Assam Court issues non-bailable arrest warrant against Subramanian Swamy

New Delhi: A court in Karimganj district of Assam has issued a non-bailable arrest warrant against senior BJP leader Subramanian Swamy for failing to honour a summons issued on March 19.

Additional CJM (Karimganj) in his order stated that Swamy should be arrested on or before June 30.

He also directed the Delhi and Assam Police to produce Swamy before the court by the date after his arrest.

A complaint has been registered against Swamy for making a controversial remark on mosques.

While speaking in Guwahati on March 13, Swamy had reportedly said, “A mosque is not a religious place. It is just a building and it can be demolished any time. If anyone disagrees with me on this, I am ready to have a debate on the issue. I got this information from people of Saudi Arabia”.

Karnataka cabinet decides to challenge acquittal of Jayalalithaa

Bengaluru: Ending three-week long suspense, Karnataka government today decided to file an appeal in the Supreme Court against acquittal of Tamil Nadu Chief Minister Jayalalithaa and three others in the disproportionate assets case.

The decision to challenge the May 11 verdict by Justice C R Kumaraswamy of the Karnataka High Court was taken at a cabinet meeting after the advice by the Special Public Prosecutor in the case B V Acharya and state Advocate General Ravivarma Kumar as also the state Law Department.

“The Chief Minister has directed me to file an appeal in the Supreme Court immediately,” Law Minister Jayachandra said.

Replying to a query, he said Acharya will be the SPP in the case in the apex court.

He said the SPP appointed on the direction of the Supreme Court had advised filing the appeal against the acquittal of Jayalalitha and three others and even the AG and law Secretary had concurred with it.

“….And now the cabinet has decided to file the appeal,” he said, adding it was being done “legally on merit”.

The Supreme Court had specifically said Karnataka has stepped into the shoes of TN and it is the sole prosecuting agency for all matters related to the disproportionate assets case, he said.

In the May 11 verdict that restored Chief Ministership to her, Jayalalithaa was acquitted of “all charges” in the 19-year old disproportionate assets case. Three other convicts, including her close aide Sasikala Natarajan, were also given a clean chit by the High Court.

A fresh legal challenge to 67-year old Jayalalithaa has come nine days after she made a triumphant return as Chief Minister with O Panneerselvam making way for her following acquittal by the High Court.

The state government had a 90-day deadline to file the appeal.

Karnataka is the sole prosecuting agency in the case, which was transferred to Bengaluru from Tamil Nadu by the Supreme Court for a “fair” trial.

Justice Kumaraswamy had set aside the trial court’s judgement which had sentenced Jayalalithaa and three others to four years in jail and allowed the appeals by all the four convicts.

Special Court Judge Michael D Cunha had on September 27 last held Jayalalithaa and three others guilty of corruption and awarded four years jail term, due to which she attracted disqualification as an MLA that divested her of Chief Ministership.The judge had also slapped a fine of Rs 100 crore on Jayalalithaa and Rs 10 crore each on three other convicts.

Giving a clean chit to Jayalalithaa, Karnataka High Court had held that the judgement and findings recorded by the trial court convicting her and three others suffers from infirmity and it is not sustainable in law.

Acquitting Jayalalithaa and three others of “all the charges levelled against them”, the single bench judge Justice Kumaraswamy, in his 919-page judgement, had also quashed the order of the trial court relating to confiscation of the properties both movable and immovable.

On disproportionate assets, the judge had held that “it is relatively small. In the instant case, the disproportionate asset is less than 10 per cent and it is within permissible limit.”

“The percentage of disproportionate assets is 8.12 per cent,” the judge had said.

AIADMK’s bitter rival DMK had raised the pitch for filing the appeal against acquittal while the original petitioner Subramanian Swamy had also said he would move the Supreme Court if Karnataka does not challenge the High Court verdict.

Blooper: Subramanian Swamy attempts to tie a knot to a bride

Tirunelveli: A gag reel showing senior BJP leader and self-styled nationalist Subramanian Swamy almost getting married for the second time is doing the rounds on social media platforms of late.

As per media reports, the BJP leader was invited to bless the bride and groom at a wedding held in Tirunelveli, Tamil Nadu. During the wedding ceremony, he was asked to hand over the nuptial chain or ‘mangala sutra’ to the groom and bless the couple.

Swamy, who seemed to be absent-minded, almost tied the nuptial chain to the bride instead of handing it over to the groom.

However, an alert elderly lady pulled back Swamy at the spur of the moment. Swamy finally handed over the nuptial chain to the groom.

One year of Modi sarkar: Hate speech galore

The coming to power of Narendra Modi in a way gave an open license to all the affiliates of RSS combine to indulge in open hate speech against the religious minorities. The current agenda behind the hate speech is to consolidate the communal polarisation of the society along lines of religion. The well-known case of MIM’s Akarbar-uddudin Owaisis’ hate speech has been despicable and very rightly Akbarudin Owaisi had to be in jail for some time. The case against him should be pursued and the legal course of action must be followed. At the same time, what about the hate speeches indulged in by the likes of Pravin Togadia, Subramaniam Swami, Giriraj Singh, Sadhvi Niranjan Jyoti, Sadhvi Prachi, Sakshi Mahraraj, Yogi Adityanth, Sanjay Raut and company?

Apart from these associates of Hindu right wing patriarch RSS, who are reported in the media, there are many more indulging in the divisive speech and worsening the communal situation. During this year, they have started feeling emboldened as they know it is ‘their’ Government and they can get away with it. Day in and day out they are becoming more aggressive and vicious in their language. The hate speech against religious minorities has been stepped up.

One recalls even before Modi Sarkar assumed the seat of power, the divisive activities of ‘BJP associates’ in the form of propaganda of love jihad and Ghar Vapasi were on, and they continued without any respite during this year. Soon after this Government came to power, Mohsin Sheikh, a person working in IT was hacked to death by activists of Hindu Jagran Sena in Pune, in the aftermath of morphed pictures of Bal Thackeray and Shivaji being posted on the social media.

The attack on Churches was very glaring and the process which was dominant in Delhi and Haryana was also witnessed in places like Panvel near Mumbai, Agra in UP amongst other places.

Sakshi Maharaj not only said that Godse was a patriot; he also went on to say that Hindu women should produce four children, as Muslims are overtaking the population. Sadhvi Prachi went to prescribe eight children for Hindu women. She also gave a call that Muslim film actors, Aamir Khan, Shahrukh Khan and Salman Khan should be boycotted. Pravin Togadia has been the leading person in making hate speeches; he has the highest number of cases regarding hate speech against him. Yogi Adityanath, BJP’s MP keeps making very derogatory remarks, said that in ‘love jihad’ if one Hindu girl is converted, then 100 Muslim girls should be converted to Hinduism. The propaganda around love jihad keeps simmering and various small and big leaders keep using it to divide the society. Same Yogi went on to say that Mosques should be converted into den of pigs and that Muslims should not be allowed to come to Hindu holy places.

Two central ministers of Modi Sarkar, Sadhvi Niranjan Jyoti and Giriaj Singh made very insulting and humiliating remarks about non-Hindus and the colour of the skin of Congress chief Sonia Gandhi. Niranjan Jyoti stated that all those who are non-Hindus are illegitimate, Haramzade. Giriraj Singh had earlier said that those not voting for Modi should go to Pakistan. Interestingly he said this before the elections and despite such a record, he was elevated to the level of minister in the Modi sarkar. He made racial comments about Sonia Gandhi recently. Sakshi Mahraj also held Godse as a patriot, while his another party colleague from Kerala, one Gopal Krishnan, wrote in RSS mouth piece Keasri that Godse chose a wrong target in killing Gandhi, he should have killed Nehru instead.

Subramaniam Swamy, one of the very senior leaders of BJP, said that God lives in temples alone, not in mosques and Churches. The hidden implication of this statement is fraught with danger. These are few of the samples from what all has been stated during this year. Its impact in increasing the sense of fear amongst religious minorities is more than obvious. BJP ally Shiv Sena’s MP Sanjay Raut went to the extent of demanding that the voting rights of Muslims should be revoked.

As such one realizes that ‘Hate speech’ is the outcome of the politics of divisiveness, it is the concentrated expression of the ‘social common sense’ prevailing in the society, it is the forthright and blunt way of putting things, which communal parties propagate anyway. It is not out of the blue that these formulations suddenly crop up, their infrastructure, the base of these has already been made by a section of political outfits.

Also ‘Hate Speech’ in case of India is an accompaniment of the politics in the name of religion and language, and also many times it precedes the violence or helps in polarization of communities for electoral benefits. While BJP was on the upswing during Ram Temple campaign; one recalls that Sadhvi Ritambhara was propped up for pravachans (religious discourses) by RSS combine. She was bluntly talking anti-minority things, duly endorsed by communal political organizations. This took place around the Babri demolition period.

One has been hearing similar things from many a sadhus of VHP, small and sundry members of communal gang, some Muslim communalists and the ilk of Togadia. There has been a more sophisticated presentation of the similar formulations by many others. Modi, in his initial rise to power, talked divisive language, but kept changing the form in a very subtle way to suit the needs of his political strategy. When he said that post-Gujarat refugee camps should be shut down as they have become factories of production of children, he was reinforcing the propaganda about Muslims having more number of children.

In the wake of Mumbai riots, Bal Thackeray had indulged in Hate speech, inciting his Shiv Sainiks to undertake violence. He also got away with it due to clever way of putting his vitriol and due to the lack of adequate laws which can distinguish the Hate speech from freedom of expression, which can distinguish between one’s political opinion and painting the ‘other’ community in a negative light.

Incidentally, it is important to distinguish between criticizing a community and criticizing a political organization. While political organizations can and must be criticized, communities should not be humiliated or insulted. Also no political organization can be synonymous with the religious community, whatever its claims.

It is not only disturbing but totally against the values of our democratic society that such ‘hate other’ ideology and speeches have become the weapon in the hands of a type of politics, which thrives on exclusion, which identifies a particular religious community as synonymous with the nation state. Again this ‘hate speech’ is the language of a section of those who thrive on identity politics far away from the real issues of the society.

As such Hate speech in India entered the political arena with the rise of communal streams in politics, like Muslim League on one side and Hindu Mahasabha and RSS on the other. These streams believed in the nation based on one religious community. These streams came from the sections of earlier rulers, landlords, Nawabas and Rajas etc. The ideology of religion based nationalism is narrow and it excludes ‘other’ from its notion of nationhood. These beliefs then get converted into Hate other, and later turn in to ‘Hate speech’. This did form the basis of many a communal violence in pre-Independence era and also during the last two decades.

Varun Gandhi, allegedly said ‘he will cut the hands’, is a BJP MP. In this atmosphere once in a while, the BJP spokespersons will say that the view expressed by the particular leader are ‘personal’ and stop at that. For BJP another escape clause is that its associated organizations like VHP, Vanvasi Kalyan Ashram and Bajrang Dal are formally different organizations though they are also part of RSS controlled Sangh Parivar. They all are working in tandem with BJP for actualization of agenda of Hindu Rashtra. So while BJP is not directly responsible for their actions, the direction of the actions is the same. Many a people call these organizations as fringe elements, while as a matter of fact, there is a division of labour between these organizations. These have become more aggressive during current time. And surely, after the Modi Sarkar coming to power their vitriol has become more intense.

Subramanian Swamy to move SC against Jayalalithaa's acquittal if Karnataka doesn't do

Bengaluru: Senior BJP leader Subramanian Swamy today said he will move the Supreme Court next month against the acquittal of AIADMK supremo J Jayalalithaa in a grafts case if the Karnataka government did not do so by then.

“I have decided to file SLP (Special Leave Petition) in SC after June 1st if K’taka govt does not file. So no need to go to KHC (Karnataka High Court),” he tweeted.

The BJP leader’s statement comes two days after he had indicated on micro blogging site ‘Twitter’ that he could file an appeal in the apex court against Jayalalithaa and “prove that the KHC judgment is a ‘tragedy of arithmetic errors'”, adding she would have to resign as Chief Minister if she had taken over by then.

Swamy is the original complainant in the case. He had filed a case in 1996 against Jayalalithaa alleging that during her tenure as Chief Minister from 1991 to 1996, she amassed properties disproportionate to her known sources of income.

The DMK government subsequently filed cases, including the Rs 66.65 crore disproportionate assets case, against Jayalalithaa which led to her conviction in September last by a special court.

The Karnataka High Court acquitted Jayalalithaa on Monday.

Subramanian Swamy launches Hindutva outfit – Virat Hindustan Sangam

New Delhi: BJP leader Subramanian Swamy on Wednesday announced the formation of an organisation that would push for Hindutva issues like securing the disputed Ram Mandir area for building a temple by persuading Muslims to accept an alternative site.

The outfit Virat Hindustan Sangam will empower the youth to articulate the “values” of Hindutva, like scrapping of Article 370, Uniform Civil Code, Ram temple and beef ban, he told a press conference.

Indicating that the new body will also act as a pressure group on the ruling BJP, he said it would provide a list of candidates to the party for consideration and work closely with the Sangh parivar.

Asked what will be his priority issue, he said it would be construction of Ram temple in Ayodhya.

“We will take up from January 1, 2016 the Ram temple issue. I will want the government to follow the Saudi Arabian example of offering the Waqf Board a site across the Saryu river for building a mosque…And leave the Ram temple premises completely for temple.

“We hope to complete it by the end of 2016 because of our activism both in courts and in terms of pushing the government,” he said, adding that he would have finished most of his legal work in the Supreme Court by then.

He also batted for scrapping of Article 370, an issue put on the back burner, saying it is in the party’s manifesto and it would have to do it by 2019 when next Lok Sabha election is scheduled.

His organisation, he said, will be open to Hindus or those Muslims and other Indians who acknowledge their Hindu ancestry.

Guwahati: BJP leader Subramanian Swamy has sparked off a massive controversy by saying that mosque is not a religious place but is merely a building that can be demolished any time.

Swamy made these controversial statements in a programme at Guwahati. Swamy’s comments have attracted condemnation from all political parties. Even Assam BJP has disassociated themselves from Swamy’s remark.

According to HT, Swamy gave the “example” of mosques demolished for construction of roads in Saudi Arabia. The controversial leader said, “A mosque is not a religious place. It is just a building. It can be demolished any time. If anyone disagrees with me on this, I am ready to have a debate on the issue. I got this information from people of Saudi Arabia”. He stoked another controversy by claiming all Indian Muslims were Hindus. He repeated the controversial comments again on Saturday.

Police have now registered a case registered an FIR under IPC sections 120 (B) [criminal conspiracy] and 153 (A) [promoting enmity between different groups on grounds of religion] against Swamy following a formal complaint by Krishak Mukti Sangram Samiti (KMSS).

KMSS has urged Chief Minister Tarun Gogoi to ban Swamy’s entry into the state. HT has quoted Tarun Gogoi as saying, “BJP will have to pay a heavy price for hurting Assamese sentiments”.

The state BJP is in backfoot as Swamy’s comments have evoked sharp reaction from all quarters. Assam BJP president Siddhartha Bhattacharyya has branded Swamy’s comment as his personal opinion. He said that they will send the footage to Central leadership.

Several minority organisations have also demanded strict action against Swamy. It’s not the first time Swamy has made a controversial statement though. From Sashi Tharoor to Sonia Gandhi, Swamy has targeted one and all.

Jayalalithaa case: HC asks Subramanian Swamy to make written submission

Bengaluru: The Karnataka High Court on Monday directed BJP leader Subramanian Swamy to make written submissions on March 11 in former Tamil Nadu Chief Minister Jayalalithaa’s appeal against her conviction in the disproportionate assets case.

As the Court began its proceedings in the case, Swamy’s assistant Pawan Chandrashekhar Shetty sought a week’s time to make written submissions, but Justice C R Kumaraswamy declined the plea and asked him to do it on March 11.

The judge had in his February five order said that the court would decide on Swamy’s prayer to allow him to make written submissions after the completion of arguments.

Swamy had filed an application seeking permission to implead himself in the case.

The Special Bench has been set up after the Supreme Court had on December 18 last directed the Chief Justice of Karnataka High Court to constitute it to decide Jayalalithaa’s appeal within three months.

A Supreme Court bench, headed by Chief Justice H L Dattu, had granted bail to Jayalalithaa on the condition that hearing in the High Court on her appeal against conviction should be completed in three months from December 18.

The special court had held Jayalalithaa and three others guilty of corruption and awarded four years jail term and slapped a fine of Rs 100 crore on her. It had also imposed a fine of Rs 10 crore each on the three other convicts.

Apart from Jayalalithaa, her close confidante Sasikala and her relatives Sudhakaran, erstwhile foster son of the AIADMK leader, and Elavarasi were also convicted.

Subramanian Swamy says will move SC on Ram Temple issue

New Delhi: Bharatiya Janata Party (BJP) leader Subramanian Swamy on Monday said he would approach the Supreme Court if Prime Minister Narendra Modi led government at the Centre does not start the construction of the Ram Temple in Ayodhya by 2016.

“There is a widespread demand in our country. For Ram we must build the temple. This is the promise we had made that whoever comes to absolute majority will do it. We cannot let down the people of India. And, therefore, if the Prime Minister doesn’t feel it can’t be done by him through the government, I will do it through the Court [Supreme Court],” he told ANI here.

“I am already a petitioner in the Supreme Court and I am already presently about to have the Supreme Court hear my petition on the facilities being given to the pilgrims in that area and I am the person who filed that petition to save Ram Setu,” he added.

The BJP, which achieved absolute majority in the 2014 Lok Sabha polls, had after coming to power said that Prime Minister Modi-led government at the Centre would clear the construction of the Ram Temple in Ayodhya.

Jayalalithaa's bail plea rejected

Bangalore: In a huge blow to the AIADMK, the Karnataka High Court on Tuesday denied bail to former Tamil Nadu chief minister and AIADMK chief J Jayalalithaa in the Rs 66.65 crore disproportionate assets case.

Denying bail to the convicted leader, the court said there wasn’t sufficient ground for awarding bail to her.

“The High Court has correctly rejected the bail for Jayalalithaa,” Bharatiya Janata Party (BJP) leader Subramanian Swamy, who has been leading the campaign against her, said.

Supporters of the AIADMK had earlier begun celebrations in Tamil Nadu after the prosecution in the case told the court that it had no objections to conditional bail to the AIADMK chief. Swamy said he was “surprised when I heard that the prosecution had agreed for a conditional bail for Jayalalithaa”. “The Karnataka government has something to explain on this,” he said.

Jayalalithaa has already spent ten days in the Bangalore jail where she was lodged immediately after her conviction on 27 September.

Ahead of the hearing, posters were spotted in Chennai with purported threats to kidnap natives of Karnataka staying in Chennai. The posters, reportedly from local AIADMK leader KC Vijay, carried the threat to hold the Kannadigas captive until Jayalalithaa is granted bail, Hindustan Times reported.

Jayalalithaa has been in jail ever since a special court in Bangalore sentenced her to four years imprisonment in September under the Prevention of Corruption Act (PoCA). She was also slapped a fine of Rs 100 crore in connection with the Rs 66.65 crore disproportionate assets case.
