Trump tells Russia to ‘get ready’ for Syria missile attacks

April 11, 2018 by Nasheman

Trump’s warning comes after the US and allies threatened to take action after a suspected gas attack in Syria [Carlos Barria/Reuters]

by Al Jazeera

US President Donald Trump told Russia in an early morning tweet to prepare for “nice and new and ‘smart!'” missile attacks in Syria after an alleged gas attack on the last rebel stronghold in the country.

The tweet came after the Russian ambassador to Lebanon said in an interview on Tuesday with Hezbollah-owned al-Manar TV that “if there is a US missile attack, we – in line with both Putin and Russia’s chief of staff’s remarks – will shoot down US rockets and even the sources that launched the missiles”.

Trump further chided Russia for its support of Syrian President Bashar al-Assad in Wednesday’s tweet, saying it “shouldn’t be partners with a Gas Killing Animal who kills his people and enjoys it!”

Russian Foreign Ministry spokeswoman Maria Zakharova responded to Trump’s tweet saying: “Smart missiles should fly towards terrorists, not [Syria’s] lawful government, which has spent several years fighting against international terrorism on its territory.”

The warnings come as the United States and several European countries threatened to use military action against the Syrian government and its main ally, Russia, in response to a suspected chemical weapons attack on the rebel-held town of Douma.

Saturday’s attack in Eastern Ghouta has killed dozens of people, mostly women and children, according to activists and local medics.

The Syrian government and Russia have denied that a chemical attack took place.

On Tuesday, rival draft resolutions by the US and Russia to set up a new expert body to probe chemical weapons attacks in Syria both failed to pass at the United Nations Security Council.

James Mattis, US defence secretary, did not rule out any military action against Assad’s forces, while US ambassador to the UN, Nikki Haley, warned Washington was ready to “respond” to the attack regardless of whether the Security Council acted or not.

Vladimir Shamanov, chairman of the defence affairs committee in Russia’s lower house of parliament, said on Tuesday that Russia has “the necessary means for that and that Americans and their allies know that quite well”, adding that a retaliatory strike could target US aircraft and naval ships, Reuters news agency reported.

Meanwhile, the Syrian government has put its forces on “high alert” amid the looming threat of a US military response.

With Russian military assistance, President Assad launched a bloody offensive on Eastern Ghouta, which had been under rebel control since mid-2013.

Since the start of the aerial bombardment campaign on February 18, the offensive has claimed more than 1,600 civilian lives, and has, through a series of deals reached with rebel groups, internally displaced more than 45,000 people according to the UN.

Trump later tweeted that Russian-US relations are “worse now” than ever before.

The president concluded by opening the possibility of a detente: “There is no reason for this. Russia needs us to help with their economy, something that would be very easy to do, and we need all nations to work together. Stop the arms race?”

Algeria: 257 killed in Boufarik military plane crash

April 11, 2018 by Nasheman

The military plane was reportedly heading to the western Algerian city of Bechar when it crashed [AFP]

by Al Jazeera

At least 257 people have been killed after a military plane crashed near the Boufarik airbase outside the Algerian capital, Algiers, according to Algerian state television.

The plane, an Ilyushin Il-76, mostly carried soldiers when it went down shortly after takeoff on Wednesday morning, state TV reported.

Algeria’s defence ministry was quoted as saying that 247 passengers and 10 crew members were among the dead following the crash.

Ennahar TV quoted an Algerian ruling party official as saying that 26 people onboard were members of the Polisario Front, a separatist movement in West Sahara – a territory also claimed by Morocco.

Algerie24, a local news website, said the plane was heading to the western Algerian city of Bechar.

Images posted on an Algerian website showed thick smoke billowing from the site of the crash, as several people rushed to help.

The crash at Boufarik would be the worst in Algeria since 2003 when an Air Algerie jet crashed shortly after takeoff from Tamanrasset, killing 102 people.

In 2014, more than 70 off-duty military personnel and their family members were killed when a C-130 plane crashed into the Djebel Fertas mountain shortly before it was to land in the northern city of Constantine.

In December 2012, two military jets conducting routine training operations collided in mid-air near Tlemcen, in Algeria’s northwest, killing the pilots of both planes.

A month earlier, a twin-turboprop CASA C-295 military transport aircraft, which was carrying a cargo of paper for the printing of banknotes in Algeria, crashed in southern France.

That plane was carrying five soldiers and a representative of the Algerian central bank, none of whom survived.

Taj Mahal a Waqf Property? Bring Shah Jahan’s Signature First : Supreme Court

April 11, 2018 by Nasheman

The Supreme Court has asked the Uttar Pradesh Sunni Waqf Board to produce documents that bear the signature of Mughal emperor Shah Jahan to prove its claim of ownership on the Taj Mahal.

the apex court on Tuesday gave the board a week’s time to produce signature of emperor Shah Jahan, who died under house arrest in the Agra Fort almost 18 years after building the monument in the memory of his beloved wife Mumtaz Mahal.
In 2010, the Archaeological Survey of India (ASI) had petitioned the court against the waqf board’s July 2005 decision ordering that the Taj be registered as the latter’s property. There is a stay on the order.

While tracing the history of the monument, the Chief Justice of India asked, “Who in India will believe that the Taj belongs to the waqf board? How did Shah Jahan sign the waqfnama? When was it given to you?”

The Board through Senior Advocate VV Giri claimed that the monument belonged to the Waqf since Shah Jahan’s time and that it is a property under the Waqfnama. The claim is challenged by the ASI.

Appearing for the ASI, advocate ADN Rao said “there was no existence of waqfnama at that time”.

“Under the 1858 proclamation, the properties taken over from the last Mughal emperor, Bahadur Shah Zafar, by the British vested with the Queen. By the 1948 Act, the buildings were taken over by the Indian government,” advocate Rao added.

The three-member bench of CJI and Justices A M Khanwilkar and D Y Chandrachud reminded the board that the monument which was built in the 17th century was passed on to the East India Company after the fall of the Mughal dynasty and further vested in the ASI post-independence.

“Shah Jahan used to view the Taj Mahal from his cell in Agra Fort where he was sent to serve house arrest by his son Aurangazeb. How did he sign the waqfnama while in custody? Show us the documents signed by the emperor,” said CJI Misra demanding for documents with Shah Jahan’s handwriting.

The issue was first initiated in the court when a resident of UP moved the Allahabad High Court to push his claims to be appointed as caretaker of the Taj Mahal, as a Mughal descendent. The High Court back then had refuse to intervene into the matter and asked to make a representation to the Waqf Board instead.

The Waqf Board is also contesting another crucial battle with the Supreme Court over the ownership of the Ayodhya land on which the erstwhile (now demolished) Babri Masjid stood.

HC increases compensation to injured soldier from Rs 4.57 lakh to Rs 73 lakh

April 11, 2018 by Nasheman

The Madras High Court has observed that the law of the nation must respect injured soldiers.

A division bench of Justices S Vimala and S Ramathilagam made the observation while enhancing the compensation to Havildar Mohan Kumar from Rs 4.57 Lakh to Rs 73 lakh.

Mohan Kumar (34), working at the frontier, was seriously injured in an accident during a visit to his native Tiruppathur in 2007.

The Motor Accidents Claims Tribunal awarded Rs. 4.57 lakh compensation to Kumar and his wife in 2012.

The soldier’s family challenged the order in the high court.

The bench observed that it was not in dispute that the claimant was totally paralysed and immobile.

“It is clear that the claimant would not be in a position to earn any more in his life. Not only the claimant who has suffered the loss, equally so his family,” it said.

The bench said the tribunal ought to have considered all aspects in proper perspective while quantifying the compensation towards loss of earning capacity.

“Therefore, it is incumbent on this court to see to it that the compensation granted is consciously just and reasonable and not for mere word sake to be termed as just and reasonable,” it said.

The bench then fixed the compensation at Rs 73 lakh and directed the New India Assurance Co Ltd in Tiruppathur to remit it to the credit of the claim petition within six weeks.

It also observed that it was high time necessary training was imparted to judicial officers regarding proper use of the ‘multiplier’ method.

The bench directed the registry to mark a copy of the order to the director, Tamil Nadu State Judicial Academy, Chennai, for necessary follow up action

Will lack of a Muslim leader hurt Congress in Hyderabad-Karnataka region?

April 11, 2018 by Nasheman

Will the lack of a Muslim leadership in the Hyderabad-Karnataka/Northeast Karnataka region hurt the prospects of the Congress party. The region comprising Bidar, Yadgir, Raichur, Koppal and Gulbarga and, Bellary districts play a crucial role in shaping the prospects of any political party.

On one hand, the Congress government in its attempt to divide dominant community Lingayat – which plays a decisive role in the election- apparently ignored to find a new Muslim leader in the region who can consolidate Muslim votes in the upcoming elections. With the passing away of former chief minister Dharam Singh and the senior most Muslim leader from the region Qamar ul Islam, the party is being crippled by the absence of tall leaders who can bring together Muslim community.

Dharam Singh hailed from the Rajput community, whose numbers are very low in the state. However, he knew the art of winning over political rivals. Qamar ul Islam a well-known name in the region, was elected six times from Gulbarga North constituency. According to reports, Khaneez Fathima, the wife of late Congress leader and minister Qamar ul Islam, has been convinced by senior leader Mallikarjun Kharge to accept a ticket if given one from Gulbarga North, the constituency Islam represented.

“The process of finding a new leader is not going to be a cakewalk for the Congress. The party wants to ride on a sympathy wave in Gulbarga North by giving the ticket to Khaneez Fathima but internal revolt cannot be overruled if the ticket is given to her. For the leadership vacuum in the region, late Qamar ul Islam has to share the blame too. He had followers but, did not groom second rung Muslim leadership in the region.”

In absence of two tall leaders, now the gigantic responsibility lies on the shoulders of senior Congress leader Mallikarjun Kharge and his son Priyanka Kharge who is currently a minister in the Congress government. Besides, recent induction of Mallikarjun Khuba, Nagappa Saloni, Basavaraj Patil Anwari and Malikayya Guttedar to the BJP has mounted pressure on the Congress leadership in the region.

Political analyst Mahadeva Prakash blamed Mallikarjun Kharge and Dharam Singh for the leadership crisis in Hyderabad-Karnataka region. Mahadeva Prakash said, “Both of them have grown like a banyan tree in the party. But they never allowed others to grow politically either Lingayats, backward class and minority. In fact, they restricted Qamar ul Islam to Gulbarga North. Qamar ul Islam’s wife may win with the help of sympathy wave. However, he ruled out opposition to her candidature.” It may be recalled that the Congress had won 27 seats out of 40 seats in 2013. The rise in the number of seats was attributed to division in BJP vote back due to Lingayat leader BS Yeddyurappa’s faction Karnataka Janata Paksha (KJP). In fact, traditionally Muslim voters have always stood by the Congress in the region. This time they may have to vote for the Congress without a prominent Muslim face around.

High Court asks govt to confirm its stand on bandhs

April 11, 2018 by Nasheman

The High Court of Karnataka on Tuesday directed the state government to file a written statement over its stand on Bandhs. It wanted the government to clarify its stand on granting permission to bandhs by pro-Kannada organisations, including Vatal Nagaraj’s outfit, over Cauvery issue on April 12th. The directive came as result of a batch of petitions challenging the permission to bandh were filed with the court.

The hearing included a division bench comprising Chief Justice Dinesh Maheshwari and Justice B M Shyam Prasad. At the hearing the advocate representing one of the petitioners submitted that the pro-Kannada organisations call bandh over and over again in violation of the court order. He contended that the state government had failed in controlling such bandhs and on contrary have supported the bandhs called by Vatal Nagaraj who also blackmails the government.

Justice Maheswari responded to the submission and observed that the court has already passed an order on February 2 in connection with the bandhs and no bandhs have been conducted since. “If you (petitioners) have proof to show that government has not taken any steps to control bandhs, submit that to the court,” he told them.

Justice Maheshwari observed that a Supreme Court order had been passed stating that bandhs called by any person or organisations is unconstitutional since they have no constitutional right to do so. Yet, petitions are being filed before the court.

The bench directed the advocate representing the state government to file a written statement over its stand on bandh. The case was adjourned to Wednesday 11th April.

C Raja, president of Rajajinagar Shradha Poshakara Sangha and others have challenged the pro-Kannada activist Vatal Nagaraj and other organisations call for bandh on April 12 following the Cauvery water dispute.
