'Haider', set in the backdrop of Kashmir, gets 41 cuts from Censor Board

September 8, 2014 by Nasheman

hansal-mehta-haider

Bangalore: Vishal Bhardwaj’s ambitious rendition of Shakespeare’s Hamlet, ‘Haider’, has become the latest victim of the sharp scissors of the censor board, with 41 cuts before getting a U/A (Unrestricted Public Exhibition-But With Parental Guidance) certificate.

A truck load of corpses, wire being inserted inside a naked man, a shot of a bloody dead body, Shahid Kapoor crying on seeing flames, are some of the scenes deleted from the movie.

Interestingly, the Vishal Bhardwaj-Basharat Peer scripted movie, was the last film to be censored by CBFC’s suspended CEO, Rakesh Kumar, who is currently in judicial custody after being accused in a bribery case.

Haider, the latest in Bhardwaj’s list of adaptations of Shakespeare, has Kashmir at the heart of the story, with Peer’s acclaimed international bestseller, ‘Curfewed Night’ as its source.

“The film is an attempt to answer the stereotypical, jingoistic films Bollywood has made about Kashmir. Every character in the film is a Kashmiri—a doctor, a lawyer, teacher, a research scholar, a police officer. These are people who have agency and they’re not just victims,” Peer has said about his debut entry.

Haider, which also stars Tabu and Kay Kay Menon, is set for release on October 2.

Salman Khan hurts Muslim religious sentiments at his Being Human show

September 8, 2014 by Nasheman

Bangalore: Salman Khan has done it again. A year after being booked in Hyderabad for hurting religious sentiment of Muslims in a TV reality show hosted by him on Colors channel in 2013, the actor is back in news again for “insulting” religion, this time at his Being Human fashion show.

The bone of contention is a video, which is being circulated on social media, showing a model walking down the ramp at his Being Human fashion show, with the Arabic word ‘Allah’ prominently displayed at the bottom of her gown.

Though it is unclear, when and where the event took place, or what the intention of the organizers or the designer was, but messages on Facebook and WhatsApp, clearly indicates, Muslims’s anger against the clip.

Last year, Khan was booked under section 295 of the Indian Penal Code at Falaknuma police station in the old city of Hyderabad for depicting “Jannat” (heaven) and “Jahannum” (hell).

Modi’s silence on hate campaign against minorities disturbing: Jamaat-e-Islami Hind

New Delhi: One of Narendra Modi’s harshest criticism against former Prime Minister Manmohan Singh, during his election campaign was the latter’s silence on issues concerning the country and its people. However, since taking reigns, Mr. Modi seems to have been afflicted by the very element he and his party had accused the previous regime with.

Addressing the press meet at their headquarters in New Delhi, the country’s largest Muslim socio-religious organization, Jamaat-e-Islami Hind (JIH) expressed their concern at Mr. Modi and his government’s silence, at the vicious hate campaigns of right wing outfits and some of his party members’s targeting against minority Muslim and Christian community in the country.

“Jamaat is seriously concerned at the rise in hate campaign against minorities, particularly Muslims, since BJP came to power at the centre. There has since been a spate of communal incidents also (Saharanpur, Meerut, Muzaffarnagar, Kanpur etc.). At regular interval, leaders of BJP and Sangh Parivar have raked up contentious issues like Article 370 and Uniform Civil Code. RSS chief Mohan Bhagwat, in violation of the ethos of the constitution, said that India is a Hindu Rashtra and all citizens of this country are Hindus,” said the gathered Jamaat leaders.

Mr. Nusrat Ali, Secretary General of JIH, criticized Mr. Modi for maintaining silence on hate campaigns in the name of concocted theories like ‘Love Jihad’ and forced conversions.

“A period of 100 days is very short to judge a government elected by people for five years. However, the initial trends are not good. It seems the government is working on two fronts – while PM Modi is talking about development, some leaders of his party and Sangh Parivar have opened aggressive hate campaign against Muslims and Modi is silent. It seems there is a silent understanding among them,” said Mr. Ali.

While appreciating Mr. Modi for some of the good measures initiated during his first 100 days as PM, the Jamaat leaders said that, “PM Modi’s austerity moves like asking ministers not to buy new cars and curtail foreign tours and his announcement for toilets at every home and school, and bank account for every citizen are indeed good. In an apparent move to provide a clean and corruption free government, he asked ministers not to hire relative as personal secretaries. His visit to Japan was also successful in terms of attracting investment.”

However, the party also ccriticized the manner in which the BJP government and PM Modi used Teachers’ Day to impose his personality on the young minds of the country. “We are against the government for having made it compulsory for schools and children to listen to PM’s speech as we think such tendency does not match with democratic values of the constitution,” said Mr. Ali.

On the question of Al-Qaeda announcing its branch in India, the party leaders expressed apprehensions that this may be used by country’s intelligence agencies to witch hunt minority youths as has been the trend for past 10 years.

“Anwar Manippady is a cheater”: Wakf Board Chairman

September 7, 2014 by Nasheman

Dr. Mohammed Yousuff

Dr. Mohammed Yousuff

Bangalore: Following the report published today by Nasheman, about the victory celebration organised by BJP leader Mr. Anwar Manippaddy and Muslim Ulemas associated with Bazm-e-Qasmi, and their allegations leveled against minority Muslim politicians and Wakq board, charging them with encroaching Wakf lands, Dr. Mohammed Yousuff, Chairman of Karnataka State Board of Auqaf, lashed out at the former Chairman of the Karnataka State Minorities Commission, calling him a cheater.

Mr. Yousuff speaking exclusively to Nasheman, said that, Mr. Mannipaddy has “has forgotten that it is the duty of the Waqf Board to recover such properties in accordance with law as provided under the Waqf Act.  According to the existing Waqf laws, it is the Waqf Board which is Competent Authority to remove the encroachments.”

Bangalore’s Hotel Windsor Manor, a Wakf property under dispute.

Calling Mr. Mannipaddy a “self styled minority leader,” Mr. Yousuff accused him of taking law into his own hands and said that Mr. Manipaddy wants to disturb the peace and tranquility in the state.

“The main intention of the above said self styled BJP leader is to create panic in the public by issuing application forms by misleading the public and has gone to the extent of proposing the construction of 2000 houses in Gorubhaidoddi Waqf land for distribution among the Muslim minority people and 25% to other community people where there is no such provisions under the Waqf Act, thereby misleading the other communities also which amounts to cheating the public.”

“The act of Mr. Anwar Mannipady clearly violates the provisions of law and he is liable for punishment. He cannot run a parallel Waqf Board and discharge the duties of the Waqf Board which is constituted and functioning as per the Waqf Act passed by the Parliament. I have got my own doubt that all these illegal and unlawful activities of Mr. Anwar Mannipady has not been brought to the notice of former Chief Minister B.S. Yedurappa, State BJP leader Pralhad Joshi and Union Ministers who would definitely not support his illegal acts and I also doubt that, these persons would participate in the alleged function as per his press statement appeared in the print media,” Mr. Yousuff added.

Mr. Mannipady for his part has maintained his stance by accusing the officials of the Wakf board to be in hands in glove with state minority Muslim politicians in embezzling hundreds of crores of rupees by encroaching Wakf lands.

Free undertrials who have served half their maximum term, orders Supreme Court

September 6, 2014 by Nasheman

Supreme Court India

New Delhi: In a landmark judgement, which would come as a sigh of relief to many undertrials who are languishing in prisons for years with only a bleak hope of justice, the country’s apex court ordered the release of all undertrials who have served half their maximum term yesterday.

The bench headed by Chief Justice R.M. Lodha said that district judges will visit jails once in a week for two months in their respective districts and identify such undertrials from October 1.

India’s criminal procedure code already states that once the undertrial has served more than half of his maximum sentence, the detainee must be released by the court on his personal bond with or without sureties, however, the law is rarely implemented.

“Having given consideration to legislative policy in Section 436 A of the CrPC and that a large number of undertrial prisoners are languishing in jails, we are of the view that an order is required to be passed by us so that undertrial prisoners do not continue to be detained in prisons beyond the maximum period as provided under Section 436 A of the CrPC,” the bench, also comprising justices Kurian Joseph and R. F. Nariman, said.

“We want some edifice to be built on the foundation that has to be laid,” the bench added. Though this would not apply in cases where death sentence was provided as maximum sentence.

Speaking to Nasheman, prisoners rights activist and founder of Bangalore based organisation, Janasadbhawana, Mr.Faiz Akram Pasha, said that, “this is a great day for justice in the country, as there are thousands of prisoners slugging their life away for petty crimes in our prisons.”

Ordering the next date of hearing of the case Dec 8, the court said that on the completion of the two-month exercise, the registrar generals of the high courts will send the report on the exercise and undertrial prisoners released to the secretary general of the Supreme Court.

No Al-Qaeda threat to Karnataka, says CM Siddaramaiah

September 6, 2014 by Nasheman

CM Siddaramaiah

Bangalore: Days after Al-Qaeda leader Ayman al-Zawahiri announced the formation of an Indian branch of his global armed group that he said would spread Islamic rule and “raise the flag of jihad” across the subcontinent, Karnataka Chief Minister Siddaramaiah play downed the issue and said that there was no threat to the state from the outfit.

However, he said the state is on high security alert, following the centre’s direction on the matter.

Al Qaeda, which many counter-insurgency experts claim have kept a low profile, since the assassination of its founder Usama bin Laden in 2011 in Pakistan, have been eclipsed mainly from its offshoot organisations, which have emerged in recent years since the uprisings in the Arab/Muslim world.

In a video posted online on social forums, the present Qaeda leader, said the new force would “crush the artificial borders” dividing Muslim populations in the region.

“This entity was not established today but is the fruit of a blessed effort of more than two years to gather the mujahedeen in the Indian sub-continent into a single entity,” he said.

Meanwhile, Home Minister K.J. George claimed that the law and order situation in Karnataka was best in the country.

Additional Director-General of Police, Law and Order, Kishore Chandra told the media that the police are always on alert and there was no need for any special security arrangements, however, according to sources close to Nasheman, the police are keeping a close watch on individuals and organisations in their radar.

"Stop All Communalism" an unequivocal call-out on Kandhamal Solidarity Day from Bangalore

August 30, 2014 by Nasheman

Kandhamal Solidarity Day Bangalore

– Jagadish G Chandra

Bangalore these days is purging itself its long held image, that it is a city that is impervious to what happens around the world. The gathering on 25th August ’14 to remember the Communal Carnage of 2007 & 2008 in Odisha’s Kandhamal district is any indication, then the ordinary working people citizens of this city are surely shrugging off their old habits.

Unlike the old times when activists struggled to organise solidarity protest actions for various people’s causes, both pertaining to India and other countries, now there is a marked change for the better in the numbers participating in such events. While the mammoth gathering of 17th July event in support of the Palestinians may remain a benchmark for an event for a long time to come, but the willing participation of the people on 25th August to express solidarity to the Victims of Communal Violence in Kandhamal, from a cross section of classes, castes, religion, gender and nationality instils a ray of hope for the struggles ahead.

It is no exaggeration to admit that we in Peoples’ Solidarity Concerns-Bangalore & New Socialist Alternative (CWI-India) have had protests with pathetic numbers, sometimes not going beyond the count of fingers in one’s hands. But it was a welcome change for the organisers to be received by dozens of young female participants from Mount Carmel College who had gathered well ahead of the start time on 25th August.

While the number might not have been more than 120 or so, but it was the quality of participation that was unique. One notable and commendable fact was that it surely did not turn out to be a protest event just by Christians because during Kandhamal violence Dalith Christians and Adivasis were the main targets. As mentioned earlier young & elderly from all religious backgrounds were there.

Speaker after speaker spoke on the issue of growing intolerance orchestrated by the Right Wing Hinduthva forces around the country, and how the majoritarianism and communal-ism is creeping into the administration, police & courts, which is increasingly eroding the values of non-partisan, secular ethos that were envisaged in the Constitution of India.

Among the speakers were, Rev. Prasad, Fr. Ambrose Pinto,(Pricipal, St. Aloysius College) , Raj Bharth Patta (SCMI), Debapriya (Student,Mount Carmel), Cynthia Stephen (Social Policy Researcher), Azharuddin Khan Chikmagalur (Political Science Researcher), Balaji Shanmughavel ( May17 movement), Manohar Ranganathan (Human Rights Activist) , Vishwanath (New Socialist Alternative & Dudiyora Horaata), Rini Ralte (United Theological College). Jagadish G Chandra, the convenor of Peoplers’ Solidarity Concerns-Bangalore conducted the event and Narasimha Murthy, Bangalore’s dedicated Human Rights Defender gave the Vote of Thanks.

Both Ambrose Pinto and Raj Bharath Patta, reiterated their unequivocal stand that All Communal Attacks must be stopped, and the democratic and progressive forces in this country must actively campaign for secular values in the society.Vishwanath of New Socialist Alternative/ದುಡಿಯೋರ ಹೋರಾಟ, in his emotional self brought the issue of Kambalapalli carnage and questioned to say

(In that case how should we the Dalits in this country understand the court’s judgement on Kambaalapalli massacre? Should we think the ghastly & demonic carnage never happened in Kambaalapalli? That my 7 Dalit brothers were never burnt alive? Is it the case that in this country only Daliths get this type of “justice”? Or is it that injustice is fully reserved for Daliths? Is this the Democracy that Daliths get?-Vishwanath)

The main speaker at the event was Meena Kandasamy;Poet, Author and Political Activist who specially travelled from Chennai to participate and express her solidarity to the victims of Kandhamal Violence, Meena emphasised on the need to unite our forces to thwart all the attempts to gang up against the vulnerable and the marginalised in the society.

She was rightly scathing in her speech about the present government at the centre led by BJP’s Modi and said that ” We have to remember Kandhamal and Godhra and all the atrocities of communal violence that have taken place. Corporate mainstream media does a complete whitewashing, for instance not even a single newspaper of the day carried any info about Kandhamal and what happened there six years ago. It was the same corporate media that whitewashed Modi and made him this Prime Minister in waiting, and he won. It was the same media that made people forget about Godhra 2002 when they went to the polling booth. So it is important that we remember all the atrocities that have been committed and keep reminding them to ourselves and the public at large.”

Meena very indignantly said “Kandhamal is also a question that we need to revisit today in the relevance of the politics of Hindutva and its present agenda. The entire argument about Love Jihad that has hit the headlines today is not very different from the politics of hate behind Kandhamal. There is a certain Hindutva neurosis and hatred and paranoia about the demographic question. There is an angst that Muslim population is increasing, that’s the reason for rumour of love jihad. We know that such rumours can be very threatening if we look at what happened in Kandhamal. Both are about the Hindu insecurity against conversions. The idea that Christian population was increasing due to conversion caused the destruction of 300 churches and the displacement of thousands of Dalit and Adivasis and Christian people”

In concluding her excellent speech the author of Gypsy Goddess said “Kandhamal is also a story about the question of justice, she quoted Teesta Setalvad, the renowned human rights defender, who says that only 2 of 27 murder trials had any conclusion, that only 3000 of the over 11,300 named in 800 FIRs were brought to trial. Giving a feminist perspective Meena said, how Kandhamal has to be seen as a feminist issue, about how the rapes of women were covered up, how the bodies of gang-raped victims were burned. So this communal violence and its effect on women has to be condemned.

Meena Kandasamy was emphatic in saying that Kandhamal, is a story that recurs all through Indian history. Whether it is Kilvenmani, Bathani Tola, Laxmanpur Bathe, or the recent Kambalapalli judgement, the ruling class, the upper caste, the majority of right wing Hindus who commit the atrocity are allowed to go scot free. We should force the judiciary to stay true.

As the convenor of Peoples’ Solidarity Concerns-Bangalore from New Socialist Alternative, I am immensely grateful and personally thank all those men, women, young and elderly, believers (of various faiths) & non-believers, Human Rights Defenders who gathered to say “No More Kandhamals, Not Here-Not Anywhere”

People United can never be defeated
Solidarity for ever

Jagadish G Chandra is a political & human rights activist based in Bangalore. He is the convenor of Peoples’ Solidarity Concerns-Bangalore from New Socialist Alternative.

Arrested for being seated while national anthem was played in the theatre

August 26, 2014 by Nasheman

Salman_Zalman

Statement by concerned citizens on the arrest of Salman and demanding his immediate release

On August 20th night 12 pm Salman a student and social activist from Trivandrum was picked up by the police from his home in Peroorkada. The immediate accusation against him was that he had insulted the national anthem while it was being played in a theatre, where he had gone to watch a movie. Later his comments on Facebook where he questions nationalism as a philosophical and political concept were also pointed out as a reason for his arrest. It is also being reported that there was a deliberate attempt to frame him by some right-wing hindutva groups and that they are the ones who are behind his arrest.

There is a lack of clarity regarding his arrest and the way it was conducted, late in the midnight hours of August 20th. It is clear, though, that none of the customary norms were followed during his arrest. Even after it was said that Salman was taken to the Thampanoor station, the police themselves later denied this. For a whole night and the next day even Salman’s parents had no access to him. In fact, Salman was taken from prison to prison like it is usually done with so called ‘notorious terrorists’ and the police refused to give out any information about him both to his parents and to the lawyers who had contacted them. It was onlyon August 21st evening that it was made known that there was an FIR recorded against him and that a case was registered under IPC act 124 A and 66 A charging him of sedition and of sending offensive messages through communicative service. Though there were many other students with him it is surprising that it was only Salman who was picked out and arrested.

The media too automatically reiterated the police version in their reports, without attempting to investigate into the case, in spite of the fact that police injustice towards Muslim youth is growing day by day. Further, we want to bring attention to the fact that vigilante right-wing hindutva groups are at present conducting an extremely abusive hate campaign against Salman on Facebook. The abusive comments on his Facebook wall have become so vicious that some even threaten to rape the women who are in support of him.

We strongly condemn the arrest and inhumane treatment of Salman Zalman at the hands of the Kerala police and call for his immediate release. We consider the charging of IPC 124 A (sedition) on him as a gross over stretching of the sedition act to encroach into the rights of a citizen to criticize the nation. We also condemn the abusive campaign that is being conducted on Facebook against him and the discriminatory nature of the media reporting, which is aiding such human right abuses.

Salman Zalman

Salman Zalman

It must also be noted that whatever the nature of the crime, the withdrawal of constitutionally established human rights is extremely problematic and illegal. We would surely connect the arrest and incarceration of Salman to the way in which Muslim youth in Kerala and elsewhere are being constantly oppressed by the criminal justice system (please remember the case of Muhsin, another trivandramite youth fabricated in a “letter bomb” case from which he was acquitted only after seven years). To avoid such illegal incarceration and delayed justice we demand that he should be allowed to use his fair legal rights as promised by the constitution.

His arrest is all the more troublesome because he was a student who has been a part of many human rights campaigns in the past and was even an artist in the play that was held in protest against UAPA in front of the Secretariat on August 14th. His clandestine arrest and subsequent secret incarceration and denial of legal access for a whole day and night reeks of police impunity, which selectively target the youth who question state ideology. We must remember that, at this moment, it has become a norm to first arrest, torture and incarcerate Muslims before allowing them to seek any kind of justice. This is sheer discrimination and we urge everyone to come together to condemn the arrest of Salman and to demand his immediate release.
