European Union​ takes on AstraZeneca in court over Covid-19 vaccine deliveries

Deliveries have increased slightly since then but, according to the European Commission, the company is set to provide only 70 million doses in the second quarter.

AstraZeneca’s contract signed with the European Commission, the EU’s executive arm, on behalf of member states foresaw an initial 300 million doses for distribution among all 27 countries, with an option for a further 100 million.

The doses were expected to be delivered throughout 2021.

But only 30 million were sent during the first quarter.

Deliveries have increased slightly since then but, according to the European Commission, the company is set to provide only 70 million doses in the second quarter.

It had promised 180 million.

EU lawyer Rafael Jafferali told the court that the company now expects to deliver the total number of doses by the end of December, but he added that “with a six-month delay, it’s obviously a failure.”

His main argument is that AstraZeneca should have used production sites in the bloc and the U.K. for EU supplies as part of a “best reasonable efforts” clause in the contract.

He said that 50 million doses that should have been delivered to the EU went to third countries instead, “in violation” of their contract.”

Jafferali has said that the company should use all four plants listed in their contract for deliveries to the EU.

He also accused the company of misleading the European Commission by providing data lacking clarity on the delivery delays.

“The information provided by AstraZeneca did not allow us to fully understand the situation before mid-March 2021,” he said.

The EU has insisted its gripes with the company are about deliveries only and has repeatedly said that it has no problems with the safety or quality of the vaccine itself.

The shots have been approved by the European Medicines Agency, the EU’s drug regulator.

While the bloc insists AstraZeneca has breached its contractual obligations, the company says it has fully complied with the agreement, arguing that vaccines are difficult to manufacture and it made its best effort to deliver on time.

Lawyers for the company will address the court later Wednesday.

As part of an advanced purchase agreement with vaccine companies, the EU said it invested 2.7 billion euros ($3.8 billion), including 336 million (USD 408 million), to finance the production of AstraZeneca’s serum at four factories.

The long-standing dispute drew media attention for weeks earlier this year amid a deadly surge of coronavirus infections in Europe, when delays in vaccine production and deliveries hampered the EU’s vaccination campaign.

Cheaper and easier to use than rival shots from Pfizer-BioNTech, the AstraZeneca vaccine developed with Oxford University was a pillar of the EU’s vaccine rollout.

But the EU’s partnership with the firm quickly deteriorated amid accusations it favoured its relationship with British authorities.

While the U.K.made quick progress in its vaccination campaign thanks to the AstraZeneca shots, the EU faced embarrassing complaints and criticism for its slow start.

Concerns over the pace of the rollout across the EU grew after AstraZeneca said it couldn’t supply EU members with as many doses as originally anticipated because of production capacity limits.

The health situation has dramatically improved in Europe in recent weeks, with the number of COVID-19 hospitalizations and deaths on a sharp downward trend as vaccination has picked up.

About 300 million doses of vaccine have been delivered in Europe — a region with around 450 million inhabitants, with about 245 million already administered.

About 46 per cent of the EU population have had at least one dose.

In total, the European Commission has secured more than 2.5 billion of vaccine doses with various manufacturers.

It recently sealed another major order with Pfizer and BioNTech through 2023 for an additional 1.8 billion doses of their COVID-19 shot to share between the bloc’s countries.

Following Wednesday’s hearing, a second one is slated for Friday, with a judgment to be delivered at a date to be announced.

In addition to the emergency action, the European Commission has launched a claim on the merits of the case for damages for which a hearing hasn’t yet been set by the court.

252 black fungus cases reported, no deaths

VIJAYAWADA: No black fungus deaths have been reported in the State and a total of 252 cases have emerged from various districts so far, Principal Secretary (Health) Anil Kumar Singhal said on Tuesday. The State government has sent 2,100 more Amphotericin-B vials to the districts to treat black fungus cases in addition to 900 vials already dispatched. Briefing the media about the Covid-19 situation in the State, he said with black fungus being declared an epidemic, all the information pertaining to the cases is being tabulated and sent to the health department.

The number is likely to cross the 75,000- mark on Wednesday as more stock will be sent to the district hospitals, he explained. With regard to oxygen supply, he said the State has enough stock to meet any emergency situation in the next 3-4 days. “Keeping Yaas in mind, we have started stocking over and above the allocated 590 MT of oxygen per day for the last 4-5 days. A total of 767 MT of oxygen was drawn on Tuesday, which is 170 MT more than the allocation. About 630-640 MT is being supplied to hospitals and the rest is being stocked as a buffer,” he said.

Making it clear that there is no change in the vaccination policy of the government announced earlier, the Principal Secretary said Covid jabs to high risk groups in the 45+ age group are being administered since Monday. “We have to receive 78,000 more Covaxin doses from the Centre. At present, the State has 1,17,980 doses of vaccine, which is sufficient to administer the second dose to 90,000 people. The second dose will be administered from Wednesday,” Anil Kumar Singhal said. On Covishield vaccine stock, he said the State has 4,35,990 doses sent by the Centre.

The State has procured 12,74,290 doses of vaccine on its own. The same is being used to administer the first dose of vaccine to high risk groups. On ‘herbal medicine’ of B Anandaiah of Krishnapatnam, he said the Ayush Commissioner had observed the process and the samples were sent to labs in Hyderabad for analysis. At the same time, the Central Council for Research in Ayurvedic Sciences (CCRAS) and Ayurvedic College in Tirupati have also collected the medicine samples to study its efficacy.

“Chief Minister YS Jagan Mohan Reddy has asked the Ayush Commissioner to find out if any people who got eye drops, have developed any adverse symptoms. The report is expected by Friday. Lab findings from Hyderabad will also be known by that day. Based on the findings of the CCRAS, the State government will take a decision on allowing the distribution of medicine,” he added.

Black fungus: Center allocates 29,250 additional vials of Amphotericin-B to States and UTs

NEW DELHI: The Union Minister for Chemicals and Fertilizers Sadananda Gowda informed on Wednesday that additional 29,250 vials of Amphotericin-B, used in the treatment of Mucormycosis, were allocated to States and Union Territories, based on their number of patients under treatment.

Earlier, additional 19,420 vials of Amphotericin- B were allocated on 24th May and 23,680 vials of the drug were supplied across the country on 21st May, the Ministry of Chemicals and Fertilizers informed.

political Tensions buzz ahead of Cabinet meet

BENGALURU: There has been an intense political activity in the state since Saturday with prominent leaders rushing off to Delhi and some top ministers holding a hush-hush meeting.Minor Irrigation Minister CP Yogeshwara who visits New Delhi regularly to meet the party central leadership was on Monday night accompanied by party MLA Arvind Bellad, who is considered an upcoming leader.

Though Yogeshwara and Bellad, who represents the Hubli-Dharwad South constituency, could not meet any of the top leaders, they spoke to Karnataka in-charge Arun Singh over phone, party .It is discussed within party circles that Bellad, a LIngayat leader, is one of the top names doing the rounds for the chief minister’s post if there is a vacancy at the top.

It was said that Mines and Geology Minister Murugesh Nirani too was expected to head to Delhi, but the visit was cancelled at the last minute. The sudden intense activity, coming ahead of the cabinet meeting on Thursday, has raised many eyebrows within BJP circles.What set off the buzz was the meeting in Hubballi on Saturday. Union minister Pralhad Joshi, who too is said to be in the race for the CM’s post, met ministers Dr K Sudhakar, Byrathi Basavraj and former minister Ramesh Jarkiholi, who were instrumental in bringing BJP to power. 

Sudhakar, who was visiting Tumakuru, later headed to Chitradurga, where he was joined by Byrathi Basavraj. The duo then went to Shiggaon, Haveri to meet Home Minister Basavraj Bommai and PWD Minister CM Udasi. The four met over dinner. But more interesting was the breakfast meeting the next morning in Hubballi where Pralhad Joshi joined them.

PU-II exams in July, dates yet to be fixed

The Second PU examinations will be held in July this year, but the exact dates are yet to be worked out, said Pre-University Education Department Director Snehal R said on Tuesday.

The exam pattern and timetable too will be decided after discussion and announced later, she said. The PU department requires around 75 days to schedule, conduct and announce the exam results, she said.

She appealed to departments concerned to hold all-India entrance exams for professional courses only after CBSE Class 12 exams, which are scheduled between July 15 and August 26 this year. By that time, the Second PU exams too should be completed to help students appear for competitive exams.

Salman Khan files defamation complaint against actor Kamaal Khan

MUMBAI: Bollywood superstar Salman Khan has filed a defamation complaint in a Mumbai court against actor Kamaal R Khan over the latter’s review of the just released Hindi film ‘Radhe’.

Kamaal Khan acknowledged the development.

He tweeted, “Salman Khan files a defamation case against me for Radhe’s review!” As per the notice, Salman Khan’s legal team will be mentioning the matter for an urgent hearing before an additional sessions judge of the city civil court on Thursday.

Vaccines found effective in combating mutated variants of coronavirus: Study

NEW DELHI: A study conducted by a private healthcare facility in Delhi has found that vaccines were found to be effective in combating the mutated variants of coronavirus and guarding against severe infection, hospitalisation and even death.

There have also been instances where people have succumbed to the virus after being vaccinated fully.

According to the Indraprastha Apollo Hospitals, the study was conducted as concerns have been raised on the efficacy of vaccination against the mutated variants of COVID-19.

The study was carried on 69 symptomatic healthcare workers working at the hospital, who tested positive for COVID-19 despite being administered the Covishield vaccine, during the first 100 days of the vaccination drive earlier this year.

Among the 69 people, 51 were fully vaccinated with two doses and the remaining 18 were partially immunised with a single dose, prior to acquiring the infection, said Dr Anupam Sibal, Group Medical Director and Senior Pediatric Gastroenterologist of Apollo Hospitals.

The predominant infections occurred from B.1.617.2 lineage (47.83 per cent), followed by B.1 and B.1.1.7 strains, he said.

“There were only two hospital admissions (2.89%) for minor symptoms, but no ICU admissions and deaths, from this group. These findings are significant because more than half of the cohort were found infected with the Variant of Concern (VoC) and still escaped from the severe illness, which could have been a severe event for them without vaccination coverage,” Sibal said.

Variants of Concern are mutated versions of a virus that may spread more rapidly or may cause severe illness and hence notified for global monitoring by the World Health Organization and other multi-lateral health agencies.

Dr Raju Vaishya, Senior Consultant, Orthopedics, Indraprastha Apollo Hospitals, and one of One of the key authors of the study, said post-vaccination, SARS-COV-2 infections were seen only in a small subset of their healthcare workers.

“Since, the immunity in an individual takes some time after the vaccination, therefore, it is essential for the vaccinated individual to be extra careful at least two weeks after the second dose of vaccination and even further, by taking universal safety precautions like maintaining social distancing, using face masks, and hand sanitation,” Vaishya said.

The study concluded that the prior vaccination in the healthcare workers offered clear protection from severe disease due to variants requiring hospital and ICU admissions and even causing deaths.

This is the second study whose findings have been released by the hospital.

The facility had also released the findings of a study on May 15 which had stated that only 0.06 percent of people who contracted the virus after vaccination required hospitalisation with no ICU or ventilators used.

The second study narrowed down to analysing those healthcare workers who were affected with the more virulent strain of coronavirus, the hospital said.

The study analysed nasopharyngeal samples for genome sequencing, in collaboration with the National Centre for Disease Control (NCDC), a statement from the hospital said.

Genome sequencing is the key test to identify the nature of the virus and the variants that may emerge.

Currently, this facility is available in only 10 select government organisations, but such testing facilities are now being increased in the near future by the Centre, the statement said.

Protest flags, slogans and marches as farmers observe ‘black day’ to mark six months of stir

NEW DELHI: Farmers agitating at three Delhi border points raised black flags, shouted anti-government slogans, burnt effigies and took out protest marches as they observed ‘black day’ on Wednesday to mark the completion of six months of their stir against the three Central agri laws.

As part of their ‘black day’ protest, the farmers put up black flags and burnt effigies of government leaders at the three border points — Singhu, Ghazipur and Tikri — to register their protest against the three laws as well as the Centre.

The Delhi Police has urged people not to hold gatherings due to the COVID-19 situation and the ongoing lockdown and said it is keeping a tight vigil to deal with any situation at the protest sites.

Senior farmer leader Avtar Singh Mehma said that black flags have been hoisted not only at the protest sites but also in villages in Haryana, Punjab and Uttar Pradesh, adding that villagers have put up black flags atop their houses as well as on their vehicles.

“Effigies of government leaders were burnt. This day is to reiterate the fact that it has been six months since we have been protesting, but the government, which also completes seven years in office today, is not listening to us,” said Mehma.

All those in solidarity of their movement also donned black turbans and dupattas.

At the Singhu border, protestors gathered at the Kajaria Tiles office, held meetings, and took out a march towards the stage.

Farmer leader Kulwant Singh said, “The protesters took out a march carrying black flags. They burnt Prime Minister Narendra Modi’s effigy while raising slogans against the three farm laws.”

“We are urging people to support farmers by putting black flag at their residence and other places,” he said.

On Tuesday, the National Human Rights Commission (NHRC) had issued notices to Delhi, UP, Haryana on alleged flouting of COVID norms by the protesting farmers.

The Delhi Police too had urged people not to hold gatherings due to the COVID-19 situation and the ongoing lockdown.

However, Mehma said that the government shouldn’t have introduced the three laws during the pandemic in the first place.

“If the government wants us to go back then it should listen to us and repeal the laws, because we are not going anywhere unless our demands are met.

“It is not our hobby to sit in the heat and the cold at the borders. We also want to go back home and be safe,” the farmer leader told PTI.

Police force has been in place at all the borders points, including the protest sites of Singhu, Tikri and Ghazipur, since Tuesday.

At Ghazipur on the Delhi-Uttar Pradesh border, hundreds of farmers, led by Bharatiya Kisan Union (BKU) leader Rakesh Tikait, converged into groups as they burnt an effigy of the Centre in protest.

A ruckus briefly ensued between protestors and the local police, donning anti-riot gears, who had tried to stop them from burning the effigy at the UP Gate below the Delhi-Meerut Expressway.

While many BKU supporters held black flags in their hands, several others had placards that condemned the government and demanded withdrawal of the contentious laws, even as COVID-19 protocols on social distancing and face masks were largely amiss at the site.

Tikait, who has been leading the protest at Ghazipur since November 2020 and had become a prominent face of the protest after the January 26 violence in Delhi, was seen sporting a black-colour turban and a black flag.

The influential BKU spokesperson from western Uttar Pradesh was credited with reviving the protest that had lost sheen after the January 26 violence with his emotional pull that overnight drew support for the farmers on Delhi’s outskirts.

Thousands of protesting farmers reached Delhi borders on November 26 last year to protest against the Centre’s three new farm laws.

Meanwhile, a plea in the Delhi High Court has sought an independent probe by a Special Investigation Team (SIT) into an alleged attack on the farmers camped on the outskirts of the national capital in protest against the Centre’s three farm laws.

The petition has alleged that on January 29 the farmers’ camp at Singhu border, between Delhi and Haryana, was attacked by some miscreants “with assistance and guidance of the police personnel” deployed there.

It has claimed that a criminal complaint in relation to the attack was filed at the Alipur police station against the miscreants and erring officers of Delhi Police, however, no FIR was lodged.

The plea has also claimed that representations were sent to the CBI, the Chief Justice of India, National Commission for Women and National Human Rights Commission requesting for proper enquiry to be conducted against the accused persons, but nothing happened.

Cyclone Yaas: Indian Army Rescue and Relief columns on alert in West Bengal

KOLKATA: The Indian Army on Wednesday said that in coordination with the West Bengal government it has positioned rescue and relief columns across the areas on the Odisha-West Bengal coast expected to be affected by “very severe cyclonic storm”, which made landfall this morning, battering coastal districts of the two states with heavy rain and strong winds.

According to the India Meterological Department, the very severe cyclonic storm Yaas centred about 50 kilometer south -southeast of Balasore and landfall process commenced at 9 am.

“Meanwhile, in East Midnapore, one rescue column has been launched to rescue 32 civilians who are stuck due to a surge in water levels”, the Army said.

The West Bengal state government has set up a round-the-clock control room in the secretariat annexe to monitor the situation.
