Post-mortem Report Says No Sexual Assault in Ryan Case

September 12, 2017 by Nasheman

New Delhi: The post-mortem report of the Class II student who was found murdered at the Ryan International School said that the victim was not subjected to sexual assault by the accused.

As per a News18 report, the report, however, confirmed that one of the nerves of the student was cut by a knife during the attack due to which the kid couldn’t shout.

Meanwhile, the 7-year-old victim’s father further reiterated his claim of a bigger conspiracy behind the murder and accused the school administration of shielding the culprits.

Earlier today, two students of Gurugram’s Ryan International School claimed to witness the accused conductor ‘masturbating’ inside the toilet, where the student was found dead with throats and ears slit.

Two students, including one from Class II-B, told the police in their statement that they saw Kumar inside the toilet just seconds before the homicide. They later identified him as well. The two had gone in to change their Karate uniform, reported DNA.

Meanwhile, hundreds of parents staged vociferous protests outside the Ryan International School branch in Sanpada, Navi Mumbai, demanding measures for safety and security of their children, on Tuesday morning.

On Monday, two top officials of the Ryan International School were arrested and the acting principal detained for questioning following the gruesome murder of a seven-year-old student on campus, even as the victim’s father moved the Supreme Court seeking a CBI probe.

The police claimed that evidence from the scene of the crime had been tampered with and said they would bring the guilty to book.

Ryan International Group CEO Ryan Pinto and his parents, who are its founders, approached the Bombay High Court today to seek anticipatory bail in connection with the child’s murder in the chain’s Gurgaon school.

SHO of Sadar Police Station on Sohna Road in Gurgaon was meanwhile suspended over a baton-charge on protesting parents, as well as journalists, outside the school premises.

Court summons Amit Shah in 2002 riot case to defend convict

Ahmedabad: A special trial court here on Tuesday directed BJP President Amit Shah to appear as a witness for Maya Kodnani, a former BJP leader and minister in the then Narendra Modi government in Gujarat in a 2002 riot case in the city where 11 Muslims were killed.

Kodnani is a convict in the biggest massacre on February 28, 2002, when nearly 100 Muslims were massacred in Naroda Patiya, close to Naroda Gam, in Ahmedabad. She was convicted and sentenced to life imprisonment in 2012 but is out on bail since 2014.

The special court asked the Bharatiya Janata Party (BJP) chief to appear before it on Monday, either in person or through his lawyer to testify on the alibi of Kodnani that she was not present at the place of the riots.

“The court has issued summons for September 18. The order was passed following a request of Maya Kodnani,” Amit Patel, lawyer of Kodnani, said, pointing out that she was not able to find Shah to issue him the summons.

Kodnani had moved an application before the court in April seeking testimony from the BJP President, who hails from Ahmedabad, as one of her defense witnesses.

She had claimed that his testimony was crucial to prove her claim that when the riots took place, she was with him, about 10 km away from the spot of the crime, first at the Gujarat Assembly and then at the hospital she ran.

After several adjournments, the court had on Monday last granted final deadline to Kodnani to bring Amit Shah to depose before the court on Friday.

The former BJP minister again sought 10 more days stating that she was unable to determine the address where she could serve summons to Amit Shah. However, the court had given time till Tuesday stating that after this, examinations of the defence witnesses would be closed.

The court on Tuesday intervened to issue direct summons to Amit Shah to appear before it.

HC dismisses plea against AIADMK general council meet

September 11, 2017 by Nasheman

Chennai: The Madras High Court today dismissed a petition seeking to stay the general council and executive committee meeting called by Chief Minister Palaniswami-led faction of the AIADMK tomorrow.

Justice C V Karthikeyan dismissed the plea filed by P Vetrivel, MLA, a supporter of sidelined AIADMK leader T T V Dhinakaran, and imposed a cost of Rs one lakh on him for “wasting the time of the court”.

The judge pointed out that being an MLA, the petitioner should have taken note of a circular issued by the High Court earlier, which stated that MPs and MLAs should first get the nod of the Chief Justice for filing petitions.

Without getting the nod, Vetrivel has filed the petition, the judge said.

The judge observed that if the petitioner was aggrieved by the call for the meeting, “he may go to the meeting venue and have lunch or ignored it by not attending and sit at home.

He may not have filed the vexatious petition”.

When Vetrivel’s counsel made a request to grant liberty to the petitioner to approach the Election Commission against the general council meet, the judge observed that no one could prevent any person from approaching an appropriate forum to vent grievances.

SIM cards not linked to Aadhaar to be deactivated after Feb next year

September 11, 2017 by Nasheman

New Delhi: The government is moving ahead with linking Aadhaar with mobile SIM cards and all unlinked phones will be deactivated after February 2018, said informed sources.

The sources said Aadhaar mobile linkage is being done as per the orders of Supreme Court passed in February this year in Lokniti foundation case and all SIM cards have to be verified with Aadhaar within a year from the date of judgement, with all unlinked phones to be deactivated after February next year, so criminals, fraudsters and terrorists cannot use the issued SIMs.

The sources said that biometrics cannot be stored by the mobile operators nor they have access to any of the other personal data.

They said biometrics collected should be encrypted by telecom company and sent to UIDAI at that moment itself and any storage of biometric by a service provider is a criminal offence punishable with up to three years of imprisonment under the Aadhaar Act 2016.

The Central government had told the Supreme Court in February that it would put in place, within a year, an effective mechanism for the verification of pre-paid mobile users who constitute 90 per cent of the total subscribers.

Asking the government to put in place the mechanism for the verification of existing pre-paid mobile connection holders “as early as possible”, the court disposed of the petition by Lokniti Foundation seeking the scrutiny of the subscribers so that those having pre-paid mobile connections on fake identities are weeded out.
