Karnataka: Villagers march to reclaim Amrit Mahal Kavals illegally blocked for Nuclear – Military Industrial Complex

Hundreds of villagers from Doddaullarthi and other villages surrounding the massive expanse of Ullarthi Amrit Mahal Kaval of Challakere Taluk, Chitradurga district, entered the grasslands which were fenced by Bhabha Atomic Research Centre braving the might of the police and district authorities today. About 1,500 acres of these ecologically sensitive grassland ecosystems and commons had been secretively allotted to BARC of the Government of India during 2008 towards establishing an uranium enrichment plant (special materials enrichment facility) for dual use: military and civilian purposes. Without securing any clearances regulatory agencies, such as the Atomic Energy Regulatory Board, Ministry of Environment and Forests, local Panchayats, etc., BARC fenced the area in 2012 blocking villagers from accessing their grazing pastures and water bodies, and thus forcing pastoralists and farmers into distress. Villagers petitioned every office of the Government of Karnataka and India to set right the grave injustice done to them, but no corrective action was taken.

These grave injustices were raised before the National Green Tribunal in petitions filed by Leo F. Saldanha and Environment Support Group. The petitioners highlighted that in addition to BARC, other agencies such as the Defence Research Development Organisation (DRDO), Indian Institute of Science (IISC), Indian Space Research Organisation (ISRO), Sagitaur, Industries Department, etc., had commenced project activities in about 10,000 acres of Amrit Mahal Kaval grassland ecosystems, all of which had been illegally and secretively diverted for the largest nuclear/military industrial complex in the region.

Following detailed submissions by all parties to the Petitions, including those of villagers who had impleaded in the case, the Tribunal in its final order of 27th August 2014 held that no agency can commence any project activity unless they were compliant with applicable statutory norms, procedures and clearance requirements per environmental, biodiversity protection, pollution control and project specific laws.

In blatant disregard of the Tribunal’s decisions, BARC, DRDO and IISC have been undertaking extensive project activities with impunity. When challenged by local villagers recently, in the presence of the Challakere Tahsildhar (Taluk Revenue Officer) and Police Circle Inspector, BARC fished out a piece of unsigned paper claiming it had received final environmental clearance on 24th July 2014, way before the Tribunal’s ruling. The unattested note claimed the clearance was a “secret” document.

Interestingly, at para 205 in the final order of the Tribunal it is noted that:

“The respondent/BARC has stated in its reply affidavit that the major constructional activities at the site would be carried out after obtaining necessary clearance from MoEF and KSPCB which would be indicative of the fact that necessary clearances have not yet been obtained.” On the basis of this submission, the Tribunal directed that “It is made clear that both BARC and ISRO shall proceed with the activities either constructional or otherwise on establishment of respective projects, only after obtaining environmental clearance from MoEF and consent for establishment from KSPCB.”

Thus, there is no doubt whatsoever that when the Tribunal issued its final decision, i.e. On 27th August 2014, no agency had obtained environmental clearance.

BARC, however, has publicly claimed, and by way of its unsigned note shared in the presence of district and police authorities, it has secured environmental clearance for the uranium enrichment plant on 24th July 2014, quite in variance to the statements made by its Senior Counsel, Shri. Uday Holla, before the Tribunal, that no clearance had yet been secured at the time of the judgment. This is clear proof that not only has BARC misled the Tribunal, but that it is now mis-leading district authorities and the police, and also the wide public. Such claims also place the Indian Ministry of Environment and Forests in a very awkward position, for the Ministry held in its affidavit before the Tribunal that Amrit Mahal Kavals are forests, and thus, no environmental clearances could be accorded unless the issue whether Amrit Mahal Kavals are forests or not is resolved by the Hon’ble Supreme Court in accordance with its decisions in the Godavarman/Lafarge case.

To expose BARC’s lies and to reclaims their commons that had been illegally blocked for over two years, hundreds of villagers marched into the Ullarthi Kavals today with thousands of sheep, goats and cattle. A massive police cordon was formed to push them back, but had to step back when confronted with the fact that any action against the villagers would be an abrogation of the Tribunal’s orders. Villagers asserted that stopping the ongoing illegal construction by BARC was their Constitutional obligation, and they would implement the Tribunal’s decision if the police and district authorities failed to. Heeding to their justful demands, the Tahsildhar and the police removed the cordons allowing villagers to joyfully march into the Kavals in a celebratory mood, where they festively made a meal of ragi (finger millet) and rice. The Tahsildhar also announced that a meeting would be called in a few days by the District Commissioner, involving all agencies, to address all issues and concerns of the villagers and also to ensure the Hon’ble Tribunal’s orders were complied with rigorously.

Scared of guards, Modi’s wife files RTI, says she is deprived of justice

Ahmedabad: Taking the Gujarat administration by surprise, Prime Minister Narendra Modi’s wife Jashodaben has sought details through a Right to Information application about the security arrangements that she and other family members of the PM are entitled to as per protocol.

Jashodaben Modi turned up at the office of Mehsana district superintendent of police on Monday and submitted a RTI application. Of late, she has become active in social life and has been seen attending events, while expressing her desire to stay with the PM in Delhi.

Jashodaben expressed unhappiness about the current security set-up, where her guards travel in government vehicles, while, despite being the prime minister’s wife, she uses public transport.

She noted that late prime minister Indira Gandhi was killed by her own bodyguards and said she felt scared by her security. The prime minister’s wife asked the government to make it compulsory for each guard to produce copy of their deployment order.

Mehsana Superintendent of Police J R Mothalia said Jashodaben wanted to know what her rights were in terms of security. “She came to our office and filed an RTI to know about her rights as the PM’s wife with regard to security cover. We will give our written reply to her in the stipulated time,” he said.

She also sought several documents from the police department related to her security cover given as per protocol, including the certified copy of the actual order passed by the government in this regard.

Jashodaben, at present, lives with her brother Ashok Modi at Unjha town in Mehsana district. After Modi was sworn in as prime minister, she was provided with security by the Mehsana police. “We have deployed ten of our policemen, including armed guards, for her security.

They work in two shifts, five each in one shift,” said Police Inspector of Mehsana Special Operations Group J S Chavda.

Later, when a television channel tracked Jashodaben on her way to Unjha when she was riding pillion on a scooter, she said she was ready to live with Modi if he invited her. “If I am invited to live with him, I am ready to move to Delhi,” she said.

When asked about her intention behind filing the RTI application, she said: “I am not given justice. No facilities have been provided to me.”

Black money issue rocks parliament

New Delhi: The issue of black money rocked the Lok Sabha on the first working day of parliament’s winter session Tuesday, as several opposition parties tried to corner the government over the issue.

As soon as the house met for the day, Trinamool Congress (TMC) members went near the speaker’s podium with black umbrellas raising slogans on black money.

They were joined by members from Janata Dal-United, Congress, Rashtriya Janata Dal (RJD), and Samajwadi Party who also raised slogans demanding a response from Prime Minister Narendra Modi as to when the black money would be brought back.

When Speaker Sumitra Mahajan did not agree to this, they moved near the speaker’s podium carrying black umbrellas with “Kaala Dhan Waapas Lao” (Bring back black money) written on them, forcing her to adjourn the house till noon.

When the house met again at noon, work resumed amid din. While opposition members continued to raise slogans, papers were presented and even matters of urgent public importance were taken up by the house.

TMC members were also seen raising slogans in the Rajya Sabha. A notice for suspension of the question hour to take up the debate on black money was also given in the upper house.

Earlier, TMC members were seen staging a protest outside parliament. They were joined in the protest by SP, JD-U and RJD leaders.

“Modi government promised to bring back black money in 100 days, almost 200 days are over, they must give an answer now,” said TMC’s Sukhendu Sekhar.

“Black money was one of the key poll planks in the Lok Sabha elections on which the BJP won, but the government has done nothing on this count since it came to power. We want a threadbare discussion on this,” JD-U leader K.C. Tyagi, who gave the notice for discussion to the Rajya Sabha Chairman on his party’s behalf.

To End Hunger, Empower Women: Study

Empowering women and girls is critical to ending hunger, extreme poverty, and malnutrition around the world—including in the United States—according to a new report released Monday by the Bread of the World Institute.

The report by the Institute, a non-partisan, Christian citizens’ movement aimed at educating policymakers, opinion leaders, and the public about hunger, shows that discrimination against women is a major cause of persistent hunger and that increasing women’s earning potential by boosting bargaining power, reducing gender inequality in unpaid work, increasing women’s political representation, and eliminating the wage gap between male and female labor could help stem the worldwide epidemic.

“Neither women nor men living in poverty have much economic bargaining power—that is, an ability to negotiate favorable economic outcomes for themselves—especially in developing countries, as the vast majority of people do low-paying, low-productivity work,” reads “When Women Flourish…We Can End Hunger” (pdf). “Even within the constraints of poverty, however, working conditions for men and women are far from equal: women suffer many more forms of discrimination, which worsen the effects of poverty on their lives. Discrimination that establishes and reinforces women’s lower status in society starts within the family and extends through community customs and national laws.”

“Discrimination,” the analysis continues, “is why women farmers labor with fewer productive resources than their male counterparts, why women in all sectors of the economy earn less than men, and why girls are pulled out of school to work or to marry.”

Yet women are the ones the world relies on to combat hunger and malnutrition. And when they are afforded more agency—when they are given control of their own earnings, allowed to participate in the development of agricultural programs, protected from domestic violence, or permitted to stay in school longer, for example—health outcomes improve.

“Eliminating barriers and empowering women around the world is key to ending hunger in our time,” said Asma Lateef, director of Bread for the World Institute. “We must not tolerate discrimination against women and instead, demand a comprehensive approach to women’s empowerment that includes applying a gender lens to all programs and policies.”

While the report examines hunger worldwide, it devotes an entire chapter to “The Feminization of Hunger and Poverty in the United States.” To reduce hunger and poverty in the U.S.—issues that are compounded by high levels of incarceration, a persistent wage gap, and insufficient childcare benefits—the report declares, “we must identify and adopt policies that help eliminate entrenched and interconnected sexism and racism.”

The report includes a joint statement from U.S. Representatives Kay Granger (R-Texas) and Nita Lowey (D-New York), urging policymakers at home and abroad to consider the implications of giving women the tools they need to survive and thrive.

“There is no greater force multiplier than empowered women,” they write. “In developed and developing countries alike, from conflict zones to refugee shelters, when we make women’s rights and opportunity top priorities, we stand a much better chance of defeating intolerance, poverty, disease, and even extremism.”

A deadline of December 1 to contain the Ebola virus will not be fully met due to escalating numbers of cases in Sierra Leone and elsewhere, the UN Ebola Emergency Response Mission which had set the target, said.

The mission set the goal in September, seeking to have 70 percent of Ebola patients under treatment and 70 percent of Ebola victims safely buried. That target will be achieved in some areas, head of UNMEER Anthony Banbury told Reuters news agency, citing progress in Liberia.

“We are going to exceed the December 1 targets in some areas. But we are almost certainly going to fall short in others. In both those cases, we will adjust to what the circumstances are on the ground,” he said in an interview.

Banbury said the areas of greatest concern are in rural parts of Sierra Leone as well as the city of Makeni in the centre of the country and Port Loko in the northwest.

Improving surveillance

Surveillance to prevent further cross-border spread of the disease must be improved, he added, given the transmission of the disease overland from Guinea into Mali, where at least six people have now died.

The death toll in the worst Ebola epidemic on record has risen to 5,459 out of 15,351 cases identified in eight countries by the end of Nov. 18, the World Health Organization said on Friday. The vast majority of those cases are in Guinea, Sierra Leone and Liberia.

US Brigadier General Frank Tate, deputy commanding general of US forces helping Liberia fight the epidemic said on Monday that there has been dramatic improvement in the situation in the country considered the worst-hit by the outbreak.

Meanwhile, an Italian doctor who has been working in Sierra Leone has tested positive for the Ebola virus and is being transferred to Rome for treatment, the health ministry said Monday. It is Italy’s first confirmed case of Ebola.

The doctor, who was not identified and who works for the non-governmental organization Emergency, is scheduled to arrive overnight in Italy for treatment at the Lazzaro Spallanzani National Institute for Infectious Diseases in Rome.

Berlin: US whistleblower Edward Snowden has been awarded Stuttgart Peace Prize 2014, established by citizens’ initiative Die AnStifter, the group said Sunday on its website.

Snowden could not attend the ceremony, but sent a message via a video, urging to fight for the observation of human rights.

“If we are to live in a liberal society, we must stand and defend liberal values,” Snowden said.

The whistleblower added that it was important to defend human rights and demand that even the most senior officials observe them, as government and democracy should be founded on people’s trust.

In 2013, Snowden leaked classified information from the National Security Agency (NSA), concerning electronic surveillance programs, conducted by US authorities around the world, which included eavesdropping on US citizens and foreign leaders.

Following the incident, the whistleblower was charged with espionage in the United States, with his passport being revoked. In August 2013, Snowden was granted temporary asylum in Russia for one year. The asylum period was extended by the Russian government for three more years in August 2014.

Danish parliament to vote on Palestine recognition

Brussels: Danish MPs are to vote on a resolution instructing the government to recognise Palestine, but Denmark’s foreign minister says the time is not right.

The motion was introduced by deputies from three small left-wing parties: the Red-Green Alliance; the Socialist People’s Party; and Greenland’s Inuit Ataqatigiit.

“The parliament directs the government to recognise Palestine as an independent and sovereign state within pre-1967 borders and, by extension, [to] provide the state of Palestine with full diplomatic rights”, the draft text says.

The Danish assembly is to hold a first debate on 11 December and to vote on a final text in early January.

Holger K. Nielsen, one of the MPs behind the initiative, doesn’t fancy its chances.

“I don’t think we’ll get a majority, but at least we’ll have a good discussion”, he told EUobserver on Monday (24 November).

He noted that if it does get through, the government is not legally obliged to comply but would find it “impossible” to say No in political terms.

Nielsen, a former foreign minister, said he was “inspired” by Sweden’s recent decision to recognise Palestine.

He added that EU recognitions could be “a tool” to help restart peace talks: “It would give the Palestinians a better position in the negotiations, or, at least, a less unequal position”.

But Denmark’s current foreign minister, Martin Lidegaard, disagrees.

“The positions of member states [on Palestine recogntion] are evolving. This, in my view, makes sense as the peace process is not showing any progress”, he told this website.

“Denmark will also come to recognise Palestine, but the timing has to be right”.

He urged the EU to take joint steps against Israeli settlements instead.

“Israel continues to, unacceptably, expand the illegal settlements and thus de facto undermines the possibilities for a two-state solution”, he said.

“The chances of bringing together the EU and actually influencing the conflict would be greater if we consider further action against the settlements”.

For its part, Israel says settlements are “not a hurdle” to peace.

It also says European recognitions harm the peace process.

Michal Weiler-Tal, a spokeswoman for Israel’s EU embassy, told EUobserver: “Recognition at this stage without direct talks between the two sides only pushes them further apart … it [sends] the wrong message – that negotiations are futile”.

“This damages the EU image in Israeli public opinion”.

The Danish resolution comes amid a series of similar votes in Europe.

The British, Irish, and Spanish parliaments recently urged their governments to recognise Palestine.

The European Parliament will vote on Thursday, while French MPs are to vote on Friday or next Tuesday (2 December).

Echoing Lidegaard, one EU diplomat told this website that even if other EU governments follow Sweden it is unlikely to have much impact.

“There was a lot of excitement back in the 1980s when [the late Palestinian leader] Arafat was threatening to proclaim a unilateral declaration of independence [UDI]”, the diplomat said.

“More than 130 countries have now recognised Palestine. But little has changed on the ground, and the whole UDI issue has lost significance”.

Karnataka: TV9 & NEWS9 taken off air, D K Shivakumar blamed

Bengaluru: Two news channels in Karnataka have alleged that they were taken off air in Bengaluru for several hours on the state government’s orders.

TV9 and NEWS9 – both belonging to the TV9 group – allege that cable operators blacked them out on Monday night in Bengaluru and surrounding areas. After criticism and backlash, both are back on air.

TV9 has alleged that the operators acted on a directive from the state Energy Minister DK Shivakumar but the government has denied it.

“The action of the cable operators emanates from a meeting between them and Karnataka minister for Energy D K Shivakumar a few days ago, at which the minister ordered them to stop telecasting TV9 and NEWS9. He threatened them that the government will impose heavy penalties on them if they did not stop telecasting TV9 and News9. As a consequence, the cable operators’ association sent the following directive to its members on Monday,” a press release issued by the channel said.

The minister was accused of telling operators that the channels had been working against industry standards. The channel alleged that it was being punished for airing an investigation against Mr Shivakumar.

Former union minister and Congress leader Janardhan Poojary on Tuesday criticized D K Shivakumar for the alleged orders to ban the two news channels.

Addressing a press meet in Mangaluru, Poojary said, “D K Shivakumar is curbing the freedom of the press. Media is an important part of the democracy.”

“The Indian Constitution clearly states the freedom of the press in Article 19 (1) (A). D K Shivakumar needs to read it,” he added.

“While taking oath as minister you (DKS) promised to respect and abide by the Constitution. Now you have done a mistake. Every human being commits mistake, but greatness lies in accepting them. Even Mahatma Gandhi committed mistakes and accepted them, so did Indira Gandhi after the Emergency,” he said.

Addressing DKS further, he said, “If you admit your mistake, will anyone behead you? The chief minister is doing good work in the state, do not embarrass him and the party with such actions. The Congress party has given you power.

“If this issue is raised in the Parliament it will be a matter of shame to Sonia Gandhi,” he added.

“You (DKS) are trying to spoil the image of the party. Correct your mistakes, I am saying this as your well-wisher,” he said.

“The CM should intervene in this matter. Freedom of press keeps democracy alive. Do you want to murder democracy?” he questioned DKS.

After 18 months haul, CM Siddaramaiah appoints chiefs for State Boards, Corporations

Bengaluru: More than a year after assuming power, Karnataka chief minister Siddaramaiah has finally ended the uncertainty over appointments of chairpersons to State-owned Boards and Corporations in the State and the State Government has issued orders for appointments through the respective departments.

Chairpersons to 90 State-owned Boards and Corporations coming under different departments were appointed through appointment orders issued on Monday.

The appointments were cleared by the Congress party high command with the rider that sitting MLAs and those who were defeated in the assembly elections would not be considered and only party workers would be given preference.

As many as 20 women Congress workers have been appointed heads to various government entities.

A good number of office-bearers of Karnataka Pradesh Congress Committee have been awarded for their hard work.

Chief Minister Siddaramaiah and KPCC President Dr G Parameshwara, who held several rounds of consultations to prepare a list of candidates, had even consulted the AICC in charge for Karnataka Digvijaya Singh before finalising the names.

The Chief Minister and KPCC Chief had obtained approval for the final list from the party high command last week.

The newly appointed chiefs and deputy chiefs will have a tenure of only 18 months. Noted film director S V Rajendra Singh Babu has been appointed as chairman of Karnataka Chalanachitra Academy, while Congress member Vijayalakshmi Urs will head Kanteerava Studios Corporation Limited.

53% of prisoners in India are Muslims, Dalits and Tribals

New Delhi: Muslims, Dalits and Adivasis — three of the most vulnerable sections of Indian society — make up more than half of country’s prison population, according to the latest data released by the National Crime Records Bureau (NCRB) on Prison Statistics India for the year 2013.

Although the proportion of these three communities in India adds up to about 39%, their share amongst prisoners is considerably higher at 53%.

According to the 2013 Census, there were 4.2 lakh people in Indian prisons. Almost 20 percent of them were Muslims although according to the Census 2001 percentage share of Muslims in India’s population was merely 13 percent.

And it is just not for the Muslims. According to the Census of 2011, Dalits constitute 22 percent of all prisoners although they make up around 17 percent of India’s total population.

That’s not it. The Scheduled Caste and Scheduled Tribes (SC/ST) make up an approximate of 25.2 percent of the Indian population according to the Census of 2011 but their share in India prisons stands at 33.3 percent.

imprisoned What could be the reason of this high percentage of these three communities in jail? Do they commit more crimes? The answer is ‘NO’. It’s not because they are more involved in criminal cases. Instead, they are in jails because they are poor and fail to pay money to fight their cases or at manier times pay bail. Some say that these communities are targeted with false cases too.

Prominent experts were also quoted by news daily saying the same about this high percentage.

Former chief justice of Delhi High Court Rajinder Sachar, who headed the committee that brought out a report on the condition of Muslim community in India in 2006, pointed out that there had been several cases of Muslim youths being acquitted after years in prison.

“Poverty is more preva lent among these three communities and that becomes an obstacle in dealing with the legal system,” said Colin Gonsalves, human rights activist and lawyer.

“Our system has an ingrained communal and casteist bias. Also, the proportion of these communities in the police officers and even judiciary is less. These are key factors behind this shocking imbalance,” he added.

AIMIM Supremo barrister Asaduddin Owaisi holds Indian political parties responsible for this pitiable condition of Muslims “The representation of Muslims in jails is high while their political representation is low,” he lamented.

The statistics about prisoners are published by National Crime Records Bureau since 1995 and caste based breakup is available since 1999.
