SC demands Mallya’s presence to proceed in contempt case

July 14, 2017 by Nasheman

Vijay Mallya

New Delhi: The Supreme Court today considered the Centre’s submission that proceedings to extradite embattled businessman Vijay Mallya are going on in London and said the contempt case against him would move further only when he is produced before it.

A bench comprising Justices A K Goel and U U Lalit took note of the fresh status report, referred by Attorney General K K Venugopal that efforts to bring Mallya back were on. The apex court, which was to pronounce quantum of the sentence today against Mallya, who has alreday been convicted for its contempt, said proceedings can’t move further unless the businessman is produced before him.

Earlier, Mallya had failed to make a personal appearance before the top court despite being directed to do so. The apex court had on May 9 held Mallya, who is presently in the United Kingdom, guilty of contempt on a plea by the consortium of lender banks, led by the State Bank of India, for his failure to furnish details of all his Indian as well as offshore assets.

It had directed Mallya to appear before it today to argue on the quantum of punishment. The offence of contempt of court entails a maximum imprisonment of up to six months or a fine of upto Rs 2,000 or both. India had recently asked Britain to ensure early extradition of Mallya, who is an accused in a bank loan default case of over Rs 9,000 crore involving his defunct Kingfisher Airlines.

The apex court’s order had come on a plea by the consortium of banks, led by the State Bank of India (SBI), which had said that Mallya had allegedly transferred INR 2,581.41 million received from British firm Diageo to his children in “flagrant violation” of various judicial orders. The bench had reserved its order on two pleas of lending banks seeking contempt action and a direction to Mallya to deposit INR 2,581.41 million received from offshore firm Diageo respectively.

The banks have alleged that Mallya had concealed facts and diverted the money to his son Siddharth Mallya and daughters Leanna Mallya and Tanya Mallya in “flagrant violation” of the orders passed by the Karnataka High Court. The bench had also pulled up Mallya for not giving details of the INR 2,581.41 million which he had allegedly received from Diageo in February last year, saying it was of the “prima facie view” that proper disclosure as per its earlier order was not made.

The banks had on August 29 last year told the Supreme Court that Mallya had deliberately not made full disclosure of his assets including the INR 2,581.41 million he received on February 25 from Diageo.

SC affirms the stay in QNET Case

July 14, 2017 by Nasheman

Dismisses application filed by the State of Maharashtra seeking vacation of stay

QNET

Delhi: Direct selling company QNet and its sub-franchisee Vihaan Direct Selling (India) Pvt. Ltd were granted further relief today when the Supreme Court granted no interference to the stay issued earlier in March.

Bench of Justice Nariman and Justice Kaul heard the matter briefly and observed that the stay granted on the earlier occasion needs no interference. The court thereafter dismissed the application filed by the State of Maharashtra seeking vacation of stay.

The Hon’ble Supreme Court sought information from the State on the status of the appointment of the Monitoring Authority. In response, the state of Maharashtra indicated that they have not taken any steps in this regard.

Earlier on March 27, 2017, the Supreme Court had ordered a stay on all FIRs and proceedings against QNet’s business in India. The order is seen as a positive development for the direct selling industry as it comes at a juncture when the government is trying to instill confidence in the industry with the introduction of the model Direct Selling Guidelines.

FIR against comedy group AIB’s Tanmay Bhat for joke against Modi

July 14, 2017 by Nasheman

AIB Modi Joke

Mumbai: The Mumbai Police Cyber Cell on Friday registered a complaint against comedian Tanmay Bhat promoted All India Bakchod (AIB) for posting an offensive meme about Prime Minister Narendra Modi, an official said here.

“We have registered the FIR at the Cyber Police Station in this regard after due legal consultations. Further details will be communicated later,” said Mumbai Police spokesperson DCP Rashmi Karandikar.

The AIB’s meme was seen on Wednesday in which a person resembling Modi is shown with the ears and nose of a dog, and a similar person is busy on a mobile in another picture.

Following an uproar on the social media and Bharatiya Janata Party (BJP) circles, the AIB deleted the meme, only to invite the wrath of Congress activists.

On Thursday, some Twitteratti vented anger and tagged the Mumbai Police demanding strictest action against the AIB for the ‘obnoxious posts’ on the Prime Minister.

Undeterred by critics, Bhat vowed he would continue to make jokes repeatedly.

“Will continue making jokes. And deleting if necessary. And making jokes again. And apologizing if necessary. Don’t care what you think,” he tweeted.

Defending the meme on the AIB website and on Twitter, Bhat termed it lack of rational reasoning.

When contacted by IANS for his comments on the FIR, Bhat did not respond to calls or messages.

A Muslim Family of 10, Women and A Disabled Child Attacked Brutally By a Mob in a UP Train

July 14, 2017 by Nasheman

Muslim Family Attacked

Lucknow: A Muslim family of 10 including women, children, elders and a handicapped teenager were brutally assaulted in a train and robbed by a gang on Wednesday evening in Uttar Pradesh’s Mainpuri district.

The horrific incident took place on the Shikohabad-Kasganj passenger train when the family was on its way back from attending a marriage ceremony. A group of 35-30 men assaulted the family with iron rods and sticks between Mota and Nibkarori railway stations- some 30 km away from Farrukhabad junction.

A video of the incident showed group banging on the passenger coach in which the family was traveling and pelting stones to break the windows. They later jumped inside the train through the emergency window by breaking the glass panel.

50-year-old Mohammad Shakir, who suffered severe head injury along with fracture in right hand in the assault said, “It was a horror which I cannot forget. They attacked us with iron roads, robbed our belonging and molested our women. They didn’t even spare my 17-year-old physically and mentally challenged son.”

Horrified by the act, Shakir added, “They verbally abused us with some in the attacking group saying, “Kill them, they are Muslims”, and they continued to beat us until we went unconscious.”

According to Arsaan (22), son of Shakir, “The assailants groped my mother and sister blouse and salwar torn it. They snatched their gold chains and took our luggage and jewellery. They even attacked other passengers who came to rescue us. Later the passengers abandoned the coach leaving us behind to fight the assailants.”

“As soon the train stopped, the assailants jumped out of the train and called 20-25 youths who were already waiting on bike. We immediately locked the doors of the coach from inside and shut down the windows but the assailants started stone pelting and broke the emergency window panel. They barged inside the coach and again started assaulting us, while the other passengers abandoned the train,” he said.

“After the incident we attempted to contact police on dial 100, but every time, call was dropped. Later when the train reached Farrukhabad junction, the GRP took us to hospital,” he added.

The victims were admitted to Dr Ram Manohar Lohia government hospital, Farrukhabad, with fractured limbs and severe injuries to the head and stomach.

An FIR has been lodged under IPC section 395 and based on the video of the incident, special operation group and other police teams have detained three men and are questioning them.

Bob Corker: Saudi terrorism support ‘dwarfs’ Qatar’s

July 13, 2017 by Nasheman

Republican says Saudi crown prince may have made ‘rookie mistake’ over Qatar blockade, as diplomatic efforts continue.

Corker has previously threatened to block US arms sales to the GCC until there was a clear path for settling the dispute [AFP]

by Al Jazeera

An influential US Republican senator has criticised the Saudi Crown Prince, Mohammed bin Salman, over a blockade on Qatar by the kingdom and three other Arab states.

The comments by Bob Corker, chairman of the US Senate Foreign Relations Committee, came as tensions in the region continue over the crisis, with US Secretary of State Rex Tillerson expected to make an unscheduled stop in Doha on Thursday.

“The amount of support for terrorism by Saudi Arabia dwarfs what Qatar is doing,” Corker said on Wednesday.

Saudi Arabia, the United Arab Emirates (UAE), Bahrain and Egypt cut ties with Qatar on June 5 and imposed a land, air and sea blockade on the country.

The quartet accuse Qatar of funding “terrorism”, an accusation Qatar rejects as “baseless”.

Corker said he was “really disappointed to see what Saudi Arabia did after having a great summit and bringing everybody together”, referring to May’s Riyadh conference that saw leaders of the GCC and other Arab states meet US President Donald Trump.

“I think this is quite possibly a rookie mistake by a crown prince who I think could be the future for Saudi Arabia,” Corker added.

The Tennessee senator made the comments while addressing the former US ambassador to Israel during a legislative committee hearing.

Al Jazeera’s Heidi Zhou-Castro, reporting from Washington, DC, said the Saudi crown prince is “widely seen as among the blockade’s chief architects and a chief organiser of the alliance behind it”.

She said that Corker has been among the blockade’s strongest US critics, adding that the senator has threatened to block weapons sales to members of the GCC until there was a clear path for settling the dispute.

Andreas Krieg, an assistant professor at King’s College London, told Al Jazeera that Corker’s comments are a lot to take in for the Saudi-led group.

“Saudi Arabia actually thought they had the Trump administration, especially the Republicans, on their side,” Krieg said. “That’s why they escalated so quickly and now they realise they actually don’t and the Trump administration has actually rolled back from earlier comments, and that is quite something to swallow for the UAE and Saudi Arabia.”

Tillerson’s Gulf visit

Corker’s comments came as Tillerson wrapped up the third leg of his four-day trip to the Gulf aimed at helping solve the GCC crisis.

Having shuttled between Kuwait, Qatar and Saudi Arabia in an effort to help solve the GCC crisis, Tillerson is set to make an unexpected return to Doha on Thursday before returning to the United States.

On Wednesday, Tillerson met the Saudi king, crown prince and his counterparts from the Saudi-led quartet.

The Jeddah visit followed meetings in Doha with the Qatari emir and foreign minister on Tuesday.

Tillerson told reporters that the Qatari government had “reasonable” views during the crisis.

“I think Qatar has been quite clear in its positions, and I think those have been very reasonable,” he said.

Tillerson and the Qatari foreign minister also announced that the US and Qatar had signed an agreement on combating “terrorism” and its financing during the visit.

Foreign Minister Sheikh Mohammed bin Abdulrahman Al Thani said the memorandum of understanding was not related to the current dispute.

But Saudi Arabia, Egypt, Bahrain and the UAE called the agreement “insufficient” and the result of “repeated calls” from the Saudi-led group over the past few years.

Ravi Shastri to pitch for Arun despite Zaheer’s presence

July 13, 2017 by Nasheman

ravi shastri

New Delhi: Back at the helm as chief coach of the Indian cricket team, Ravi Shastri is likely to pitch for the return of bowling coach Bharath Arun despite the presence of Zaheer Khan in their ranks.

Shastri’s choice of bowling coach was always Arun and it is now apparent that Cricket Advisory Committee did not take Shastri into confidence while recommending Zaheer as the bowling coach although his role would be similar to that of Rahul Dravid — that of a consultant.

It has been learnt that Zaheer is unlikely to give around 250 days a year that a full-time bowling coach will be required to and may not be available for more than 100 days. It may also be mentioned that Zaheer’s salary package has not yet been inked as negotiations are still on.

Earlier, when Shastri was asked about his choice of bowling coach, he had said Arun but one particular member of CAC was against it. Shastri then apparently said that : “Give me Jason Gillespie then”. Gillespie is widely acknowledged as the best bowling coach in the cricketing fraternity.

The wily cricketer that he was, Shastri knew that BCCI can’t rope in someone like Gillespie, who is already contracted with Papua New Guinea. The BCCI has also kept Venkatesh Prasad’s name on stand by but it is unlikely Shastri will settle for anything less than Arun. Prasad however may not be liked by the Indian team as one complaint against him during his earlier tenure was turning quick bowlers into line and length medium fast bowlers.

According to reliable sources in the BCCI, Shastri is expected to meet the top officials and the Committee of Administrators (COA) during the weekend as he is expected to cut short his trip to United Kingdom. “Ravi has highest regards for Zaheer but he believes that a full-time bowling coach is required. Let Zak create a roadmap for bowlers and it will be Arun who will implement it.

Ravi is expected to speak to COA on Saturday and make it clear that he would like Arun to join the team from Sri Lanka tour itself,” a reliable BCCI source told PTI on conditions of anonymity. In case Shastri can get Arun on board, it will be a sweet revenge for him on his bete noire Sourav Ganguly, who had vehemently opposed his candidature. Arun had replaced Joe Dawes in 2014 and was there with the Indian team till 2016 when Shastri was dumped.

He didn’t have a distinguished playing career but has always been regarded as a great academy coach with a sound grip on the theories related to fast bowling. Arun and Shastri go back a long way having been buddies since their U-19 days back in early 80’s. It was on Shastri’s recommendation that erstwhile President N Srinivasan gave a go-ahead to Arun’s appointment with the senior team when he was the bowling consultant at the NCA.
