Bombay HC grants interim protection to IPS officer Rashmi Shukla till March 25 in phone tapping case

MUMBAI: The Bombay High Court on Friday restrained the Pune police from taking any coercive action against IPS officer Rashmi Shukla till March 25 in connection with the FIR registered against her recently in an alleged phone tapping case.

The bench also noted in its order that the said FIR had been registered against Shukla after a considerable delay.

It took note of Shukla’s counsel and senior advocate Mahesh Jethmalani that though the alleged incident of illegal phone tapping had taken place over three years ago, the Pune police’s FIR was registered against Shukla only on February 25 this year.

Jethmalani further said that while several other officers of the Maharashtra police had been involved in obtaining the sanction for putting certain phone numbers under surveillance, the FIR had been registered only against Shukla.

The Maharashtra government’s counsel Y P Yagnik, however, opposed Shukla’s request for interim protection from arrest.

He further sought some time to file a reply to her plea saying that a copy of the petition had been served to him only on Thursday.

Yagnik urged the high court not to pass any interim orders on the plea.

The bench, however, said that Shukla had made a case fit for ad-interim relief and that in passing its order, the high court was merely following the mandate of the Supreme Court.

“We will pass appropriate orders. As per the petitioner’s submissions, you (state police) are filing the FIR after three-and-a-half years of the alleged cause of action,” the HC said.

“Is it not a case of malafide action that while apparently several officers are involved, the FIR is filed against only one officer? She is a serving IPS officer, holding a responsible post in Andhra Pradesh. Where is the scope of her absconding?” it said.

While Yagnik argued that the court was considering “only one side of the case,” Jethmalani argued that Shukla had been singled out and therefore, prayers in the petition deserved consideration.

Jethmalani further said that though a number of officers were involved in the process of alleged surveillance and phone interception on the basis that the said phone holders were supplying narcotics to college students, nobody else had been named in the said FIR.

The senior lawyer also told the HC that none of the phone numbers allegedly intercepted were registered in the name of any politicians.

The HC then said that prima facie, it was “convinced” that Shukla deserved to be granted protection until further orders.

“First of all, there is a delay in registering the FIR. Secondly though other officers were involved in obtaining sanction for the surveillance of certain phone numbers, FIR is only against the petitioner,” the high court said in its order.

“Thirdly, the petitioner is a high-ranking officer and is occupying a responsible post of ADG with the CRPF, Hyderabad. It is unlikely that she will abscond. Therefore, she needs to be given protection,” it said.

The HC bench also recorded in its order that Jethmalani, on the instructions from Shukla, said that she was willing to extend “full cooperation” to the police in its probe in the case.

The HC granted two weeks to the Pune police to file its reply to Shukla’s plea.

It posted the matter for further hearing on March 25 and said that no coercive action must be taken against Shukla in the case until then.

Shukla, who was posted as Pune police commissioner between March 2016 and July 2018, is presently on central deputation and posted as additional director general of Central Reserve Police Force (CRPF) in Hyderabad.

The FIR was filed against Shukla under relevant sections of the Indian Telegraph Act for alleged illegal tapping of phones of politicians between 2015 and 2019 during her tenure as the Pune police commissioner.

Seeking to quash the FIR, the IPS officer has said in her plea that she was being “falsely implicated” in the case and that she was a victim of “political vendetta”.

Poll-centric Karnataka budget may focus on welfare, farmers’ income

BENGALURU: Hoping to strike the right balance in his maiden budget, Chief Minister Basavaraj Bommai, who also holds the Finance portfolio, will look to focus on welfare schemes, ensure economic development and financial discipline without burdening the people. He is due to present the budget on Friday afternoon.

In the past few months, the government has given a lot of emphasis on implementing the Central government’s ambitious Jal Jeevan Mission and announced measures to increase farmers’ income, and its focus on these initiatives is likely to be reflected in the budget, sources said.

In 2021, former CM BS Yediyurappa had, in his budget, allocated Rs 7,795 crore for the development of Bengaluru city. With BBMP polls likely in the next few months, Bommai is likely to announce development works and better infrastructure too. Bengaluru, that has 28 assembly constituencies, plays a major role in any assembly election.

The economy, that suffered a setback for two consecutive years, has been showing signs of recovery. There is also pressure on the CM not to hike taxes on fuel and liquor, and the CM is unlikely to announce additional tax/cess, sources said. B T Manohar, Chairman, GST Committee, FKCCI, said, “The government might not take the risk of announcing additional taxes as everyone, including industries and commoners, suffered during the pandemic.

The government’s borrowings are likely to increase.” Karnataka State Government Employment Association President Shadakshari said they are demanding constitution of the Pay Commission to increase state government employees’ salaries on par with that of central government employees.

Yediyurappa urged Bommai to make the announcement on constituting the Pay Commission in the State Budget. State Government employees are demanding salaries on par with Central Government staff. In the legislative session, the CM had hinted at constituting a Pay Commission. In his letter to the CM, Yediyurappa said the state revises employees’ salaries once every five years and during his tenure as CM, he implemented the recommendations of 5th Pay Commission. “Like many other states, there is a need to bring Karnataka government employees’ salaries on par with central government employees,” he said.

Russian troops are shelling Europe’s largest nuclear power station in Ukraine.

“We demand that they stop the heavy weapons fire. There is a real threat of nuclear danger in the biggest atomic energy station in Europe,” Andriy Tuz, spokesperson for the plant in Enerhodar, said in a video posted on Telegram.

The plant accounts for about one quarter of Ukraine’s power generation.

Tuz told Ukrainian television that shells were falling directly on the Zaporizhzhia plant and had set fire to one of the facility’s six reactors.

That reactor is under renovation and not operating, but there is nuclear fuel inside, he said.

Firefighters cannot get near the fire because they are being shot at, Tuz said.

A live-streamed security camera linked from the homepage of the nuclear power plant showed what appeared to be armoured vehicles rolling into the facility’s parking lot and shining spotlights on the building where the camera was mounted.

Mekedatu yatra ends today with huge rally,Traffic Jam across city,High court raps Cong for taking out Mekedatu padayatra in Bengaluru

The five-day padayatra demanding immediate implementation of the contentious Mekedatu project culminated here Thursday night with a massive rally and a meeting at the National College Grounds.

The Congress had launched the 165-km ‘Namma Neeru Namma Hakku’ (our water, our right) padayatra on January 9, and it was originally scheduled to end on January 19. However, the party was forced to halt it temporarily amid rising Covid cases in the state and a rap from the high court.

The last day of Congress padayatra demanding implementation of the Mekedatu project started from Mekri circle and ended at national college grounds on Thursday.

Thousands of party workers marched on padayatra leading to traffic disruptions across city .

The traffic police blamed people adamant for not taking diversion which led to chaos .

Though elaborate security arrangements and traffic diversion were made,many motorists caught off guard at major junctions and vent their ire for the jam.  

However the international airport road was not affected and the traffic movement was as usual , a senior police officer said .

The procession started from mekhri circle in the morning,passed through,Sadashivanagar,cauvery theatre junction,Malleshwaram, Khoday’s junction, Cottonpet main road,Chamarajpet to reach National college grounds.

Few motorists who were caught in the traffic blamed the protestors asking them to go and protest in front of CM’s residence instead of harassing people.

There are many office goers and students attending school have been asked to take diversion, which irked them.

Heavy police deployment in and around the national college grounds with over 900 police men headed by DCP south and nine ACPs,16 inspectors and 55 PSIs,68 ASIs,195 Head Constables and 469 constables deputed for the security duty.

Meanwhile,The Karnataka high court on Thursday pulled up the Basavaraj Bommai-led Bharatiya Janata Party (BJP) government over the Congress padayatra for Mekedatu project, directing that there be no permissions given for protests,meetings or processions that adversely impact traffic flow in Bengaluru,except at the Freedom Park.

Since there are several issues with regard to holding of processions the rules and whether the processions/protests etc.

Can be held in accordance with the law, having regard to the fact that the processions/protests, etc,have serious repercussions on the city as well as cascading effect on the day to day activity in the entire city, including traffic, etc.

Pending decision in this petition,we deem it appropriate to direct the state government that no protests/processions/meetings held in the entire city of Bengaluru by any group, political or non-political,except at the Freedom Park,Gandhinagar,in an organised manner and ensuring traffic in the city does not get adversely affected, especially during rush hours,” the court said in the order.

The bench said the directions would be in force during the pendency of the PIL petition,initiated by the court in 2021.

The court’s orders came on the last day of the padayatra, which culminated in Bengaluru on Thursday, a day before Karnataka chief minister Basvaraj Bommai presents his maiden budget.

The Congress party’s padayatra has been traversing the breadth of Bengaluru as it tries to drive home the point that the struggle for Mekedatu is to ensure drinking water supply for the city’s over 12 million residents.

On February 28, the Karnataka police booked at least 37 persons, including Karnataka Congress president DK Shivakumar, Leader of Opposition Siddaramaiah, among other senior leaders for violating Covid-19 norms. The Ramanagar district administration had filed the complaint.

Two muggers armed robbers arrested by Kengeri police, recovered stolen property Worth Rs.1 lakh

Kengeri police on Wednesday arrested two persons who had assaulted a private firm employee with a knife and robbed his I-Phone on February 25.

The accused has been identified as,Salman,22 and his associate,Inzamam,23.

Senior officer told media persons,Based on the complaint filed by Manoj TS,31,a software engineer, the Kengeri police inspector,Vasanth C,and his team swung into action and with the help of police investigation skills and technology inputs the team tracked down the accused and arrested Salman, 22 and his associates Inzamam, 23 and recovered robbed mobile phone and bike and a dagger used to commit the robbery from him.

During investigation the accused confessed the crime and it was found that Manoj was waiting outside the metro station for the transport when the duo confronted him and threatened at knife point to handover the mobile .

Manoj tried to resist and was injured in the melee.The duo attacked him with a dagger and escaped with his mobile phone worth Rs 40,000.

The police team analyzed the CCTV footage from in and around the area and arrested the accused.

With their arrest the police have solved another mobile robbery case which is being investigated . 

The accused would move around the city on bike and target people having expensive phones,he said.

Five held,four home guard, including self styled journalist arrested for carrying out fake raids extorting money from Spa and commercial establishments

The East Division police of Ramamurthynagar police on Wednesday arrested a gang of five including a self styled journalist who along with four home guards was running an extortion racket.

The accused has been identified as,Syed Kaleem,28, resident of RT Nagar,Sampangiram, 31, Asif Babujan, 27, Anand Raj, 30 and Vinayaka, 28,working as Home guards.

Senior officer told media persons,A spa owner approached Ramamurthynagar police station after they got some fishy when the gang of five members posing as cops visited their saloon and took 1.6 lakhs from them as the owner got doubt on them as one of the member of the gang got transferred money through online.

The owner approached Ramamurthynagar police inspector, Melwin Francis,and explained about the incident and stated that they run a spa and saloon situated on Jayanthi Nagar main road a five member gang posing as cops raided his spa accused him of running prostitution racket and extorted Rs 1.6 lakh on Feb 26.

As soon as the complaint was filed inspector Melwin Francis passed information to his senior officers as ACP, Ningappa B Sakkiri,DCP, Bheemashankar S Guled,after seeking a detailed report,a special team was formed under the leadership of ACP Ningappa B Sakkiri team headed by PI, Melwin Francis and his crime team swung into action.

The team visited the spa and after verifying the CCTV footage the team got a vital clues on the gang the team identified four persons as they were working as Home guards.

The team secured all the five member gang and during investigation all the five member confessed the crime.

During the investigation the accused were identified as Syed Kaleem,28,from RT Nagar who claimed to be reporter for “Custom and Excise news” reporter of Newsportal along with Sampangiram,31,Asif Babujan,27,Anand Raj,30 and Vinayaka, 28.

The team recovered Rs.60,000 cash and Rs.1 lakh from the bank account which Kaleem had forced the spa owner to transfer online.

A detailed investigation by the team who grilled the accused and he spilled the beans and it has revealed that the prime accused is Kaleem posing as journalist would visit the spa and small commercial establishments threatened them for being involved in illegal business and extort money after carrying out fake raids with the help of his associates who were working as home guards .

We suspect that the accused might have cheated many people and taken them into custody for further investigations.

Hennur police arrest two car thieves, 2 Stolen cars Worth Rs.6.9 lakhs seized

The Hennur police on Wednesday arrested two persons who were stealing cars from service stations and selling them after fabricating the documents.

The accused has been identified as, Manjunath,27,Sheikh Nawaz,22.

Senior officer told media persons,the service station owner approached to Hennur police station and registered complaint stating two persons posing as customer came to their show room on February 21 and stole the SUV after hoodwinking the security guard .

Following the complaint the police flashed the message around the city alerting their counterparts to keep an eye on the stolen SUV.

Inspector,M Vasanth flashed the message across city and swung into action .The accused were caught while they were driving the stolen SUV in Ashoknagar involved in a self accident and the police on duty caught them and alerted the Hennur police,who had circulated the details of the stolen car.

The duo identified as Manjunath,27 and Sheikh Nawaz, 22, was brought to station along with the stolen car.

During investigation the duo confessed the crime A detailed questioning led them to confess one more vehicle theft case which is reported in Mahadevapura police station limits.

Based on their confession the police recovered two cars worth RS 6.9 lakh from them.

Manjunath and Nawaz are part of the gang led by Salman,a habitual offender who is now on the run.Efforts are on to track him down and further investigation is on.

200 ACB Personnel Raid 33 BBMP Offices,found large scale irregularities worth thousands Crores

Prima facie evidences found the ACB  officials  during the raid and search on the 33 offices of the BBMP in three zones across the city found that large scale irregularities and from the documentary verification it was estimated sum of Rs 300 crore has not been collected by the officials towards the advertisement revenue, incurring huge loss to the BBMP and the state exchequer.

Senior ACB official said in a release,the BBMP officials concerned have not collected the advertisement taxes from bus stands and skywalks and also from the newly constructed bus stop under PPP model.

At the TDR section,the town planning section officials allegedly committed large scale irregularities in fixing TDR and created fake records to claim TDR.

In many instances sanctioned excess TDRs for many projects.The officials also created fake  documents to claim the compensation for the road widening projects .

Even the internal vigilance section headed by engineer has not acted on the report submitted to him about the irregularities

The ACB officials also found that the town planning officials have sanctioned the building plan to construct multi storeyed apartments at the lakes bed and buffer zone.The officials also approved the land records submitted to them illegally .

Even many under construction residential buildings across the city have issued OC (Occupancy Certificates),A three storeyed building plan was later converted into a six storeyed building and approved by the officials.

A 10 storeyed building and building constructed on two acres or more have been approved despite having many violations and the tax rate has been fixed to minimal causing huge revenue loss to BBMP and the state exchequer.

The officials of the BBMP revenue department have fixed minimum tax on the residential buildings, multi-storeyed residential complexes and even commercial complexes and IT companies  .

The Revenue officials have fixed old tax rates to the newly constructed buildings and complexes causing revenue loss to the BBMP to the tune of several crores.

According to the rough estimation a total sum of Rs 217 crore loss was calculated and the ACB officials have seized seven files pertaining to the details of the tax irregularities have been seized for further probe .

Storm water drain section :The ACB officials seized unaccounted Rs.1.18 lakh cash from the office of the Assistant Executive engineer .

The officials also seized records pertaining to a Rs.1050 crore for various projects and desilting work which was awarded to only a few contractors since the year 2017.

Even at the solid waste management section a bill of Rs 100 crore was created and sanctioned to the beneficiaries but no action has been taken against the official concerned.

Even at the accounts and finance section of the BBMP even though there was no project,the officials created fake documents and released the amount.   

The tender process has not been done as per the rules and violation of transparency act.

While the raid and searches were on,many private firms and individuals rushed to the office to pay their dues.

A total of Rs 15 crore has been paid toward the taxes since the past two days,the ACB officials said .

As many as 200 officials took part in the operation which was launched three days ago .

BBMP Chief Commissioner, Gaurav Gupta inspects the restoration of village roads in Yelahanka zone

The restoration of roads in the villages (of the 110 villages) in Yelahanka constituency limits is going on in a speedy manner and today,the BBMP Chief Commissioner Gaurav Gupta instructed the officials to accelerate the work speed further.

Speaking after inspecting the road restoration works at Ananthapura,AMS layout limits in Yelahanka constituency,he said that, the roads in the city should be motorable well enough.

He also instructed the officials to finish the asphalt works in major roads and also the restoration work of village roads within the scheduled period of time.

Roads,footpaths should be restored ensuring the quality work where the BWSSB’s works related to the drinking water and the drainage have been finished.

No residents should face problem at any cost, the Gaurav Gupta instructed the officials.

Executive Engineer,Sudhakar Reddy,explaining about the works to the Chief Commissioner,said that,among the 110 villages,8 villages (Ananthapura,Chikkabettahalli, Doddabettahalli, Kenchenahalli, Harohalli,Nagenahalli,Vaderapura, Govindapura),are coming under the Yelahanka constituency.

The road restoration is being held in all those villages except Vaderapura and Govindapura.

“The BWSSB has dug up 151 km of road to take up the works related to drinking water and drainage.Of that 151 km, the BBMP, has restored 60 km of road.

The pending 91 km of road will be restored within the prescribed time duration”the Executive Engineer explained to the Chief Commissioner.

All the crossroads,including footpaths at the AMS Layout in Attur ward limits have been asphalted.

On this,local resident Mr.Bellave appreciated the BBMP’s work.BBMP is doing excellent work he said.

Top priority to bring Naveen’s mortal remains: CM Bommai

Bringing home the mortal remains of Naveen,the Karnataka student who lost his life in the war zone of Ukraine,is the top priority for State government.

All help and cooperation would be extended to Naveen’s family,Chief Minister Basavaraj Bommai said.

Speaking to media persons Bommai said, Naveen’s friends have sent a few photographs of a body with dress resembling what Naveen was wearing,however it has to be confirmed with the External Affairs minister and the officials of the Indian Embassy in Ukraine.

Serious efforts are being made to bring Naveen’s body back home,Bommai said.

Replying to a question the Chief Minister said that an ex-gratia too would be presented to Naveen’s family, however the top priority now is to bring his mortal remains back.

The Government of India is making relentless efforts to evacuate the Indians stranded in Ukraine,26 aircraft would be sent to bring home Indians in the next 2-3 days.We are trying to get as many Kannadigas as possible among them,” Bommai said.

The task is proving tough as the war is raging. The Indian government it coordinating with the Ukraine government to make arrangements for passage of Indians in groups to safe zones and railway stations through the Western region of Ukraine, Bommai said.

Efforts are on to get more information on whereabouts of one of Naveen’s friends who is said to have been injured.
