SC rejects Yakub Memon's plea for review of his death sentence

New Delhi: The Supreme Court on Thursday dismissed the plea by 1993 Mumbai serial bomb blast mastermind Yaqub Abdul Razak Memon for a review of his death sentence.

Memon had sought the recall of March 21, 2013, apex court order upholding his death sentence by the special court.

The apex court bench of Justice Anil R. Dave, Justice J. Chelameswar and Justice Kurian Joseph in its order said the review plea is dismissed. The court had reserved its verdict March 25, 2015.

This is the second time that Memon’s plea for review of the verdict awarding him death sentence has been dismissed.

Memon’s plea for the recall of his death sentence verdict was rejected earlier too, but it was taken up once again as the Constitution bench by its September 2, 2014, judgment said that review pleas in death sentence cases would be heard in the open court by a bench of three judges.

The Constitution bench also ruled: ‘It will also apply where a review petition is already dismissed but the death is not executed so far. In such cases, the petitioners can apply for the reopening of their review petition within one month from the date of this judgment.’

The apex court on June 2, 2014, suspended the execution of the death sentence which was further extended on September 26, 2014, after it issued notice to the Maharashtra government on Memon’s petition for an open court hearing of his plea for the review of the Supreme Court’s verdict upholding his death sentence.

Pakistan court suspends Lakhvi's detention; orders his release

Lahore: A Pakistani court today suspended the Punjab government’s detention order against 2008 Mumbai attack mastermind and LeT operations commander Zakiur Rehman Lakhvi under a public security act and ordered his immediate release.

Justice Muhammad Anwarul Haq of Lahore High Court suspended the detention of 55-year-old Lakhvi under Maintenance of Public Order after the government failed to present sensitive records against him in the court.

The judge ordered Lakhvi to submit two surety bonds worth Rs 1 million each for his release.

“The law officer had submitted important information about Lakhvi, but the court did not accept this and declared the evidence unsatisfactory,” an official of LHC told PTI.

Justice Muhammad Anwarul Haq on the last hearing on April 7 had directed the government’s counsel to submit record of secret documents about activities of Lakhvi today.

Lakhvi had challenged the March 14 order of Punjab government’s District Coordination Officer, Okara to detain him for 30 days.

Lakhvi’s counsel Raja Rizwan Abbasi argued that after the LHC’s earlier direction he had filed a representation before the Punjab home secretary against his “illegal” detention but the home secretary dismissed it and upheld the 30-day detention order issued by District Coordination Officer, Okara.

Abbasi pleaded that a person could not be detained beyond 90 days without obtaining an order from review board and the detention period of his client had gone beyond 90 days.

A provincial review board comprises judges of the high court.He pointed out that trial court had released Lakhvi on bail in December 2014, however, District Magistrate of Islamabad issued detention order against him.

Later, Islamabad High Court set aside Lakhvi’s detention and ordered the government to release him.

However, another detention order was issued by the DCO Okara and he was not released, the counsel argued.

He had pleaded the court to strike down the impugned order and order the government to release Lakhvi.

India had earlier strongly reacted to the IHC’s ruling on March 13, saying the overwhelming evidence against Lakhvi has not been presented properly before court by Pakistani agencies.

Lakhvi and six others – Abdul Wajid, Mazhar Iqbal, Hamad Amin Sadiq, Shahid Jameel Riaz, Jamil Ahmed and Younis Anjum – have been charged with planning and executing the Mumbai attack in November, 2008 that left 166 people dead.

Lakhvi, believed to be a close relative of LeT founder and Jamat-Ud Dawa (JuD) chief Hafiz Saeed, was arrested in December 2008 and was indicted along with the six others on November 25, 2009 in connection with the 26/11 attack case.

The trial has been underway since 2009.

Shiv Sena protests outside Shobhaa De home

Mumbai: The Shiv Sena staged a noisy protest on Thursday outside celebrity author Shobhaa De’s residence, after she attacked a move to force multiplexes to show Marathi movies in the prime time slot.

Carrying banners as well as ‘vada-pav’ and ‘misal’, the Sainkis shouted slogans against De.The protesters condemned De’s comments opposing the Bharatiya Janata Party-Sena government’s diktat to all multiplexes in Maharashtra to daily exhibit Marathi movies between 6 and 9 p.m.

Police personnel deployed in large numbers outside De’s residence in the upmarket Cuffe Parade in south Mumbai prevented the Sainiks from entering the building premises.

De told journalists that she was overwhelmed by the support she received for her tweets on the social media and elsewhere.

On the protests, she said she was not at all worried.”I have full faith in Mumbai Police… Police barricades are up… I am feeling perfectly calm and safe… Thank You, Mumbai Police.

she later tweeted.Shiv Sena legislator Pratap Sarnaik has sought an apology and moved a notice for breach of privilege in the assembly.

Sarnaik accused De of “insulting the chief minister (Devendra Fadnavis) and the people of the state”.

De on Wednesday tweeted: “Now a privilege motion demanding an apology from me? Come on! I am a proud Maharashtrian and love Marathi films. Always have. Always will!”

“No more pop corn at multiplexes in Mumbai? Dahi missal and vada pav only. To go better with the Marathi movies at prime time,” De later tweeted.

On April 7, De’s tweets were: “Devendra Fadnavis is at it again!!! From beef to movies. This is not the Maharashtra we all love! Nako! Nako! Yeh sab roko! I love Marathi movies. Let me decide when and where to watch them, Devendra Fadnavis. This is nothing but Dadagiri.”

Satyam case: Ramalinga Raju, nine others get seven-year jail

Hyderabad: A special CBI court on Thursday sentenced B. Ramalinga Raju, his two brothers and seven others to seven years in prison in the multi-crore-rupee Satyam case, India’s biggest corporate fraud.

The court also imposed over Rs.5 crore fine each on 60-year-old Ramalinga Raju, the Satyam Computer Services Ltd’s founder and former chairman, and his brother B. Rama Raju and up to Rs.50 lakh each on the remaining accused, CBI counsel K. Surender said.

“Various sentences ranging from two years to seven years were imposed on all the accused but all the sentences would run concurrently. That is the reason the maximum sentence is seven years which they have to serve,” he told reporters.

The other accused are Ramalinga Raju’s another brother, B. Suryanarayana Raju, Satyam’s former chief financial officer Vadlamani Srinivas, former PricewaterhouseCoopers auditors Subramani Gopalakrishnan and T. Srinivas, former employees G. Ramakrishna, D. Venkatpathi Raju and Ch. Srisailam, and Satyam’s former internal chief auditor V.S. Prabhakar Gupta.

Police were making arrangements for all the convicts to serve their sentences in Cherlapally Jail here.

Special Judge B.V.L.N. Chakravarthi of the Central Bureau of Investigation (CBI) court announced the quantum of punishment in the afternoon, hours after pronouncing all the accused guilty on various counts.

The much-awaited judgement in the packed court hall came in the presence of Ramalinga Raju and all the other accused.

The judge did not take into account the plea by the convicts for leniency in the punishment on grounds of their age, health and the problems faced by their families.

The accused told the judge that they have already spent more than two years in jail.

Ramalinga Raju, the main accused, also sought leniency on the ground of social service he had done in the past.

“They told the honourable judge that they and their families have faced a lot of hardships due to the case. They also brought to his notice that there was no loss to people (due to the fraud),” said Venkateswara Rao, one of the defence lawyers.

The CBI, however, sought maximum punishment, citing it as the biggest corporate fraud in the country and also on the ground of huge losses caused to the investors.

The scam came to light on January 7, 2009 when Ramalinga Raju confessed that the company’s account books and profits were inflated over many years to the tune of several crores of rupees.

Police arrested him two days later on a complaint by some shareholders.

The CBI, which took up investigation in February 2009, put the loss to the shareholders at Rs.14,000 crore.

The investigating agency also charged Raju with gaining Rs.2,500 crore by selling his family shares in Satyam.

Raju was charged with floating several front companies to buy land with the scam money. He was arrested by Andhra Pradesh Police on January 9, 2009.

The CBI filed three chargesheets against Raju and the other accused, charging them with cheating, criminal conspiracy, forgery, falsification of accounts and breach of trust.

The disgraced IT czar, who even shared the dais with then US president Bill Clinton during the latter’s visit to Hyderabad, spent nearly 32 months in jail.

Raju, who was released on bail in 2011, later retracted his confession and contended that all the charges levelled against him were false.

After the scam, Tech Mahindra took over Satyam Computers in a government-sponsored auction. Mahindra Satyam later merged with Tech Mahindra.

An economic offences court on December 8 last year sentenced Ramalinga Raju and three others to six months imprisonment in six of the seven cases filed by the Serious Fraud Investigation Office (SFIO).

Government allows pharma companies to hike prices of 509 essential drugs

New Delhi: The government has allowed pharmaceutical companies to hike rates of 509 essential medicines used for treating various ailments like diabetes, hepatitis and cancer by 3.84 per cent with effect from April 1.

The National Pharmaceutical Pricing Authority (NPPA) has issued a notification for price hike of drugs in line with the wholesale price index of 2014 under Drug Price Control Order (DPCO), 2013.

“As confirmed by the economic adviser (Minister of Commerce and Industry), the annual increase in the wholesale price index (WPI) works out at 3.84 per cent during calendar year 2014 over the corresponding period in 2013,” NPPA said in a notification.

The 509 medicines which have become costlier include Alpha Interferon injection used to treat hepatitis B and C as well as certain types of cancer, carboplatin injection used for cancer treatment and fluconazole capsules indicated for fungal infections, among others.

Welcoming the decision, Indian Pharmaceutical Alliance (IPA) Secretary General D G Shah told PTI: “It is a part of the policy. Pharmaceutical companies don’t get a chance to hike prices (more than once) a year. This price hike is linked to inflation.”

Prices of condoms, which are also part of the list of essential medicines, have also gone up due to cost revision.

According to the notification, antibiotics which have Amoxicillin capsules have also become costlier with effect from April 1.

At present, the government caps prices of a total of 348 essential medicines based on the simple average of all medicines in a particular therapeutic segment with sales of more than 1 per cent.

Besides, the government regulates prices of all other medicines and companies are allowed to hike prices of such drugs by only up to 10 per cent in a year.

The government had notified DPCO, 2013, which covers 680 formulations, with effect from May 15, 2014, replacing the 1995 order that regulated prices of only 74 bulk drugs.

Centre extends AFSPA in Arunachal Pradesh

New Delhi: India has granted the Army shoot-to-kill powers to fight militants in a wide swathe of the far-flung state of Arunachal Pradesh.

The Army was already exercising “special powers” in other northeastern states, where various separatist, leftist and tribal rebels are waging insurgencies, but Arunachal Pradesh has been relatively peaceful until recently.

Last month, three soldiers were killed in an ambush in the state that the Army blamed on militants from the Naga tribe.

Rebel groups have set up camps across the state, the Home Ministry said in its “special powers” order, and use it as a base to launch attacks in the neighboring state of Assam, which has been hardest hit by an upsurge in militancy in the region.

The order, obtained by Reuters and dated March 27, extended the controversial Armed Forces Special Powers Act (AFSPA) to all districts of Arunchal Pradesh that border Assam – a measure that will affect most of the state`s 1.3 million people.

“We were compelled to expand the jurisdiction of AFSPA due to a drastic rise in violence in the north-east region. The separatist groups have been targeting the police and security officials,” said a senior home ministry official in New Delhi.

The northeastern states, are connected to the rest of the country by a thin sliver of land, and contain diverse ethnic groups, some with links to neighbouring Myanmar.

Militant activity surged in the states, known as “the Seven Sisters”, last year with 465 deaths reported, up from 252 a year earlier, according to the South Asian Terrorism Portal, a think-tank that tracks militancy.

In Assam, the death toll tripled to 305, making 2014 the state`s worst year since 2009. Only nine people were killed last year in Arunchal Pradesh.

The special powers for “disturbed areas” was first used in 1958 to control Naga separatists, and was subsequently extended to most of the north-east. It has been in force in the disputed region of Kashmir since 1990.

Human rights groups blame AFSPA for a host of extra-judicial killings and arbitrary detentions by security forces. On Wednesday, lawmakers in Kashmir called for it to be repealed.

Citizens from the rest of India require a permit to visit Arunchal Pradesh, which is the size of Austria, and heavily militarised along parts of border with China.

China has not responded to the new measure, but Beijing has become increasingly vocal in recent years about India`s control of the region it calls South Tibet.

VHP, RSS force Muslim to sell off his bungalow in Hindu neighbourhood

Bhavnagar: The atrocities of the VHP and RSS groups have grabbed the headlines again after the Hindu right-wing activists forced a Muslim scrap dealer to sell off his bungalow in a Hindu neighbourhood.

As per a report published in a national daily, a Muslim scrap dealer Ali Asgar Zaveri had bought a bungalow worth Rs 49 lakhs in Bhavnagar, a Hindu locality.

However, Zaveri was not welcomed by the Hindus living in that area and they protested against him.

Gatherings were held outside Zaveri’s bungalow and VHP leader PraveenTogadia was invited to address the gathering.

A senior RSS leader, who had participated in this protest, told The Indian Express that the Muslim scrap dealer tried everything possible to sort out things, but all in vain. They pressurized him to sell of his bungalow to Bhumiti Associates, a real-state firm owned by Jains.

Confirming the same, president of VHP’s Bhavnagar city unit, S D Jani, as quoted in The Indian Express, said, “Due to our agitation, the vidharmi (one from another faith, Zaveri) realized he would not be able to settle in and eventually gave in.”

Chittoor encounter 'survivor' surfaces, cops come under fire

Chittoor: A rights group said on Wednesday it has traced a “survivor” from a group of loggers shot dead by Andhra Pradesh police in an incident dubbed as a “massacre” of wood-cutters from neighbouring Tamil Nadu.

On Tuesday, Andhra Pradesh police had claimed to have shot dead 20 illegal red sandalwood smugglers in a forest close to the temple town of Tirupati, sparking violent protests in the neighbouring state which continued on Wednesday.

Andhra Pradesh Civil Liberties Committee member Kranthi Chaitanya, in the forefront of a demand for a judicial enquiry into the encounter, said the organisation has “managed to establish contact with the survivor through relatives of the deceased who have come here (Chittoor) from Tamil Nadu.

“He is being kept at a safe place. We will produce him before the National Human Rights Commission,” he added.

The NHRC has already taken suo moto cognizance of the incident and asked for reports from the Andhra Pradesh chief secretary and police chief.

Family-members of a few of the slain “smugglers” arrived at the government mortuary in Chittoor also said the “survivor” was among of 8 wood-cutters hired by red sanders smugglers in Andhra.

The identity of the “survivor”, said to be from Arjuna Puram village in Thiruvanamalai district of Tamil Nadu, was not given.

They quoted him as saying that seven of his group were pulled out of a bus on Monday by police during a search at Nagari on the inter-state border.

“They were traveling in a bus from Thiruvanamalai to Chitoor on Monday afternoon. The bus was stopped by police and seven of the eight men were arrested. He was sitting separately and managed to slip away quietly,” said Raja Babu (38), a relative of one of those killed in the encounter.

The survivor is said to have returned to village on Tuesday morning, around the time news of the encounter broke on TV.

Media reports said that right group Amnesty International has also called for a fair probe into the incident.

Meanwhile, protests continued in Tamil Nadu with incidents of stone-pelting on buses originating in Andhra.

Police said four persons have been arrested over the attacks on buses. Several outfits organised protests in some parts of Tamil Nadu condemning the incident.

Tamil Nadu chief minister O Panneerselvam had written to the Andhra government, demanding a probe into what he called a massacre of innocent Tamils.

Union home minister Rajnath Singh also called up Andhra Pradesh chief minister N Chandrababu Naidu over the incident.

Modi's 'Make in India' dream sours as defence firms spurn tenders worth $15 bn

New Delhi: Indian firms have spurned some $15 billion worth of government tenders to make a range of weapons since 2013, Defence Ministry officials say, in a blow to Prime Minister Narendra Modi and his drive to wean the country off imported arms.

Executives cited unrealistic quality demands from a military short of planes, tanks and guns as a key reason for their reluctance to bid for projects. Complicating things further, the military doesn’t want weapons from Indian firms with no track record in defence manufacturing, experts said.

Irked by India’s status as the world’s biggest arms importer, Modi wants to build an advanced defence industry but almost a year into his “Make in India” campaign, which aims to turn the country into a manufacturing powerhouse, not one large domestic weapons project has been awarded.

Tenders for anything from air defence guns to surface-to-air missiles to transport planes have lapsed, Defence Ministry officials told Reuters. The tenders total around $15 billion according to a Reuters compilation of offers since early 2013.

“‘Make in India’ is a laudable aim, but it’s moving rather slowly. It’s not a switch you can press and everything will fall into place,” said Vivek Rae, head of procurement at the Defence Ministry from 2010-2012.

Anil Ambani, the billionaire chairman of the Reliance Group, recounted at a recent conference how Modi asked him if he knew India didn’t make tear gas shells.

“Even the tears we shed are foreign,” Ambani quoted the nationalist leader, who took office last May, as saying.

Modi wants to build a strong military after years of neglect that military planners say has left India vulnerable should rivals China and Pakistan ever launch a combined attack, although experts say this is highly unlikely. India is being challenged, however, in its Indian Ocean backyard, where China’s more modernised navy is starting to assert itself.

Defence Minister Manohar Parrikar has said new defence production policies will be unveiled this month to address the concerns of private firms: opaque procedures, unrealistic quality requirements and slow decision-making.

“We’re trying to simplify procedures, create a level-playing field but still there are many cases of zero participation in tenders,” said G. Mohan Kumar, the defence production secretary leading the localisation drive.

The military declined to comment, referring queries to the Defence Ministry, which controls procurement.

Ringfencing Projects

India gets 70 percent of its arms from abroad. For decades, it has bought off-the-shelf equipment mainly from Russia, which offered to assemble some weaponry locally but little in the way of technology transfers.

Modi has vowed to change that by ringfencing $100 billion worth of defence deals for domestic companies over the next decade under which they can build on their own or with foreign partners.

Last year the government asked several Indian companies to show interest in an estimated $1.7 billion deal to replace 1960s-era Swedish air defence guns, but only one said it could meet the requirements, said one of the Defence Ministry officials. He declined to identify the company.

The head of one firm which told the government it was not interested in the project said the military laid down “impossible” requirements by insisting on technology that only foreign manufacturers had. He declined to be identified because of the sensitivity of defence issues.

In November, the government put an estimated $2 billion proposal to replace its ageing fleet of Avro cargo planes on ice after the tender attracted only one bidder, a partnership between Europe’s Airbus Group and India’s Tata Sons .

“Even if there is an alternative better solution, as per current practice the requirements cannot be changed, or if they are changed it is questioned,” said M.V. Kotwal, head of defence business at infrastructure group Larsen and Toubro. “The flexibility is not there.”

Over the past 18 months, 41 requests for expressions of interest for naval projects alone fell through because of problems relating to manufacturing requirements, the Defence Ministry official added.

Trying to move projects along, Modi’s government in February approved an $8 billion proposal to build warships in India that had been awaiting cabinet signoff since 2012.

It has also ordered an accelerated local programme to build six diesel-electric submarines, in addition to six similar vessels that French firm DCNS is assembling in Mumbai port to replace India’s ageing underwater fleet.

A Defence Ministry committee submitted a report last month identifying five private and state-run shipyards where the submarines could be built with a foreign partner. It will now invite expressions of interest for the $8.5 billion project.

Experts said one problem is that some military officers eye technology only available in the west, without understanding what Indian firms can produce.

“The armed forces are reluctant to accept hardware that doesn’t have a record in operational conditions. Indian companies have no track record,” said Bharat Karnad at the Centre for Policy Research in New Delhi.

Retired vice admiral Premvir Das added that to expect Indian companies to manufacture major defence platforms in the forseeable future is to “live in a dreamland”.
