May 9, 2015 by Nasheman

Mangaluru: A complaint has been lodged against Mysuru-Kodagu MP Pratap Simha for having allegedly threatened a Mangaluru-based journalist.

The complaint has been lodged at Kadri police station here by journalist Shreyas, resident of Boluvar in Puttur taluk, currently working for a city-based news portal.

With regard to the 2002 hit-and-run case, in which noted cine actor Salman Khan was convicted of culpable homicide among other charges by the sessions court on Wednesday, the columnist-turned-politician Pratap Simha had uploaded a post on his Facebook timeline in support of the actor who’s contribution to the industry and needy “outweighed his unintentional but terrible mistake.”

In the post, he also batted for introduction of the proposed Motor Vehicles (Amendment) Bill, 2014 to put stringent traffic norms into place.

The complainant Shreyas said that he had conversed with the MP in this regard and sought his statement over a phone call. He had also made a news report on the subject quoting the MP, which was published in the news portal he worked for. He had also quoted a few critics of Pratap Simha.

However, on learning of the news article, MP Pratap Simha is alleged to have threatened the journalist and also used filthy language over phone.

In this regard, a complaint was lodged by the journalist on Friday, and an FIR was registered by Kadri police subsequently on Saturday morning.

Memorandum

On Saturday, a delegation of mediapersons, including the complainant, submitted a memorandum to Dakshina Kannada Additional Deputy Commissioner demanding appropriate legal action against the Mysore-Kodagu MP for his misbehaviour and life-threat to a journalist.

A similar memorandum was submitted by the delegation to Mangaluru City Police Commissioner on Saturday.

Salman Khan won't go to jail for now! 5-year sentence suspended by High Court

May 8, 2015 by Nasheman

Salman Khan

Mumbai: In a huge relief to Bollywood superstar Salman Khan, the Bombay High Court today suspended his 5-year sentence in the 2002 hit-and-run case and granted him bail pending his appeal against conviction. The term of interim bail was to expire today.

“He has been on bail for a long time and his liberty was not curtailed. Normally, in such cases, the appeal is admitted and an accused is granted bail,” Justice Abhay Thipsay said, while staying his conviction and granting him bail.

The judge directed him to surrender before the trial court and furnish a fresh bail bond of Rs 30,000.

Thipsay had on May 6 granted 48-hour interim bail to the actor, hours after he was convicted and sentenced to five years rigorous imprisonment by the trial court on the ground that he had not been supplied with a detailed order explaining the reasons for his conviction.

Here are the latest developments:

  1. The trial court had on Wednesday found Salman Khan guilty of drunkenly driving over a group of men sleeping on a pavement, killing one. It had sentenced him to five years in prison for culpable homicide.

  2. The actor had been exempted from appearing in court today. He had broken down in the sessions court on Wednesday when the trial court sentenced him.

  3. The 49-year-old actor had the same day moved the Bombay High Court, which had granted him interim or temporary bail till today.

  4. Salman Khan’s appeals are being argued in the High Court by senior lawyers Amit Desai and Shrikant Shivade. Today is the final working day of the High Court before it begins annual summer vacations till June 8.

  5. People protested outside the court, some in support of the actor, others holding up placards that said, “We are the city, we are not dogs,” a reference to tweets by Bollywood singer Abhijit and other members of the film fraternity that caused outrage.

  6. On Wednesday, Additional Sessions Judge DW Deshpande held Salman Khan guilty on all the prosecution’s seven charges, including culpable homicide not amounting to murder, rash and drunken driving and driving without a valid licence.

  7. In a 240-page judgment, Judge Deshpande has said, “I find that it is established beyond reasonable doubt by prosecution that accused was driving the vehicle at the time of the accident,” rejecting the actor’s submission that his driver Ashok Singh was driving.

  8. He has also observed that Salman Khan “did not wait for police on the spot… Instead of visiting police station, the accused went to his house and till 10.30 a.m. he hided himself… If really the accused did not commit any wrong, he could have visited the police station immediately. (sic)”

  9. The judge has rebuked Salman Khan for not taking “any positive steps by visiting hospital to see the injured and provide medical aid to them” and said that the “well known cine actor” knew he must not drive without a license and after consuming liquor.

  10. In the early hours of September 28, 2002, Salman’s Toyota Land Cruiser ran over a group of men sleeping on the pavement in front of a bakery not far from the actor’s sea-facing home in Galaxy Apartments in upscale Bandra (West). One man died, four were injured.

I still watch Salman Khan’s movies; No benefit for me if he is punished, says victim

May 7, 2015 by Nasheman

abdullah-rauf-shaikh

Mumbai: “Compensation matters more than conviction,” say the victims of the 2002 hit-and-run case in which Bollywood star Salman Khan has been sentenced to five years in jail.

Abdullah Rauf Shaikh, who lost a leg in the accident, said, “Nobody came to visit me in the last 13 years. I am forced to do petty jobs to support my family and face a lot of problems.” “However, I have no hard feelings for him (Salman).

I still watch his movies,” he said, adding they were not pressurised by anyone. “Compensation matters more than conviction, my health and work suffered,” Shaikh said.

“If Salman is punished, I will not be benefited in any way as neither my leg will heal nor my problems would go away. Instead if they compensate us then we do not have any problem,” he said, recalling that he was 22 years old when he lost his leg in the incident.

The wife of Nurullah Mehboob Sharif, who died in the accident, said, “We were told we will get a compensation of Rs 10 lakh, but what will we do of that amount at this time of inflation.” She said that she would be benefited if her son gets a job.

Salman Khan gets two days interim bail

May 6, 2015 by Nasheman

salman-khan

Mumbai: Supreme Court lawyer Harish Salve, who represented Salman, challenged the sessions court order of a five year sentence, in the High Court. “Have received only operative part of the order. You cannot put someone in jail without a proper court order,” Salve argues.

Bombay High has now granted a 2-day interim bail to Salman.

Salve argued that a convict cannot be put in jail without a proper order. Salve argued his client has not got the complete order yet. He argued that Salman had received only the operative part of the order.

This means Salman Khan can stay out of jail till Friday, May 8, which is also when the Bombay High Court goes on vacation.

Huge relief for Salman Khan, his family and friends. Salman is still at the sessions court. His sisters Alvira and Arpita are at the Bombay High Court.

Salman Khan gets 5-year rigorous imprisonment in hit-and-run case

May 6, 2015 by Nasheman

salman-khan-mumbai-court

Mumbai: Salman Khan was today sentenced to five years rigorous imprisonment by a Mumbai sessions court, which convicted him of culpable homicide in the 2002 hit-and-run case, dealing a big blow to the Bollywood superstar.

Judge D W Deshpande, who held the 49-year-old actor guilty of “all charges”, including driving under influence of liquor and not possessing a driving licence, pronounced the sentence after a 45-minute adjournment of the proceedings.

A big crowd, mostly of Salman’s fans, thronged around the court located in Fort area of south Mumbai.

The actor, who had fought back tears after being convicted, looked calm and composed as the judgement was read out to him in the presence of his close family members.

The superstar’s brothers Arbaaz and Sohail and sister Arpita were present in the court on the judgement day, which came after a long drawn legal process.

Dressed in a white shirt and blue jeans, the actor arrived in the jam-packed courtroom minutes before the proceedings began in the morning.

Sessions court judge D W Deshpande ruled “all charges” against the actor have been proved, including the stringent charge of culpable homicide not amounting to murder, besides various other offences, including rash and negligent driving and driving under influence of liquor.

The judge held that the actor also did not have a driving licence. The prosecution had alleged that Khan was driving without holding a licence and, to buttress its charge, produced RTO records to show that the actor had procured a licence only in 2004, two years after the tragedy.

The court, while pronouncing the judgement, drew parallels with the Alistair Pereira and Sanjeev Nanda BMW cases.
Asked if he had to say anything about the verdict, Salman denied the charge that he was driving the vehicle at the time of the accident.

Salman had earlier been tried for the lesser offence of causing death by rash and negligent driving which attracts a lighter punishment of imprisonment upto two years.

After examining several witnesses, a Bandra Metropolitan Magistrate had called off the trial midway in 2012 and slapped the serious charge of culpable homicide against the actor before committing the matter to the sessions court.

The court, while convicting the hugely popular actor, upheld the prosecution’s contention that he was at the wheel when his Toyota Land Cruiser ran over five people sleeping on the pavement outside American Express bakery in suburban Bandra, killing one person and wounding four.

Arms Act case: Salman Khan accused of misleading court, hearing on April 29

April 24, 2015 by Nasheman

Salman Khan

Jodhpur: An application has been moved in Jodhpur court against Salman Khan accusing him of misleading the court by seeking exemption from appearance on health grounds in an Arms Act case related to the black buck shooting though he was reportedly working in a film during the period.

Chief Judicial Magistrate Anupama Bijlani has admitted the application moved by Lalit Boda, the then forest officer who had registered the case against Khan for alleged poaching of black bucks in 1998.

The matter has been listed for hearing on April 29.

However, Khan’s counsel H M Saraswat said they had mentioned in the exemption application that Khan had a problem in his ear and has been recommended not to travel by air.

“This application is not maintainable as we had never said that he could not go for shooting. We only said that on account of some ear problem, he has been advised not to go for air travel,” said Saraswat

Boda in his application cited a news report showing Salman Khan shooting for his upcoming film, ‘Bajrangi Bhaijaan’, in Jammu and Kashmir.

He alleged that by seeking exemption on health grounds, Salman Khan has given wrong facts and has misled the court. Boda sought stringent action against Khan for misleading the court.

A case had been registered against Khan by the forest department under the Arms Act mentioning that licence of the arms used by Khan during alleged poaching of black bucks at village Kankani near Jodhpur on the intervening night of 1-2 October, 1998, had expired and hence the actor had been using the arms illegally.

BJP's Sadhvi Prachi calls for boycott of Khan triumvirate, slams Mother Theresa

March 3, 2015 by Nasheman

sadhvi_prachi

Dehradun: Suggesting that films starring Bollywood actors Shah Rukh Khan, Aamir Khan and Salman Khan are spreading a ‘culture of violence’, BJP MP Sadhvi Prachi advised youngsters not to idolise the triumvirate.

Speaking at a programme of Vishwa Hindu Parishad here yesterday, the Sadhvi, known for stoking controversies by her statements, said once she had been to a programme in Meerut where she asked a young boy what he wanted to become in life.

“He said he wanted to become like Hritik Roshan, Shahrukh Khan, Salman Khan, Aamir Khan. When I asked why, his mother told me because they are good at doing stunts,” she said.

Calling for a boycott of the Khan triumvirate’s films by the right wing Hindu outfits, she said, “I, for one, would ask the Bajrangis to make a bonfire of the posters of films of Shahrukh Khan, Salman Khan and Aamir Khan.”

Sadhvi Prachi also accused Mother Teresa of proselytising in the name of service like all missionaries do.

“Mother Teresa indulged in conversion by luring people over to Christianity under the pretext of service,” she said.

RSS chief Mohan Bhagwat had also made similar remarks saying that Christianity was the main objective behind Mother Teresa’s service to the poor.

“Mother Teresa’s service would have been good. But it used to have one objective, to convert the person, who was being served, into a Christian,” he had said while speaking at a function organised by NGO Apna Ghar.

SC sets aside order staying Salman Khan's conviction in blackbuck case

January 14, 2015 by Nasheman

Salman Khan

New Delhi: In a setback to filmstar Salman Khan, Supreme Court Wednesday set aside the Rajasthan High Court order staying his conviction in the blackbuck hunting case.

An apex court bench headed by Justice S.J. Mukhopadhyay remanded the matter back to the high court for fresh consideration.

Pronouncing the verdict, Justice Mukhopadhyay said the filmstar could tell the court that he would suffer irreversible damage if his conviction is not stayed and he is eventually acquitted.

The court said that the Rajasthan government at the same time could argue that no irreversible damage which cannot be undone would be caused if his conviction is not stayed.

The Rajasthan High Court had stayed Salman’s conviction on his plea that it was coming in his way to get visa to travel to England.

Salman’s sentence has already been stayed by the high court.

Shame on Salman Khan for supporting Sri Lanka's Rajapaksa

January 6, 2015 by Nasheman

It is the actor and those who support him in this act of insensitivity who need to be condemned.

The Sri Lankan government and President Mahinda Rajapaksa have for several years denied the fact that foreign citizens who enter the country with tourist visas have been a part of political meetings and discussions in Lankan media forums. Previously, many Tamil sympathisers, including poet VIC Jayabalan, a citizen of Norway, and journalist Maha Tamil Prabhakaran, were arrested and deported by the Sri Lankan government. Also, Kumar Gunaratnam, a leader of one of Sri Lanka’s leading parties – the Frontline Socialist Party – was clandestinely arrested, imprisoned and deported on the grounds of being an Australian citizen. Senior Tamil professor, A Marx, who was scheduled to deliver a speech at a public gathering in Colombo, was arrested by policemen, even before he could begin. I have always considered such actions by the Sri Lankan government anti-democratic.

But now, Mahinda Rajapaksa has brought Salman Khan, a foreign citizen into the country, to campaign for him in the forthcoming polls. Kumar Gunaratnam, who was deported three years ago, has also been brought back into the country under a tourist visa, and I see the prime reason behind this to be his capability to affect the Opposition party’s performance. Having said that, it also holds true that no one campaigning in support of the Opposition party is allowed to enter the country, even if he/she is of Sri Lankan origin under a tourist visa. Doing so could lead to his/her arrest and deportation.

While I agree that Salman Khan has the right to express his views at any forum, joining a political campaign in support of a man who has been accused of war crimes and genocide, is condemnable for me and anyone who is also a supporter of democracy. On one hand, when the democratic forces and minorities of the country are together striving to defeat Mahinda Rajapaksa and get his government out of power, this act by Salman Khan is insulting, endorses discrimination and neglects the insensitivities that have occurred on this soil.

CommentOne of the groups protesting against Salman Khan in Mumbai – the Naam Tamilar Katchi – had in the past attacked a group of Buddhist monks and pilgrims visiting India from Sri Lanka. While such acts of violence can never be justified, a calm, democratic protest being carried out against the actor is fair to the freedom of people. It is Salman Khan and those who support him in this act of insensitivity, who need to be condemned, and not the ones voicing their angst against it in peaceful objection.
