Salman to court: Let me travel abroad without permission

August 4, 2018 by Nasheman

Actor Salman Khan moved an application in the sessions court on Friday seeking exemption from an order that mandates him to take permission for going abroad.

Judge Chandra Kumar Sonagra said the order will be pronounced on Saturday.

Khan has appealed against the five-year sentence in the black buck poaching case.

Public prosecutor P.R. Bishnoi objected to the application, saying that since arguments would close soon, a permanent exemption would not be appropriate.

Khan’s counsel Mahesh Bora told the court that the applicant’s profession demands him to travel abroad frequently.

Bora cited an earlier exemption by the High Court. He also recalled the grounds on the basis of which Khan was earlier acquitted by the High Court in two other poaching cases and by the trial court in a case against him under the Arms Act.

The arguments lasted about three hours, after which the judge adjourned the hearing, which will continue on Saturday.

No need for Bharat Bandh, SC/ST Act being restored: LJP

August 4, 2018 by Nasheman

The Lok Janshakti Party (LJP) on Friday said the proposed bandh on August 9 should be called off as the government has decided to restore the SC/ST Act to its original form. LJP termed its earlier demand for removal of NGT Chairman A.K. Goel “a non-issue”.

The LJP had earlier said the party-affiliated Dalit Sena would participate in the “Bharat bandh”, called by several Dalit organizations for August 9 to press for restoration of the SC/ST Act.

“The government has brought the bill to restore the SC/ST Act. So, we do not find any reason for a bandh on August 9,” LJP Parliamentary Board Chairman and MP Chirag Paswan told reporters here.

Chirag Paswan, who is son of Union Minister Ram Vilas Paswan, also said that now his party would not pursue the demand of Justice Goel’s removal as its concern was the order passed by him as Supreme Court judge, which had “weakened” the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

“We do not have anything personal against him (Goel). We were against the order passed by him. Now that the government has made the order ineffective, the matter is over,” he said.

The Jamui MP said there were angry and negative sentiments among the SCs and STs after the Supreme Court on March 20 put a safeguard against the arrest of those committing an offense under the SCs/STs (Prevention of Atrocities) Act.

“With the amendment bill, the government has fulfilled all promises it had made,” he said.

Chirag Paswan also thanked the Bharatiya Janata Party (BJP)-led Central government for giving constitutional status to the National Commission for Backward Classes (NCBC).

Backwardness of SCs/STs enough to grant them quotas in promotions, Centre tells SC

August 4, 2018 by Nasheman

The Centre on Friday told the Supreme Court that mere backwardness of the Scheduled Caste and Scheduled Tribes was enough to grant them reservations in promotions and that there was no need for the government to back their inadequate representation with quantifiable data.

The contention came during a hearing by a five-judge bench headed by Chief Justice Deepak Misra on a government plea seeking a re-look by a seven-judge constitution bench at a 2006 judgment that barred reservations in promotions.

The top court in 2006 had said, ” … The state will have to show in each case the existence of the compelling reasons, namely, backwardness, the inadequacy of representation and overall administrative efficiency before making provision for reservation” in promotions.

The 2006 judgment is also known as Nagaraj judgment.

Pointing to the social oppression that Scheduled Caste people suffer at the hands of dominant castes, Attorney General K.K. Venugopal said: “They are not even allowed to ride horses” during their family functions.

The court directed the listing of the matter on August 16.

Two Romanians held for Kolkata ATM frauds

August 4, 2018 by Nasheman

Two Romania nationals were detained in connection with ATM frauds in the eastern metropolis wherein many persons were swindled out of money totaling Rs 18-20 lakh through fraudulent transactions, Kolkata Police said on Friday.

The accused were picked from Vasant Vihar in Delhi and 20 duplicate ATM cards, also called clone cards, seized from them. Magnetic strips used in ATM cards were also seized, police told the media here.

Preliminary investigation revealed that the two accused arrived in Kolkata in March and stayed for around two months.

The fraud was committed by the use of skimming machines on ATMs to clone users’ card details. The accused then fraudulently withdrew around Rs 18-20 lakh from different bank accounts at unmanned ATMs in a week.

A Special Investigation Team was set up to probe the fraud after the victims approached city police earlier this week with complaints that money ranging from Rs 4,000 to Rs 40,000 were withdrawn from their bank accounts fraudulently.

Police has so far received 77 complaints, primarily customers of Canara Bank and Punjab National Bank. A former Calcutta University Professor and a renowned radio jockey were among the victims.

Canara Bank identified 37 customers from its south Kolkata branch as victims and said it was taking steps to compensate affected customers within a week. The PNB said it has started compensating depositors as well.

Modi government gave a clean chit to Choksi, alleges Rahul

August 4, 2018 by Nasheman

Congress President Rahul Gandhi on Friday hit out at Prime Minister Narendra Modi, alleging that his government gave a clean chit to fugitive diamond merchant Mehul Choksi and enabled him to obtain Antiguan citizenship.

“In today’s big news: India gave Mehul “Bhai” Choksi, Mr 56s ‘suit-boot’ BFF, a clean chit in Nov 2017, enabling him to obtain Antiguan citizenship. This “Bhai” looted PNB of 13,000 Cr., before scooting from India,” said Gandhi on Twitter.

“Here’s a little video of Mr 56 with Mehul “Bhai” (quiet smiley),” he added attaching a video where Modi is seen praising Choksi.

The extradition request for fugitive diamond merchant Mehul Choksi, who has secured an Atiguan passport and is living there, will soon be sent to the Caribbean country, the CBI said on Friday.

The Central Bureau of Investigation is probing the Rs 13,500-crore bank fraud allegedly committed by the jeweler and his nephew Nirav Modi. It said its letter to get Choksi deported has been forwarded to the External Affairs Ministry.

The CBI sent on Monday the letter to the Union Home Ministry which in turn forwarded it to the External Affairs Ministry, an official said.

Night ban on vehicles through Karnataka forest to stay: CM

August 4, 2018 by Nasheman

The night-long ban on vehicular movement through the 30km Bandipur forest road in southwest Karnataka would continue, said state Chief Minister H.D. Kumaraswamy on Friday.

“The night ban on movement of vehicles through Bandipur forest area from 9 p.m to 6 a.m will continue as before,” Kumaraswamy told reporters here.

The Chief Minister’s Office also clarified that there was no proposal to build an elevated road through the forest for vehicular traffic towards Kerala.

“There’s no change in the state government’s stand on night ban on vehicles, and construction of an elevated road through the forest is not feasible,” reiterated Kumaraswamy.

The assertion and clarification came a day after a local media report alleged that the state government had agreed to lift the night ban on vehicles, especially buses and trucks, as sought by the Kerala government through the Central government.

Citing a letter from Union Ministry of Road Transport and Highways Secretary Y.S. Malik, the report said the Chief Minister and state Public Works Department (PWD) Minister H.D. Revanna had recently agreed to lift the night ban as sought by the neighbouring Kerala state.

Revanna is the elder brother of Kumaraswamy and both are sons of former Prime Minister and Janata Dal-Secular (JD-S) supremo H.D. Deve Gowda.

Vehicular movement has been banned since 2009 for nine hours from 9 p.m. to 6 a.m in the forest area to prevent road mishaps, man-animal conflict and to protect wildlife on both sides of the Karnataka-Kerala border.

Attempts by the Kerala government and the transport lobby to lift the night ban has failed over the years after the Karnataka High Court banned it and the Supreme Court upheld it subsequently.

Outraged by the reported consent on lifting the ban, conservationists, activists and wildlife experts took to the social media since Thursday and initiated an online campaign for continuation of the ban.

Earlier in the day, state Forest and Environment Minister R. Shankar told reporters at Mysuru, about 150km from here, the state government would maintain status quo to protect wild animals from air and noise pollution.

“We will not buckle under the pressure of Kerala or central government to lift the night ban as man has no right to endanger the life of animals or disturb their fragile ecosystem,” Shankar told reporters.

Two held for misappropriating Rs 1.72 crore

August 4, 2018 by Nasheman

Two employees of ATM replenishing company SIS Cash Service Ltd have been arrested for misappropriating over Rs 1.7 crore from its Rajouri Garden branch in the national capital, police said on Friday.

The accused — Manish Kumar and Satpal — were arrested on Thursday from their residences in Uttam Nagar and Rohini here, respectively.

“In a well-planned manner, they withdrew Rs 2.54 crore from company’s vault on two occasions to fill into 10 ATM machines but they put only Rs 65 lakh,” the police said.

The company officials came to know about misappropriation on August 1 after a mismatch of the amount found during calculation of withdrawal and deposit amounts in the vault.

“We found the ATM machines allotted to Manish and Satpal were receiving a lesser amount than they were withdrawing from the vault,” Deputy Commissioner of Police (DCP) Vijay Kumar said.

During the investigation, the investigating team discovered that Manish and Satpal had withdrawn Rs 1.84 crore on July 27 from Prema Savariya branch of SIS Cash Service, located in Rajouri Garden. But the accused had replenished only Rs 65 lakh in 10 ATMs, the DCP said.

“They have misappropriated Rs 1.19 crore and not loaded in ATM kiosks. The accused did not stop here. They also visited some other ATM kiosks, opened them with the help of keys and passwords and further removed Rs 70,28,500,” he said.

“Manish and Satpal have misappropriated a total sum of Rs 1,72,78,500,” he said, adding that “we have recovered Rs 76 lakh from them so far”.

An investigation is on to recover the rest of the amount, the DCP added.
