GST compliance: from complication to simplification

January 25, 2018 by Nasheman

by Ankit Agarwal, MD at Alankit

In the past couple of months, there has been enough discussion and debate around GST and its implementation. We have almost seen it all, whether it is talking about the viability of GST, its impact on economy, global comparison with various nations which have adopted the structure, experts from various sectors dissecting it, etc. The fact which is now a reality of the day leaves no option for the businesses and other sectors but to adopt and accept this reform in the Indian tax structure. And, in all fairness, this change is only going to lead to a larger national good in the long run.

If we talk about introduction of GST, like any other major transformation in the country- this fact will also take some time to settle in the minds of the people and for the businesses to change the way of doing businesses. The question remains that why is there such a furore and pother about something which has been scanned by various financial experts and has been implemented after thorough economic deliberation for larger good of the nation? Maybe it’s just the fear of unknown.

In India’s tax compliance structure, major challenge lies in the fact that India is not a DIY (Do it yourself) economy. Whenever there is anything related to direct/ indirect business taxation we prefer and reach out to our very own subject matter expert – ‘The CA friend’ to do it for us. Despite the availability of various tools and techniques which can actually help us ease the compliance, we ignore them being too complex for our understanding. Taxation is not the only subject.

There have been many roadblocks for GST compliance which have been highlighted such as technological dependence, complicated compliance tax structure, immense revisions in product changes within the tax slabs, changes in the deadlines etc. most often goes unnoticed is the psychological barrier in change adoption. Taking a step back to remember that when was the last time any economic reform was welcomed with open arms by all stakeholder groups in India? Talking about diversity, it is a well-known reality to everyone. It brings with itself plethora of divergent opinions, which are then laced by local/national political point of views and undercurrents, which together make a perfect cocktail of sentiments which have you vote-in or against a change.

Looking at the situation from a different perspective, we see GSTN is being chastened for many technology glitches, network failure, etc. while filing returns in the present tax structure. Not only GSTN, if we talking about searching for CBSE board results, booking a ticket in ‘tatkal quota’ on the IRCTC website, logging in to a flash sale at any e-commerce website portal, when has the network not broken down? Every form/technology comes with a specific capacity and whenever we overshoot that, it is bound to break down. Then, why are we only pointing out GSTN in this case? Instead, shouldn’t we question our laidback behavior for this break-down?

Procrastination is intrinsic to our nature, we always end up waiting for the last moment or the last minute to file tax returns and if given an option, we don’t even mind paying a little extra to get our jobs done of filing our tax returns post the date of compliance. If this same load is divided across different days of the month in even timeslots, half the problem would be resolved there itself. Therefore, It wouldn’t be wrong to say that GST compliance is a reality we cannot shy away from and hence, instead of creating much ado about nothing, let us all embrace the change and start acting in the direction of positivity together to bring the change in the economy.

by Al Jazeera

Police have arrested the main suspect involved in the rape and murder of a seven-year-old girl in the central Punjab province of Pakistan, a police official told Al Jazeera.

Zainab Ansari was found dead in a rubbish dump on January 9 in Kasur, several days after her disappearance.

An autopsy revealed she had been raped and strangled to death.

“The suspect lives in the same [area] where Zainab lived,” a police district official confirmed to Al Jazeera on Tuesday.

The suspect has confessed, the official said.

“He was arrested before, but was released as we did not have evidence. After that, he shaved his beard off so that no one could recognise him.”

The rape and murder of Zainab Ansari was the 12th such case in Kasur district in the last year, according to local media reports.

The incident led to angry protests in various parts of Kasur that resulted in at least two deaths and several injuries.

In 2015, Kasur was in the international headlines when hundreds of videos of child molestation surfaced, and police later arrested several members of a racket involved in selling child pornography to websites in Europe.

Most of the victims were under 14, including a six-year-old boy, according to officials.

The hashtag #JusticeForZainab has trended in Pakistan and elsewhere.

U19 World Cup: Sri Lanka crush Kenya by 311 runs

January 23, 2018 by Nasheman

Sri Lanka crushed Kenya by 311 runs in the Plate Quarter-Final 3 at the Under-19 World Cup here on Tuesday

Sri Lanka U-19s claimed the joint-second biggest win in the format ever as they progress to face Zimbabwe in the Plate semi-finals.

A brilliant batting performance from Sri Lanka saw them post 419/4 and recorded the highest U-19 ODI score in their history.

Hasitha Boyagoda (191), Nishan Madushka (60), Kamindu Mendis (53) scored handsomely to post a mammoth total.

In reply, Kenya were bundled out for 108.

Hareen Buddila scalped four wickets while Nipun Malinga chipped in with two wickets.

In the second match, West Indies defeated Ireland by four wickets.

Half-centuries from Yadram (53) Emmanuel Stewart (50 off 67), Nyeem Young (55 not out off 33) and a fine knock of 46 from Kristan Kallicharan helped West Indies beat Ireland.

After posting 278/8, thanks to a 116-run stand between Ireland captain Harry Tector and Neil Rock, a poor display in the field meant it was all in vain.

West Indies’ approach to the chase was typically belligerent and the batsmen outplayed the Ireland bowlers to chase down the total.

In another match, Australia edged past England by 31 runs.

Australia’s Lloyd Pope took 8/35 — the best figures in all ICC Under 19 Cricket World Cups — to skittle out England for 96, defending a 127-run total in the process.

Triple talaq bill a tactic to punish Muslim men: Asaduddin Owaisi

January 23, 2018 by Nasheman

Aurangabad: The triple talaq bill is a conspiracy against Muslims and a move to punish men from the community, AIMIM president Asaduddin Owaisi has alleged. A committee was constituted to look into the row over the film “Padmaavat” but no such step was taken on the triple talaq issue, said the Lok Sabha member from Hyderabad as he launched a scathing attack against the Centre.

“The triple talaq bill is a conspiracy against the Muslim community. It a tactic to bring out the women of the community on roads and send the men to prison,” the All India Majlis-e-Ittehadul Muslimeen (AIMIM) leader said at a public meeting last night.

At the same time, he asked the Muslim community to socially boycott those who take the instant triple talaq route to divorce. He said Rs 2,000 crore should be allocated for Muslim women in the budget. The Muslim Women (Protection of Rights on Marriage) Bill, 2017 was passed by the Lok Sabha in the recently concluded winter session, but could not be passed in the Rajya Sabha with the opposition demanding that it be sent to a Select Committee for a detailed scrutiny.

According to the draft law, instant triple talaq will attract a jail term of three years for the husband. Owaisi claimed that Prime Minister Narendra Modi was doing nothing for the nation but was always ahead to take credit for the good work done by others.

“The BJP wants a Muslim-free India and this would not happen,” he said and urged the people from his community and the Dalits to wake up and raise their voice against injustice. Owaisi alleged that the Union government was trying to forcefully implement the ideology of V D Savarkar.

“The ideology of M S Golwalkar, K B Hedgewar and Sawarkar was Hinduism and we are not going to accept it,” he added. He also sought to know why Sambhaji Bhide of the Shiv Pratishthan Hindustan and Milind Ekbote of the Hindu Ekta Aghadi were not arrested in connection with the violence on January 1 during an event to commemorate the bicentenary of the Koregaon Bhima battle in Pune.

SC says NIA can’t probe marital status of Hadiya, hearing to continue on Feb 22

January 23, 2018 by Nasheman

New Delhi: The Supreme Court Tuesday said the NIA could continue with its probe into the alleged love jihad case involving Hadiya and Shafin Jahan but it cannot investigate the marital status of the man and the woman.

A bench headed by Chief Justice Dipak Misra observed this after the NIA told the court that it had made substantial progress in the investigation which was conducted after the apex court’s direction.

“We are not concerned with it (probe). Whether you carry on your investigation or arrest someone, we are not concerned,” the bench also comprising Justices A M Khanwilkar and D Y Chandrachud said.

“You can investigate it but you cannot investigate about their marital status,” the bench said.

The top court also said that Hadiya had appeared before it and had specifically said she had married Shafin Jahan on her own.

The bench also observed that it would examine whether the Kerala High Court was correct in annulling the marriage while hearing a Habeas Corpus petition.

“We are only concerned with the choice of an adult to marry someone,” the bench said and posted the matter for hearing on February 22.

On November 27, last year, the apex court freed Hadiya from her parents’ custody and sent her to college to pursue her studies, even as she pleaded to be allowed to go with her husband.

The court took the decision after interacting with the 25-year-old woman, a Hindu by birth who had converted to Islam and married Jahan months later.

The court was hearing a plea filed by Jahan challenging the Kerala High Court’s order annulling his marriage with Hadiya.

While Hadiya’s parents have been alleging that her marriage was a case of love jihad and that she was converted to Islam forcibly, Hadiya has refuted these claims so far.

Rape victim writes in her blood to Modi, UP CM for justice

January 23, 2018 by Nasheman

Raebareli: Desperate to get justice for the wrongs done on her, a rape victim has reportedly written a letter in her blood to Prime Minister Narendra Modi and Uttar Pradesh Chief Minister Adityanath, demanding action against those responsible for her state.

“The police is not taking action against the accused due to their powerful links. They (accused) are putting pressure on me to withdraw the case. I should be given justice otherwise I will commit suicide,” the girl said in the letter written on January 20.

When contacted, ASP Shashi Shekhar Singh, said an FIR was registered on March 24, 2017, against Divya Pandey and Ankit Verma on rape charges in Barabanki, following a complaint by the victim’s father.

The father alleged that the accused raped his daughter, an engineering student, and were blackmailing her since. In October, 2017, another FIR against unidentified persons was registered in Raebareli in which it was alleged that a fake Facebook profile of the girl was made and obscene pictures were posted on it.

A probe is on in the matter, Singh said.

On being asked about the victim’s letter, the ASP said he did not have any information about it.
