Gujarat genocide: 11 get life term in Bilkis gangrape case; no death penalty

Mumbai: The Bombay High Court today upheld the conviction and life imprisonment of 12 people (one among them is already dead) in the Bilkis Bano gang rape case while setting aside the acquittal of seven persons including policemen and doctors.

The court also dismissed an appeal filed by CBI seeking death penalty for three of the convicts.

“The appeal against conviction filed by the 11 convicts is dismissed. The conviction and sentence is upheld,” a division bench of Justices V K Tahilramani and Mridula Bhatkar said.

“The appeal filed by the prosecution against the acquittal of seven persons (in the case) is allowed. The acquittal is set aside,” the court said.

The bench said the seven persons, which includes five policemen and two doctors, are convicted under sections 218 (not performing their duties) and section 201 (tampering of evidence) of the Indian Penal Code (IPC).

“We will consider the undergone period in jail of these seven persons as their sentence. But we will impose a fine amount of them,” the court said today.

The convicted policemen and doctors are – Narpat Singh, Idris Abdul Saiyed, Bikabhai Patel, Ramsingh Bhabhor, Sombhai Gori, Arun Kumar Prasad (doctor) and Sangeeta Kumar Prasad (doctor).

Now 18 people stand convicted in the case

The court had last year reserved its judgement in the appeals filed by 11 persons convicted in the case and also the appeal filed by CBI for capital punishment to three of them.

A special court had on January 21, 2008 convicted and sentenced to life imprisonment 11 men for gangraping Bilkis and murdering seven of her family members in the aftermath of the Godhra riots.

The convicts later approached the high court here challenging their conviction and sought for the trial court’s order to be quashed and set aside.

The CBI had also filed an appeal in the high court seeking harsher punishment of death for three of the convicted persons on the ground that they were the main perpetrators of the crime.

According to the prosecution, on March 3, 2002, Bilkis Bano’s family was attacked by a mob at Randhikpur village near Ahmedabad during the post-Godhra riots and seven members of her family were killed.

Bilkis, who was five months pregnant at the time, was gang raped while six other members of her family managed to escape from the mob.

The trial in the case began in Ahmedabad. However, after Bilkis expressed apprehensions that witnesses could be harmed and CBI evidence tampered, Supreme Court transferred the case to Mumbai in August 2004.

The 11 convicted are Jaswantbhai Nai, Govindbhai Nai, Shailesh Bhatt, Radhesham Shah, Bipin Chandra Joshi, Kesarbhai Vohania, Pradeep Mordhiya, Bakabhai Vohania, Rajubhai Soni, Mitesh Bhatt and Ramesh Chandana.

The convicts had challenged the order on three main grounds — that all evidence in the case was fabricated by CBI, that Bilkis gave birth to a child after the incident, thus, the same proved that she could not have been gang raped, and the failure to find the bodies of some of her family members proves that they were not killed.

The CBI had sought enhancement of punishment for three of them- Jaswantbhai, Govindbhai and Radhesham Shah— on the grounds that they had raped Bilkis.

What is Bilkis Bano gangrape case?

The rape of Bilkis Bano and the murder of her family members was one of the most horrifying incidents that had taken place during the 2002 post-Godhra riots in Gujarat. For the past 15 years, Bilkis Bano had taken up the matter with the local police, an NGO, the CBI and the courts to get justice for herself.

On March 3, 19-year-old Bilkis Bano along with her family were on their way, escaping a mob on a truck. Bilkis was five months pregnant and accompanying her were 17 other people in the truck, including her 2-year-old daughter. The truck was attacked by an armed mob, who gangraped her and killed 14 members of her family including her daughter, her mother Halima and cousin Shamim.

The 19-year-old approached the local police station to register a case against the assailants. However, the police dismissed her case and threatened her with dire consequences if she proceeded with the matter. She then approached the National Human Rights Commission of India and petitioned the Supreme Court. The Supreme Court directed the CBI to probe into the matter. In the meantime, she along with her family were issued threats, which forced her to request the SC to move the case outside Gujarat. The SC then shifted the case to Maharashtra.

In the Mumbai court, charges were filed against 19 men, including 6 police officers and a government doctor. In January 2008, 11 of them were sentenced to life imprisonment for gangrape and murder. The CBI however had asked for death penalty for Jaswantbai Nai, Govindbhai Nai and Radhesham Shah, who were charged for having played a significant role in planning and execution of the entire incident. The 11 convicts had however, filed an appeal to the High Court challenging their conviction.

Indore cleanest city; Mysuru slipped to 5th place; Mangaluru 63; Udupi 143

New Delhi: Indore in Madhya Pradesh is India’s cleanest city and Gonda in Uttar Pradesh the filthiest, a nationwide cleanliness survey by the urban development ministry has found.

The survey of 434 cities, conducted as part of the Modi government’s Swachh Bharat Abhiyan, or Clean India Mission, has seen the historic city in MP knock off Karnataka’s Mysuru, which has been topping the rankings. In previous survey Mysuru had bagged first place.

Though in waste collection, solid-waste processing and recycling of water Mysure fared well, the city failed to construct targeted 425 individual household toilets, Urban Development Minister M Venkaiah Naidu told reporters here while releasing survey results.

Bengaluru City ranked 210 place in the country indicating the city is not up to mark in its cleanliness. Bengaluru scored just 967 out of 2000 score in the survey. Coastal Karnataka’s Mangaluru got 63 position while Udupi bagged 143 place in the country.

Bhopal capital city of Madhya Pradesh bagged second place while Visakhapatnam in Andhra Pradesh and Surat in Gujarat are got third and fourth place respectively. Tiruchirapalli in Tamil Nadu bagged sixth place in the survey.

The cleanliness survey was carried out during January and February this year. Prime Minister Narendra Modi launched the Swachh Bharat campaign in 2014 aimed at making India clean and open-defecation free by 2019.

How city ranked

The criteria for this year’s ranking included 45% marks for cities becoming open defecation free, solid waste management (including sweeping, collection, transportation and processing of garbage), education and capacity building. Another 25% marks was kept for field inspection and 30% for citizen feedback. At least 18 lakh citizens across the cities gave their feedback about the sanitation in their respective cities and towns.

An ailing Congress president Sonia Gandhi should quickly appoint her son Rahul Gandhi as party chief as the delay is only helping Prime Minister Narendra Modi achieve his ambition of a Congress-mukt India, a Congress leader said on Wednesday.

“If Sonia Gandhi is sick, then she should not make (the) Congress sick and she should not help Modi to make Congress-mukt bharat,” former Goa Congress president John Fernandes said.

“If she wants to give leadership to Rahul Gandhi, she should do it fast because she is sick,” Fernandes added.

He also faulted the Congress high command for not holding a session of the All India Congress Committee for three years, after the defeat in the 2014 general elections, which he said would only harm the party.

“Congress should not be sick. Congress can bounce back, if there are workers like me and we work together. Congress will come back because people want the Congress. And the Goa election is an indicator,” the two-term Rajya Sabha MP said.

Fernandes was appointed state president of the party’s Goa unit in 2013 soon after the Congress was routed in the 2012 state assembly elections. He was subsequently replaced by Luizinho Faleiro as state president in 2014.

ipl-10: Delhi keep play-offs dreams alive with 6-wicket win over Sunrisers

Delhi Daredevils kept their chances of qualifying for the Indian Premier League (IPL) play-offs alive after beating Sunrisers Hyderabad by six wickets at the Ferozeshah Kotla here on Tuesday.

On paper, it was a mismatch between Daredevils and Sunrisers but the hosts put on a collective batting effort to register a win with five balls to spare.

With their third win in the tournament, Delhi moved up to the sixth spot with six points while Hyderabad are still at the third spot with 13 points after their fourth away loss in the tournament.

All-rounders Corey Anderson’s quick-fire 24-ball unbeaten 41 and Chris Morris’ 7-ball 15 helped Delhi raise an unbeaten 41-run fifth wicket stand to register the much-needed win.

Chasing a mammoth 186, Delhi were off to a decent start with Sanju Samson (24 off 19 balls) and skipper Karun Nair (39 off 20) putting on 40 runs before medium pacer Mohammed Siraj packed back Samson.

Samson, who had faced 19 balls by now and struck two boundaries and a six off Siraj’s first delivery of the match, was undone by a slower one in the bowler’s second over which Shikhar Dhawan latched on comfortably at cover point.

Nair looked in good touch during his brief stay, which saw the ball crossing the boundary on five occasions besides twice over it.

The right-hander could add 32 runs for the second wicket with wicketkeeper-batsman Rishabh Pant (34 off 20) before the first strategic time-out once again saw the dismissal of a batsman, this time in the form of Nair.

Medium pacer Siddharth Kaul, who was clobbered for a six and a four in his very first over by Nair, got his knuckleball to send the right-hander back caught by Bhuvneshwar Kumar at long-off.

With both the openers back in the dug out, the onus was on Pant and new man Shreyas Iyer (33 off 25) but Siraj, after getting clobbered for a six in the previous ball got a toe crusher to cannon into the southpaw’s stumps. The right-handed duo batted well to put 37 runs for the third wicket before being separated by Siraj.

Pant’s dismissal brought together all-rounder Corey Anderson and Iyer, who was at his destructive best, clobbering two consecutive sixes off Yuvraj Singh, before Purple Cap holder Bhuvneshwar Kumar packed Iyer back with a slower bouncer.

Anderson then took on the responsibility and with new man Morris, wasted no time in using the long handle. With 24 needed off the last three overs, Anderson clobbered Bhuvneshwar for a six and a four off back to back balls before Morris sent Kaul outside the park to take Delhi within sniffing distance of the win.

Earlier, Yuvraj Singh (70 not out from 41 balls) made the most of the life he got on 29 when he was dropped bySamson at deep square, to propel Sunrisers to 185/3 after being sent to bat.

The Punjab batsman, who initially struggled to put bat to ball opened up with two glorious straight drives before bringing up his fifty in 34 balls, and help the visitors accumulate 71 runs in the last five overs.

The left-hander made the most of South African Kagiso Rabada’s poor line and length, clobbering him for a four and six off consecutive balls in the 18th over.

All-rounder Moises Henriques (25 not out) played the perfect second fiddle to Yuvraj as the left-right combo added an unbeaten stand of 93 runs for the fourth wicket from 51 deliveries.

Skipper David Warner (30 from 21) and Dhawan (28 from 17) gave the visitors a flying start, putting on 53 runs before pacer Mohammed Shami in his very second delivery cleaned up the Aussie, who struck four boundaries and a six over backward point.

New Zealander Kane Williamson (24 from 24) along with Dhawan added 22 runs before the first strategic time-out did the trick for Delhi, in the form of the southpaw’s wicket.

Syrian rebels have suspended their participation in the latest round of Russian-backed talks in Kazakhstan in protest against ongoing air strikes in the war-torn country.

Syrian rebel and government delegations were discussing a Russian plan for “de-escalation zones” on Wednesday when the opposition walked out, citing the bombardment of rebel-held areas.

“The opposition delegation, that is the military delegation, has announced they are ‘suspending’ their participation in these talks,” Al Jazeera Jamal Elshayyal, reporting from the capital Astana, said.

“They aren’t fully withdrawing participation, they’ve walked out of the meetings but they haven’t left – at least not yet,” he said.

No progress

Syria’s six-year civil war has killed hundreds of thousands of people and has drawn in world powers on all sides.

The two sides are in the Kazakh capital for a new round of talks sponsored by opposition supporter Turkey and Syrian government backers Russia and Iran.

The Astana negotiations are viewed as complementary to broader UN-brokered talks in Geneva on a political settlement, but neither have yielded real progress so far.

A source close to the opposition provided AFP news agency with an Arabic-language version of a proposal drafted by Russia, which an opposition official confirmed was being discussed on Wednesday.

It calls for the creation of “de-escalation zones” in rebel-held territory in the northwestern province of Idlib, in parts of Homs province in the centre, in the south, and in the opposition enclave of Eastern Ghouta near Damascus.

The aim is to “put an immediate end to the violence” and “provide the conditions for the safe, voluntary return of refugees”.

The designated zones would also see the immediate delivery of relief supplies and medical assistance.

Mandeep Singh struck in the 43th, 50th and 58th minutes after Rupinder Pal Singh (8th minute) powered home a penalty corner to hand India an early lead.

Japan fought back through Kuzama Murata (13th minute), Heita Yoshihara (42nd minute) and Genki Mitani (44th minute).

India now have seven points from four matches. They had started their campaign with a 2-2 draw with title contenders Britain in the opening match of the tournament.

They had then defeated New Zealand 3-1 before going down by a similar margin to favourites Australia on Tuesday.

Beheading of soldiers: India summons Pak high commissioner

New Delhi: India today summoned Pakistan High Commissioner Abdul Basit in connection with the beheading of two Indian security force personnel in Jammu and Kashmir by Pakistan forces. Basit was called in by Foreign Secretary S Jaishankar to convey India’s strong views on the incident, the external affairs ministry said.

The Indian Director General of Military Operations (DGMO) Lt Gen A K Bhatt has conveyed to his Pakistan counterpart that such a dastardly and inhuman act was beyond any norms of civility and merits unequivocal condemnation and response.

Naib Subedar Paramjeet Singh and BSF Head Constable Prem Singh were slain by Pakistan Border Action Team (BAT) by sneaking 250 metres into Indian territory in Poonch of J-K on May 1.

New Delhi: An estimated USD 770 billion in black money entered India during 2005-2014, US-based think tank Global Financial Integrity (GFI) has said in its latest report.

Nearly USD 165 billion in illicit money exited the country during the same period, the global financial watchdog said. During 2014 alone, about USD 101 billion black money entered the country while USD 23 billion exited, the report added. “Illicit financial flows (IFFs) from developing and emerging economies kept pace at nearly USD one trillion in 2014,” it said.

Titled ‘Illicit Financial Flows to and from Developing Countries: 2005-2014’, the report is the first global study to place equal emphasis on illicit outflows and inflows.
