on Saturday paid tributes to former prime minister Indira Gandhi and India’s Iron Man Sardar Vallabhbhai Patel.

They paid tribute to Indira Gandhi on her death anniversary at the Shakti Sthal memorial site dedicated to her.

“We pay tribute to Indira Gandhi today (Saturday). A leader with courage and compassion. She protected the poor and died for India,” Rahul Gandhi tweeted.

Indira Gandhi was assassinated on October 31, 1984 by her bodyguards a few months after the Indian Army took action in the Golden Temple in Amritsar to remove militants from there as part of a move to counter the insurgency in Punjab.

President Pranab Mukherjee and Vice President Hamid Ansari also visited Shakti Sthal to pay floral tributes to Indira Gandhi.

Prime Minister Narendra Modi paid tribute and said: “Tributes to former prime minister Indira Gandhi on her death anniversary.”

She was born on November 19, 1917.

She held the office of prime minister from January 1966 to March 1977. She also became the prime minister from January 14, 1980 till her death.

The three Congress leaders also paid tribute to India’s first home minister Sardar Vallabhbhai Patel on his birth anniversary.

Sardar Patel, known as India’s Iron Man, played a major role in the country’s struggle for independence and subsequently guided its integration into a united, independent nation.

Patel was born on October 31, 1875 in Gujarat’s Nadiad town. He died on December 15, 1950.

In his tweet, Rahul Gandhi said: “My tribute to Sardar Patel on his birth anniversary. One of the founding fathers of our nation, a patriot and a great Congressman.”

“His contribution to unifying India and guarding against fundamentalist forces will always inspire us,” he said.

Rahul Gandhi said Sardar Patel was truly India’s Iron Man as he believed in a strong, united India where every Indian is equal.

PM, RSS, BJP practising politics of crushing the weak: Rahul Gandhi

October 21, 2015 by Nasheman

rahul gandhi

Faridabad: Visiting the Dalit family which lost two children yesterday in an attack by upper caste men here, Congress Vice President Rahul Gandhi accused the Prime Minister, Harayana Chief Minister, the BJP and RSS of practicing “politics of crushing” those who are weak which results in such incidents.

“This is an attitude shared by the Prime Minister, Chief Minister of the state and the entire BJP and RSS. The attitude is if somebody is weak, he can be crushed. What you have seen is the result of this attitude,” Gandhi said.

He was meeting the family of the victims and villagers who had gathered here. Two children died when their house was set afire allegedly by a crowd of upper caste men in the wee hours yesterday.

“In Haryana, there is no government for the poor and poor people are being targeted here which is totally wrong. I have assured the victims’ family that I would do whatever they want from me including pressuring the government.

Asked whether he was doing politics over the incident, Rahul angrily retorted: “This is insulting when someone says it when someone comes here. It is not insulting to me. It is insulting to these people. What is a photo op. What you mean? People are dying. I will keep coming to such places.”

Dalits including children today blocked the Faridabad highway demanding stringent action against the guilty.

Two children of a Dalit family were burnt alive and their parents suffered injuries allegedly after some persons from upper caste set their house afire at Sunped village near Ballabhgarh while they were sleeping.

11 persons, including a father-son duo, have been booked on murder, rioting and other charges, a police spokesman said.

Vaibhav, who was two-and-a-half years old, and his sister, 11-month-old Divya, died after the attackers allegedly poured petrol from the window and set the house ablaze. A religious programme was being held nearby in the village at that time.

Their mother Rekha, 28, suffered serious burns and has been referred to Delhi for treatment, while their father Jitender, 31, too suffered injuries trying to save his family.

After visiting the victims’ family members at Sunped village, Gandhi also met agitating villagers, a majority of them women, who had blocked the Ballabhgarh-Faridabad highway to protest against the incident.

Charging that atrocities against “Dalits and weaker sections” were rising, Congress leader Kumari Selja said that her party “will raise this issue strongly, be it in Parliament and on the streets”.

BJP’s strategy is to make Hindus, Muslims fight each other: Rahul Gandhi

October 10, 2015 by Nasheman

Rahul Gandhi

Mandya: Launching a direct attack on Prime Minister and BJP in the wake of Dadri beef lynching, Congress leader Rahul Gandhi on Friday alleged that they have a “strategy” to polarise the country by pitting Hindus and Muslims against each other as he remarked that Narendra Modi has a “history”.

“The BJP and the Prime Minister have a strategy of polarising this country. They have a strategy of making Hindus and Muslims fight against each other.

“You can see that in every election, polarisation taking place, riots taking place. There were BJP people involved in the Dadri incident,” the Congress vice president alleged while talking to reporters here.

Dismissing the Prime Minister’s pitch yesterday for communal harmony, he said that while it was very nice of Modi to make such comments, “the Prime Minister has a history and the PM has a party that is behaving in a completely different way, which he doesn’t seem to want to stop”.

Modi had yesterday pitched for communal harmony, saying Hindus and Muslims should not fight each other but together fight poverty.

Gandhi, who is on a two-day visit of party-ruled state during which he will meet farmers affected by drought and other agricultural problems, also accused the Centre of neglecting farmers’ interests.

“The central government does not think that agriculture or the farmer is important. Whether it is the issue of Minimum Support Price (MSP) or crops being destroyed by bad weather, the government does not seem to have a strategy. It does not give priority to farmers,” he said.

Ruing that farmers are committing suicide in large numbers, he insisted the central government needs to do something about it.

“The Prime Minister has to take a look at it and help the farmers of the country,” he said.

Contrasting the functioning of the previous UPA government with that of the present dispensation, Gandhi said the Congress-led government had given a loan waiver of Rs 70,000 crore to the farmers.

He will also undertake a ‘padyatra’ tomorrow and hold interactions with farmers, students and women workers in Haveri district.

Karnataka: Cabinet expansion to be delayed as Rahul, Digvijay not in India

September 24, 2015 by Nasheman

siddaramaiah

Bengaluru: The state government’s much-awaited Cabinet expansion and reshuffle have been indefinitely put off as AICC Vice-President Rahul Gandhi and Congress General Secretary Digvijay Singh are not in the country.

Digvijay Singh, for the past few weeks has been in the US as he is attending his ailing daughter, though he was supposed to return on Thursday, his trip has been delayed. Rahul, too is in the US. Hence, CM Siddaramaiah who was supposed to stay back in Delhi and discuss regarding the Cabinet expansion and reshuffle, will return to Bengaluru on Thursday evening. Digivjay Singh is in-charge of party affairs in the state. It should be noted that several ministerial aspirants who were in Delhi to campaign for ministerial posts will return empty-handed as the decision will be postponed.

CM Siddaramaiah said that since both Rahul and Digivjay were not in the country, he would discuss with them once they return.

He indicated that the talks would take place only after Rahul visits the state and speaks to the families of farmers who committed suicide which is scheduled for October 6 and 7.

With regard to the Kalasa-Banduri project, the state government will file an interim petition in the Supreme Court, said the Chief Minister and added that the petition would be filed after a legal team looked into the available options.

Modi scripting his own downfall: Rahul Gandhi

September 21, 2015 by Nasheman

rahul gandhi

Mathura: Firing yet another salvo at Prime Minister Narendra Modi, Rahul Gandhi today claimed that the PM is scripting his own “downfall” as he has “failed” to fulfil promises made to the people.

In a pepup up talk at Congress Executive meet in the key state of Uttar Pradesh, where Congress is reduced to fourth position, Rahul invoked Steve Jobs’ efforts to revive a floundering Apple and said the party men should work unitedly as a team so that they can fill the void that will be created after “exit” of Modi, who was “harming himself the most”.

The Congress Vice President said that everybody has “Congress DNA” and ideologically the party still occupies the first position as it is not like RSS “in which everything is decided from the top”.

He said that the Prime Minister has not fulfilled his poll promises and is “damaging himself” much more than Congress could have inflicted on him.

“He has promised good days to farmers. Now farmers are committing suicide. Wherever I go in the country, the farmers are abusing Modiji. They are not criticising but abusing. Youths are not getting jobs and despite making repeated promises thrice, OROP has not been given yet.

“Modi is damaging himself much more than we can together do to him. We have to make our place. Modiji is bound to go down but when he goes, we have to fill that space. You may keep on attacking Modi but Modi is attacking himself much more,” Rahul said.

The Congress Vice President, who has frequently taunted the PM with his “suit-boot” barbs, had yesterday attacked Modi over ‘Make in India’ initiative, saying it was “Take in India” in reality.

Telling party workers that everybody has “Congress DNA” in their blood, Rahul today said that they need to motivate people to work and fight together, and gave a message of unity to revive the party that has lost much of its base in the key Hindi belt state.

Maintaining that Congress is different from the RSS, Rahul said, “This is not RSS. Had it been RSS, (Mohan) Bhagwat would have come and told you that the sky is black and then all of you would have echoed that the sky is black. Decisions do not percolate from the top in the Congress party.”
