Child labour law amended: Children below 14 can now work in family businesses

May 13, 2015 by Nasheman

child-labour

New Delhi: Government today gave its nod to a proposal allowing children below 14 years of age to work only in family enterprises or entertainment industry with certain conditions while completely banning their employment elsewhere.

The original child labour law banned employment of children below 14 in only 18 hazardous industries.

The amendments also make it clear that children between 14 and 18 years will also not be allowed to work in hazardous industries.

The changes in the labour law also provide for stricter punishment for employers for violation. While there is no penalty provision for parents for the first offence, the employer would be liable for punishment even for the first violation.

In case of parents, the repeat offenders may be penalised with a monetary fine up to Rs 10,000

In case of first offence, the penalty for employers has been increased up to two and half times from the existing up to Rs 20 thousand to up to Rs 50,000 now.

In case of a second or subsequent offence of employing any child or adolescent in contravention of the law, the minimum imprisonment would be one year which may extend to three years.

Earlier, the penalty for second or subsequent offence of employing any child in contravention of the law was imprisonment for a minimum term of six months which may extend to two years.

After the Cabinet nod, Government will move official amendments to the Child Labour (Prohibition and Regulation) Amendment Bill, 2012 in Parliament.

While child rights activists were opposed to the dilution saying it will promote child labour, those involved in business maintained that children need to be trained in traditional arts at an early stage or they will not be able to acquire the required skills like weaving and stitching.

The age of prohibition of employment has been linked to age under Right of Children to Free and Compulsory Education Act, 2009.

Exceptions have, however, been made in case of works in which the child helps the family or family enterprises.

The condition is that such enterprises should not involved any hazardous occupation. Another condition set forth is that they should work after school hours or during vacations.

Moreover, exemption has also been given where the child works as an artist in an audio-visual entertainment industry, including advertisement, films, television serials or any such other entertainment or sports activities except the circus.

This exemption is also conditional and stipulates taking up prescribed safety measures

An official statement said that while considering a total prohibition on employment of child, it would be prudent to also keep in mind the country’s social fabric and socio- economic conditions.

Justifying the amendments, it said, “In a large number of families, children help their parents in their occupations like agriculture, artisanship etc and while helping the parents, children also learn the basics of occupations.

“Therefore, striking a balance between the need for education for a child and the reality of the socio-economic condition and social fabric in the country, the Cabinet has approved that a child can help his family or family enterprise, which is other than any hazardous occupation or process, after his school hours or during vacation.”

Besides a new definition of adolescent has been introduced in the Child Labour (Prohibition and Regulation) Act and employment of adolescents (14 to 18 years of age) has been prohibited in hazardous occupations and processes.

“These provisions would go a long way in protecting adolescents from the employment not suitable to their age,” it said.

The statement said that in case of first offence of employing any child or adolescent in contravention of the law, penalty would be imprisonment for a term not less than six months but which may extend to two years.

Besides they could be fined an amount not less than Rs 20,000 which may extend to Rs 50,000. They could also be penalised with both imprisonment and monetary fine.

Earlier, penalty for employing any child in contravention of the law was imprisonment for a term not less than three months, which could extend to one year.

The monetary penalty for the same was a fine not less than Rs 10000, which could extend to Rs 20,000 either alone or with the imprisonment.

In case of a second or subsequent offence of employing any child or adolescent in contravention of the law, the minimum imprisonment would be one year which may extend to three years now.

Earlier, penalty for second or subsequent offence of employing any child in contravention of the law was imprisonment for a minimum term of six months which may extend to two years.

Besides, the offence of employing any child or adolescent in contravention of the law by an employer has been made cognisable which allows police to arrest without a warrant.

Government believes that this provision would act as a deterrent against the offence of employing a child or adolescent in contravention of the law.

In the principal Act, the same punishment was provided for parents or guardians for permitting a child to work in contravention of the Act, as prescribed for the employer of the child.

However, taking a “realistic view” of the socio-economic conditions of the parents, there would be no punishment in case of a first offence by them and in case of a second and subsequent offence, the penalty would be a fine which may extend to Rs 10,000, the statement said.

The proposal also provides for the setting up of a Child and Adolescent Labour Rehabilitation Fund for one or more districts for rehabilitation of children or adolescents rescued.

Thus, the Act itself will provide for a fund to carry out rehabilitation activities.

The Child Labour (Prohibition and Regulation) Act (CLPR Act) 1986 prohibits employment of a child in 18 occupations and 65 processes and regulates the conditions of working of children in other occupations/ processes.

As per this Act, a child means any person who has not completed 14 years of age. The Act provides punishment for the offence of employing or permitting employment of any child in contravention of the provisions of this Act.

The Right of Children to Free and Compulsory Education Act, 2009 enjoins the state to ensure free and compulsory education to all children in the age group of 6 to 14 years.

A corollary to this would be that if a child is in the work place, he would miss school.

It was felt that thus, the CLPR Act is not aligned to the RTE Act as it permits employment of child below 14 years in occupations and processes not prohibited.

It was also felt that the CLPR Act is not in conformity with the International Labour Organisation (ILO) Conventions 138 and 182, which provide for minimum age of entry into employment and prohibition of employment of persons below 18 years, in work which is likely to harm health, safety and morals.

The amendments being brought in the Act takes care of these anomalies, the government said.

Modi government not much different from UPA: Govindacharya

New Delhi: Days after Arun Shourie criticised Narendra Modi Government, BJP’s former ideologue KN Govindacharya on Tuesday too questioned its performance, saying it was not much different from the UPA dispensation and the PM has to come up with “Made for India” policies.

Govindacharya, founder of outfit Rashtriya Swabhiman Andolan, said people continue to witness the “same partial” and “corrupt” dispensation at the central level.

“The government has completed a year. But at this moment, we can’t see a ground to list their achievements, which is a matter of concern. On one hand, it is directionless (on policy issues). On the other, there are internal differences amongst ministries.

“People feel even though Modiji looks different from others…People will have their own assessments…. But (I) can’t see much of a difference in the (two) Governments. Same partiality, corruption is there,” he told reporters.

On the Government’s policies over land acquisition bill and concepts of Smart Cities and Make in India, he cautioned the Prime Minister Modi over his advisors in these matters.

“I don’t know who are the advisors of Narendra Modi… who unnecessarily (have) brought into his head this type of a problem of Land Acquisition bill in which the basic norms could not be followed.

“Therefore, I think, that a clever person like Narendra Mod…I think he should beware of his advisors,” he said.

Govindacharya advised the government to properly supplement the “Make in India” concept with “Make for India” and “Made by India” policies.

“Otherwise, it will just be a signboard that ‘India on Sale’, which won’t do any good to people of Bharat,” he said.

Shourie, a minister in the Atal Bihari Vajpayee government, had earlier this month hit out at the Modi Government saying its economic policy was “directionless” while the social climate was causing “great anxiety” among the minorities.

FIR against IIPM founder Arindam Chaudhuri after UGC accuses him of misleading students

May 12, 2015 by Nasheman

Arindam Choudhari

New Delhi: Delhi Police have registered an FIR against Arindam Chaudhuri, founder of Indian Institute of Planning and Management (IIPM), on the basis of a complaint by the University Grants Commission of “misleading, cheating and fooling” its students as its courses were not acknowledged by any recognised authority.

“We have registered an FIR under Section 420 of IPC against IIPM Dean Arindam Choudhari and his father Malayendra Kisor Chaudhuri, who is a Director, based on the UGC complaint. We are probing the matter,” Joint CP (Crime) Ravindra Yadav said.

A notice has been sent to both of them to join the investigation, police said.

IIPM, however, has questioned the UGC complaint and said the institute was not cheating its students.

The UGC, in its complaint, has said that despite the fact its courses are not authorised, the institute was “fooling” the students by charging a hefty fee from them.

Chaudhari said in a statement it was sad that some sections of the media have decided to pick up a case that was 6 months old and wondered how this could amount to cheating.

“UGC and AICTE keep themselves in news by targeting IIPM with their lies because we have stayed consciously out of their purview and accused them of massive corruption”, he said.

“We have never claimed that the institute is recognised by any statutory body nor have we claimed we give degrees. We give certificates and write clearly everywhere that “students interested in de jure recognition of IIPM’s programmes need not apply to IIPM! Its written clearly since 1970s in our prospectus and in our websites since it came into effect,” the IIPM dean also said.

“We have been cooperating with the police ever since the first notice came and will continue to do so as law abiding citizens,” he added.

Another massive earthquake: 26 killed in Nepal, eight in Bihar

May 12, 2015 by Nasheman

NEPAL-EARTHQUAKE

Kathmandu: At least 26 people were killed and over 150 were injured when a big earthquake struck Nepal on Tuesday.

Initial reports reaching here said that 19 people were killed in Dolakha district, located about 170 km from here.

Dolakha is about 130 km from Kodari, the epicentre of the 7.3 magnitude earthquake that struck in the afternoon.

Two five-storeyed buildings collapsed in capital Kathmandu, an official said.

Police spokesman Kamal Singh Bam earlier said that four people were killed in Chautara town in Sindhupalchowk district and three people died in capital Kathmandu.

He said that the number of deaths is likely to go up as they await news from other areas.

A major earthquake on Tuesday jolted Nepal, striking fear among the people and causing panic in a country which was barely recovering from the devastating April 25 temblor.

Cracked buildings collapsed in a heap of debris and landslides cut off roads as an earthquake measuring 7.3 on the Richter scale hit Nepal, with its epicentre not far from Mount Everest — the world’s highest peak at 8,848 m.

Terrified people ran out of homes and offices as the buildings began to shake violently due to the earthquake. They ran to open space and parks here.

“It was frightening,” said an eyewitness who clutched her daughter. “It felt worse than last time,” she added

Six strong aftershocks followed in quick succession. Four of the aftershocks were in the epicentre Kodari while the strongest aftershock measured 6.3 on the Richter scale.

Indian Prime Minister Narendra Modi said he has directed authorities to be on alert for rescue and relief operations.

A tweet from the prime minister’s office said: “PM took stock of the situation following the fresh major earthquake felt in Nepal and parts of India, at a high-level meeting.”

India Meteorological Department chief L.S. Rathore said that aftershocks could well continue for a few more weeks and months.

The tremors were felt in India, particularly in capital Delhi, Lucknow, Jaipur, Amritsar, Kolkata and the northeastern city of Guwahati. Buildings also shook in faraway Kochi in Kerala.

In Delhi, people ran out as buildings began to shake. Metro services were brought to a halt.

Rohtash Sharma said in Delhi: “I was at a bank when I felt the earthquake. I immediately ran out along with others.”

“Oh…this time I felt that it lasted longer than the one that we had in April. We all rushed out of our houses,” said Rakesh Sharma, who lives on the fifth floor in a high-rise building in C-Scheme area of Jaipur in India’s Rajasthan state.

In Kathmandu, an eyewitness said that he saw a building fall.

Another witness told IANS that he saw debris falling on a taxi packed with people. The fate of the people in the taxi was not immediately known.

Onlookers were left dazed and distraught on seeing the buildings collapse with a roar, a replay of the April 25 quake horror.

There was no electricity in Kathmandu. Internet connectivity too snapped.

People desperate for news tried to get in touch through their mobile phones, but that too did not work. The mobile network was jammed.

In Kathmandu, people made a beeline for shops to stock on water and other essential commodities here.

Harried shopkeepers were seen trying to manage the surging crowds at their shops.

People feared a repeat of the April 25 earthquake which caused widespread devastation.

“It is really scary,” said a Kathmandu resident as he rushed to join the people at the local grocery shop.

Nepal’s National Assembly was in session when the earth began to shake, creating panic among the lawmakers. They quickly trooped out of the building, which was soon plunged into darkness.

Kathmandu airport was closed temporarily as the ATC staff hurried out of the tower.

Eight killed as quake strikes Bihar

At least eight people, including three children, were killed and nearly two dozen people were injured when a massive earthquake caused walls to collapse in parts of Bihar on Tuesday, officials said.

The 7.3 magnitude earthquake’s epicentre was in Kodari, Nepal and its effect was felt across north India, including Bihar.

A labourer was killed when an under-construction wall collapsed in Danapur near Patna and a child was killed in Siwan district when a wall collapsed. Another child was seriously injured, officials of state disaster management department said.

Two children were killed in Manigachi in Darbhanga district in a wall collapse and a woman was killed in Dumra of Sitamarhi district when she came under the debris of a wall that fell.

One person died in Hajipur in Vaishali district, Nawada and Saran districts due to the quake.

Over half a dozen girl students of a government middle school at Bihya in Bhojpur district were injured when they were trying to rush out of class room.

“All of them were admitted at a primary health centre for treatment,” a district official said.

In Forbesganj in Araria district, bordering Nepal, at least 12 people were injured in a stampede during the quake.

People in Patna, Darbhanga, Purnea, Kishanganj, Madhubani, Jehanabad and Aurangabad felt the tremors for over a minute.

“People across Bihar felt the tremors,” Patna Met Office director A.K. Sen said.

According to state disaster management department officials here, there were reports of cracks in several houses in Jehanabad, Darbhanga, Muzaffarpur, Patna, Gaya, and Raxaul in East Champaran district.

Chief Minister Nitish Kumar has called a meeting of the state disaster management department and directed officials concerned to assess the damage caused by the quake.

Hundreds of thousands of people came out of their houses across the state as soon as they felt temblor.

In Patna, people rushed out of their houses and took shelter in open spaces.

Salim Khan rejected Padma award; Ramdev was not even considered for award, reveals RTI

May 12, 2015 by Nasheman

Baba Ramdev

New Delhi: Noted movie writer Salim Khan, former diplomat K S Bajpai and spiritual gurus Sri Ravi Shanker, Mohammed Burhanuddin and Mata Amritanandamayi had refused to accept the Padma awards this year while Ramdev was not considered for the honours, according to an RTI response.

To a query seeking to know the names of persons who were shortlisted for the civilian honours but turned it down, the Home Ministry said Salim Khan, former diplomat K S Bajpai and spiritual gurus Sri Ravi Shanker, late Mohammed Burhanuddin and Mata Amritanandamayi had refused to accept the Padma awards.

The Ministry in an RTI response to activist Subhash Agrawal referred him to web site which had lists of people considered for Padma awards and those shortlisted for them but it did not have name of yoga guru Ramdev.

Two days before the awards were to be presented on January 26, 2015, Ramdev had claimed that he had written to Home Minister Rajnath Singh declining the award as he came to know that he was being considered for it.

“Meeting of the Padma Awards Committee was held on October 31, December 5, and December 13-14, 2014 for two days. The minutes of the meeting were not maintained,” the Ministry said in its response.

The reply said recommendations for the awards were dispatched from MHA to Awards-Committee members for their study and perusal before the meeting of the committee on October 25, 2014.

The Ministry refused to give information about persons whose names were recommended but were not considered following objections from agencies like CBI, IB and tax authorities saying information received from such agencies is secret in nature and cannot be provided under RTI Act.

It said search committee meetings were held on August 21, 2014 and September 8, 2014.

Recently, Ramdev created controversy saying lobbying takes place for Padma awards.

Traffic constable attacks woman with brick, suspended

May 11, 2015 by Nasheman

cop-attacks-woman

New Delhi: In a case of police brutality, a head constable today attacked a woman with a brick in the posh Golf Link area of central Delhi over a minor altercation following which he was suspended pending a detailed inquiry.

The traffic cop was suspended and a criminal case was filed against him after a video clip of the attack surfaced.

The victim, who was riding a two-wheeler, alleged that the constable demanded a bribe accusing her of violating traffic rules.

She alleged that her small child was also abused by the cop.

She said that following an argument, the cop picked up a brick and attacked her.

“On behalf of myself and Delhi Police, I want to express my regret. The Head Constable has already been suspended. Apart from that, I have ordered that a criminal case be registered. We will investigate the matter,” Delhi Police Commissioner B S Bassi said.

The victim alleged that the cop accused her of violating traffic norms and started abusing her after she refused to pay bribe, insisting that a receipt of the fine he was demanding be issued to her.

The woman was also seen in the video picking up a brick which she threw on the ground.

Muktesh Chander, Special Commissioner of Police (Traffic), said strict action would be taken against the head constable.

“We regret such a shameful act. We will take strictest possible action,” said Chander.

The woman also alleged that her two-wheeler was damaged in the incident.

Judge who convicted Kodnani, Babu Bajrangi gets 22 threat letters

May 11, 2015 by Nasheman

jyotsna-yagnik

Ahmadabad: Jyotsana Yagnik, the special judge who convicted and handed life terms to former Gujarat minister and BJP leader Maya Kodnani, former Bajrang Dal leader Babu Bajrangi and 30 others in the 2002 massacre of 97 Muslims in Naroda Patiya, has received at least 22 threat letters and “blank phone calls” at her home since the August 2012 verdict.

Sixty-two-year-old Yagnik, who has since retired, has informed the Supreme Court-appointed Special Investigation Team (SIT) about the threat letters and phone calls.

Her security cover has been scaled down to Y category from the Z-plus she was granted as Principal City Civil and Sessions Judge in Ahmedabad and she is said to have taken up the matter with the government.

Sources said Yagnik, who retired a few months after the Naroda Patiya massacre case verdict, has been receiving these letters — most are anonymous but one carries the letterhead of a private organisation.

In the letters, she has been threatened over the verdict in the massacre case, the sources said, adding that she has also been receiving “blank phone calls” at night.

Worried about her safety and that of her family, Yagnik informed the SIT.

Yagnik, who now heads a law institute on the Sarkhej-Gandhinagar highway, said: “Yes, I have been receiving threat letters and have informed the SIT in a letter I wrote to them.” She declined to speak on the contents of the “threat letters”, the nature of the threat or when she wrote to the SIT.

When his comments were sought, SIT convenor and Additional Director General of Police Ashish Bhatia said that in the last six- eight months, he had not come across threat letters to any judge, including Yagnik. “I don’t know if she received (the letters) before that,” Bhatia said.

Asked if the SIT had received any communication from Yagnik about the threat perception, Bhatia said: “Six to eight months ago, the government scaled down her security category from Z-plus to Y. At that time, she had represented to the government to step up the security cover. However, the security category has been maintained at Y and her request is pending before the government.”

A K Malhotra, SIT officer and a retired DIG, said he had “heard” about the threat letters and calls to Yagnik but did not details.

On August 29, 2012, Yagnik delivered the Naroda Patiya case order, convicting 32 people, among them Kodnani and Babu Bajrangi, for their roles in the massacre. Bajrangi was sentenced to life imprisonment till death by Yagnik.

On Kodnani, this is what the judge said: “… it stands proved that A-37 (Maya Kodnani) was not a member of the unlawful assembly but was a kingpin and one of the principal conspirators”.

Sentenced to life in jail, Kodnani was released on bail by the Gujarat High Court in July last year. On April 23 this year, Bajrangi was granted bail for three months after he claimed he was turning blind.
