Netaji files to be declassified from January 23: Modi

New Delhi: Prime Minister Narendra Modi on Wednesday announced that the government will start de-classifying files related to Netaji Subhas Chandra Bose from January 23 – his birth anniversary.

Modi said this in a series of tweets after meeting members of Bose’s extended family at his residence here.

The prime minister said the government would also request foreign governments to declassify their files on Bose, whose reported death in a plane crash in 1945 in Formosa, now Taiwan, is widely disputed.

Modi said he will begin the process involving other countries with Russia in December when he visits Moscow.

Bose, a leading light of India’s freedom movement who at one time was elected the Congress president, was said to be fleeing to Russia when his plane reportedly crashed and caught fire.

This version has been challenged for decades by innumerable Bose fans who have held varying versions of what happened to him after 1945.

Bose’s family members met Modi in the light of the West Bengal government’s declassification of official files related to the last days of Bose, who set up the Indian National Army (INA).

“It was a privilege to welcome family members of Subhas Babu to 7RCR. We had a remarkable and extensive interaction,” Modi said.

“I told Subhas Babu’s family members – please consider me a part of your family. They shared their valuable suggestions with me,” he added.

Modi said: “There is no need to strangle history. Nations that forget their history lack the power to create it.”

The prime minister had announced in September that he would meet over 50 members of Bose’s extended family living in India and abroad.

Bihar electoral battle enters second phase

Patna: The battle for Bihar enters into its second phase tomorrow with voters set to decide the fate of 456 candidates in 32 constituencies spread over six Naxal-hit districts, posing a big challenge to security forces.

The districts are Kaimur, Rohtas, Arwal, Jehanabad, Aurangabad and Gaya.
After the completion of the first phase of polling in 49 seats, the second phase saw NDA sharpening attack on the grand secular alliance in the backdrop of a sting video that purportedly showed a minister accepting Rs 4 lakh bribe.

Prime Minister Narendra Modi grabbed the ‘windfall’ with both hands and flagged it at his rallies in Jehanabad and Bhubua on October 12, a day after the damning video showed up on the 113th birth anniversary of socialist icon Jayaprakash Narayan.

The second phase polling constitutes a great challenge for the security personnel as the six districts are heavily affected by Naxalism. In view of the security concerns, voting time has been curtailed by one hour and two hours in as many as 23 Constituencies.

Additional Chief Electoral Officer R Lakshamanan said that while voting would start at 7 AM in all 32 constituencies it would end at 3 PM in 11 constituencies and at 4 PM at 12 others. Only 9 seats would have scheduled voting from 7 AM to 5 PM.

A total of 86,13,870 electors are expected to decide the fate of 456 candidates, 32 out of whom are women. There are 9,119 polling stations.

A total of 993 companies of Central Para Military forces and state police would be deployed on the day to ensure peaceful voting.

As many as 334 companies would be in service in Gaya, 201 in Rohtas and 193 in Aurangabad.

While contest on all the seats is intense, the battle at Imamganj (reserved SC seat) would be keenly watched where former chief minister Jitan Ram Manjhi of HAM is locked in a straight contest with the Speaker of the outgoing assembly Uday Narain Chaudhary of JD(U). Chaudhary is a five-term MLA from the seat.

Manjhi is also trying his luck from Makhdumpur seat in Jehanabad too.

Senior BJP leader and former minister Prem Kumar (Gaya town), former state unit chief of the saffron party Gopal Narayan Singh (Nabinagar) and state minister Jay Kumar Singh (Dinara) are among those whose fate would be decided in this phase.

‘1,000 Hardiks will rise’: 22-year-old challenges BJP chief Amit Shah

Ahmedabad: Hardik Patel, Gujarat’s 22-year-old politician, has in a message shared on WhatsApp, asked BJP chief Amit Shah to “stay away” from the agitation he is leading for reservation in government jobs and colleges for the Patel community in the state.

“I request Amit Shah to stay away from the Patel community’s agitation to get reservation. We will not stop it just because you want it. The agitation will not stop till I am alive. And if you still want to crush the stir by force, then you will have to kill me,” Hardik Patel said.

In Ahemdabad, also Amit Shah’s home-town, Hardik Patel said he had “learned from sources” that Amit Shah has been tasked with mediating to end the Patel agitation. “Since we will not end the stir merely on his request, we know that he will use other tactics and force our movement to finish. So I have issued that open message asking him to stay away,” Patel said.

BJP leaders here did not react to Patel’s comments and said they do not know of any plans for Amit Shah to visit Gujarat to resolve the reservation row. In Patel’s challenge to the BJP chief, they see a new attempt to draw attention.

“Even if you kill me, thousand other Hardiks will rise. Try to accept our demands and give us justice. Otherwise, do whatever you can do,” said Patel, who has alleged that he is being prevented from holding rallies and public meetings in Gujarat at the behest of Shah, whose party governs the state.

Hardik Patel is demanding that either the Patels, wealthy and politically influential, be included among the castes that benefit from affirmative action in Gujarat, or then all quota be scrapped. He has also repeatedly reminded the BJP that the Patels have played an important role in powering its political ascent in Gujarat.

The Anandiben Patel government has said it will be unable to meet Patel’s demands and has also prevented the young politician from gathering crowds and addressing public meetings ever since his brief detention after a rally in Ahemedabad led to two days of violence in several cities.

Zaheer Khan announces retirement from international cricket

Mumbai: Left-arm pacer Zaheer Khan announced his retirement from international cricket on Thursday.

The 37-year old pacer made the announcement on Thursday, ending his 14-year long international career. Zaheer made his India debut in 2000 and played his last game for India in 2014 at Wellington against New Zealand.

He is leaving the field after playing in 92 Tests and 200 One-Day Internationals (ODIs), picking up 282 and 311 wickets, respectively.

Zaheer was the joint highest wicket-taker in the 2011 World Cup along with Pakistan’s Shahid Afridi, claiming 21 wickets at 18.76.

“The BCCI appreciates Zaheer Khan’s outstanding service to Indian Cricket. He served Indian cricket with remarkable passion and commitment. Being a fast bowler in the Indian sub continent is challenging but he led the bowling attack with distinction and contributed significantly to the success of Indian cricket .I wish him all the best for the future,” Shashank Manohar, BCCI president said in a statement on Thursday.

“Zaheer will go down as one of the finest fast bowler in the history of Indian cricket. He has been the leader of Indian fast bowlers in the last decade or so and of the best exponent of reverse swing in the country. He has been an outstanding role model on and off the field for Indian cricket. Zaheer has been of the key reasons for IndiaÂ’s success over the last fifteen years. I congratulate him on his wonderful career, ” Anurag Thakur, BCCI secretary, said.

“New Beginning ….

The toughest call in a cricketing career is when one has to walk away from the game itself. You almost ‘will’ yourself and want to push that few, extra miles but then the body, after nearly two decades, decides not to respond.

As I was training for the upcoming season, it dawned on me that my shoulder may not last the rigours of bowling nearly eighteen overs a day, and that’s when I knew it was time….

With immediate effect, I bid adieu to my career in international cricket. I look forward to signing off my last season in domestic cricket at the conclusion of Indian Premier League season 9.

As a kid from a small town Shrirampur, I gave up a career in engineering to pursue bowling.

My parents backed that decision and every decision since! My dad, I distinctly remember said, ‘Engineers toh bahut saare hein tu bowler hi ban na!’

I fondly remember my initial days, way back in 1996 at National Cricket Club at Cross Maidan to the call up for the Mumbai Under-19 team. My crucial months of training at the MRF Pace Foundation, my debut with Baroda in the Ranji trophy to going on to leading Mumbai, I have cherished every game. Each game was an opportunity that allowed me to express myself freely in the best way I could – on the cricket field, always trying to improve as a player.

Leading up to my debut for India in 2000 and beyond, I got crucial opportunities, with people backing me at different and difficult stages and I was able to contribute to Indian cricket and learn many things along the way. I was able to try out different ideas while playing because of the unconditional support I received from my Captains and Coaches, who trusted and supported me in setting fields or trying a different approach or tactic that was loaded with risk.

My greatest cricketing moment was lifting the World Cup as part of team India and creating history. We played as a top team and being part of the journey of India as a top ODI side was very fulfilling. As a young fast bowler who grew up watching the legends of the game, I remember the satisfaction and joy to win a test match for India. Winning ways are addictive and I thoroughly enjoyed sporting the whites for India as we emerged as the No 1 test playing nation in the world.

For those who supported me, especially in the BCCI, Baroda Cricket Association and Mumbai Cricket Association, I am grateful for the encouragement. It has been a privilege to be part of various teams during my career including the Indian cricket team, Baroda, Mumbai, Worcestershire (critical to my come back in the national team in 2007), Mumbai Indians, Royal Challengers Bangalore and Delhi Daredevils.

Today, I have many many individuals to thank — from physios, trainers, support staff, colleagues, captains, coaches, selectors, senior officials, administrators in various Associations, groundsmen, Team management as also team owners. Kindly pardon me for my inability to name each one of you but that does not take away from the deep sense of gratitude I have for your support in allowing me to live my dream.

My colleagues, who I shared dressing room pranks have, over the years, become some of my closest friends. It has been a pleasure to play alongside them as each added a different perspective. I’ve enjoyed listening to them as also contributing in a small way to their growth.

My family has been patiently watching from the sidelines but they have always been central to my life. I can’t thank my parents enough for understanding me and allowing me to chase my dream. My elder brother, Zeeshan, who dutifully reminded me that, ‘my job wasn’t finished with my India debut, but I needed to make every game count’.

My younger brother, Anees, has shouldered a lot of pressure which allowed me the freedom to enjoy on the cricket field. He’s never watched me play live, but his encouragement has been a significant part of my life.

To those millions of fans and well wishers of Indian cricket who’ve watched and encouraged me over the years, I trust you know that I was always trying and never gave up.

I thank the members of the media for the many words of appreciation and constructive criticism during the course of my career.

Cricket has been my only life over the past two decades and is in fact that the only thing I know well. Cricket has made me the individual I am, giving me everything in life and much more. I walk away with fantastic memories, life defining experiences and great friendships. My mother summarised it well in reaction to my decision to retire,
‘Theek hein, bahut accha safar tha hamara ….’

‘Zak is Back’ is perhaps a headline that may come my way again, as I have every intention of giving back to this game and our wonderful country which gave this kid from Shrirampur the opportunity to chase and live his dream!”

Supreme Court stays ban on dance bars in Maharashtra

New Delhi: The Supreme Court today stayed the operation of 2014 amendment in the Maharashtra Police Act that had banned dance performances at bars and some other places, paving the way for reopening of dance bars across the state.

Referring to the brief history of judicial pronouncement in the case and subsequent amendment in the state law, a bench comprising Justices Dipak Misra and Prafulla Chandra Pant said “We think it appropriate to stay the provisions section 33 (A)(1) of the Maharashtra Police (second amendment) Act.”

The court however added a rider to its interim order and allowed the licensing authorities in the state to regulate indecent dance performances at bars and other places.

“However, we have a rider that no performance of dance will be remotely expressive of any kind of obscenity…the licensing authority can regulate such dance performances so that individual dignity of woman performer is not harmed,” the bench said.

The apex court has now fixed the petition filed by Indian Hotel and Restaurant Association for final hearing on November 5 and said that the matter pertaining to the similar issue had already been decided by this court in 2013.

Additional Solicitor General Tushar Mehta, appearing for Maharashtra said at the outset that interim relief may be granted to the Association and added that 2014 amendment in the Act is distinct by its nature.

The Maharashtra government had brought an amendment in 2005 — the Bombay Police Act — which was challenged in high court by an association representing restaurants and bars.

The Bombay High Court on April 12, 2006 had quashed the government’s decision and declared the provision as unconstitutional saying that it is against Article 19(1)(g) (to practise any profession, or to carry on any occupation, trade or business) of the constitution.

However, the state government had moved the apex court against the high court’s order that same year.

On July 16, 2013, the Supreme Court upheld the Bombay High Court verdict quashing the state government’s order and had said that the ban violated the constitutional right to earn a living.

Victims file suit against CIA torture architects for ‘systemic brutality’

The two psychologists credited with creating the brutal, post-9/11 Central Intelligence Agency (CIA) torture regime are being sued by three victims of their program on charges that include “human experimentation” and “war crimes.”

The American Civil Liberties Union (ACLU) on Tuesday filed the suit against CIA contractors James Mitchell and Bruce Jessen, on behalf of torture survivors Suleiman Abdullah Salim and Mohamed Ahmed Ben Soud, as well as the family of Gul Rahman, who died of hypothermia in his cell as result of the torture he endured.

The suit, which is the first to rely on the findings of the Senate Intelligence Committee report on CIA torture, charges Mitchell and Jessen under the Alien Tort Statute for “their commission of torture, cruel, inhuman, and degrading treatment; non-consensual human experimentation; and war crimes,” all of which violate international law.

The pair, both former U.S. military psychologists, earned more than $80 million for “designing, implementing, and personally administering” the program, which employed “a pseudo-scientific theory of countering resistance that justified the use of torture,” that was based on studies in which researchers “taught dogs ‘helplessness’ by subjecting them to uncontrollable pain,” according to the suit.

“These psychologists devised and supervised an experiment to degrade human beings and break their bodies and minds,” said Dror Ladin, a staff attorney with the ACLU National Security Project. “It was cruel and unethical, and it violated a prohibition against human experimentation that has been in place since World War II.”

In a lengthy report, the ACLU describes each plaintiff’s journey.

After being abducted by CIA and Kenyan agents in Somalia, Suleiman Abdullah, a newly wed fisherman from Tanzania, was subjected to “an incessant barrage of torture techniques,” including being forced to listen to pounding music, doused with ice-cold water, beaten, hung from a metal rod, chained into stress positions “for days at a time,” starved, and sleep deprived. This went on for over a month, and was continually interspersed with “terrifying interrogation sessions in which he was grilled about what he was doing in Somalia and the names of people, all but one of whom he’d never heard of.”

Held for over five years without charge and moved numerous times, Abdullah was eventually sent home to Zanzibar “‘with a document confirming he posed no threat to the United States.” He continues to suffer from flashbacks, physical pain, and has “become a shell of himself.”

Mohamed Ben Soud was captured in April 2003 during a joint U.S.-Pakistani raid on his home in Pakistan, where he and his wife moved after fleeing the Gaddafi regime in Libya. Ben Soud said that Mitchell even “supervised the proceedings” at one of his water torture sessions.

Describing Ben Soud’s ordeal, the ACLU writes:

The course of Mohamed’s torture adhered closely to the “procedures” the CIA laid out in a 2004 memo to the Justice Department. Even before arriving at COBALT, [a CIA prison in Afghanistan] Mohamed was subjected to “conditioning” procedures designed to cause terror and vulnerability. He was rendered to COBALT hooded, handcuffed, and shackled. When he arrived, an American woman told him he was a prisoner of the CIA, that human rights ended on September 11, and that no laws applied in the prison.

Quickly, his torture escalated. For much of the next year, CIA personnel kept Mohamed naked and chained to the wall in one of three painful stress positions designed to keep him awake. He was held in complete isolation in a dungeon-like cell, starved, with no bed, blanket, or light. A bucket served as his toilet. Ear-splitting music pounded constantly. The stench was unbearable. He was kept naked for weeks. He wasn’t permitted to wash for five months.

According to the report, the torture regime designed and implemented by Mitchell and Jessen “ensnared at least 119 men, and killed at least one—a man named Gul Rahman who died in November 2002 of hypothermia after being tortured and left half naked, chained to the wall of a freezing-cold cell.”

Gul’s family has never been formally notified of his death, nor has his body been returned to them for a dignified burial, the ACLU states. Further, no one has been held accountable for his murder. But the report notes, “An unnamed CIA officer who was trained by Jessen and who tortured Rahman up until the day before he was found dead, however, later received a $2,500 bonus for ‘consistently superior work.'”

The ACLU charges that the theories devised by Mitchell and Jessen and employed by the CIA, “had never been scientifically tested because such trials would violate human experimentation bans established after Nazi experiments and atrocities during World War II.” Yet, they were the basis of “some of the worst systematic brutality ever inflicted on detainees in modern American history.”

Despite last year’s release of the Senate Torture Report, the government has prosecuted only a handful of low-level soldiers and one CIA contractor for prisoner abuse. Meanwhile, the architects of the CIA’s torture program, which include Mitchell and Jessen, have escaped any form of accountability.

Physicians for Human Rights (PHR) issued a statement saying they welcomed the federal lawsuit as “a landmark step toward accountability,” and urged the U.S. Department to follow suit and criminally “investigate and prosecute all those responsible for torture, including health professionals.”

In the wake of the Senate report, the group strongly criticized Mitchell and Jessen for betraying “the most fundamental duty of the healing professions.”

In Tuesday’s statement, Donna McKay, PHR’s executive director, said: “Psychologists have an ethical responsibility to ‘do no harm,’ but Mitchell and Jessen’s actions rank among the worst medical crimes in U.S. history.”

Jamaican author Marlon James has won the Man Booker Prize for his novel inspired by the attempted assassination of Bob Marley in the 1970s.

Michael Wood, chair of the judges, described A Brief History of Seven Killings as the “most exciting” book on the shortlist.

The 680-page epic was “full of surprises” as well as being “very violent” and “full of swearing”.

James was announced as the winner of the £50,000 prize in London on Tuesday.

He is the first Jamaican author to win the Man Booker Prize. Receiving the award, he said a huge part of the novel had been inspired by reggae music.

“The reggae singers Bob Marley and Peter Tosh were the first to recognise that the voice coming out our mouths was a legitimate voice for fiction and poetry.”

The 44-year-old author was presented with his prize by the Duchess of Cornwall.

He admitted it was “so surreal” to win and dedicated the award to his late father who had shaped his “literary sensibilities”.

Set across three decades, the novel uses the true story of the attempt on the life of reggae star Marley to explore the turbulent world of Jamaican gangs and politics.

Wood said the judges had come to a unanimous decision in less than two hours.

He praised the book’s “many voices” – it contains more than 75 characters – which “went from Jamaican slang to Biblical heights”.

He said: “One of the pleasures of reading it is that you turn the page and you’re not quite sure who the next narrator will be.”

But he acknowledged that some of the content might be too much for some readers.

“Someone said to me they like to give Booker winners to their mother to read, but this might be a little difficult.”

Wood admitted his own mother wouldn’t have got beyond the first few pages on the basis of the swearing.

“A lot of it is very very funny,” he added. “It is not an easy read. It is a big book. There is some tough stuff and there is a lot of swearing but it is not a difficult book to approach.”

In his novel’s acknowledgements, Marlon James himself thanks his family but adds: “This time around maybe my mother should stay away from part four of the book”.

‘Visceral and uncompromising’

This is the second year the Man Booker prize has been open to all authors writing in English, regardless of nationality.

James, who currently lives in Minneapolis, US, can expect a dramatic boost in sales following his win. After A Brief History of Seven Killings was named on the Booker shortlist last month sales tripled to more than 1,000 copies a week, according to Nielsen Book Research.

“It’s a visceral and uncompromising novel that sheds a stark light on a profoundly disturbing chapter of Jamaica’s history, but it’s also an ingeniously structured feat of storytelling that draws the reader in with its eye-catching use of language,” said Jonathan Ruppin, web editor at Foyles bookshops.

“For booksellers, it’s truly heartening to see such ambition and originality recognised and rewarded, and readers have already been embracing it with great enthusiasm.”

Australian author Richard Flanagan won last year’s prize for his wartime novel The Narrow Road to the Deep North.
