Dec 16 gangrape: Delhi HC refuses to stop juvenile’s release

New Delhi: Decks were cleared for the release on Sunday of the juvenile convict in the horrific December 16, 2012 gangrape case with the Delhi High Court today refusing to intervene, saying he cannot be stopped from walking free under the existing provisions of law.

The convict, now 20-year-old, is expected to walk out of the reformation home on December 20, at the end of his three- year jail term unless there is a stay from the Supreme Court.

Brushing aside the public outcry against his release, a high court bench of Chief Justice G Rohini and Justice Jayant Nath directed the Juvenile Justice Board to interact with the convict, his parents and concerned officials of Department of Women and Child Development regarding his “rehabilitation and social mainstreaming”.

The bench said BJP leader Subramanian Swamy’s plea seeking stay on the release of juvenile convict cannot be allowed as the statutory and existing law was coming in its way.

“Having regard to the fact that the maximum stay that can be directed in the Special Home under Section 15(1) of the Juvenile Justice Act is three years and that the convict would be completing the period of three years by December 20, 2015, there cannot be any direction to continue his stay in the special home beyond December 20. Hence, we decline to issue any direction as prayed by the petitioner,” the bench said while allowing the convict to walk free.

Six persons, including the juvenile, had brutally assaulted and raped a 23-year-old girl in a moving bus in south Delhi on December 16, 2012. The victim had died in a Singapore hospital on December 29, 2012.

Mukesh, Vinay, Pawan and Akshay were awarded death penalty by trial court in the gang rape and murder case which was later confirmed by Delhi High Court. Their appeals are pending before the Supreme Court.

Accused Ram Singh had allegedly committed suicide in Tihar Jail on March 11, 2013, and proceedings against him were abated following his death.

Karnataka outplay Kerala by 9 wickets in Vijay Hazare

Bengaluru: Karnataka leg-spinner Shreyas Gopal bagged a five-wicket haul to help the defending champions pack Kerala for 49 runs and register a nine-wicket win in their Group B Vijay Hazare cricket match, here today.

Electing to bat at the M Chinnaswamy Stadium, the Kerala batting line-up fell like a pack of cards in 22 overs against a disciplined Karnataka bowling attack.

Pace spearhead and captain R Vinay Kumar started the opposition fall by bagging a couple of wickets as left-arm bowler Sreenath Aravind also picked two scalps.

But Gopal soon took over to rattle the middle and the lower-order in no time.

Opener Nikhilesh Surendran (11) and skipper Sachin Baby (12) were the only two batsmen to get into double figures as the innings saw four ducks in all.

Coming into bat, Karnataka top-order wasted little time in chasing down the score in 5.5 overs. Mayank Agarwal (5) was out early, but Lokesh Rahul (19) and Karun Nair (24) made sure that there were no hiccups in the remaining chase.

Karnataka have registered three wins in five matches.

American filmmaker, political and social activist Michael Moore has sent Republican presidential candidate Donald Trump a letter chastising him on his recent anti-Muslim statements and his call to “ban all Muslims from coming to the United States”.

In his letter, which he posted on his Facebook page on Wednesday night, Moore said Trump’s anti-Muslim statements “were made in depression and insanity”.

Moore also published a picture of himself in front of Trump Tower in New York with the caption “We are all Muslim”.

During his campaign stops, Trump called for a “total and complete” block on all Muslims entering the US and an end to Muslim immigration to the country.

Trump is the current frontrunner among the Republican candidates seeking the party nomination for the presidency of the United States.

In the letter, Moore reminded Trump that the US today is no longer a country of “angry white guys”, that the future US president will be chosen by more diverse voters and that “fortunately” the US no longer looks like Trump or his supporters.

Addressing Trump, Moore said: “Here’s a statistic that is going to make your hair spin: 81 percent of the electorate who will pick the president next year are either female, people of colour, or young people between the ages of 18 and 35 … In other words, not you” or “the people who want you leading their country”.

Moore went on to say that he was raised to believe in equality of people as brothers and sisters, regardless of race, colour and religion.

He added that “we are all Muslim, just as we are all Mexican, we are all Catholic and Jewish and white and black and every shade in between.”

Moore, born in Michigan in 1954, is known for his documentary films that criticised US gun laws, globalisation, the Iraq war and the US healthcare system.

He has been awarded several awards for his work, including an Academy Award for “Bowling for Columbine”, the 2002 film that examined the Columbine high school massacre in Colorado.

‘CID found similarities in killing of three rationalists’

Bengaluru: “The Criminal Investigation Department (CID) of Karnataka, which has been probing the murder of Kannada writer Kalburgi, has found evidence of a common link in the killing of the three rationalists. Prima facie , we have found similarities,” said State Home Minister G Parameshwara on Wednesday.

Denying reports about the investigation by the CID being slow, Parameshwara said, “The CID is seriously conducting the probe and it has grilled suspected persons in this regard. We are expecting to arrest the culprits involved in the killing of Kalburgi.” he said.

The sources said that all the three rationalists were murdered by professional killers.

The CID teams that travelled to Kolhapur and Pune, hometowns of Dabholkar and Pansare, have been investigating whether the killing of Kalburgi is linked to the other two murders.

Earlier in the Parliament, Union Minister of State for Home Kiren Rijiju had told that as per available information, there is no report to suggest any link/connection between the murders of Pansare, Dabholkar and Kalburgi.

Rationalist MM Kalburgi was shot dead on the morning of August 30, 2015. In August 2013, Dabholkar, an anti-superstition activist, was shot dead in Pune. In February this year, social activist and veteran CPI leader Govind Pansare — who was leading a campaign against toll, among other issues — was shot dead in similar circumstances in Kolhapur.

In all the three cases, there were two men who struck in the morning, and used a bike to get away.

AAP calls Jaitley corrupt, asks Modi to sack him

New Delhi: Keeping up the attack on Finance Minister Arun Jaitley, AAP today alleged huge financial bunglings in DDCA during his 13 year-old tenure as its chief, saying large amounts were siphoned off through fake companies besides other irregularies including in team selection.

At a press conference here, the AAP leaders, quoting from reports of Serious Fraud Investigation Office (SFIO), DDCA’s internal probe committee and a Delhi Government-appointed inquiry panel, accused Jaitley of giving “direct and indirect” consent to “massive corruption” in the cricket body.

Jaitley had yesterday rubbished the allegations and said he will not respond to vague charges. “The bunglings had happened under direct or indirect consent of Arun Jaitley during his tenure as DDCA chief. Prime Minister Narendra Modi must ask Jaitley to resign to ensure fair probe as some of the competent agencies to invstigate the are under Finance Ministry,” said AAP Spokesperson Raghav Chadha, flanked by a number of other leaders.

Citing instances of such “frauds”, he alleged an additional expenditure of Rs 90 crore was incurred in renovation of the Feroz Shah Kotla stadium against sanctioned budget of Rs 24 crore and that fake companies were set up by DDCA office bearers to siphon off money through roundtripping.

“Payments were made to five companies whose registered addresses were same and were headed by same director. There was duplication of funds and fictitious companies were paid for work they never did,” alleged Chadha. Calling the irregularities a “Commonwealth Scam of Cricket”, they said BJP MP and former cricketer Kirti Azad had been seeking investigation into the serious allegations and a number of inquiry commitees have found gross misappropriation of funds in DDCA.

The AAP leaders repeated their allegations that Jaitley was behind the CBI raid at Delhi Secretariat on Monday as well as “take over” of Delhi ACB from Delhi Government by the Centre to scuttle probe into DDCA affairs.

“The DDCA was a den of corruption under Jaitley,” said Chadha. Asked why they have come out with the reports of SFIO and DDCA’s internal committee which were already in public domain, AAP leader Sanjay Singh said the Delhi government was committed to investigate the irregularities unlike past dispensations which “sat over them”.

“The CBI had come looking for few incriminating documents that are not yet in public domain. The raids were carried out in an attempt to intimidate the Delhi Government,” he alleged.

AAP said the statutory auditor of DDCA has been facing prosecution for fudging accounts and that a statement to this effect was made by MoS in Finance Ministry Jayant Sinha in Parliament.

To Jaitley’s comment that he would only respond to specific charges, Singh said now the Finance Minister should not only answer to the allegations but also should resign from the post. “Jaitley is not only answerable to us. But he is answerable to his own party members.”

The AAP leaders said acting on a communication dated July 27 from Union Sports Ministry, the Delhi government initiated a probe into irregularities in DDCA.

“A three-member committee was formed for the purpose headed by senior IAS officer Chetan Sanghi. The committee on November 17 gave a report to the Chief Minister highlighting glaring irregularities in DDCA and recommended setting up of a Commission of Enquiry to thoroughly probe the matter,” said Chadha.

Ashutosh claimed that Sanghi was threatened of dire consequences by a joint secretary in the Ministry of Home Affairs. The party said 22 days after Sanghi filed the report, on December 9, the ACB registered a case of corruption against him in connection with some of his decisions during the Sheila Dikshit Government.

The AAP leaders quoted a DDCA internal fact-finding committee report which they said “the magnitude and extent of improprieties, irregularities and misconduct committed by various officials were of gigantic proportions”.

They alleged that 10 newly constructed corporate boxes at Feroz Shah Kotla were given out on lease to companies without following laid down rules during Jaitley’ tenure.

“There were instances of proxy litigations to mint money. Lawyers who used to appear against DDCA were paid by the cricket body itself,” said Chadha.

They alleged that Jaitley had turned DDCA into “an exclusive club of elites and had institutionalised corruption. Only wards of political leaders and the rich can hope to play for Delhi due to nepotism.”

AAP said forged age cerificates were used to fudge to let certain players get selected despite exceeding age limit and quoted FIR into large number of such cases which the Delhi Police did not pursue.

“Selection of selectors and players for across age groups were as per Jaitley’s choice,” said Singh adding the party will come out with “part two of the revealation soon”. Kumar Vishwas said the party had “overheard” that there was a big agenda against it lined up for Friday.

Film Federation Of India Makes An Ardent Appeal

The Film Federation of India (FFI) has ardently appealed to all the members of the film fraternity to pledge one day’s theatrical collections from all across the country for the relief work in Chennai. In a note sent to all the association bodies and its members, FFI president J P Chowksey said that the amount can be deposited in the Prime Minister’s Relief Fund. In Chennai, he said several actors had helped people on the streets and some cinema houses opened their doors for the homeless or those seeking shelter. He added that the film industry has always come forward to offer help whenever there has been any calamity of this nature in the country.

Government Level Film Festival On Disability Ends

A total of 40 films including features, shorts & documentaries were screened at the very 1st Government run International Film Festival for Persons with Disabilities (IFFPD) which ended recently with the presentation of awards by Social Justice & Empowerment Mnister Thaawar Chand Gehlot. Minister of State in the Ministry Vijay Sampla & Minister of State for Information & Broadcasting Col. Rajyawardhan Rathore were also present. Speaking on the occasion. Vivek Oberoi said that it was heartening to see that the disabled were being brought into the mainstream in an inclusive society. Gehlot said 500 entries had been received for the film festival which in itself was a big feat. In the years to come, the festival may be expanded to achieve more success and achieve its objective of creating greater awareness about the problems of the disabled. During the opening day, he had said the Government was taking several initiatives for empowering people with disabilities and one such initiative was the Accessible India Campaign launched by Prime Minister Narendra Modi recently, which marks the International day of Persons with Disabilities. This Campaign intends to create a disabled friendly public infrastructure in 50 most important cities to bring the people with disabilities into the mainstream.

Bombay High Court Acquits Salman Khan Of All Charges

It’s been more than 13 years since the case of Salman Khan being accused of killing people on the streets has been in court expecting a verdict. The latest update on the case is that, recently, the Bombay High Court has acquitted Salman Khan of all the criminal charges. It was Justice A. R. Joshi, who, while pronouncing the justice, said that the prosecution has failed to prove charges against Khan on all counts. As per the media reports, he asserted that the court has come to the conclusion that the prosecution has failed to bring material on record to establish beyond reasonable doubt that the appellant (Salman Khan) was driving and under the influence of alcohol, also, whether the accident occurred due to bursting (of tyre) prior to the incident or tyre burst after the incident.Needless to say that Salman Khan, who was present in the court during the verdict, along with his sister Alvira Khan – Sharma and her husband Aayush Sharma, got emotional, after the verdict was delivered. He, then, was seen reciting the ‘kalma’ with tears of joy & relief rolling down from his eyes. Speaking about the verdict, Salman’s lawyer Amit Desai mentioned that he did not take that as a personal victory and that his entire team had worked hard on this for 6 months now.

Mani Ratnam Conducts IFTDA Master Class

Padmashri Mani Ratnam, the director known for cult films like ‘Nayagan’, ‘Anjali’, ‘Bombay’, ‘Roja’, ‘Dil Se’, ‘OK Kanmani’ et al and the winner of 6 National awards & 10 Filmfare Awards will have his 1st ever IFTDA Master Class in Mumbai. The initiative was taken by the director’s fraternity of Indian Film & Television Directors’ Association (IFTDA) and the event took place on 16th Nov, 2015 at 3:30 pm at ISKCON, Juhu. The IFTDA ‘Meet The Director’ Master Class session aimed to bring together 2 masters, one who shared his expertise and another who moderated the session. The Mani Ratnam session was moderated by renowned filmmaker Sudhir Mishra. The session was held for a duration of 2 hours and it also comprised of a Q & A session with the audiences. These master class was attended by students, assistant directors, aspirants & general public for free of cost. Sridevi Takes Legal Action

The magnum opus ‘Puli’ starring Vijay & Sridevi though had buzz but failed to live upto expectations. And now, the veteran actress is miffed with the makers for not clearing her remuneration for the film. Sridevi is yet to receive Rs. 50 lakhs of her fee which was supposed to be given after the release of the film. However, since the actress hasn’t received the amount as yet she decided to go the legal way and has apparently filed a complaint at the producers’ council in Mumbai. Though the actress hasn’t divulged any details as yet, one of the producers of the film Shibu Thameens recently posted a tweet referring to the issue, saying, “Will clarify Sridevi mam’s complaint, postpone my surgery and joining my partner pts in Chennai”.

50 Cr Copyright Infringement Case Filed

The makers of ‘Bajrangi Bhaijaan’ which created waves at the box office are facing a Rs. 50 crore copyright infringement law suit that claims the entire plot line & even some locales were blatantly inspired from another script. The suit filed in the Bombay High Court by director & TV producer Mahim Joshi, alleges the infringement is `career damaging’, si1950y. As per Joshi’s claims, the story of ‘Bajrangi Bhaijaan’ is grounds for a 100% infringement along with prominent similarities in the screenplay & locales. Along with his petition to the High Court, Joshi has also furbished documents that include detailed comparisons of the film’s scenes and the sequences shot by Joshi. Following this, in its hearing held recently, the High Court bench presided by Justice Gautam Patel, has directed all parties including producers Rockline Venkatesh, Rajessh Bhatt and Salman Khan, a co – producer, writer KV Vijayendra Prasad & director Kabir Khan, to maintain accounts of business with respect to the movie. It also directed all respondents to file their replies by 21st Oct, 2015.

Censor Board Refuses To Give Reasons

40 days after the censor board declared to the media that they have refused to give a censor certificate to Kamal Swaroop’s documentary ‘Battle For Banaras’, the censor board is yet to officially communicate to the producer the reason for the rejection of the film. The documentary was officially invited to play at the 17th Jio Mami Mumbai Film Festival but the invitation was withdrawn in the absence of clarity on the censor certificate. “This lack of clarity & communication from the censor board is irresponsible,” says Manu Kumaran,the producer of the film. The film was screened for the censor board on 27th August. Inspired by Nobel laureate Elias Canetti’s book, “Crowds And Power”, the documentary, ‘Battle For Banaras’ captures the excitement, the madness & the noise behind the high octane poll battle in the holy city of Banaras, Produced by Manu Kumaran & Mediente International Films, the documentary was shot in 4K, over a 44 day schedule in Banaras during the 2014 Lok Sabha elections.

‘Court’ To Compete With Films From 80 Countries At The Oscars

India’s official entry to the Oscars, ‘Court’, will be competing with films from 80 countries in the Foreign Language Film category for the 88th Academy Awards. The Oscars have this year received film entries from 81 countries in this category including Paraguay, which is a 1st time entrant. The Marathi language film ‘Court’ is directed by Chaitanya Tamhane. Eros International Media’s Proposal Approved

The Government has cleared Eros International Media’s proposal of setting up a Limited Liability Partnership (LLP). The approval followed recommendation of the Foreign Investments Promotion Board (FIBP) and will involve a foreign direct investment (FDI) of Rs 49.90 lakh. The Government cleared as many as 11 FDI proposals worth Rs 1,567.91 crore, including that of Eros International Media. Additionally, approval was also granted to Amar Ujala Publications Limited for foreign shareholding in the company up to 26% of the post issue paid up equity share capital pursuant to proposed initial public offering, issue of equity shares to FIIs / FPIs / NRIs and transfer of 26,90,234 shares by existing shareholders for an aggregate consideration of Rs 50 crore.

‘Kadambari’ Bags Top Award

Bengali film ‘Kadambari’ by Suman Ghosh about Kadambari Devi, sister – in – law of Rabindranath Tagore with whom he is supposed to have had a close personal relationship and who eventually committed suicide, won the Best Film award at the 4th Washington South Asian Film Festival.

Chaitanya Tamhane won the “Best Director” award for ‘Court’, a Hindi and Marathi film, which is India’s official entry for the Academy Awards. Aparna Sen received the “Special Achievement Award”, while Huma Beg from Pakistan got the “Special Appreciation Award Documentary”. ‘Sarmad Khoosat’ received the Special Award for Contribution to Pakistan TV & Films. The Festival of independent alternate cinema on the theme of “Art and culture transcend boundaries” had 14 features, 10 shorts & 1 documentary from India, Pakistan, United States & Canada.

Vir & Soha’s Film ’31 October’ In Censor Trouble

Soha Ali Khan & Vir Das’ next release ’31 October’ is in Censor trouble. The film was recently submitted to the Board for certification. However, they have raised objections on certain scenes.”The makers are considering the changes that have been suggested but since these are integral to the film’s narrative, they are trying to figure out how to go about it. They can’t afford to lose the core essence of the film by incorporating any random cuts. All of this would mean that the film may not really make it for its 30th Oct, 2015 release.

Censor Board Allows Producers To Modify ‘A’ films to ‘UA’ for television

In a significant move to end the deadlock between the producers and the censor board over the conversion of Adults films to ‘UA’ to make them suitable for television viewing, the Central Board Of Film Certification (CBFC) has decided to let producers voluntarily cut their films and submit them for censor certification. Explaining the important decision to allow filmmakers the liberty to decide on how to cut their films for re -certification the CBFC chairperson Pahlaj Nihalani says, “As we all know, all Adult films have to be re -certified before telecast. However producers complained about a delay in the re -certification process as the CBFC often found the material unpalatable for family viewing on the home medium. Now we’ll allow producers to make the cuts that would make their ‘A’ films eligible for a ‘UA’ certificate and bring their films to us.” This is not to say that the films would become automatically eligible when submitted.

R. S. Infotainment had released the 1st look poster of Jiiva & Bobby Simha starrer Kavalai Vendam in Jun, 2015 itself, but the project got delayed due to the sudden walking out of the heroine Keerthi Suresh.

Now Kajal Agarwal has been roped in for the lead heroine role and the shooting of Kavalai Vendam is all set to resume from Pongal 2016. The film is directed by Deekay of Yamirukka Bayamey fame and has Jiiva, Bobby Simha, Kajal Agarwal, Nikki Galrani, Mayliswamy and Karunakaran in the cast. The story is said to be based on modern marriages and according to the team will be a laugh riot on the lines of the timeless classic Kadhalikka Neramillai.

Nannaku Prematho Audio Release Date Fixed

The audio release of Young Tiger NTR’s upcoming movie Nannaku Prematho is going to be held on 25th Dec, 2015. This is NTR’s 25th film in his career. The Sukumar directorial is tipped to be a revenge drama and features Rajendra Prasad & Jagapathi Babu in pivotal roles.

Currently, the shooting of the film is progressing at rapid pace in Spain. Except for some portions of the talkie and an item number, the entire shooting would be wrapped up in this schedule. The unit is expected to return to Hyderabad on 20th Dec, 2015. BVSN Prasad is producing the film and is planning to release it on 13th Jan, 2016 for Pongal.

Bellamkonda 1s Now Speedunnodu

Bellamkonda Srinivas, who made an impressive debut with Alludu Seenu, has signed another project with Bheemaneni Srinivasa Rao. The film, a remake of Tamil hit Sundarapandian is nearing completion. Produced by Bheemaneni Sunitha, the film features Sonarika Bhadoria of Jadoogadu fame as the leading lady.

The makers have finally finalised Speedunnodu as the film’s title. Starring Sasi Kumar & Lakshmi Menon, the Tamil version has become one of the biggest hits of the year and grabbed the attention of filmmakers from other languages. Bheemaneni has acquired the rights and is producing this film under his banner Good Will Cinema. The film is likely to hit the screens for Pongal.

The Syrian National Coalition (SNC) said the opposition would not agree to a ceasefire unless Bashar al-Assad signs an agreement to step down as president of Syria.

The comments came on Wednesday as the United States and Russia prepared for the next Syrian peace talks in New York on Friday.

“If they [US and Russia] want to fight terrorism as they say, why not get rid of the main problem, the government that is targeting civilians in Syria everyday?” SNC Vice President Naghm al-Ghadri told Al Jazeera on Wednesday.

“The US and Russia have always disagreed on the fate of Bashar al-Assad, but agreed on countering [the Islamic State of Iraq and the Levant], which is ironic because instead of getting rid of the root of all problems, they want to tackle an off-shoot that resulted because of the government itself.

“It is our basic right to choose what we want for our country. We are not be waiting for anyone to tell us the fate of a Syrian leader lies with the Syrian people. We were born with this right.

“Yes they will meet abroad and negotiate on behalf of Syria’s future, but at the end of the day the whole world knows that if the Syrian people do not agree on any given political solution, they will not apply it.

“All those people who were killed and the millions of refugees living in tents for the past five years did not go through all this so one day the international community can make up their minds regarding Syria. We will decide our own fate, regardless of all the talks and meetings held by them.”

US Secretary of State John Kerry met with Russian President Vladimir Putin and Foreign Minister Sergey Lavrov in Moscow on Tuesday and agreed to hold the peace process on Syria in New York on Friday.

“We will meet this Friday on the 18th in New York with the International Syria Support Group, and then for the purposes of affirming under the UN auspices what we are doing within that group, and if promoted, that we would pass a UN resolution regarding the Vienna communiques and the next steps with respect to negotiations and hopefully a ceasefire,” Kerry told a press conference on Tuesday.

The SNC vice president said that the opposition coalition was not officially invited to the New York talks, but they expressed their views and opinions about the meeting through ambassadors of countries they consider as friends of Syria.

“We know if we were asked to attend the talks in New York, which are going to be a follow up to Vienna 1 and 2, the Syrian government would want to attend too. We refuse to negotiate with the government at this point,” Ghadri said.

Riyadh Talks

The opposition met in Riyadh last week and agreed on a transitional government in the country that does not include Assad.

The coalition, headed by Khaled Khoja, aims to replace Syria’s current leadership with a transitional government after achieving international recognition.

“Many factions signed the agreement in Riyadh which highlights and stresses on the importance of Assad leaving. If some day we were left with no choice but to sit at the same table as the government, we will, but nothing the Syrian people do not want will be applied in our country.

“As we speak there are Russian jets targeting two areas in Latakia suburbs, where there is absolutely no presence for ISIL or al-Nusra Front, why? Because it is now clear, the intention is to target the Syrian rebels and not ISIL or al-Nusra. They mock us by saying they are targeting ISIL,” Ghadri said.

Kerry and Putin agreed to continue what they called a final stage on listing terrorist organisations and on providing assistance to the UN in forming the opposition delegation that should be representative and that should be ready for negotiations with the Syrian government.

CBI accessed documents not related with probe: Kejriwal

New Delhi: Delhi Chief Minister Arvind Kejriwal on Wednesday said that the CBI seized documents that had “no relation” to the allegations being probed against Principal Secretary Rajendra Kumar.

“Docs seized from my office. No relation to allegations being probed. CBI kept reading DDCA file in my office. They wud hv seized it. But after my media briefing, they left it. Not clear if they took a copy,” Kejriwal said in a series of tweets on Wednesday.

He also attacked Finance Minister Arun Jaitley, asking why he was scared of a probe into the alleged irregularities at the Delhi and District Cricket Association (DDCA).

“FM lied in the Parliament yesterday…. Why is Jaitley ji so scared of DDCA probe? What is his role in DDCA scam?,” he tweeted.

The CBI had searched the office of Principal Secretary Rajendra Kumar in connection with a corruption case where the officer allegedly abused his position to award contracts to a particular firm.
